'A'isha (Allah be pleased with her) said: There were three issues which were clarified in case of Barira: her owners had decided to sell her on the condition that the right of her inheritance would vest with them. She ('A'isha) said: I made a mention of that to Allah's Apostle ﷺ and he said: Buy her and emancipate her, for verily the right of inheritance vests with one who emancipates. She said that she emancipated (her) and Messenger of Allah ﷺ gave her the option (either to retain her matrimonial alliance or break it after emancipation). She (taking advantage of the option) opted for herself (the severing of matrimonial alliance). 'A'isha said: The people used to give her charity and she gave us that as gift. I made a mention of it to Allah's Apostle ﷺ, whereupon he said: That is charity for her but gift for you, so take that.

"Three judgments were established because of Barirah. Her masters wanted to sell her but they stipulated that Al-Wala should still be to them. I mentioned that to the Prophet and he said: 'Buy her and set her free, for Al-Wala, is to the one who sets the slave free.' She was set free and the Messenger of Allah gave her the choice, and she chose herself. And she used to be given charity and she would give some of it as a gift to us. I mentioned that to the Prophet and he said: 'Eat it for it is charity for her and a gift for us.'"

she wanted to buy Barirah to set her free, but they stipulated that her loyalty (should be to them. She mentioned that to the Messenger of Allah and the Messenger of Allah said: "Buy her, and wet her free and loyalty (Wala) belongs to the one who sets the slave free." Some meat was brought to the Messenger of and it was said that this had been given in charity to Bariirah. He said: "It is charity for her, and a gift for us." And she was given the choice

she wanted to buy Barirah and set her free, but they stipulated that her loyally as a freed slave (wala') should be to them. She mentioned that to the Messenger of Allah and he said: "Buy her and set her fee, and loyally is due to the one who frees the slave." She was given the choice when she was freed. Some meat was brought to the Messenger of Allah and it was said: "This is something that is given in charity to Barirah." He said: "It is charity for her and gift for us." She said: 'Even if you gave me such and such, I would not stay with him,' so she chose herself and her husband was a free man." (Using translation from Nasāʾī 3449)

[AI] Ibn Abbas: I used to see him squeezing his eyes in the streets of Medina. The Messenger of Allah ﷺ ruled that four conditions of loyalty be fulfilled towards it, and the Prophet ﷺ ruled that loyalty belong to whoever frees it and gives it the choice, so it chose itself and was commanded to observe hijab and give charity. ابْنُ عَبَّاسٍ كُنْتُ أُرَاهُ فِي سِكَكِ الْمَدِينَةِ يَعْصِرُ عَيْنَيْهِ فَقَضَى رَسُولُ اللهِ ﷺ فِيهَا بِأَرْبَعٍ شَرَطَ مَوَالِيهَا عَلَيْهَا الْوَلَاءَ فَقَضَى النَّبِيُّ ﷺ «أَنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ وَخَيَّرَهَا فَاخْتَارَتْ نَفْسَهَا وأَمَرَها أَنْ تَعْتَدَّ وَتُصُدِّقَ عَلَيْهَا بِصَدَقَةٍ» وَأَهْدَتْ إِلَى عَائِشَةَ مِنْهَا فَسَأَلَتْ عَائِشَةُ النَّبِيَّ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ «هُوَ عَلَيْهَا صَدَقَةٌ وَهُوَ لَنَا هَدِيَّةٌ»

[AI] "As if I see him following her in the streets of the city, he focused his eyes on her. The Messenger of Allah ﷺ made four judgments concerning her and said, 'Indeed, the loyalty is for the one who sets her free, chooses her, and commands her to observe modesty.' He said, 'And she should give charity to prove her sincerity.' So she gave some of it to Aisha and mentioned that to the Prophet ﷺ . He said, 'It is a charity for her and a gift for us.'"

فَكَأَنِّي أُرَاهُ يَتْبَعُهَا فِي سِكَكِ الْمَدِينَةِ يَعْصِرُ عَيْنَيْهِ عَلَيْهَا قَالَ وَقَضَى رَسُولُ اللهِ ﷺ فِيهَا أَرْبَعَ قَضِيَّاتٍ فَقَالَ إِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ وَخَيَّرَهَا وَأَمَرَهَا أَنْ تَعْتَدَّ قَالَ وَتُصُدِّقَ عَلَيْهَا بِصَدَقَةٍ فَأَهْدَتْ مِنْهَا لِعَائِشَةَ فَذَكَرَتْ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ
