16. Oaths and Vows (2/2)
١٦۔ كِتَابُ الْأَيْمَانِ وَالنُّذُورِ ص ٢
"The Prophet passed by a man who was circumambulating the Ka'bah, led by another man with a reign in his nose. The Prophet took him by the hand and commanded him to lead him by his hand." Ibn Juraij said: "Sulaiman told me that Tawus told him, from Ibn 'Abbas, that the Prophet passed by him when he was circumambulating the Ka'bah, and a man had tied his hand to another man with some string or thread or whatever. The Prophet cut it with his hand then said: 'Lead him with your hand.'" (Using translation from Nasāʾī 3811)
أَنَّ النَّبِيَّ ﷺ مَرَّ يَعْنِي بِرَجُلٍ وَهُوَ يَطُوفُ بِالْكَعْبَةِ يَقُودُهُ إِنْسَانٌ بِخِزَامَةٍ فِي أَنْفِهِ فَقَطَعَهُ النَّبِيُّ ﷺ بِيَدِهِ ثُمَّ «أَمْرَهُ أَنْ يَقُودَهُ بِيَدِهِ» قَالَ ابْنُ جُرَيْجٍ وَأَخْبَرَنِي سُلَيْمَانُ أَنَّ طَاوُسًا أَخْبَرَهُ عَنِ ابْنِ عَبَّاسٍ أَنَّ النَّبِيَّ ﷺ مَرَّ وَهُوَ يَطُوفُ بِالْكَعْبَةِ بِإِنْسَانٍ وَقَدْ رَبَطَ يَدَهُ بِإِنْسَانٍ آخَرَ بِسَيْرٍ أَوْ بِخَيْطٍ أَوْ بِشَيْءٍ غَيْرِ ذَلِكَ فَقَطَعَهُ النَّبِيُّ ﷺ بِيَدِهِ ثُمَّ قَالَ «قُدْهُ بِيَدِهِ»
16.32 [Machine] The vow in what cannot be possessed
١٦۔٣٢ النَّذْرُ فِيمَا لَا يُمْلَكُ
"There is no vow to commit an act of disobedience, and no vow concerning that which the son of Adam does not possess." (Using translation from Nasāʾī 3812)
أَنَّ النَّبِيَّ ﷺ قَالَ «لَا نَذَرَ فِي مَعْصِيَةِ اللهِ وَلَا فِيمَا لَا يَمْلِكُ ابْنُ آدَمَ»
"Whoever swears by a religion other than Islam, telling a lie, will be as he said, and whoever kills himself with something, he will be punished with it in the Hereafter, and there is no vow concerning that which a man does not possess." (Using translation from Nasāʾī 3813)
قَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ بِمِلَّةٍ سِوَى الْإِسْلَامِ كَاذِبًا فَهُوَ كَمَا قَالَ وَمَنْ قَتَلَ نَفْسَهُ بِشَيْءٍ فِي الدُّنْيَا عُذِّبَ بِهِ يَوْمَ الْقِيَامَةِ وَلَيْسَ عَلَى رَجُلٍ نَذْرٌ فِيمَا لَا يَمْلِكُ»
16.33 [Machine] Who has vowed to walk to the house of Allah?
١٦۔٣٣ مَنْ نَذَرَ أَنْ يَمْشِيَ إِلَى بَيْتِ اللهِ
My sister took a vow to walk on foot to the House of Allah (i.e. Ka'bah). She asked me to consult the Prophet ﷺ about her. So I consulted the Prophet ﷺ. He said: Let her walk and ride. (Using translation from Abū Dāʾūd 3299)
أَنْ أَسْتَفْتِيَ لَهَا رَسُولَ اللهِ ﷺ فَاسْتَفْتَيْتُ النَّبِيَّ ﷺ فَقَالَ «لِتَمْشِي وَلْتَرْكَبْ»
16.34 [Machine] If the woman vows to walk barefoot without being fermented
١٦۔٣٤ إِذَا نَذَرَتِ الْمَرْأَةُ أَنْ تَمْشِيَ حَافِيَةً غَيْرَ مُخْتَمِرَةٍ
"Tell her to cover her head and ride, and fast for three days." (Using translation from Nasāʾī 3815)
أَخْبَرَهُ أَنَّهُ سَأَلَ النَّبِيَّ ﷺ عَنْ أُخْتٍ لَهُ نَذَرَتْ أَنْ تَمْشِيَ حَافِيَةً غَيْرَ مُخْتَمِرَةٍ فَقَالَ لَهُ النَّبِيُّ ﷺ «مُرْهَا فَلْتَخْتَمِرْ وَلْتَرْكَبْ وَلْتَصُمْ ثَلَاثَةَ أَيَّامٍ»
16.35 [Machine] Who vowed to fast but died before fasting.
