16. Oaths and Vows (1/2)
١٦۔ كِتَابُ الْأَيْمَانِ وَالنُّذُورِ ص ١
"When Allah created Paradise and Hell, He sent Jibril, peace be upon him, to Paradise and said: 'Look at it and at what I have prepared for its people in it.' He looked at it, then he came back and said: 'By Your Glory, no one will hear of it but he will enter it.' So He commanded that it be surrounded by hardships and said: 'Go and look at it and at what I have prepared for its people in it.' He looked at it and saw that it had been surrounded with hardships. He (Jibril) said: 'By Your Glory, I fear that no one will enter it.' He (Allah) said: 'Go and look at the Fire and at what I have prepared for its people in it.' So he looked at it and parts of it were piled upon other parts. He came back and said: 'By Your Glory, no one will enter it.' So He commanded that it be surrounded with pleasures and said: 'Go and look at it.' So he looked at it and saw that it was surrounded with pleasures. He came back and said: 'By Your Glory, I fear that no one will be saved from it and all will enter it.'" (Using translation from Nasāʾī 3763)
عَنْ رَسُولِ اللهِ ﷺ قَالَ «لَمَّا خَلَقَ اللهُ الْجَنَّةَ وَالنَّارَ أَرْسَلَ جِبْرِيلَ إِلَى الْجَنَّةِ» فَقَالَ «انْظُرْ إِلَيْهَا وَإِلَى مَا أَعْدَدْتُ لِأَهْلِهَا فِيهَا فَرَجَعَ» فَقَالَ «وَعِزَّتِكَ لَا يَسْمَعُ بِهَا أَحَدٌ إِلَّا دَخَلَهَا فَأَمَرَ بِهَا فَحُفَّتْ بِالْمَكَارِهِ» فَقَالَ «اذْهَبْ إِلَيْهَا فَانْظُرْ إِلَيْهَا وَإِلَى مَا أَعْدَدْتُ لِأَهْلِهَا فِيهَا فَإِذَا هِيَ قَدْ حُفَّتْ بِالْمَكَارِهِ» فَقَالَ «وَعِزَّتِكَ لَقَدْ خَشِيتُ أَنْ لَا يَدْخُلَهَا أَحَدٌ» قَالَ «اذْهَبْ فَانْظُرْ إِلَى النَّارِ وَإِلَى مَا أَعْدَدْتُ لِأَهْلِهَا فِيهَا فَنَظَرَ إِلَيْهَا فَإِذَا هِيَ يَرْكَبُ بَعْضُهَا بَعْضًا فَرَجَعَ» فَقَالَ «وَعِزَّتِكَ لَا يَدْخُلُهَا أَحَدٌ فَأَمَرَ بِهَا فَحُفَّتْ بِالشَّهَوَاتِ» فَقَالَ «ارْجِعْ إِلَيْهَا فَانْظُرْ إِلَيْهَا فَنَظَرَ إِلَيْهَا فَإِذَا هِيَ قَدْ حُفَّتْ بِالشَّهَوَاتِ فَرَجَعَ» فَقَالَ «وَعِزَّتِكَ لَقَدْ خَشِيتُ أَنْ لَا يَنْجُوَ مِنْهَا أَحَدٌ إِلَّا دَخَلَهَا»
16.2 [Machine] The oath of the heart's overturn.
١٦۔٢ الْحَلِفُ بِمُقَلِّبِ الْقُلُوبِ
"The oath by which the Messenger of Allah used to swear was: 'No, by the Controller of the hearts.'" (Using translation from Nasāʾī 3761)
كَانَتْ «يَمِينٌ يَحْلِفُ عَلَيْهَا النَّبِيُّ ﷺ لَا وَمُقَلِّبِ الْقُلُوبِ»
16.3 [Machine] The Alliance with the Bank of Hearts
١٦۔٣ الْحَلِفُ بِمُصَرِّفِ الْقُلُوبِ
"The oath by which the Messenger of Allah used to swear was: 'No, by the Controller of the hearts.'" (Using translation from Nasāʾī 3762)
كَانَتْ يَمِينُ رَسُولِ اللهِ ﷺ يَحْلِفُ بِهَا لَا وَمُصَرِّفِ الْقُلُوبِ
16.4 [Machine] Intensification of swearing by other than Allah
١٦۔٤ التَّشْدِيدُ فِي الْحَلِفِ بِغَيْرِ اللهِ
The Prophet ﷺ said, "If anybody has to take an oath, he should swear only by Allah." The people of Quraish used to swear by their fathers, but the Prophet ﷺ said, "Do not swear by your fathers. " (Using translation from Bukhārī 3836)
قَالَ رَسُولُ اللهِ ﷺ مَنْ كَانَ حَالِفًا فَلَا يَحْلِفُ إِلَّا بِاللهِ وَكَانَتْ قُرَيْشٌ تَحْلِفُ بِآبَائِهَا فَقَالَ «لَا تَحْلِفُوا بِآبَائِكُمْ»
"A man from Banu Ghifar told me, in the gathering of Salim bin 'Abdullah, Salim bin 'Abdullah said: 'I heard 'Abdullah -that is, Ibn 'Umar- say: "The Messenger of Allah said: 'Allah forbids you to swear by your forefathers.'"'" (Using translation from Nasāʾī 3765)
قَالَ رَسُولُ اللهِ ﷺ «إِنَّ اللهَ يَنْهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ»
