١٥۔ كِتَابُ الْمُزَارَعَةِ ص ٢
"He went out to him (and met him) in Al-Balat, and I was with him. He asked him (about that) and he said: 'Yes, the Messenger of Allah forbade leasing arable land.' So 'Abdullah stopped leasing it." (Using translation from Nasāʾī 3912)
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ نَهَى عَنْ ذَلِكَ قَالَ نَافِعٌ فَخَرَجَ إِلَيْهِ عَلَى الْبَلَاطِ وَأَنَا مَعَهُ فَسَأَلَهُ فَقَالَ «نَعَمْ نَهَى رَسُولُ اللهِ ﷺ عَنْ كِرَاءِ الْمَزَارِعِ» فَتَرَكَ عَبْدُ اللهِ كِرَاءَهَا
"A man told Ibn 'Umar that Rafi' bin Khadij had narrated a Hadith concerning leasing of land. He and I, along with the man who had told him that, went to Rafi', and he told us that the Messenger of Allah had forbidden leasing land. So 'Abdullah stopped leasing land." أَنَّ رَسُولَ اللهِ ﷺ «نَهَى عَنْ كِرَاءِ الْأَرْضِ» فَتَرَكَ عَبْدُ اللهِ كِرَاءَ الْأَرْضِ
It was narrated from Nafi' that Rafi' bin Khadij told 'Abdullah bin 'Umar that the Messenger of Allah forbade leasing arable land. (Using translation from Nasāʾī 3914)
أَنَّ رَسُولَ اللهِ ﷺ «نَهَى عَنْ كِرَاءِ الْمَزَارِعِ»
"Ibn 'Umar used to lease his land in return for some of its produce. Then he heard that Rafi' bin Khadij warned against that. He said: 'The Messenger of Allah forbade that.' He said: 'We used to lease our land before we came to know Rafi'.' Then he (Ibn 'Umar) became unsure, so he put his hand on my shoulder and we went to Rafi'. 'Abdullah said to him: 'Did you hear the Prophet forbid leasing land?' Rafi' said: 'I heard the Prophet say: Do not lease land in return for anything.'" (Using translation from Nasāʾī 3915)
وَقَالَ نَهَى رَسُولُ اللهِ ﷺ عَنْ ذَلِكَ قَالَ قَدْ كُنَّا نُكْرِي الْأَرْضَ قَبْلَ أَنْ نَعْرِفَ رَافِعًا ثُمَّ وَجَدَ فِي نَفْسِهِ فَوَضَعَ يَدَهُ عَلَى مَنْكِبَيَّ حَتَّى دَفَعْنَا إِلَى رَافِعٍ فَقَالَ لَهُ عَبْدُ اللهِ أَسَمِعْتَ النَّبِيَّ ﷺ نَهَى عَنْ كِرَاءِ الْأَرْضِ؟ قَالَ رَافِعٌ سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ «لَا تُكْرُوا الْأَرْضَ بِشَيْءٍ»
It was narrated from Rafi' bin Khadij that the Messenger of Allah forbade leasing land. (Using translation from Nasāʾī 3916)
أَنَّ رَسُولَ اللهِ ﷺ «نَهَى عَنْ كِرَاءِ الْأَرْضِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَرَوَاهُ ابْنُ عُمَرَ عَنْ رَافِعِ بْنِ خَدِيجٍ وَاخْتُلِفَ عَلَى عَمْرِو بْنِ دِينَارٍ فِي رِوَايَتِهِ عَنْهُ فِيهِ
Jabir (Allah be pleased with him) reported Allah's Apostle ﷺ having forbidden Mukhabara. (Using translation from Muslim 1536q)
أَنَّ رَسُولَ اللهِ ﷺ «نَهَى عَنِ الْمُخَابَرَةِ»
[Machine] He heard the Prophet ﷺ say, "He is forbidden from false information." Hammad ibn Zaid agreed with them.