١٦۔٣٥ مَنْ نَذَرَ أَنْ يَصُومَ ثُمَّ مَاتَ قَبْلَ أَنْ يَصُومَ
"A woman traveled by sea and vowed to fast for a month, but she died before she could fast. Her sister came to the Prophet and told him about that, and he told her to fast on her behalf." (Using translation from Nasāʾī 3816)
أَنْ تَصُومَ فَأَتَتْ أُخْتُهَا النَّبِيَّ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ «فَأَمَرَهَا أَنْ تَصُومَ عَنْهَا»
16.36 [Machine] Who dies with a vow?
١٦۔٣٦ مَنْ مَاتَ وَعَلَيْهِ نَذْرٌ
Fulfil it on her behalf. (Using translation from Muslim 1638a)
أَنَّ سَعْدَ بْنَ عُبَادَةَ اسْتَفْتَى رَسُولَ اللهِ ﷺ فِي نَذْرٍ كَانَ عَلَى أُمِّهِ تُوُفِّيَتْ قَبْلَ أَنْ تَقْضِيَهُ فَقَالَ «اقْضِهِ عَنْهَا»
"Sa'd consulted the Messenger of Allah about a vow which his mother had to fulfill, but she died before doing so. The Messenger of Allah said: 'Fulfill it on her behalf.'" (Using translation from Nasāʾī 3659)
اسْتَفْتَى سَعْدُ بْنُ عُبَادَةَ رَسُولَ اللهِ ﷺ فِي نَذْرٍ كَانَ عَلَى أُمِّهِ فَتُوُفِّيَتْ قَبْلَ أَنْ تَقْضِيَهُ فَقَالَ رَسُولُ اللهِ ﷺ «اقْضِهِ عَنْهَا»
Sa'd bin 'Ubadah came to the Prophet and said: "My mother has died and she had a vow to fulfill but she did not do so." He said: "Fulfill it on her behalf." (Using translation from Nasāʾī 3663)
جَاءَ سَعْدُ بْنُ عِبَادَةَ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنَّ أُمِّي مَاتَتْ وَعَلَيْهَا نَذْرٌ لَمْ تَقْضِهِ قَالَ «اقْضِهِ عَنْهَا»
16.37 [Machine] If he vowed and then submitted before fulfilling it
١٦۔٣٧ إِذَا نَذَرَ ثُمَّ أَسْلَمَ قَبْلَ أَنْ يَفِيَ
It was narrated from ‘Umar that he had vowed during the days of Ignorance to spend one night in I’tikaf. He asked the Prophet ﷺ about it, so he commanded him to spend it in I’tikaf. (Using translation from Ibn Mājah 1772)
أَنَّهُ كَانَ عَلَيْهِ لَيْلَةٌ نَذْرٌ فِي الْجَاهِلِيَّةِ يَعْتَكِفُهَا فَسَأَلَ رَسُولَ اللهِ ﷺ «فَأَمَرَهُ أَنْ يَعْتَكِفَ»
"Umar had made a vow to spend a night in 'Itikaf in Al-Masjid Al-Haram. He asked the Messenger of Allah about that, and he ordered him to perform the 'Itikaf." (Using translation from Nasāʾī 3821)
كَانَ عَلَى عُمَرَ بْنِ الْخَطَّابِ نَذْرٌ فِي اعْتِكَافِ لَيْلَةٍ فِي الْمَسْجِدِ الْحَرَامِ فَسَأَلَ رَسُولَ اللهِ ﷺ «فَأَمَرَهُ أَنْ يَعْتَكِفَ»
It was narrated from Ibn 'Umar that 'Umar had vowed -during the Jahiliyyah- to spend a day in 'Itikaf. He asked the Messenger of Allah about that, and he commanded him to perform the 'Itikaf. (Using translation from Nasāʾī 3822)