16.5 [Machine] The oath of the fathers
١٦۔٥ الْحَلِفُ بِالْآبَاءِ
The Messenger of Allah ﷺ heard me swearing an oath by my father and said: “Allah forbids you to swear by your fathers.” ‘Umar said: By Allah, I never swore by my father after that, whether saying it myself or narrating what someone else had said. (Using translation from Aḥmad 241)
سَمِعَ النَّبِيَّ ﷺ عُمَرَ وَهُوَ يَقُولُ وَأَبِي وَأَبِي فَقَالَ «إِنَّ اللهَ يَنْهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ» قَالَ عُمَرُ فَوَاللهِ مَا حَلَفْتُ بِهَا بَعْدُ ذَاكِرًا وَلَا آثِرًا

16.6 [Machine] Al-Halifu Bil-Ummahat
١٦۔٦ الْحَلِفُ بِالْأُمَّهَاتِ
The Prophet ﷺ said: Do not swear by your fathers, or by your mothers, or by rivals to Allah; and swear by Allah only, and swear by Allah only when you are speaking the truth. (Using translation from Abū Dāʾūd 3248)
قَالَ رَسُولُ اللهِ ﷺ «لَا تَحْلِفُوا بِآبَائِكُمْ وَلَا بِأُمَّهَاتِكُمْ وَلَا بِالْأَنْدَادِ وَلَا تَحْلِفُوا بِاللهِ إِلَّا وَأَنْتُمْ صَادِقُونَ»
16.7 [Machine] Swearing allegiance to a different religion other than Islam
١٦۔٧ الْحَلِفُ بِمِلَّةٍ سِوَى الْإِسْلَامِ
"The Messenger of Allah said: 'Whoever swears by a religion other than Islam, telling a lie, will be as he said.'" In his narration, Qutaibah said: "Intentionally." Yazid said: "Telling a lie will be as he said, and whoever kills himself with something. Allah will punish him with it in the Fire of Hell." (Using translation from Nasāʾī 3770)
قَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ بِمِلَّةٍ سِوَى الْإِسْلَامِ كَاذِبًا فَهُوَ كَمَا قَالَ وَمَنْ قَتَلَ نَفْسَهُ بِشَيْءٍ عُذِّبَ بِهِ فِي نَارِ جَهَنَّمَ» وَقَالَ قُتَيْبَةُ فِي حَدِيثِهِ بِشَيْءٍ مُتَعَمِّدًا
"Whoever swears by a religion other than Islam, telling a lie, will be as he said, and whoever kills himself with something will be punished with it in the Hereafter." (Using translation from Nasāʾī 3771)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ حَلَفَ بِمِلَّةٍ سِوَى الْإِسْلَامِ كَاذِبًا فَهُوَ كَمَا قَالَ وَمَنْ قَتَلَ نَفْسَهُ بِشَيْءٍ عُذِّبَ بِهِ فِي الْآخِرَةِ»
16.8 [Machine] The swearing of innocence from Islam
١٦۔٨ الْحَلِفُ بِالْبَرَاءَةِ مِنَ الْإِسْلَامِ
the Messenger of Allah ﷺ said: "Whoever says: 'I have nothing to do with Islam,' if he is lying then he is as he said, and if he is telling the truth, his Islam will not be sound." (Using translation from Ibn Mājah 2100)
قَالَ رَسُولُ اللهِ ﷺ «مَنْ قَالَ إِنِّي بَرِيءٌ مِنَ الْإِسْلَامِ فَإِنْ كَانَ كَاذِبًا فَهُوَ كَمَا قَالَ وَإِنْ كَانَ صَادِقًا لَمْ يَعُدْ إِلَى الْإِسْلَامِ سَالِمًا»
16.9 [Machine] The oath by the Kaaba
١٦۔٩ الْحَلِفُ بِالْكَعْبَةِ
"You are setting up rivals (to Allah) and associating others (with Him). You say: 'Whatever Allah wills and you will,' and you say: 'By the Ka'bah.'" So the Prophet commanded them, if they wanted to swear an oath, to say: "By the Lord of the Ka'bah;" and to say: "Whatever Allah wills, then what you will." (Using translation from Nasāʾī 3773)
أَنَّ يَهُودِيًّا أَتَى النَّبِيَّ ﷺ فَقَالَ إِنَّكُمْ تُنَدِّدُونَ وَإِنَّكُمْ تُشْرِكُونَ تَقُولُونَ مَا شَاءَ اللهُ وَشِئْتُ وَتَقُولُونَ وَالْكَعْبَةِ فَأَمَرَهُمُ النَّبِيُّ ﷺ إِذَا أَرَادُوا أَنْ يَحْلِفُوا أَنْ يَقُولُوا وَرَبِّ الْكَعْبَةِ وَيَقُولُ أَحَدُهُمْ مَا شَاءَ اللهُ ثُمَّ شِئْتُ
16.10 [Machine] Taking an Oath with the Tyrants
١٦۔١٠ الْحَلِفُ بِالطَّوَاغِيتِ
"Do not swear by your forefathers or by false gods (At-Tawaghit)." (Using translation from Nasāʾī 3774)
