"عَنْ أَبِي سَلَمَةَ بن عَبْد الرَّحْمن قَالَ: بِيْنَا أنَا وأبُو هريرَة عِنْد ابن عَبَّاس إذ جَاءَتْهُ امْرأة فَقَالَتْ: توَفيَّ زَوْجِي وَأنَا حَامِل فَذكَرَت أَنَّها وَضَعَتْ لأَدْنَى مِنْ أَرْبَعة أَشْهُر مِنْ يَوْمِ مَاتَ عَنْهَا فَقَالَ ابن عَباس: أَنْتِ لآخر الأَجَلَيْن، فقَالَ أَبُو سَلَمَةَ: فَقُلْت: إنَّ عِنْدِي عِلمًا، فَقَالَ ابنُ عَبَّاسٍ: عَلَيَّ المرأة، فَقَالَ أَبُو سَلَمَة: أَخْبَرنِي رَجُلٌ مِنْ أَصْحَابِ النَّبِيِّ ﷺ إنَّ سُبَيعةَ الأَسْلَمِيَّةَ جَاءَت النبِيَّ ﷺ فقالت: توفي عنها زوجها فوضعت فأخبرته بأدنى مِنْ أَرْبَعَة أَشْهُر مِنْ يَوْم مَات، فَقال النَّبِيُّ ﷺ : يَا سبَيْعَة أربعِي بِنَفْسِكِ، قَالَ أَبُو هُرَيرةَ وَأَنَا أشهد بِذَلِكَ، فَقَال ابْنُ عَبَّاس للْمرأَة: اسْمَعي مَا تَسْمَعِينَ".

‘Ubaid Allah bin ‘Abd Allah bin ‘Utbah said that his father wrote (a letter) to ‘Abd Allaah bin Al Arqam Al Zuhri asking him to visit Subai’ah daughter of Al Harith Al Aslamiyyah and ask her about her story and what the Apostle of Allaah ﷺ said to her when she asked his opinion (about her). So, ‘Umar bin Abd allah wrote in reply to ‘Abd Allah bin ‘Utbah informing him what she told him. She told that she was under (i.e., the wife of) Sa’d bin Khawlah who belonged to Banu Amir bin Luwayy. He was one of those who participated in the battle of Badr. He died at the Farwell Pilgrimage while she was pregnant. Soon after his death she gave birth to a child. When she was purified from her bleeding after child birth she adorned herself for seekers in marriage. Then Abu Al Sanabil bin Ba’kah a man from Banu Abd Al Dar entered upon her and said to her “What is the matter seeing you adorned, perhaps you are seeking marriage? I swear by Allah you cannot marry until four months and ten days pass away. Saubai’ah said “When she said this to me, I gathered my clothes on me when the evening came and I came to the Apostle of Allaah ﷺ and asked him about that. He told me that I became lawful when I had delivered a child. He suggested me to marry if I wished. Ibn Shihab said “I do not see any harm if she marries when she gives birth to the child, even though she had the bleeding after the child birth, but her husband should not have sexual intercourse till she is purified.

"While Abu Hurairah and I were with Ibn 'Abbas, a woman came and said that her husband had died while she was pregnant, then she had given birth less than four months after the day he died. Ibn 'Abbas said: '(You have to wait) for the longer of the two periods.'" Abu Salamah said: "A man from among the Companions of the Prophet told me that Subai'ah Al-Aslamiyyah came to the Messenger of Allah and said that her husband died while she was pregnant, and she gave birth less than four months after he died. The Messenger of Allah told her to get married. Abu Hurairah said: 'And I bear witness to that.'"

'Why do I see you adorned? Perhaps you want to get married, but by Allah you will not get married until four months and ten days have passed.' Subai'ah said: 'When he said that to me, I put on my clothes in the evening and went to the Messenger of Allah and asked him about that. He ruled that it had become permissible for me to marry when I gave birth, and he told me to get married if I wanted to.'"