أَنَّ عُمَرَ كَانَ قَدْ جَعَلَ عَلَيْهِ يَوْمًا يَعْتَكِفُهُ فِي الْجَاهِلِيَّةِ فَسَأَلَ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ «فَأَمَرَهُ أَنْ يَعْتَكِفَ»
"O Messenger of Allah! I want to give all my wealth in charity for Allah and His Messenger." The Messenger of Allah said to him: "Keep some of your wealth for yourself; that is better for you." (Using translation from Nasāʾī 3823)
أَنَّهُ قَالَ لِرَسُولِ اللهِ ﷺ حِينَ تِيبَ عَلَيْهِ يَا رَسُولَ اللهِ إِنِّي أَنْخَلِعُ مِنْ مَالِي صَدَقَةً إِلَى اللهِ وَرَسُولِهِ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ «أَمْسِكْ عَلَيْكَ بَعْضَ مَالِكَ فَهُوَ خَيْرٌ لَكَ» قَالَ لَنَا أَبُو عَبْدِ الرَّحْمَنِ يُشْبِهُ أَنْ يَكُونَ الزُّهْرِيُّ سَمِعَ هَذَا الْحَدِيثَ مِنْ عَبْدِ اللهِ بْنِ كَعْبِ بْنِ مَالِكٍ وَسَمِعَهُ مِنْ عَبْدِ الرَّحْمَنِ بْنِ عَبْدِ اللهِ عَنْهُ فِي الْحَدِيثِ الطَّوِيلِ
16.38 [Machine] If he dedicates his money for the purpose of a vow
١٦۔٣٨ إِذَا أَهْدَى مَالَهُ عَلَى وَجْهِ النَّذْرِ
"I heard Ka'b bin Malik narrating his Hadith about when he stayed behind and did not join the Messenger of Allah on the campaign to Tabuk. He said: 'When I sat down before him I said: "O Messenger of Allah, as part of my repentance I want to give my wealth in charity to Allah and His Messenger." The Messenger of Allah said: "Keep some of your wealth for yourself; that is better for you." I said: "I will keep my share that is in Khaibar."'" (Using translation from Nasāʾī 3824)
عَنْ رَسُولِ اللهِ ﷺ فِي غَزْوَةِ تَبُوكَ قَالَ فَلَمَّا جَلَسْتُ بَيْنَ يَدَيْهِ قُلْتُ يَا رَسُولَ اللهِ إِنَّ مِنْ تَوْبَتِي أَنْ أَنْخَلِعَ مِنْ مَالِي صَدَقَةً إِلَى اللهِ وَإِلَى رَسُولِهِ قَالَ رَسُولُ اللهِ ﷺ «أَمْسِكْ عَلَيْكَ بَعْضَ مَالِكَ فَهُوَ خَيْرٌ لَكَ» قُلْتُ فَإِنِّي أَمْسِكُ سَهْمِيَ الَّذِي بِخَيْبَرَ مُخْتَصَرٌ مِنْ حَدِيثِ التَّوْبَةِ
I said: Messenger of Allah, to make my repentance complete I should divest myself of my property as sadaqah (alms) for Allah and His Apostle. The Messenger of Allah ﷺ said: Retain some of your property, for that will be better for you. So he said: I shall retain the portion I have at Khaybar. (Using translation from Abū Dāʾūd 3317)
عَنْ رَسُولِ اللهِ ﷺ فِي غَزْوَةِ تَبُوكَ قَالَ قُلْتُ يَا رَسُولَ اللهِ إِنَّ مِنْ تَوْبَتِي أَنْ أَنْخَلِعَ مِنْ مَالِي صَدَقَةً إِلَى اللهِ وَإِلَى رَسُولِهِ قَالَ رَسُولُ اللهِ ﷺ «أَمْسِكْ عَلَيْكَ بَعْضَ مَالِكَ فَهُوَ خَيْرٌ لَكَ» قُلْتُ فَإِنِّي أَمْسِكُ سَهْمِي الَّذِي بِخَيْبَرَ