عَنِ النَّبِيِّ ﷺ قَالَ «لَا تَحْلِفُوا بِآبَائِكُمْ وَلَا بِالطَّوَاغِيتِ»
16.11 [Machine] The alliance with Al-Lat
١٦۔١١ الْحَلِفُ بِاللَّاتِ
He who takes an oath in the course of which he says: By Lat (and al-'Uzza), he should say: There is no god but Allah; and that if anyone says to his friend:" Come and I will gamble with you," he should pay sadaqa. (Using translation from Muslim 1647a)
قَالَ رَسُولُ اللهِ ﷺ مَنْ حَلَفَ مِنْكُمْ فَقَالَ بِاللَّاتِ فَلْيَقُلْ لَا إِلَهَ إِلَّا اللهُ وَمَنْ قَالَ لِصَاحِبِهِ تَعَالَ أُقَامِرْكَ فَلْيَتَصَدَّقْ
16.12 [Machine] The Pledge of Al-Lāt and Al-ʿUzza
١٦۔١٢ الْحَلِفُ بِاللَّاتِ وَالْعُزَّى
"We were talking about something, and I had only recently left Jahiliyyah behind, so I swore by Al-Lat and Al-'Uzza. The Companions of the Messenger of Allah said to me: 'What a bad thing you have said! Go to the Messenger of Allah and tell him, for we think that you have committed Kufr.' So I went to him and told him, and he said to me: 'Say: La ilaha illallah wahdahu la sharika lah (There is none worthy of worship except Allah alone, without partner) three times, and seek refuge with Allah from the Shaitan three times, and spit dryly to your left three times, and do not say that again.'" (Using translation from Nasāʾī 3776)
كُنَّا نَذْكُرُ بَعْضَ الْأَمْرِ وَأَنَا حَدِيثُ عَهْدٍ بِالْجَاهِلِيَّةِ فَحَلَفْتُ بِاللَّاتِ وَالْعُزَّى فَقَالَ لِي أَصْحَابُ رَسُولِ اللهِ ﷺ بِئْسَ مَا قُلْتَ ائْتِ رَسُولَ اللهِ ﷺ فَأَخْبِرْهُ فَإِنَّا لَا نَرَاكَ إِلَّا قَدْ كَفَرْتَ فَلَقِيتُهُ فَأَخْبَرْتُهُ فَقَالَ «قُلْ لَا إِلَهَ إِلَّا اللهُ وَحْدَهُ ثَلَاثَ مَرَّاتٍ وَتَعَوَّذْ مِنَ الشَّيْطَانِ ثَلَاثَ مَرَّاتٍ وَاتْفِلْ عَنْ شِمَالِكَ ثَلَاثَ مَرَّاتٍ وَلَا تَعُدْ لَهُ»
"I swore by Al-Lat and Al-'Uzza and my companions said to me: 'What a bad thing you have said! You have said something horrible.' So I went to the Messenger of Allah and told him about that. He said: 'Say: La ilaha illallah wahdahu la sharika lah, lahul-mulk wa lahul-hamd wa huwa 'ala kulli shay'in qadir (There is none worthy of worship except Allah with no partner or associate; His is the Dominion, to Him be all praise, and He is able to do all things). Spit to your left three times, seek refuge with Allah from the Shaitan, and do not say that again.'" (Using translation from Nasāʾī 3777)
أَصْحَابِي بِئْسَ مَا قُلْتَ هُجْرًا فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ «قُلْ لَا إِلَهَ إِلَّا اللهُ وَحْدَهُ لَا شَرِيكَ لَهُ لَهُ الْمُلْكُ وَلَهُ الْحَمْدُ وَهُوَ عَلَى كُلِّ شَيْءٍ قَدِيرٌ وَانْفُثْ عَنْ شِمَالِكَ ثَلَاثًا وَتَعَوَّذْ بِاللهِ مِنَ الشَّيْطَانِ الرَّجِيمِ ثُمَّ لَا تَعُدْ»
16.13 [Machine] Ibrrar Al-Qasam
١٦۔١٣ إِبْرَارُ الْقَسَمِ
"The Messenger of Allah commanded us to do seven things: He commanded us to attend funerals, visit the sick, to reply (say: Yarhamuk Allah [may Allah have mercy on you]) to one who sneezes, to accept invitations, to support the oppressed, to fulfill oaths (when adjured by another) and to return greetings of Salaam." أَمَرَنَا رَسُولُ اللهِ ﷺ بِسَبْعٍ «أَمَرَنَا بِاتِّبَاعِ الْجَنَائِزِ وَعِيَادَةِ الْمَرِيضِ وَتَشْمِيتِ الْعَاطِسِ وَإِجَابَةِ الدَّاعِي وَنَصْرِ الْمَظْلُومِ وَإِبْرَارِ الْقَسَمِ وَرَدِّ السَّلَامِ»
16.14 [Machine] Whoever takes an oath and sees something better than it
١٦۔١٤ مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا
"There is nothing on Earth that I swear an oath upon, and I see that something else is better, but I do that which is better." (Using translation from Nasāʾī 3779)