[AI] He informed him that he and Ibn Abbas met with Abu Hurairah and they mentioned a man whose wife dies and he remarries after a few nights. Ibn Abbas said that her waiting period is the end of the two terms (the waiting period for pregnancy and for being widowed). Abu Salama said that when she gives birth, her waiting period ends. They disagreed about it, so Abu Hurairah said, "I am with my nephew's son, meaning Abu Salama." So they sent Kureib, the slave of Ibn Abbas, to Umm Salamah and he asked her. Umm Salamah mentioned that Subay'ah bint al-Harith al-Aslamiyah died and her husband passed away and after him she got her period after a few nights, and a man from Bani Abd Ad-Dar proposed to her and informed her that she had her period. She wanted to marry someone else, so Abu As-Sanabil said to her, "Indeed, you have not completed your waiting period." Subay'ah mentioned this to the Messenger of Allah ﷺ and he ordered her to get married.
أَخْبَرَهُ أَنَّهُ اجْتَمَعَ هُوَ وَابْنُ عَبَّاسٍ عِنْدَ أَبِي هُرَيْرَةَ فَذَكَرُوا الرَّجُلَ يُتَوَفَّى عَنِ الْمَرْأَةِ فَتَلِدُ بَعْدَهُ بِلَيَالٍ قَلَائِلَ فَقَالَ ابْنُ عَبَّاسٍ حِلُّهَا آخِرُ الْأَجَلَيْنِ وَقَالَ أَبُو سَلَمَةَ إِذَا وَضَعَتْ فَقَدْ حَلَّتْ فَتَرَاجَعَا فِي ذَلِكَ بَيْنَهُمَا فَقَالَ أَبُو هُرَيْرَةَ أَنَا مَعَ ابْنِ أَخِي يَعْنِي أَبَا سَلَمَةَ فَبَعَثُوا كُرَيْبًا مَوْلَى ابْنِ عَبَّاسٍ إِلَى أُمِّ سَلَمَةَ فَسَأَلَهَا فَذَكَرَتْ أُمُّ سَلَمَةَ أَنَّ سُبَيْعَةَ بِنْتَ الْحَارِثِ الْأَسْلَمِيَّةَ مَاتَ عَنْهَا زَوْجُهَا فَنَفِسَتْ بَعْدَهُ بِلَيَالٍ وَأَنَّ رَجُلًا مِنْ بَنِي عَبْدِ الدَّارِ يُكَنَّى أَبَا السَّنَابِلِ خَطَبَهَا وَأَخْبَرَهَا أَنَّهَا قَدْ حَلَّتْ فَأَرَادَتْ أَنْ تَتَزَوَّجَ غَيْرَهُ فَقَالَ لَهَا أَبُو السَّنَابِلِ فَإِنَّكِ لَمْ تَحِلِّينَ فَذَكَرَتْ سُبَيْعَةُ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ «فَأَمَرَهَا أَنْ تَتَزَوَّجَ»
[AI] Marwan bin Abdullah ibn Uthbah sent a message to Subay'ah bint Al-Harith, asking her about what the Messenger of Allah ﷺ had given her. She informed him that she was under the guardianship of Saad ibn Khwala, but he passed away during the Farewell Hajj. She said that she had given birth to her child before four and ten months had passed since his death. Abu As-Sanabil, Ibn Ba'kkak, met her when she was experiencing postpartum bleeding and had applied kohl. He told her to wait for forty menstrual periods or their equivalent before considering marriage again. She then went to the Prophet ﷺ and informed him about what Abu As-Sanabil had said. The Prophet ﷺ told her that she was allowed to remarry as soon as she completed her postpartum bleeding.