قُلْتُ يَا رَسُولَ اللهِ إِنَّ اللهَ إِنَّمَا نَجَّانِي بِالصِّدْقِ وَإِنَّ مِنْ تَوْبَتِي أَنْ لَا أُحَدِّثُ إِلَّا صِدْقًا مَا بَقِيتُ إِنْ شَاءَ اللهُ وَإِنَّ مِنْ تَوْبَتِي أَنْ أَنْخَلِعَ مِنْ مَالِي صَدَقَةً إِلَى اللهِ وَإِلَى رَسُولِهِ قَالَ «أَمْسِكْ عَلَيْكَ بَعْضَ مَالِكَ فَهُوَ خَيْرٌ لَكَ» قُلْتُ فَإِنِّي أَمْسِكُ سَهْمِيَ الَّذِي بِخَيْبَرَ
16.39 [Machine] Does the Earthfowl enter its property if warned?
١٦۔٣٩ هَلْ تَدْخُلُ الْأَرْضُونَ فِي مَالِهِ إِذَا نُذِرَ
"We were with the Messenger of Allah in the year of Khaibar, and we did not get any spoils of war except for wealth, goods and clothes. Then a man from Banu Ad-Dubaib, who was called Rifa'ah bin Zaid, gave the Messenger of Allah a black slave who was called Mid'am. The Messenger of Allah set out for Wadi Al-Qura. When we were in Wadi Al-Qura, while Mid'am was unloading the luggage of the Messenger of Allah, an arrow came and killed him. The people said: 'Congratulations! You will go to Paradise,' but the Messenger of Allah said: 'No, by the One in Whose hand is my soul! The cloak that he took from the spoils of war on the Day of Khaibar is burning him with fire.' When the people heard that, a man brought one or two shoelaces to the Messenger of Allah and the Messenger of Allah said: 'One or two shoelaces of fire.'" (Using translation from Nasāʾī 3827)
كُنَّا مَعَ رَسُولِ اللهِ ﷺ يَوْمَ خَيْبَرَ فَلَمْ نَغْنَمْ إِلَّا الْأَمْوَالَ الْمَتَاعَ وَالثِّيَابَ فَأَهْدَى رَجُلٌ مِنْ بَنِي الضَّبِيبِ يُقَالُ لَهُ رِفَاعَةُ بْنُ زَيْدٍ لِرَسُولِ اللهِ ﷺ غُلَامًا أَسْوَدَ يُقَالُ لَهُ مِدْعَمٌ فَتَوَجَّهَ رَسُولُ اللهِ ﷺ إِلَى وَادِي الْقُرَى حَتَّى إِذَا كُنَّا بِوَادِي الْقُرَى بَيْنَمَا مِدْعَمٌ يَحُطُّ رَحْلَ رَسُولِ اللهِ ﷺ إِذْ جَاءَهُ سَهْمٌ فَأَصَابَهُ فَقَتَلَهُ فَقَالَ النَّاسُ هَنِيئًا لَهُ الْجَنَّةُ فَقَالَ رَسُولُ اللهِ ﷺ كَلَّا وَالَّذِي نَفْسِي بِيَدِهِ إِنَّ الشَّمْلَةَ الَّتِي أَخَذَ يَوْمَ خَيْبَرَ مِنَ الْمَغَانِمِ لَمْ تُصِبْهَا الْمَقَاسِمُ لَتَشْتَعِلُ عَلَيْهِ نَارًا فَلَمَّا سَمِعَ النَّاسُ ذَلِكَ جَاءَ رَجُلٌ بِشِرَاكٍ أَوْ شِرَاكَيْنِ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ «شِرَاكٌ أَوْ شِرَاكَانِ مِنْ نَارٍ»
16.40 [Machine] The Exception
١٦۔٤٠ الِاسْتِثْنَاءُ
