[Machine] He said, "Verily, the Messenger of Allah ﷺ forbade us from a matter that used to be beneficial for us." Rafi' said, "So I asked him, what did the Messenger of Allah ﷺ say? For it is the truth." He said, "Do you see your gardens? What do you do with them?" We said, "We rent them out for a quarter (of the produce) and for the poorest of dates and barley." He said, "Do not do that. Cultivate them or withhold them."

البيهقي:١١٧١٦ – أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو عَبْدِ اللهِ إِسْحَاقُ بْنُ مُحَمَّدِ بْنِ يُوسُفَ السُّوسِيُّ قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا الْعَبَّاسُ بْنُ الْوَلِيدِ أَخْبَرَنِي أَبِي قَالَ سَمِعْتُ الْأَوْزَاعِيَّ قَالَ حَدَّثَنِي أَبُو النَّجَاشِيِّ قَالَ صَحِبْتُ رَافِعَ بْنَ خَدِيجٍ سِتَّ سِنِينَ قَالَ فَحَدَّثَنِي عَنْ عَمِّهِ ظُهَيْرِ بْنِ رَافِعٍ أَنَّهُ لَقِيَهُ يَوْمًا فَقَالَ

لَهُ إِنَّ رَسُولَ اللهِ ﷺ نَهَانَا عَنْ أَمْرٍ كَانَ لَنَا نَافِعًا قَالَ رَافِعٌ فَقُلْتُ لَهُ مَا قَالَ رَسُولُ اللهِ ﷺ فَهُوَ الْحَقُّ قَالَ أَرَأَيْتَ مَحَاقِلَكُمْ مَاذَا تَصْنَعُونَ بِهَا؟ قُلْنَا نُؤَاجِرُهَا عَلَى الرُّبُعِ وَعَلَى الْأَوْسُقِ مِنَ التَّمْرِ وَالشَّعِيرِ قَالَ فَلَا تَفْعَلُوا ازْرَعُوهَا أَوْ أَمْسِكُوهَا

My uncle Zuhair said, "Messenger of Allah ﷺ forbade us to do a thing which was a source of help to us." I said, "Whatever Messenger of Allah ﷺ said was right." He said, "Messenger of Allah ﷺ sent for me and asked, 'What are you doing with your farms?' I replied, 'We give our farms on rent on the basis that we get the yield produced at the banks of the water streams (rivers) for the rent, or rent it for some Wasqs of barley and dates.' Messenger of Allah ﷺ said, 'Do not do so, but cultivate (the land) yourselves or let it be cultivated by others gratis, or keep it uncultivated.' I said, 'We hear and obey.'

Messenger of Allah ﷺ forbade a practice which was useful for us. I said: What is this? (I believe) that whatrver Messenger of Allah ﷺ says is absolutely true. He (Zuhair) said that he (the Holy Prophet) asked me: What do you do with your cultivable lands? I said: Messenger of Allah, we rent those irrigated by canals for dry dates or barley. He said: Don't do that. Cultivate them or let them be cultivated (by others) or retain them yourself.

"Zuhair bin Rafi' came to us and said: 'The Messenger of Allah forbade me to do something that was convenient for us.' I said: 'What was that?' He said: 'The command of the Messenger of Allah is true. He asked me: What do you do with your land? I said: We rent it out in return for one-quarter (of the yield) and a number of Wasqs of dates or barley. He said: Do not do that. Cultivate it, give it to someone else to cultivate, or keep it.'"

ذِكْرُ خَبَرٍ ثَالِثٍ يُصَرِّحُ بِأَنَّ قَوْلَهُ ﷺ «أَوْ لِيُزْرِعْهَا»، أَرَادَ بِهِ الزَّجْرَ عَنِ الْمُخَابَرَةِ الَّتِي تَكُونُ بِشَرَائِطَ مَجْهُولَةٍ فَنُدِبَ إِلَى الْمَنِيحَةِ مِنْ أَجْلِهَا