Yahya related to me from Malik from Yahya ibn Said from Sulayman ibn Yasar that Abdullah ibn Abbas and Abu Salama ibn Abd ar-Rahman ibn Awf differed on the question of a wornan who gave birth a few nights after the death of her husband. Abu Salama said, "When she gives birth to the child she is carrying, she is free to marry." Ibn Abbas said, "At the end of two periods." Abu Hurayra came and said, "I am with my nephew", meaning Abu Salama. They sent Kurayb, a mawla of Abdullah ibn Abbas to Umm Salama, the wife of the Prophet ﷺ to ask her about it. He came back and told them that she had said that Subaya al-Aslamiya had given birth a few nights after the death of her husband, and she had brought the matter to the Messenger of Allah ﷺ and he had said, "You are free to marry, so marry whomever you wish." Malik said, "This is how the people of knowledge here continue to act." 29.31 Widows Remaining in Their Houses until Free to Marry
أَنَّ عَبْدَ اللَّهِ بْنَ عَبَّاسٍ وَأَبَا سَلَمَةَ بْنَ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ اخْتَلَفَا فِي الْمَرْأَةِ تُنْفَسُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ فَقَالَ أَبُو سَلَمَةَ إِذَا وَضَعَتْ مَا فِي بَطْنِهَا فَقَدْ حَلَّتْ وَقَالَ ابْنُ عَبَّاسٍ آخِرَ الأَجَلَيْنِ فَجَاءَ أَبُو هُرَيْرَةَ فَقَالَ أَنَا مَعَ ابْنِ أَخِي يَعْنِي أَبَا سَلَمَةَ فَبَعَثُوا كُرَيْبًا مَوْلَى عَبْدِ اللَّهِ بْنِ عَبَّاسٍ إِلَى أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ ﷺ يَسْأَلُهَا عَنْ ذَلِكَ فَجَاءَهُمْ فَأَخْبَرَهُمْ أَنَّهَا قَالَتْ وَلَدَتْ سُبَيْعَةُ الأَسْلَمِيَّةُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ قَدْ حَلَلْتِ فَانْكِحِي مَنْ شِئْتِ
That she was married to Sad bin Khaula who was from the tribe of Bani 'Amr bin Luai, and was one of those who fought the Badr battle. He died while she wa pregnant during Hajjat-ul-Wada.' Soon after his death, she gave birth to a child. When she completed the term of deliver (i.e. became clean), she prepared herself for suitors. Abu As-Sanabil bin Bu'kak, a man from the tribe of Bani Abd-ud-Dal called on her and said to her, "What! I see you dressed up for the people to ask you in marriage. Do you want to marry By Allah, you are not allowed to marry unless four months and ten days have elapsed (after your husband's death)." Subai'a in her narration said, "When he (i.e. Abu As-Sanabil) said this to me. I put on my dress in the evening and went to Messenger of Allah ﷺ and asked him about this problem. He gave the verdict that I was free to marry as I had already given birth to my child and ordered me to marry if I wished." (Using translation from Bukhārī 3991)

She informed him that she was under the guardianship of Sa'd bin Khawlah, and he passed away during the Farewell Pilgrimage while she was pregnant. She gave birth to her child before four months and ten days had passed since his death. Then Abu As-Sinabil bin Ba'kkak met her when she had finished her childbirth period, and she had put on kohl. He said to her, "Perhaps you want to get married, as it has been four months and ten days since your husband's death." She said, "So I went to the Prophet ﷺ and mentioned to him what Abu As-Sinabil had said. The Prophet ﷺ replied, 'You are allowed to marry, as your 'iddah ended when you gave birth.'"