عَنِ النَّبِيِّ ﷺ قَالَ «مَا عَلَى الْأَرْضِ يَمِينٌ أَحْلِفُ عَلَيْهَا فَأَرَى غَيْرَهَا خَيْرًا مِنْهَا إِلَّا أَتَيْتُهُ»
16.15 [Machine] Atonement before transgression
١٦۔١٥ الْكَفَّارَةَ قَبْلَ الْحِنْثِ
I went to Messenger of Allah ﷺ along with a group of people from (the tribe of) Al-Ashʿari, asking for mounts. The Prophet ﷺ said, "By Allah, I will not give you anything to ride, and I have nothing to mount you on." We stayed there as long as Allah wished, and after that, some camels were brought to the Prophet and he ordered that we be given three camels. When we set out, some of us said to others, "Allah will not bless us, as we all went to Messenger of Allah ﷺ asking him for mounts, and although he had sworn that he would not give us mounts, he did give us." So we returned to the Prophet; and mentioned that to him. He said, "I have not provided you with mounts, but Allah has. By Allah, Allah willing, if I ever take an oath, and then see that another is better than the first, I make expiration for my (dissolved) oath, and do what is better and make expiration." (Using translation from Bukhārī 6718)
أَتَيْتُ رَسُولَ اللهِ ﷺ فِي يَعْنِي رَهْطٍ مِنَ الْأَشْعَرِيِّينَ نَسْتَحْمِلُهُ فَقَالَ «وَاللهِ لَا أَحْمِلُكُمْ وَمَا عِنْدِي مَا أَحْمِلُكُمْ» ثُمَّ لَبِثْنَا مَا شَاءَ اللهُ فَأُتِيَ بِإِبِلٍ فَأَمَرَ لَنَا بِثَلَاثَةِ ذَوْدٍ فَلَمَّا انْطَلَقْنَا قَالَ بَعْضُنَا لِبَعْضٍ لَا يُبَارِكُ اللهُ لَنَا أَتَيْنَا رَسُولَ اللهِ ﷺ نَسْتَحْمِلُهُ فَحَلَفَ لَا يَحْمِلُنَا فَحَمَلْنَا قَالَ أَبُو مُوسَى فَأَتَيْنَا النَّبِيَّ ﷺ فَذَكَرْنَا ذَلِكَ لَهُ فَقَالَ «مَا أَنَا حَمَلْتُكُمْ بَلِ اللهُ حَمَلَكُمْ إِنِّي وَاللهِ إِنْ شَاءَ اللهُ لَا أَحْلِفُ عَلَى يَمِينٍ فَأَرَى غَيْرَهَا خَيْرًا مِنْهَا إِلَّا كَفَّرْتُ عَنْ يَمِينِي وَأَتَيْتُ الَّذِي هُوَ خَيْرٌ»
He who took an oath and then found another thing better than (this) should expiate for the oath (broken) by him and do (the better thing). (Using translation from Muslim 1650b)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى الَّذِي هُوَ خَيْرٌ فَلْيُكَفِّرْ عَنْ يَمِينِهِ وَلْيَفْعَلْ»
the Messenger of Allah ﷺ, said: "Whoever swears an oath then sees that something else is better than it, let him do that which is better and offer expiation for what he swore about. " (Using translation from Ibn Mājah 2108)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيُكَفِّرْ عَنْ يَمِينِهِ وَلْيَأْتِ الَّذِي هُوَ خَيْرٌ»
"If any one of you swears an oath, then he sees something better than it, let him offer expiation for his oath, and look at what is better and do it." (Using translation from Nasāʾī 3782)
عَنْ رَسُولِ اللهِ ﷺ قَالَ «إِذَا حَلَفَ أَحَدُكُمْ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيُكَفِّرْ عَنْ يَمِينِهِ وَلْيَنْظُرْ إِلَى الَّذِي هُوَ خَيْرٌ فَلْيَأْتِهِ»
"The Messenger of Allah said: 'If you swear an oath, offer expiation for your oath, then do that which is better.'" (Using translation from Nasāʾī 3783)
قَالَ لِي رَسُولُ اللهِ ﷺ «إِذَا حَلَفْتَ عَلَى يَمِينٍ فَكَفِّرْ عَنْ يَمِينِكَ ثُمَّ ائْتِ الَّذِي هُوَ خَيْرٌ»
"If you swear an oath, then you see something better than it, then offer expiation for your oath, and do that which is better." (Using translation from Nasāʾī 3784)
أَنَّ النَّبِيَّ ﷺ قَالَ «إِذَا حَلَفْتَ عَلَى يَمِينٍ فَرَأَيْتَ غَيْرَهَا خَيْرًا مِنْهَا فَكَفِّرْ عَنْ يَمِينِكَ وَائْتِ الَّذِي هُوَ خَيْرٌ»
16.16 [Machine] Atonement after committing a sin.