أَنَّهُ سَمِعَ النَّبِيَّ ﷺ «يَنْهَى عَنِ الْخَبَرِ» وَافَقَهُمَا حَمَّادُ بْنُ زَيْدٍ
"I heard Ibn 'Umar say: 'We did not see anything wrong with Al-Khibr until last year, when Rafi' said that the Prophet of Allah forbade it.'" (Using translation from Nasāʾī 3919)
أَنَّ نَبِيَّ اللهِ ﷺ «نَهَى عَنْهَا» خَالَفَهُ عَارِمٌ فَقَالَ عَنْ حَمَّادٍ عَنْ عَمْرٍو عَنْ جَابِرٍ
It was narrated from Jabir bin 'Abdullah that the Prophet forbade leasing land. (Using translation from Nasāʾī 3919b)
أَنَّ النَّبِيَّ ﷺ «نَهَى عَنْ كِرَاءِ الْأَرْضِ» تَابَعَهُ مُحَمَّدُ بْنُ مُسْلِمٍ
"The Messenger of Allah forbade Al-Mukhabarah, Al-Muhaqalah and Al-Muzabanah." (Using translation from Nasāʾī 3920)
«نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُخَابَرَةِ وَالْمُحَاقَلَةِ وَالْمُزَابَنَةِ» سُفْيَانُ بْنُ عُيَيْنَةَ جَمَعَ الْحَدِيثَيْنِ فَقَالَ عَنِ ابْنِ عُمَرَ وَجَابِرٍ
It was narrated from Ibn 'Umar and Jabir that the Messenger of Allah forbade selling fruits until it was clear that they were free of blemish, and (he forbade from) Al-Mukhabarah; leasing land in return for one-third or one-quarter (of the yield). (Using translation from Nasāʾī 3921)
عَنِ ابْنِ عُمَرَ وَجَابِرٍ قَالَا «نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الثَّمَرِ حَتَّى يَبْدُوَ صَلَاحُهُ وَنَهَى عَنِ الْمُخَابَرَةِ كِرَاءِ الْأَرْضِ بِالثُّلُثِ وَالرُّبُعِ» رَوَاهُ أَبُو النَّجَاشِيِّ عَطَاءُ بْنُ صُهَيْبٍ وَاخْتُلِفَ عَلَيْهِ فِيهِ
"Do you rent out your arable land?" I said: "Yes, O Messenger of Allah. We rent it out in return for one-quarter, and in return for (a number of) Wasqs of barley." The Messenger of Allah said: "Do not do that. Cultivate it (yourselves), or lend it, or keep it." (Using translation from Nasāʾī 3922)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لِرَافِعٍ «أَتُؤَاجِرُونَ مَحَاقِلَكُمْ؟» قُلْتُ نَعَمْ يَا رَسُولَ اللهِ نُؤَاجِرُهَا عَلَى الرُّبُعِ وَعَلَى الْأَوْسَاقِ مِنَ الشَّعِيرِ فَقَالَ رَسُولُ اللهِ ﷺ «لَا تَفْعَلُوا ازْرَعُوهَا أَوْ أَعِيرُوهَا أَوِ امْسِكُوهَا» خَالَفَهُ الْأَوْزَاعِيُّ فَقَالَ عَنْ أَبِي النَّجَاشِيِّ عَنْ رَافِعٍ عَنْ ظُهَيْرِ بْنِ رَافِعٍ
Messenger of Allah ﷺ forbade a practice which was useful for us. I said: What is this? (I believe) that whatrver Messenger of Allah ﷺ says is absolutely true. He (Zuhair) said that he (the Holy Prophet) asked me: What do you do with your cultivable lands? I said: Messenger of Allah, we rent those irrigated by canals for dry dates or barley. He said: Don't do that. Cultivate them or let them be cultivated (by others) or retain them yourself. (Using translation from Muslim 1548e)
