عَنْ نُبَيْهِ بْنِ وَهْبٍ قَالَ أَرْسَلَ عُمَرُ بْنُ عُبَيْدِ اللَّهِ بْنِ مَعْمَرٍ إِلَى أَبَانَ بْنِ عُثْمَانَ يَسْأَلُهُ أَيَنْكِحُ الْمُحْرِمُ فَقَالَ أَبَانُ إِنَّ عُثْمَانَ بْنَ عَفَّانَ حَدَّثَ أَنَّ النَّبِيَّ ﷺ قَالَ لاَ يَنْكِحُ الْمُحْرِمُ وَلاَ يَخْطُبُ
Umar b. Ubaidullah b. Ma'mar sent me to Aban b. Uthman as he wanted to make the proposal of the marriage of his son with the daughter of Shaiba b. Uthman. He (Aban b. Uthman) was at that time (busy) in the season of Pilgrimage. He said: I deem him to be a man of the desert (for it is a common thing) that a Muhrim can neither marry, nor is he allowed to be married to anyone. It is Uthman (b. Affan) who reported this to us from Messenger of Allah ﷺ.
حَدَّثَنِي نُبَيْهُ بْنُ وَهْبٍ قَالَ بَعَثَنِي عُمَرُ بْنُ عُبَيْدِ اللَّهِ بْنِ مَعْمَرٍ وَكَانَ يَخْطُبُ بِنْتَ شَيْبَةَ بْنِ عُثْمَانَ عَلَى ابْنِهِ فَأَرْسَلَنِي إِلَى أَبَانِ بْنِ عُثْمَانَ وَهُوَ عَلَى الْمَوْسِمِ فَقَالَ أَلاَ أُرَاهُ أَعْرَابِيًّا إِنَّ الْمُحْرِمَ لاَ يَنْكِحُ وَلاَ يُنْكَحُ أَخْبَرَنَا بِذَلِكَ عُثْمَانُ عَنْ رَسُولِ اللَّهِ ﷺ
ʿUmar bin ʿUbaidullah sent word to Aban bin ʿUthman ؓ , (to ask) whether he could apply something to his eyes when he was in ihram - or (to ask) what he could apply to his eyes when he was in ihram. He sent word back to him telling him that he could apply aloes to them, and I heard ʿUthman bin Affanؓ narrating that from the Messenger of Allah ﷺ .
عَنْ نُبَيْهِ بْنِ وَهْبٍ قَالَأَرْسَلَ عُمَرُ بْنُ عُبَيْدِ اللهِ إِلَى أَبَانَ بْنِ عُثْمَانَ أَيُكَحِّلُ عَيْنَيْهِ وَهُوَ مُحْرِمٌ؟ أَوْ بِأَيِّ شَيْءٍ يُكَحِّلُهُمَا وَهُوَ مُحْرِمٌ؟ فَأَرْسَلَ إِلَيْهِ أَنْ يُضَمِّدَهُمَا بِالصَّبِرِ فَإِنِّي سَمِعْتُ عُثْمَانَ بْنَ عَفَّانَ يُحَدِّثُ ذَلِكَ عَنْ رَسُولِ اللهِ ﷺ
ʿThe pilgrim in ihram should not get married, arrange a marriage or propose marrіage.”
عَنْ نُبَيْهِ بْنِ وَهْبٍأَنَّ عُمَرَ بْنَ عُبَيْدِ اللهِ أَرَادَ أَنْ يُزَوِّجَ ابْنَهُ وَهُوَ مُحْرِمٌ فَنَهَاهُ أَبَانُ وَزَعَمَ أَنَّ عُثْمَانَ حَدَّثَ عَنْ رَسُولِ اللهِ ﷺ قَالَ الْمُحْرِمُ لَا يَنْكِحُ وَلا يُنْكِحُ
ʿUmar bin Ubaidullah bin Ma’mar proposed marriage on behalf of his son to the daughter of Shaibah bin ʿUthman. He sent me to Aban bin ʿUthman, who was the leader of the Hajj, and he [Aban] said: I think he must be a Bedouin. ʿThe pilgrim in ihram should not get married or arrange a marriage.ʿ ‘Uthman ؓ told me that from the Prophet ﷺ , and Nubaih told me something similar from his father.
حَدَّثَنِي نُبَيْهُ بْنُ وَهْبٍ قَالَبَعَثَنِي عُمَرُ بْنُ عُبَيْدِ اللهِ بْنِ مَعْمَرٍ وَكَانَ يَخْطُبُ بِنْتَ شَيْبَةَ بْنِ عُثْمَانَ عَلَى ابْنِهِ فَأَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ وَهُوَ عَلَى الْمَوْسِمِ فَقَالَ أَلا أُرَاهُأَعْرَابِيًّا إِنَّ الْمُحْرِمَ لَا يَنْكِحُ وَلا يُنْكِحُ أَخْبَرَنِي بِذَلِكَ عُثْمَانُ عَنِ النَّبِيِّ ﷺ وحَدَّثَنِي نُبَيْهٌ عَنْ أَبِيهِ بِنَحْوِهِ
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِدَفْعِ قَوْلِ الْقَائِلِ الَّذِي بِهِ دَفْعُ الْخَبَرِ
[Machine] I was told by Abdul-A'ala and Abdul-Jabbar, the sons of Nubayh ibn Wahb, from their father Nubayh ibn Wahb, from Aban ibn Uthman, from Uthman ibn Affan, from the Prophet ﷺ , who said, "The one who is forbidden to marry shall not marry, nor be married, nor propose marriage."
حَدَّثَنِي عَبْدُ الْأَعْلَى وَعَبْدُ الْجَبَّارِ ابْنَا نُبَيْهِ بْنُ وَهْبٍ عَنْ أَبِيهِمَا نُبَيْهِ بْنِ وَهْبٍ عَنْ أَبَانَ بْنِ عُثْمَانَ عَنْ عُثْمَانَ بْنِ عَفَّانَ عَنِ النَّبِيِّ ﷺ قَالَ «لَا يَنْكِحُ الْمُحْرِمُ وَلَا يُنْكِحُ وَلَا يَخْطُبُ»
ذِكْرُ خَبَرٍ ثَالِثٍ يَدْحِضُ تَأْوِيلَ هَذَا الْمُتَأَوِّلِ لِهَذَا الْخَبَرِ
"The Muhrim should not get or propose marriage." (Using translation from Nasāʾī 2844)
عَنْ نُبَيْهِ بْنِ وَهْبٍ أَنَّ عُمَرَ بْنَ عُبَيْدِ اللَّهِ بْنِ مَعْمَرٍ أَرَادَ أَنْ يَنْكِحَ وَهُوَ مُحْرِمٌ فَأَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ فَقَالَ أَبَانُ إِنَّ عُثْمَانَ حَدَّثَ أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «الْمُحْرِمُ لَا يَنْكِحُ وَلَا يَخْطُبُ وَلَا يُنْكِحُ»