١٦۔١٦ الْكَفَّارَةُ بَعْدَ الْحِنْثِ
the Messenger of Allah ﷺ, said: "Whoever swears an oath then sees that something else is better than it, let him do that which is better and offer expiation for what he swore about. " (Using translation from Ibn Mājah 2108)
قَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ وَلْيُكَفِّرْ عَنْ يَمِينِهِ»
"The Messenger of Allah said: 'Whoever swears an oath, then sees something better than it, let him leave his oath, and do that which is better, and offer expiation for it.'" (Using translation from Nasāʾī 3786)
قَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَدَعْ يَمِينَهُ وَلْيَأْتِ الَّذِي هُوَ خَيْرٌ وَلْيُكَفِّرْ»
He who took an oath, but he found something else better than that, should do that which is better and break his oath. (Using translation from Muslim 1651b)
قَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ وَلْيَتْرُكْ يَمِينَهُ»
"I said: 'O Messenger of Allah, I have a cousin, and I come to him and ask him (for help) but he does not give me anything, and he does not uphold the ties of kinship with me. Then, when he needs me, he comes to me and asks me (for help). I swore that I would not give him anything, nor uphold the ties of kinship with him.' He commanded me to do that which is better and to offer expiation for my oath." (Using translation from Nasāʾī 3788)
قُلْتُ يَا رَسُولَ اللهِ أَرَأَيْتَ ابْنَ عَمٍّ آتِيهِ أَسْأَلُهُ فَلَا يُعْطِينِي وَلَا يَصِلُنِي ثُمَّ يَحْتَاجُ إِلَيَّ فَيَأْتِينِي فَيَسْأَلُنِي وَقَدْ حَلَفْتُ أَلَّا أُعْطِيَهُ وَلَا أَصِلُهُ «فَأَمَرَنِي أَنْ آتِيَ الَّذِي هُوَ خَيْرٌ وَأُكَفِّرَ عَنْ يَمِينِي»
"The Prophet said to me: 'If you swear an oath, and you see something that is better, then do that which is better and offer expiation for your oath.'" (Using translation from Nasāʾī 3789)
قَالَ رَسُولُ اللهِ ﷺ «إِذَا آلَيْتَ عَلَى يَمِينٍ فَرَأَيْتَ غَيْرَهَا خَيْرًا فَأْتِ الَّذِي هُوَ خَيْرٌ وَكَفِّرْ عَنْ يَمِينِكَ»
"The Messenger of Allah said: 'If you swear an oath, then you see something that is better, then do that which is better and offer expiation for your oath.'" (Using translation from Nasāʾī 3790)
قَالَ يَعْنِي رَسُولُ اللهِ ﷺ «إِذَا حَلَفْتَ عَلَى يَمِينٍ فَرَأَيْتَ غَيْرَهَا خَيْرًا مِنْهَا فَأْتِ الَّذِي هُوَ خَيْرٌ وَكَفِّرْ عَنْ يَمِينِكَ»
16.17 [Machine] The right in what is not owned
١٦۔١٧ الْيَمِينُ فِيمَا لَا يُمْلَكُ
"There is no vow and no oath concerning that which one does not possess, nor to commit sin, nor to sever the ties of kinship." (Using translation from Nasāʾī 3792)
قَالَ رَسُولُ اللهِ ﷺ «لَا نَذْرَ وَلَا يَمِينَ فِيمَا لَا تَمْلِكُ وَلَا فِي مَعْصِيَةِ اللهِ وَلَا قَطِيعَةِ رَحِمٍ»
16.18 [Machine] Whoever swears an oath must exclude
١٦۔١٨ مَنْ حَلَفَ فَاسْتَثْنَى