نَهَى رَسُولُ اللهِ ﷺ عَنْ أَمْرٍ كَانَ بِنَا رَافِقًا قُلْتُ وَمَا ذَاكَ؟ مَا قَالَ رَسُولُ اللهِ ﷺ فَهُوَ حَقٌّ قَالَ سَأَلَنِي «كَيْفَ تَصْنَعُونَ فِي مَحَاقِلِكُمْ؟» قُلْتُ نُؤَجِّرُهَا عَلَى الرُّبُعِ وَالْأَوْسَاقِ مِنَ التَّمْرِ أَوِ الشَّعِيرِ قَالَ «فَلَا تَفْعَلُوا ازْرَعُوهَا أَوْ أَزْرِعُوهَا أَوِ امْسِكُوهَا» رَوَاهُ بُكَيْرٌ عَنْ أُسَيْدِ بْنِ رَافِعٍ فَجَعَلَ الرِّوَايَةَ لِأَخِي رَافِعٍ
"Today the Messenger of Allah has forbidden something which was convenient for you, but following his command is an act of obedience (to Allah) and is good. He forbade Al-Haql." (Using translation from Nasāʾī 3924)
لِقَوْمِهِ قَدْ نَهَى رَسُولُ اللهِ ﷺ الْيَوْمَ عَنْ شَيْءٍ كَانَ لَكُمْ رَافِقًا «وَأَمْرُهُ طَاعَةٌ وَخَيْرٌ نَهَى عَنِ الْحَقْلِ»
"I heard Usaid bin Rafi' bin Khadij Al-Ansari say that they did not allow Al-Muhaqalah, which is land that is cultivated in return for some of its produce." (Using translation from Nasāʾī 3925)
سَمِعْتُ أُسَيْدَ بْنَ رَافِعِ بْنِ خَدِيجٍ الْأَنْصَارِيِّ يَذْكُرُ أَنَّهُمْ «مَنَعُوا الْمُحَاقَلَةَ» وَهِيَ أَرْضٌ تُزْرَعُ عَلَى بَعْضِ مَا فِيهَا رَوَاهُ عِيسَى بْنُ سَهْلِ بْنِ رَافِعٍ
"I was an orphan in the care of my grandfather Rafi' bin Khadij. I reached puberty and became a man, and I performed Hajj with him. My brother 'Imran bin Sahl bin Rafi' bin Khadij came and said: 'O my father, we have leased our land to so and so (a woman) for two hundred Dirhams.' He said: 'O my son, leave that (do not do it), for Allah will give you other provision. The Messenger of Allah forbade leasing land.'" (Using translation from Nasāʾī 3926)
يَا أَبَتَاهُ إِنَّا قَدْ أَكْرَيْنَا أَرْضَنَا فُلَانَةَ بِمِئَتَيْ دِرْهَمٍ فَقَالَ يَا بُنَيَّ دَعْ ذَاكَ فَإِنَّ اللهَ سَيَجْعَلُ لَكُمْ رِزْقًا غَيْرَهُ إِنَّ رَسُولَ اللهِ ﷺ قَدْ «نَهَى عَنْ كِرَاءِ الْأَرْضِ»
[Machine] "The Messenger of Allah ﷺ said, 'If this is your affair, then do not plow the fields.' Rafi' heard his statement 'do not plow the fields,' but Yazid ibn Zurai' opposed him, saying about Walid ibn Walid."
رَسُولُ اللهِ ﷺ «إِنْ كَانَ هَذَا شَأْنَكُمْ فَلَا تُكْرُوا الْمَزَارِعَ» فَسَمِعَ رَافِعٌ قَوْلَهُ «لَا تُكْرُوا الْمَزَارِعَ» خَالَفَهُ يَزِيدُ بْنُ زُرَيْعٍ فَقَالَ عَنِ الْوَلِيدِ بْنِ الْوَلِيدِ
[Machine] "The Messenger of Allah ﷺ said, 'If this is your concern, then do not sow seeds.' Al-Walid ibn al-Walid agreed with his statement, and Bashr ibn al-Mufaddal."