'Whoever swears an oath and says In sha' Allah, he will have made an exception."(2) (Using translation from Ibn Mājah 2104)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ حَلَفَ فَقَالَ إِنْ شَاءَ اللهُ فَلَهُ ثُنْيَاهُ
"The Messenger of Allah said: 'Whoever swears an oath and says: If Allah wills, then he has made an exception.'" (Using translation from Nasāʾī 3828)
قَالَ رَسُولُ اللهِ ﷺ مَنْ حَلَفَ فَقَالَ إِنْ شَاءَ اللهُ فَقَدِ اسْتَثْنَى
"Whoever swears an oath and says, 'If Allah wills,' then he has the choice: If he wishes, he may go ahead, and if he wishes he may not." (Using translation from Nasāʾī 3830)
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ حَلَفَ عَلَى يَمِينٍ فَقَالَ إِنْ شَاءَ اللهُ فَهُوَ بِالْخِيَارِ إِنْ شَاءَ مَضَى وَإِنْ شَاءَ تَرَكَ
16.41 [Machine] If a man swears an oath and another man says to him "If Allah wills, does he have any exception?
١٦۔٤١ إِذَا حَلَفَ رَجُلٌ فَقَالَ لَهُ رَجُلٌ إِنْ شَاءَ اللهُ هَلْ لَهُ اسْتِثْنَاءٌ
Messenger of Allah ﷺ said, "(The Prophet) Solomon once said, 'Tonight I will sleep with ninety women, each of whom will bring forth a (would-be) cavalier who will fight in Allah's Cause." On this, his companion said to him, "Say: Allah willing!" But he did not say Allah willing. Solomon then slept with all the women, but none of them became pregnant but one woman who later delivered a halfman. By Him in Whose Hand Muhammad's soul is, if he (Solomon) had said, 'Allah willing' (all his wives would have brought forth boys) and they would have fought in Allah's Cause as cavaliers. عَنْ رَسُولِ اللهِ ﷺ قَالَ «وَقَالَ سُلَيْمَانُ بْنُ دَاوُدَ» لَأَطُوفَنَّ اللَّيْلَةَ عَلَى تِسْعِينَ امْرَأَةً كُلُّهُنَّ تَأْتِي بِفَارِسٍ يُجَاهِدُ فِي سَبِيلِ اللهِ فَقَالَ لَهُ صَاحِبُهُ قُلْ إِنْ شَاءَ اللهُ فَلَمْ يَقُلْ إِنْ شَاءَ اللهُ فَطَافَ عَلَيْهِنَّ جَمِيعًا فَلَمْ تَحْمِلْ مِنْهُنَّ إِلَّا امْرَأَةٌ وَاحِدَةٌ جَاءَتْ بِشِقِّ رَجُلٍ وَأَيْمُ الَّذِي نَفْسُ مُحَمَّدٍ بِيَدِهِ لَوْ قَالَ إِنْ شَاءَ اللهُ لَجَاهَدُوا فِي سَبِيلِ اللهِ فُرْسَانًا أَجْمَعُونَ
16.42 [Machine] The expiation of a vow
١٦۔٤٢ كَفَّارَةُ النَّذْرِ
The Messenger of Allah ﷺ as saying: The atonement for a vow is the same as for an oath. Abu Dawud said: This tradition has also been transmitted by 'Amr b. al-Harith from Ka'b b. 'Alqamah, from Ibn Shamasah on the authority of 'Uqbah. (Using translation from Abū Dāʾūd 3323)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «كَفَّارَةُ النَّذْرِ كَفَّارَةُ الْيَمِينِ»