"Whoever swears an oath and says: 'If Allah wills', then if he wishes he may go ahead, and if he wishes he may not, without having broken his oath." (Using translation from Nasāʾī 3793)
عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ حَلَفَ فَاسْتَثْنَى فَإِنْ شَاءَ مَضَّى وَإِنْ شَاءَ تَرَكَ غَيْرَ حَنِثٍ»
16.19 [Machine] Intention in the Right
١٦۔١٩ النِّيَّةُ فِي الْيَمِينِ
I heard the Messenger of Allah ﷺ say: “Action is but by intention and each person will have but that which he intended. So whoever migrated for the sake of Allah and His Messenger, then his migration was for the sake of Allah and His Messenger, whoever migrated for some worldly purpose or for the sake of a woman whom he could marry, his migration was for the purpose for which he migrated.” (Using translation from Aḥmad 300)
عَنِ النَّبِيِّ ﷺ قَالَ «إِنَّمَا الْأَعْمَالُ بِالنِّيَّةِ وَإِنَّمَا لِامْرِئٍ مَا نَوَى فَمَنْ كَانَتْ هِجْرَتُهُ إِلَى اللهِ وَرَسُولِهِ فَهِجْرَتُهُ إِلَى اللهِ وَرَسُولِهِ وَمَنْ كَانَتْ هِجْرَتُهُ إِلَى دُنْيَا يُصِيبُهَا أَوِ امْرَأَةٍ يَتَزَوَّجُهَا فَهِجْرَتُهُ إِلَى مَا هَاجَرَ إِلَيْهِ»
16.20 [Machine] The Prohibition of what Allah has Made Permissible
١٦۔٢٠ تَحْرِيمُ مَا أَحَلَّ اللهُ
I heard ʿAisha saying, "The Prophet ﷺ used to stay for a long while with Zanab bint Jahsh and drink honey at her house. So Hafsa and I decided that if the Prophet ﷺ came to anyone of us, she should say him, "I detect the smell of Maghafir (a nasty smelling gum) in you. Have you eaten Maghafir?' " So the Prophet ﷺ visited one of them and she said to him similarly. The Prophet ﷺ said, "Never mind, I have taken some honey at the house of Zainab bint Jahsh, but I shall never drink of it anymore." So there was revealed: 'O Prophet ! Why do you ban (for you) that which Allah has made lawful for you . . . If you two (wives of Prophet) turn in repentance to Allah,' (66.1-4) addressing Aisha and Hafsa. 'When the Prophet ﷺ disclosed a matter in confidence to some of his wives.' (66.3) namely his saying: But I have taken some honey." (Using translation from Bukhārī 5267)
أَنَّ النَّبِيَّ ﷺ كَانَ يَمْكُثُ عِنْدَ زَيْنَبَ بِنْتِ جَحْشٍ فَيَشْرَبُ عِنْدَهَا عَسَلًا فَتَوَاصَيْتُ أَنَا وَحَفْصَةُ أَنَّ أَيَّتَنَا دَخَلَ عَلَيْهَا النَّبِيُّ ﷺ فَلْتَقُلْ إِنِّي أَجِدُ مِنْكَ رِيحَ مَغَافِيرَ أَكَلْتَ مَغَافِيرَ فَدَخَلَ عَلَى إِحْدَاهُمَا فَقَالَتْ ذَلِكَ لَهُ فَقَالَ «لَا بَلْ شَرِبْتُ عَسَلًا عِنْدَ زَيْنَبَ بِنْتِ جَحْشٍ وَلَنْ أَعُودَ لَهُ» فَنَزَلَتْ {يَا أَيُّهَا النَّبِيُّ لِمَ تُحَرِّمُ مَا أَحَلَّ اللهُ لَكَ تَبْتَغِي مَرْضَاةَ أَزْوَاجِكَ} {إِنْ تَتُوبَا إِلَى اللهِ} [التحريم 4] لِعَائِشَةَ وَحَفْصَةَ { وَإِذْ أَسَرَّ النَّبِيُّ إِلَى بَعْضِ أَزْوَاجِهِ حَدِيثًا} [التحريم 3] لِقَوْلِهِ «بَلْ شَرِبْتُ عَسَلًا»
16.21 [Machine] If he swears not to be harmed, then he ate bread with vinegar.