رَسُولُ اللهِ ﷺ «إِنْ كَانَ هَذَا شَأْنُكُمْ فَلَا تُكْرُوا الْمَزَارِعَ» وَافَقَهُ عَلَى قَوْلِهِ الْوَلِيدِ بْنِ الْوَلِيدِ بِشْرُ بْنُ الْمُفَضَّلِ
“May Allah (SWT) forgive Rafi' bin Khadij. By Allah (SWT)! I have more knowledge of Ahadith than he does. Two men who had quarreled came to the Prophet ﷺ and he said: 'If this is your situation, do not lease farms,' and what Rafi' bin khadij heard was 'Do not lease farms.' ” (Using translation from Ibn Mājah 2461)
يَغْفِرُ اللهُ لِرَافِعِ بْنِ خَدِيجٍ أَنَا كُنْتُ أَعْلَمُ بِالْحَدِيثِ إِنَّمَا جَاءَ رَجُلَانِ مِنَ الْأَنْصَارِ إِلَى رَسُولِ اللهِ ﷺ قَدِ اقْتَتَلَا فَقَالَ «إِنْ كَانَ هَذَا شَأْنَكُمْ فَلَا تُكْرُوا الْمَزَارِعَ» فَسَمِعَ قَوْلَهُ «لَا تُكْرُوا الْمَزَارِعَ»
15.2 Section
١٥۔٢ ذِكْرُ الْأَخْبَارِ الْمَأْثُورَةِ فِي الْمُزَارَعَةِ
"Muhammad used to say: 'In my view land is like the wealth put into a Mudarabah (limited partnership) contract. Whatever is valid with regard to the wealth put into a Mudarabah partnership, is valid with regard to land, and whatever is not valid with regard to the wealth put into a Mudarabah partnership, then it is not valid with regard to land.'" He said: "He did not see anything wrong with giving all of his land to the plowman on the basis that he would work with it himself, or with his children, and helpers, and oxen, and, that he would not spend anything on it; all expenses were to be paid by the owner of the land." كَانَ مُحَمَّدٌ يَقُولُ «الْأَرْضُ عِنْدِي مِثْلُ الْمَالِ الْمُضَارَبَةِ فَمَا صَلَحَ فِي الْمَالِ الْمُضَارَبَةِ صَلَحَ فِي الْأَرْضِ وَمَا لَمْ يَصْلُحْ فِي الْمَالِ الْمُضَارَبَةِ لَمْ يَصْلُحْ فِي الْأَرْضِ» قَالَ «وَكَانَ لَا يَرَى بَأْسًا أَنْ يَدْفَعَ أَرْضَهُ إِلَى الْأَكَّارِ عَلَى أَنْ يَعْمَلَ فِيهَا بِنَفْسِهِ وَوَلَدِهِ وَأَعْوَانِهِ وَبَقَرِهِ وَلَا يُنْفِقُ شَيْئًا وَتَكُونُ النَّفَقَةُ كُلُّهَا مِنْ رَبِّ الْأَرْضِ»
The Prophet ﷺ handed over the Jews of Khaibar the palm trees and the land of Khaibar on condition that they should employ what belonged to them in working on them, and that he should have half of the fruits. (Using translation from Abū Dāʾūd 3409)
أَنَّ النَّبِيَّ ﷺ «دَفَعَ إِلَى يَهُودِ خَيْبَرَ نَخْلَ خَيْبَرَ وَأَرْضَهَا عَلَى أَنْ يَعْتَمِلُوهَا مِنْ أَمْوَالِهِمْ وَأَنَّ لِرَسُولِ اللهِ ﷺ شَطْرَ ثَمَرَتِهَا»
Messenger of Allah ﷺ gave the land of Khaibar to the Jew's on the condition that they work on it and cultivate it, and be given half of its yield. (Using translation from Bukhārī 2331)
عَنِ رَسُولِ اللهِ ﷺ أَنَّهُ «أَعْطَى اليَهُودَ خَيْبَرَ عَلَى أَنْ يَعْمَلُوهَا وَيَزْرَعُوهَا وَلَهُمْ شَطْرُ مَا يَخْرُجُ مِنْهَا»
"Arable land used to be leased out at the time of the Messenger of Allah on condition that the owner of the land would have whatever grew on the banks of the streams and a share of straw, I do not know how much it was." (Using translation from Nasāʾī 3931)
أَنَّ عَبْدَ اللهِ كَانَ يَقُولُ «كَانَتِ الْمَزَارِعُ تُكْرَى عَلَى عَهْدِ رَسُولِ اللهِ ﷺ عَلَى أَنَّ لِرَبِّ الْأَرْضِ مَا عَلَى رَبِيعِ السَّاقِي مِنَ الزَّرْعِ وَطَائِفَةً مِنَ التِّبْنِ لَا أَدْرِي كَمْ هُوَ»
"Two of my paternal uncles used to cultivate (land) in return for one-third or one-quarter of the crop, and my father was their partner. 'Alqamah and Al-Aswad knew about that and did not change anything." (Using translation from Nasāʾī 3932)
«كَانَ عَمَّايَ يُزَارِعَانِ بِالثُّلُثِ وَالرُّبُعِ وَأَنَا شَرِيكُهُمَا وَعَلْقَمَةُ وَالْأَسْوَدُ يَعْلَمَانِ فَلَا يُغَيِّرَانِ»
"Ibn 'Abbas said: 'The best thing you can do is for one of you to rent his land out in return for gold and silver.'" (Using translation from Nasāʾī 3933)
أَنْ يُؤَاجِرَ أَحَدُكُمْ أَرْضَهُ بِالذَّهَبِ وَالْوَرِقِ»
[Machine] "There is no harm in renting the white land with gold and silver."