أَرْسَلَ مَرْوَانُ عَبْدَ اللهِ بْنَ عُتْبَةَ إِلَى سُبَيْعَةَ بِنْتِ الْحَارِثِ يَسْأَلُهَا عَمَّا أَفْتَاهَا رَسُولُ اللهِ ﷺ فَأَخْبَرَتْهُ أَنَّهَا كَانَتْ تَحْتَ سَعْدِ بْنِ خَوْلَةَ فَتُوُفِّيَ عَنْهَا فِي حَجَّةِ الْوَدَاعِ وَكَانَ بَدْرِيًّا فَوَضَعَتْ حَمْلَهَا قَبْلَ أَنْ يَمْضِي لَهَا أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا مِنْ وَفَاتِهِ فَلَقِيَهَا أَبُو السَّنَابِلِ بْنُ بَعْكَكٍ حِينَ تَعَلَّتْ مِنْ نِفَاسِهَا وَقَدِ اكْتَحَلَتْ فَقَالَ لَعَلَّكِ تُرِيدِينَ النِّكَاحَ إِنَّهَا أَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ مِنْ وَفَاةِ زَوْجِكِ قَالَتْ فَأَتَيْتُ النَّبِيَّ ﷺ فَذَكَرْتُ لَهُ مَا قَالَ أَبُو السَّنَابِلِ فَقَالَ النَّبِيُّ ﷺ «قَدْ حَلَلْتِ حِينَ وَضَعْتِ حَمْلَكِ»
"While Abu Hurairah and I were with Ibn 'Abbas, a woman came and said that her husband had died while she was pregnant, then she had given birth less than four months after the day he died. Ibn 'Abbas said: '(You have to wait) for the longer of the two periods.'" Abu Salamah said: "A man from among the Companions of the Prophet told me that Subai'ah Al-Aslamiyyah came to the Messenger of Allah and said that her husband died while she was pregnant, and she gave birth less than four months after he died. The Messenger of Allah told her to get married. Abu Hurairah said: 'And I bear witness to that.'" (Using translation from Nasāʾī 3517)
تُوُفِّيَ عَنْهَا زَوْجُهَا وَهِيَ حَامِلٌ فَوَلَدَتْ لِأَدْنَى مِنْ أَرْبَعَةِ أَشْهُرٍ مِنْ يَوْمِ مَاتَ فَقَالَ ابْنُ عَبَّاسٍ ائْتِ آخِرَ الْأَجَلَيْنِ فَقَالَ أَبُو سَلَمَةَ أَخْبَرَنِي رَجُلٌ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ أَنَّ سُبَيْعَةَ الْأَسْلَمِيَّةَ جَاءَتْ إِلَى رَسُولِ اللهِ ﷺ فَقَالَتْ تُوُفِّيَ عَنْهَا زَوْجُهَا وَهِيَ حَامِلٌ فَوَلَدَتْ لِأَدْنَى مِنْ أَرْبَعَةِ أَشْهُرٍ «فَأَمَرَهَا رَسُولُ اللهِ ﷺ أَنْ تَتَزَوَّجَ» فَقَالَ أَبُو هُرَيْرَةَ وَأَنَا أَشْهَدُ عَلَى ذَلِكَ
[AI] Ibn Abbas and Abu Huraira had a conversation about a man who dies and after his death his wife remarries after a short period. I said, "If she remarries, then she has become halal (permissible)." Ibn Abbas said, "Her waiting period is the end of the two waiting periods." So they both reconsidered their opinions. Abu Huraira said, "I am with the opinion of my nephew, Abu Salama." They sent Kuraib, the servant of Ibn Abbas, to Umm Salama, and she said, "Indeed, Subay'a remarried after the death of her husband after forty nights, and a man from the Banu Abd ad-Dar clan proposed to her and informed us that she has become halal. She wanted to marry someone else, so Abu as-Sanabil said to her, 'Indeed, you are not halal.' So Subay'a mentioned this to the Messenger of Allah, and he ordered her to get married."