١٦۔٢١ إِذَا حَلَفَ أَنْ لَا يَأْتَدِمَ فَأَكَلَ خُبْزًا بِخَلٍّ
"I entered the house of the Prophet with him and there was some bread and vinegar. The Messenger of Allah said: 'Eat; what a good condiment is vinegar.'" (Using translation from Nasāʾī 3796)
دَخَلْتُ مَعَ النَّبِيِّ ﷺ بَيْتَهُ فَإِذَا فَلْقٌ وَخَلٌّ قَالَ رَسُولُ اللهِ ﷺ «كُلْ فَنِعْمَ الْأُدُمُ هُوَ»
16.22 [Machine] Oath and lying for those who do not believe in the heart-
١٦۔٢٢ الْحَلِفُ وَالْكَذِبُ لِمَنْ لَمْ يَعْتَقِدِ الْيَمِينَ بِقَلْبِهِ
"At the time of the Messenger of Allah we used to be called Samasir (brokers). The Messenger of Allah came to us when we were selling and called us by a name that was better than that. He said: 'O merchants (Tujjar), this selling involves lies and (false) oaths, so mix some charity with it.'" (Using translation from Nasāʾī 3797)
كُنَّا نُسَمَّى السَّمَاسِرَةَ فَأَتَانَا النَّبِيُّ ﷺ وَنَحْنُ نَبِيعُ فَسَمَّانَا بِاسْمٍ هُوَ أَحْسَنُ لَنَا مِنِ اسْمِنَا فَقَالَ «يَا مَعْشَرَ التُّجَّارِ إِنَّ هَذَا الْبَيْعَ يَحْضُرُهُ الْحَلِفُ وَالْكَذِبُ فَشُوبُوا بَيْعَكُمْ بِصَدَقَةٍ»

16.23 [Machine] Frivolity and lying
١٦۔٢٣ اللَّغْوَ وَالْكَذِبَ
"The Prophet came to us when we were in the marketplace and said: 'This marketplace is filled with idle talk and (false) oaths, so mix some charity with it.'" (Using translation from Nasāʾī 3799)
أَتَانًا النَّبِيُّ ﷺ وَنَحْنُ فِي السُّوقِ فَقَالَ «إِنَّ هَذِهِ السُّوقَ يُخَالِطُهَا اللَّغْوُ وَالْكَذِبُ فَشُوبُوهَا بِصَدَقَةٍ»
"In Al-Madinah we used to buy and sell Wasqs (of goods), and we used to call ourselves Samasir (brokers), and the people used to call us like that. The Messenger of Allah came out to us one day, and called us by a name that was better than that which we called ourselves and which the people called us. He said: 'O Tujjar (traders), your selling involves (false) oaths and lies, so mix some charity with it.'" (Using translation from Nasāʾī 3800)
كُنَّا بِالْمَدِينَةِ نَبِيعُ الْأَوْسَاقَ وَنَبْتَاعُهَا وَكُنَّا نُسَمِّي أَنْفُسَنَا السَّمَاسِرَةَ وَيُسَمِّينَاهُ النَّاسُ فَخَرَجَ إِلَيْنَا رَسُولُ اللهِ ﷺ ذَاتَ يَوْمٍ فَسَمَّانَا بِاسْمٍ هُوَ خَيْرٌ مِنَ الَّذِي سَمَّيْنَا أَنْفُسَنَا وَسَمَّانَا النَّاسُ فَقَالَ «يَا مَعْشَرَ التُّجَّارِ إِنَّهُ يَشْهَدُ بَيْعَكُمُ اللَّغْوُ فَشُوبُوهُ بِالصَّدَقَةِ»

16.25 [Machine] Prohibition of Vows
١٦۔٢٥ النَّهْيُ عَنِ النَّذْرِ
It does not (necessarily) bring good (in the form of substantial, and tangible results), but it is the meant whereby something is extracted from the miserly persons. (Using translation from Muslim 1639c)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ النَّذْرِ وَقَالَ إِنَّهُ لَا يَأْتِي بِخَيْرٍ إِنَّمَا يُسْتَخْرَجُ بِهِ مِنَ الْبَخِيلِ
The Prophet ﷺ forbade vowing and said, "In fact, vowing does not prevent anything, but it makes a miser to spend his property." (Using translation from Bukhārī 6608)
نَهَى رَسُولُ اللهِ ﷺ عَنِ النَّذْرِ وَقَالَ «إِنَّهُ لَا يَرُدُّ شَيْئًا وَإِنَّمَا يُسْتَخْرَجُ بِهِ مِنَ الشَّحِيحِ»
16.26 [Machine] Promises do not advance anything nor delay it.