«لَا بَأْسَ بِإِجَارَةِ الْأَرْضِ الْبَيْضَاءِ بِالذَّهَبِ وَالْفِضَّةِ»
It was narrated from Ibrahim and Sa'eed bin Jubair that they did not see anything wrong with renting uncultivated land. (Using translation from Nasāʾī 3934)
عَنْ إِبْرَاهِيمَ وَسَعِيدِ بْنِ جُبَيْرٍ «أَنَّهُمَا كَانَا لَا يَرَيَانِ بَأْسًا بِاسْتِئْجَارِ الْأَرْضِ الْبَيْضَاءِ»
"I do not know that Shuraih ever ruled on Mudarabah disputes except in two ways. He would say to the Mudarib (the one who contributed his labor to the partnership): 'You must provide proof that a calamity befell you so that you may be excused.' Or he would say to the one who invested his money in the partnership: 'You must provide proof that your trustee betrayed his trust, otherwise his oath sworn by Allah that he did not betray you is sufficient.'" لَمْ أَعْلَمْ شُرَيْحًا كَانَ يَقْضِي فِي الْمُضَارِبِ إِلَّا بِقَضَائَيْنِ كَانَ رُبَّمَا قَالَ لِلْمُضَارِبِ بَيِّنَتُكَ عَلَى مُصِيبَةٍ تُعْذَرُ بِهَا وَرُبَّمَا قَالَ لِصَاحِبِ الْمَالِ بَيِّنَتُكَ عَلَى أَنَّ أَمِينَكَ خَانَكَ وَإِلَّا فَيَمِينُهُ بِاللهِ مَا خَانَكَ
15.3 [Machine] Mentioning the Difference in Negotiation
١٥۔٣ ذِكْرُ الِاخْتِلَافِ عَلَى الْمُفَاوَضَةِ
"I formed a partnership with 'Ammar and Sa'd on the day of Badr. Sa'd brought two prisoners but 'Ammar and I did not bring anything." (Using translation from Nasāʾī 3937)
«اشْتَرَكْتُ أَنَا وَعَمَّارٌ وَسَعْدٌ يَوْمَ بَدْرٍ فَجَاءَ سَعْدٌ بِأَسِيرَيْنِ وَلَمْ أَجِيءْ أَنَا وَعَمَّارٌ بِشَيْءٍ»
[Machine] It is permissible if they both agree for one of them to decide over the other.
