“A man came to Abu Musa Al-Ash’ari and Salman bin Rabi’ah Al-Bahili and asked them about (the shares of) a daughter, a son’s daughter, a sister through one’s father and mother. They said: ‘The daughter gets one half, and what is left goes to the sister. Go to Ibn Mas’ud, for he will concur with what we say.’ So the man went to Ibn Mas’ud, and told him what they had said. ‘Abdullah said: ‘I will go astray and will not be guided (if I say that I agree); but I will judge as the Messenger of Allah ﷺ judged. The daughter gets one half, and the son’s daughter gets one- sixth. That makes two thirds. And what is left goes to the sister.’” (Using translation from Ibn Mājah 2721)

Abu Musa was asked regarding (the inheritance of) a daughter, a son's daughter, and a sister. He said, "The daughter will take one-half and the sister will take one-half. If you go to Ibn Masʿud, he will tell you the same." Ibn Masʿud was asked and was told of Abu Musa's verdict. Ibn Masʿud then said, "If I give the same verdict, I would stray and would not be of the rightly-guided. The verdict I will give in this case, will be the same as the Prophet ﷺ did, i.e. one-half is for daughter, and one-sixth for the son's daughter, i.e. both shares make two-thirds of the total property; and the rest is for the sister." Afterwards we cams to Abu Musa and informed him of Ibn Masʿud's verdict, whereupon he said, "So, do not ask me for verdicts, as long as this learned man is among you."

A man came to Abu Musa al-Ash'ari and Salman b. Rabi'ah, and asked about a case where there were a daughter, a son's daughter and full sister. They replied: The daughter gets half and the full gets half. The son's daughter gets nothing. Go to Ibn Mas'ud and you will find that he agrees with me. So the man came to him and informed him about their opinion. He said: I would then be in error and not be one of those who are rightly guided. But I decide concerning the matter as the Messenger of Allah ﷺ did: The daughter gets half, and the son's daughter gets a share which complete thirds (i.e. gets a sixth), and what remain to the full sister."

[Machine] I have indeed gone astray and I am not one of the guided ones, but I rule in it (the matter) according to the judgment of the Messenger of Allah ﷺ : "The daughter takes half, and the granddaughter takes the completion of two-thirds, and what remains is for the sister from the father and the mother."

“A man came to Abu Musa Al-Ash’ari and Salman bin Rabi’ah Al-Bahili and asked them about (the shares of) a daughter, a son’s daughter, a sister through one’s father and mother. They said: ‘The daughter gets one half, and what is left goes to the sister. Go to Ibn Mas’ud, for he will concur with what we say.’ So the man went to Ibn Mas’ud, and told him what they had said. ‘Abdullah said: ‘I will go astray and will not be guided (if I say that I agree); but I will judge as the Messenger of Allah ﷺ judged. The daughter gets one half, and the son’s daughter gets one- sixth. That makes two thirds. And what is left goes to the sister.’” (Using translation from Ibn Mājah 2721)  

الكبرى للنسائي:٦٢٩٤أَخْبَرَنَا مَحْمُودُ بْنُ غَيْلَانَ الْمَرْوَزِيُّ قَالَ حَدَّثَنَا وَكِيعٌ يَعْنِي ابْنَ الْجَرَّاحِ قَالَ حَدَّثَنَا سُفْيَانُ يَعْنِي الثَّوْرِيَّ عَنْ أَبِي قَيْسٍ وَاسْمُهُ عَبْدُ الرَّحْمَنِ بْنُ ثَرْوَانَ عَنْ هُزَيْلِ بْنِ شُرَحْبِيلَ قَالَ جَاءَ رَجُلٌ إِلَى أَبِي مُوسَى وَهُوَ الْأَمِيرُ وَسُفْيَانَ بْنِ رَبِيعَةَ الْبَاهِلِيِّ فَسَأَلَهُمَا عَنِ ابْنَةٍ وَابْنَةِ ابْنٍ وَأُخْتٍ لِأَبٍ وَأُمٍّ قَالَ لِلِابْنَةِ النِّصْفُ وَمَا بَقِيَ فَلِلْأُخْتِ وَائْتِ ابْنَ مَسْعُودٍ فَإِنَّهُ سَيُتَابِعُنَا فَأَتَى الرَّجُلُ ابْنَ مَسْعُودٍ فَسَأَلَهُ فَأَخْبَرَهُ بِمَا قَالَا فَقَالَ

ابْنُ مَسْعُودٍ لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ وَلَكِنِّي سَأَقْضِي بِمَا قَضَى بِهِ رَسُولُ اللهِ ﷺ لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَمَا بَقِيَ فَلِلْأُخْتِ

Abu Musa was asked regarding (the inheritance of) a daughter, a son's daughter, and a sister. He said, "The daughter will take one-half and the sister will take one-half. If you go to Ibn Masʿud, he will tell you the same." Ibn Masʿud was asked and was told of Abu Musa's verdict. Ibn Masʿud then said, "If I give the same verdict, I would stray and would not be of the rightly-guided. The verdict I will give in this case, will be the same as the Prophet ﷺ did, i.e. one-half is for daughter, and one-sixth for the son's daughter, i.e. both shares make two-thirds of the total property; and the rest is for the sister." Afterwards we cams to Abu Musa and informed him of Ibn Masʿud's verdict, whereupon he said, "So, do not ask me for verdicts, as long as this learned man is among you."