١٦۔٢٦ النَّذْرُ لَا يُقَدِّمُ شَيْئًا وَلَا يُؤَخِّرُهُ
"The Messenger of Allah said: 'A vow does not bring anything forward or put it back; it is just a means of taking wealth from the miserly.'" (Using translation from Nasāʾī 3803)
قَالَ رَسُولُ اللهِ ﷺ «النَّذْرُ لَا يُقَدِّمُ شَيْئًا وَلَا يُؤَخِّرُهُ إِنَّمَا هُوَ شَيْءٌ يُسْتَخْرَجُ بِهِ مِنَ الشَّحِيحِ»
"A vow does not bring anything to the son of Adam that has not been decreed for him. It is just a means of taking wealth from the miserly." (Using translation from Nasāʾī 3804)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَأْتِي النَّذْرُ عَلَى ابْنِ آدَمَ شَيْئًا لَمْ يُقَدَّرْ عَلَيْهِ وَلَكِنَّهُ شَيْءٌ اسْتُخْرِجَ بِهِ مِنَ الْبَخِيلِ
16.27 [Machine] The vow is extracted from the stingy person
١٦۔٢٧ النَّذْرُ يُسْتَخْرَجُ بِهِ مِنَ الْبَخِيلِ
Do not take vows, for a vow has no effect against Fate; it is only from the miserly that something is extracted. (Using translation from Muslim 1640a)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا تُنْذِرُوا فَإِنَّ النَّذْرَ لَا يُغْنِي مِنَ الْقَدَرِ شَيْئًا وَإِنَّمَا يُسْتَخْرَجُ بِهِ مِنَ الْبَخِيلِ»
16.28 [Machine] The vow in obedience
١٦۔٢٨ النَّذْرُ فِي الطَّاعَةِ
The Messenger of Allah ﷺ as saying: If anyone vows to obey Allah, let him obey Him, but if anyone vows to disobey Him, let him not disobey Him. (Using translation from Abū Dāʾūd 3289)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ نَذَرَ أَنْ يُطِيعَ اللهَ فَلْيُطِعْهُ وَمَنْ نَذَرَ أَنْ يَعْصِيَ اللهَ فَلَا يَعْصِهِ»
16.29 [Machine] Nadher (vow) in disobedience
١٦۔٢٩ النَّذْرُ فِي الْمَعْصِيَةِ
The Messenger of Allah ﷺ as saying: If anyone vows to obey Allah, let him obey Him, but if anyone vows to disobey Him, let him not disobey Him. (Using translation from Abū Dāʾūd 3289)
عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ نَذَرَ أَنْ يُطِيعَ اللهَ فَلْيُطِعْهُ وَمَنْ نَذَرَ أَنْ يَعْصِيَ اللهَ فَلَا يَعْصِهِ»
[Machine] I heard the Messenger of Allah ﷺ saying, "Whoever vows to obey Allah, let him obey Him. And whoever vows to disobey Allah, let him not disobey Him." Abu Abdur-Rahman Talhah ibn Abdil-Malik said, "He is a trustworthy narrator."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «مَنْ نَذَرَ أَنْ يُطِيعَ اللهَ فَلْيُطِعْهُ وَمَنْ نَذَرَ أَنْ يَعْصِيَ اللهَ فَلَا يَعْصِهِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ طَلْحَةَ بْنِ عَبْدِ الْمَلِكِ ثِقَةٌ ثِقَةٌ ثِقَةٌ
16.30 [Machine] Fulfilling the vow
١٦۔٣٠ الْوَفَاءُ بِالنَّذْرِ
I heard ʿImran bin Husain saying, "The Prophet ﷺ said, 'The best people are those living in my generation, then those coming after them, and then those coming after (the second generation)." ʿImran said "I do not know whether the Prophet ﷺ mentioned two or three generations after your present generation. The Prophet ﷺ added, 'There will be some people after you, who will be dishonest and will not be trustworthy and will give witness (evidences) without being asked to give witness, and will vow but will not fulfill their vows, and obesity will appear among them." أَنَّ رَسُولَ اللهِ ﷺ قَالَ «خَيْرُكُمْ قَرْنِي ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ» فَلَا أَدْرِي ذَكَرَ قَرْنَيْنِ بَعْدُ أَوْ ثَلَاثَةً ثُمَّ ذَكَرَ قَوْمًا يَخُونُونَ وَلَا يَؤْتَمَنُونَ وَيَشهَدُونَ وَلَا يُسْتَشْهَدُونَ وَيَنْذِرُونَ وَلَا يُوفُونَ وَيَظْهَرُ فِيهِمُ السِّمَنُ
16.31 [Machine] Vows in matters not intended for the sake of Allah
١٦۔٣١ النَّذْرُ فِيمَا لَا يُرَادُ بِهِ وَجْهَ اللهِ
"The Messenger of Allab passed by a man who was leading another man with something that he had stipulated in a vow. The Prophet took it and broke it, and he said: 'It is a vow.'" (Sahih) Chatper 136. It Is Permissible To Speak During Tawaf (Using translation from Nasāʾī 2921)