جَائِزٌ إِذَا كَانَا مُتَفَاوِضَيْنِ يَقْضِي أَحَدُهُمَا عَلَى الْآخَرِ
15.4 [Machine] In the rentals
١٥۔٤ فِي الْإِجَارَاتِ
"When you hire a worker, tell him what his wages will be." (Using translation from Nasāʾī 3857)
«إِذَا اسْتَأْجَرْتَ أَجِيرًا فَأَعْلِمْهُ أَجْرَهُ»
It was narrated from Al-Hasan that he disliked to hire a man without telling him what his wages would be. (Using translation from Nasāʾī 3858)
أَنْ يُسْتَأْجَرَ الرَّجُلُ حَتَّى يُعْلِمَهُ أَجْرَهُ»
"No, not until he tells him (what his wages will be)." (Using translation from Nasāʾī 3859)
«لَا حَتَّى يُعْلِمَهُ»
"I will lease (something) from you until I reach Makkah for such and such a payment, and if I travel for a month or such and such -something that he named- I will give you such and such in addition." They did not see anything wrong with that, but they did not like it if he said: "If I travel for more than a month I will deduct such and such from your lease." (Using translation from Nasāʾī 3860)
لِرَجُلٍ أَسْتَكْرِي مِنْكَ إِلَى مَكَّةَ بِكَذَا وَكَذَا فَإِنْ سِرْتُ شَهْرًا أَوْ كَذَا وَكَذَا شَيْئًا سَمَّاهُ فَلَكَ زِيَادَةُ كَذَا وَكَذَا «فَلَمْ يَرَيَا بِهِ بَأْسًا» وَكَرِهَا أَنْ يَقُولَ أَسْتَكْرِي مِنْكَ بِكَذَا وَكَذَا فَإِنْ سِرْتُ أَكْثَرَ مِنْ شَهْرٍ نَقَصْتُ مِنْ كِرَائِكَ كَذَا وَكَذَا
"I said to 'Ata': 'What if I hire a slave for a year in return for his food, and for another year, in return for such and such?' He said: 'There is nothing wrong with that, and you may stipulate your conditions of hiring even for a few days.' 'How about if I make a deal to hire him when part of the year has passed?' He said: 'Do not hold me to account for what has passed.'" (Using translation from Nasāʾī 3861)
قُلْتُ لِعَطَاءٍ عَبْدٌ أُؤَاجِرُهُ سَنَةً بِطَعَامِهِ وَسَنَةً أُخْرَى بِخَرَاجِ كَذَا وَكَذَا قَالَ «لَا بَأْسَ» قَالَ وَكَرِهَ اشْتِرَاطَكَ حَتَّى تُؤَاجِرَهُ أَيَّامًا لَغْوًا أَوْ آجَرْتَهُ وَقَدْ مَضَى بَعْضُ الشَّهْرِ قَالَ «إِنَّكَ لَا تُحَاسِبُنِي بِمَا مَضَى»
15.5 [Machine] The Dispute Between the Spouses.
١٥۔٥ الشِّقَاقِ بَيْنَ الزَّوْجَيْنِ
[Machine] A man and a woman came to Ali, each with a group of people. When the two judges were appointed, he said, "Both of you wait until I inform you about what is upon you. Do you know what is upon you? If the two of you agree to be together, you shall be together, and if you agree to part ways, you shall part ways." Then he turned to the woman and asked, "Have you accepted their verdict?" She replied, "Yes, I have accepted the judgment of Allah upon me and my guardian." Then he turned to the man and asked, "Have you accepted their verdict?" He replied, "No, but I would prefer that we stay together rather than separate." Ali said, "By Allah, you have lied! You shall not leave until you are satisfied with the same judgment that she has accepted."
جَاءَ رَجُلٌ وَامْرَأَةٌ إِلَى عَلِيٍّ مَعَ كُلِّ وَاحِدٍ مِنْهُمَا فِئَامٌ مِنَ النَّاسِ فَلَمَّا بَعَثَ الْحَكَمَيْنُ قَالَ رُوَيْدَكُمَا حَتَّى أُعْلِمَكُمَا مَاذَا عَلَيْكُمَا هَلْ تَدْرِيَانِ مَاذَا عَلَيْكُمَا إِنَّكُمَا إِنْ رَأَيْتُمَا أَنْ تَجْمَعَا جَمَعْتُمَا وَإِنْ رَأَيْتُمَا أَنْ تُفَرِّقَا فَرَّقْتُمَا ثُمَّ أَقْبَلَ عَلَى الْمَرْأَةِ فَقَالَ «قَدْ رَضِيتِ بِمَا حَكَمَا؟» قَالَتْ نَعَمْ رَضِيتُ بِكِتَابِ اللهِ عَلَيَّ وَلِي ثُمَّ أَقْبَلَ عَلَى الرَّجُلِ فَقَالَ «قَدْ رَضِيتَ بِمَا حَكَمَا؟» قَالَ لَا وَلَكِنْ أَرْضَى أَنْ يَجْمَعَا وَلَا أَرْضَى أَنْ يُفَرِّقَا فَقَالَ عَلِيٌّ «كَذَبْتَ وَاللهِ لَا تَبْرَحْ حَتَّى تَرْضَى بِمِثْلِ الَّذِي رَضِيتُ»
[Machine] "Divorce is not valid until it comes from the wife."
