قَوْلُهُ تَعَالَى: {وَلِكُلٍّ جَعَلْنَا مَوَالِيَ مِمَّا تَرَكَ الْوَالِدَانِ وَالْأَقْرَبُونَ} [النساء: 33]

"To those also, to whom your right hand was pledged, give your portion." When the Emigrants came to Medina. they inherited from the Helpers without any blood-relationship with them for the brotherhood which the Messenger of Allah ﷺ established between them. When the following verse was revealed: "To (benefit) everyone we have appointed shares and heirs to property left by parent and relatives." it abrogated the verse: "To those also, to whom your right hand was pledged, give their due portion." This alliance was made for help, well wishing and cooperation. Now a legacy can be made for him. (The right to)inheritance was abolished. (Using translation from Abū Dāʾūd 2922)

Ibn ʿAbbas said, "When the emigrants came to the Prophet ﷺ in Medina, the emigrant would inherit the Ansari while the latter's relatives would not inherit him because of the bond of brotherhood which the Prophet established between them (i.e. the emigrants and the Ansar). When the verse: 'And to everyone We have appointed heirs' (4.33) was revealed, it canceled (the bond (the pledge) of brotherhood regarding inheritance)." Then he said, "The verse: To those also to whom your right hands have pledged, remained valid regarding cooperation and mutual advice, while the matter of inheritance was excluded and it became permissible to assign something in one's testament to the person who had the right of inheriting before.

Regarding the Verse: "To everyone, We have appointed heirs." (4.33) 'Mawali' means heirs. And regarding:-- "And those to whom your right hands have pledged." When the Emigrants came to Medina, an Emigrant used to be the heir of an Ansari with the exclusion of the latter's relatives, and that was because of the bond of brotherhood which the Prophet ﷺ had established between them (i.e. the Emigrants and the Ansar). So when the Verses:-- "To everyone We have appointed heirs." was revealed, (the inheritance through bond of brotherhood) was cancelled. Ibn ʿAbbas then said: "And those to whom your right hands have pledged." is concerned with the covenant of helping and advising each other. So allies are no longer to be the heir of each other, but they can bequeath each other some of their property by means of a will.

Regarding the Holy Verse:--'And to everyone, We have appointed heirs..' And:-- (4.33) 'To those also to Whom your right hands have pledged.' (4.33) When the emigrants came to Medina, the Ansar used to be the heir of the emigrants (and vice versa) instead of their own kindred by blood (Dhawl-l-arham), and that was because of the bond of brotherhood which the Prophet ﷺ had established between them, i.e. the Ansar and the emigrants. But when the Divine Verse:-- 'And to everyone We have appointed heirs,' (4.33) was revealed, it cancelled the other, order i.e. 'To those also, to whom Your right hands have pledged.'

[Machine] In His statement {And those who have established their oaths, give them their share} [An-Nisa 33], it is said that when the immigrants arrived in Madinah, the Ansar bequeathed their inheritance to the Muslims beyond their own relatives due to the brotherhood that the Messenger of Allah ﷺ had established among them. Then, when the verse {And for all, We have made heirs to what the parents and close relatives leave behind} [An-Nisa 33] was revealed, it was abrogated by the verse {And those who have established their oaths, give them their share} [An-Nisa 33] regarding victory, advice, and support. 12526 Abu Ali Al-Ruzbary informed us that Muhammad ibn Bakr informed us that Abu Dawud informed us that Harun ibn Abdullah informed us that Abu Usamah mentioned it in a similar manner, adding inheritance, support, and assistance.

[Machine] In His saying, "And [also for] those who are settled [in Medina] and firmly rooted [in faith] from among the believers and [also for] those who followed them in [thechiyyah] [faith], Allah is pleased with them and they [i.e., the Muhajireen] are pleased with Him. He has prepared for them gardens beneath which rivers flow, wherein they will abide forever. That is the great attainment." (Quran 9:100)

In explaining this verse, Ibn Abbas said, "When the Muhajireen (the migrants) arrived in Medina, they would inherit from the Ansar (the supporters of the Prophet Mohammed ﷺ ) without the descendants of the migrants claiming their right of inheritance, because of the brotherhood established amongst them by the Prophet ﷺ . Then this verse was revealed, 'And for all, We have made heirs to what is left by parents and relatives.' Then it was abrogated and this verse was revealed, 'And [also for] those who are settled [in Medina] and firmly rooted [in faith] from among the believers and [also for] those who followed them in [thechiyyah] [faith].' Meaning, they have a share of the spoils of war, the obligation of the source of the inheritance is waived because of the special relationship that was in effect."

رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنِ الصَّلْتِ بْنِ مُحَمَّدٍ وَغَيْرِهِ عَنْ أَبِي أُسَامَةَ وَرُوِّينَا عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ ؓ قَالَ {وَالَّذِينَ عَقَدَتْ أَيْمَانُكُمْ فَآتُوهُمْ نَصِيبَهُمْ} [النساء 33] كَانَ الرَّجُلُ يُحَالِفُ الرَّجُلَ لَيْسَ بَيْنَهُمَا نَسَبٌ فَيَرِثُ أَحَدُهُمَا الْآخَرَ فَنَسَخَ ذَلِكَ الْأَنْفَالُ فَقَالَ {وَأُولُو الْأَرْحَامِ بَعْضُهُمْ أَوْلَى بِبَعْضٍ} [الأحزاب 6]