وَابْنُ عَبَّاسٍ وَأَبُو هُرَيْرَةَ فَتَذَاكَرْنَا الرَّجُلَ يَمُوتُ عَنِ الْمَرْأَةِ فَتَضَعُ بَعْدَ وَفَاتِهِ بِيَسِيرٍ فَقُلْتُ إِذَا وَضَعَتْ فَقَدْ حَلَّتْ وَقَالَ ابْنُ عَبَّاسٍ ؓ أَجَلُهَا آخِرُ الْأَجَلَيْنِ فَتَرَاجَعَا بِذَلِكَ فَقَالَ أَبُو هُرَيْرَةَ أَنَا مَعَ ابْنِ أَخِي يَعْنِي أَبَا سَلَمَةَ فَبَعَثُوا كُرَيْبًا مَوْلَى ابْنِ عَبَّاسٍ إِلَى أُمِّ سَلَمَةَ ؓ فَقَالَتْ إِنَّ سُبَيْعَةَ وَضَعَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِأَرْبَعِينَ لَيْلَةً وَأَنَّ رَجُلًا مِنْ بَنِي عَبْدِ الدَّارِ يُكَنَّى أَبَا السَّنَابِلِ خَطَبَهَا وَأَخْبَرَنَا أَنَّهَا قَدْ حَلَّتْ فَأَرَادَتْ أَنْ تَتَزَوَّجَ غَيْرَهُ فَقَالَ لَهَا أَبُو السَّنَابِلِ إِنَّكِ لَمْ تَحِلِّينَ فَذَكَرَتْ ذَلِكَ سُبَيْعَةُ لِرَسُولِ اللهِ ﷺ فَأَمَرَهَا أَنْ تُزَوَّجَ
" وَعَنْ عُبَيْد اللهِ بْنِ عَبْدِ اللهِ، قَالَ: أَرْسَلَ مَرَوَانُ عَبْدَ اللهِ بْنَ عُتْبَةَ إِلَى سُبَيْعَةَ بِنْتِ الحَارِثِ يَسْأَلُهَا عَمَّا أَفْتَاهَا بِهِ رَسُول اللهِ ﷺ فَأَخْبَرَتْهُ أَنَّهَا كَانَتْ تَحْتَ سَعْدِ بْنِ خَوْلَةَ فَتُوُفِّيَ عَنْهَا فِي حَجَّةِ الوَدَاعِ، وَكَانَ بَدْرِيّا فَوَضَعَتْ حَمْلَهَا قَبْلَ أَنْ يَمْضِيَ لَهَا أَرْبَعَةُ أَشْهُرٍ وَعَشْرًا مِنْ وَفَاتِهِ، فَلَقِيهَا أَبُو السَّنَابِلِ بْنُ بَعْكٍ حِينَ تَعَلَّتْ مِنْ نِفَاسِهَا وَقَدِ اكْتَحلَتْ فَقَالَ: لَعَلَّكِ تُرِيدِينَ النِّكَاحَ؟ إِنَّهَا أَرْبَعَةُ أَشْهُرٍ وَعَشْرًا مِنْ وَفَاةِ زَوْجِكِ، فَأَتَتِ النَّبِيَّ ﷺ فَذَكَرَتْ لَهُ مَا قَالَ أَبُو السَّنَابِلِ، فَقَالَ لَهَا النَّبِيُّ ﷺ قَدْ حَلَلْتِ حِينَ وَضَعْتِ حَمْلَكِ".
"عن أبي سلمة بن عبد الرحمن قال: سئل ابن عباس وأبو هريرة عن رجل توفي عن امرأة فوضعت قبل أن يمضي لها أربعة أشهر، فقال ابن عباس تعتد آخر الأجلين، قال أبو سلمة فقلت: إذا وضعت حملها فقد حل أجلها، فقال أبو هريرة: أنا مع ابن أخي - يعني أبا سلمة- فأرسل ابن عباس وأبو هريرة إلى أم سلمة يسئلونها عن ذلك، فأخبرت أن سبيعة بنت الحارث توفي عنها زوجها فوضعت بعد وفاته بليال، فلقيها أبو السنابل بن بعكك حين بلغت من نفاسها، وقد اكتحلت ولبست، فقال لعلك ترين أن
قد حللت إنك لا تحلين حتى يمضي لك أربعة أشهر وعشر من وفاة زوجك، فلما أمست أتت النبي ﷺ فذكرت له شأنها، وما قال لها أبو السنابل، فقال لها النبي ﷺ إذا وضعت حملك، قالت: وحسبت أن النبي ﷺ قال لها: كذب أبو السنابل".