«لَا يَصْلُحُ الْخُلْعُ حَتَّى يَجِيءَ مِنَ الْمَرْأَةِ»
[Machine] The Prophet ﷺ said, "The worst earnings are the price of a dog, the dowry of a rebellious woman, and the earnings of a cupper." Hatim ibn Ismail disagreed with him.
عَنِ النَّبِيِّ ﷺ «شَرُّ الْكَسْبِ ثَمَنُ الْكَلْبِ وَمَهْرُ الْبَغِيِّ وَكَسْبُ الْحَجَّامِ» خَالَفَهُ حَاتِمُ بْنُ إِسْمَاعِيلَ
[Machine] The Messenger of Allah ﷺ said, "The worst type of earnings are the dowry of a corrupt woman, the price of a dog, and the earnings of a cupper." This was narrated by Yazid ibn Khusaifah, from Saaib ibn Yazid, from Rafei.
قَالَ رَسُولُ اللهِ ﷺ «شَرُّ الْكَسْبِ مَهْرُ الْبَغِيِّ وَثَمَنُ الْكَلْبِ وَكَسْبُ الْحَجَّامِ» رَوَاهُ يَزِيدُ بْنُ خُصَيْفَةَ عَنِ السَّائِبِ بْنِ يَزِيدَ عَنْ رَافِعٍ
[Machine] He heard the Messenger of Allah ﷺ say, "The worst of earnings is the earnings of a bloodletter, the price of a dog, and the dowry of a prostitute." Abdullah ibn Abdullah disagreed with him.
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ «شَرُّ الْكَسْبِ كَسْبُ الْحَجَّامِ وَثَمَنُ الْكَلْبِ وَمَهْرُ الْبَغِيِّ» خَالَفَهُ عَبْدُ الرَّحْمَنِ بْنُ عَبْدِ اللهِ
[Machine] The Messenger of Allah ﷺ said, "There are three types of illicit earnings: the dowry of a woman obtained by force, income earned from cupping, and the price of a dog." Abdur-Rahman ibn Maghrah disagreed with him.
قَالَ رَسُولُ اللهِ ﷺ «السُّحْتُ ثَلَاثٌ مَهْرُ الْبَغِيِّ وَكَسْبُ الْحَجَّامِ وَثَمَنُ الْكَلْبِ» خَالَفَهُ عَبْدُ الرَّحْمَنِ بْنُ مَغْرَاءَ
[Machine] The Messenger of Allah, ﷺ , said, "The price of a dog, the dowry for an adulterer, and the earnings of a cupper are impure." Abu Abdur Rahman said, "It is also similar that Ibn Fudayl narrated that Abdullah is related to his grandfather." Yahya bin Abi Kathir narrated it from Ibrahim bin Abdullah, who narrated it from Al-Sa'ib bin Yazid, who narrated it from Rafi' bin Khadeej.
قَالَ رَسُولُ اللهِ ﷺ «مِنَ السُّحْتِ ثَمَنُ الْكَلْبِ وَمَهْرُ الْبَغِيِّ وَكَسْبُ الْحَجَّامِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَيُشْبِهُ أَنْ يَكُونَ ابْنُ فُضَيْلٍ نَسَبَ عَبْدَ الرَّحْمَنِ إِلَى جَدِّهِ رَوَاهُ يَحْيَى بْنُ أَبِي كَثِيرٍ عَنْ إِبْرَاهِيمَ بْنِ عَبْدِ اللهِ عَنِ السَّائِبِ بْنِ يَزِيدَ عَنْ رَافِعِ بْنِ خَدِيجٍ
[Machine] The Messenger of Allah ﷺ said, "The earnings of a cupper (bloodletter) are impure, the dowry of a woman obtained unlawfully is impure, and the price of a dog is impure." Hisham ibn Abdullah disagreed with them.
قَالَ رَسُولُ اللهِ ﷺ «كَسْبُ الْحَجَّامِ خَبِيثٌ وَمَهْرُ الْبَغِيِّ خَبِيثٌ وَثَمَنُ الْكَلْبِ خَبِيثٌ» خَالَفَهُمَا هِشَامُ بْنُ عَبْدِ اللهِ
[Machine] The Messenger of Allah ﷺ said, "The earnings of a cupper are impure, and the dowry of a wrongdoer is impure, and the price of a dog is impure." Muhammad ibn Yusuf also narrated from him, as well as Malik ibn Anas and Ibn Jurayj.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «كَسْبُ الْحَجَّامِ خَبِيثٌ وَمَهْرُ الْبَغِيِّ خَبِيثٌ وَثَمَنُ الْكَلْبِ خَبِيثٌ» وَمُحَمَّدُ بْنُ يُوسُفَ قَدْ رَوَى عَنْهُ أَيْضًا مَالِكُ بْنُ أَنَسٍ وَابْنُ جُرَيْجٍ
[Machine] That they should perform eleven units of prayer for the people.
أَنْ «يَقُومَا لِلنَّاسِ بِإِحْدَى عَشْرَةَ رَكْعَةً»
"I entered upon Umm Salamah and she told me that the Messenger of Allah ﷺ used to wake up in a state of Janabah without having had a wet dream, then he would fast." And she told him that she brought the Prophet ﷺ some grilled ribs and he ate from that, then he got up and prayed, and did not perform Wudu'. (Using translation from Nasāʾī 183)
أَنَّ رَسُولَ اللهِ ﷺ كَانَ «يُصْبِحُ جُنُبًا مِنْ غَيْرِ احْتِلَامٍ ثُمَّ يَصُومُ» وَحَدَّثَنَا مَعَ هَذَا الْحَدِيثِ أَنَّهَا حَدَّثَتْهُ أَنَّهَا قَرَّبَتْ إِلَى رَسُولِ اللهِ ﷺ جَنْبًا مَشْوِيًّا فَأَكَلَ مِنْهُ ثُمَّ قَامَ إِلَى الصَّلَاةِ وَلَمْ يَتَوَضَّأْ خَالَفَهُ الْحَجَّاجُ بْنُ مُحَمَّدٍ الْأَعْوَرُ
[Machine] "It brought a grilled side dish to the Prophet Muhammad ﷺ , and he ate from it, then he stood up for prayer without performing ablution." Zaid ibn Aslam disagreed with him.
أَنَّهَا «قَرَّبَتْ لِلنَّبِيِّ ﷺ جَنْبًا مَشْوِيًّا فَأَكَلَ مِنْهُ ثُمَّ قَامَ إِلَى الصَّلَاةِ وَلَمْ يَتَوَضَّأْ» خَالَفَهُ زَيْدُ بْنُ أَسْلَمَ
The Messenger of Allah ﷺ took (the meat of) a (goat's) shoulder and offered prayer and did not perform ablution. (Using translation from Abū Dāʾūd 187)
أَنَّ رَسُولَ اللهِ ﷺ «أَكَلَ كَتِفَ شَاةٍ وَلَمْ يَتَوَضَّأْ»
15.6 [Machine] Translation: "The Stallion's Hoof
١٥۔٦ عَسْبِ الْفَحْلِ
"A man from Banu As-Sa'q, one of Banu Kilab, came to the Messenger of Allah and asked him about charging stud fees for a stallion. He forbade him to do that, but he said: 'We give payment for that. "' (Using translation from Nasāʾī 4672)
جَاءَ رَجُلٌ مِنْ بَنِي الصَّعْقِ أَحَدُ بَنِي كِلَابٍ إِلَى رَسُولِ اللهِ ﷺ فَسَأَلَهُ عَنْ عَسْبِ الْفَحْلِ «فَنَهَى عَنْهُ»
"The Messenger of Allah forbade the earnings of a cupper, the price of a dog and stud fees for a stallion." (Using translation from Nasāʾī 4673)
سَمِعْتُ أَبَا هُرَيْرَةَ يَقُولُ «نَهَى رَسُولُ اللهِ ﷺ عَنْ كَسْبِ الْحَجَّامِ وَثَمَنِ الْكَلْبِ وَعَسْبِ الْفَحْلِ» خَالَفَهُ هِشَامٌ
