“Every division that was allocated according to (the rules of) the Ignorance days, stands as it is, and every division that was allocated according to (the rules of) Islam, stands according to the rules of Islam.”
قَالَ رَسُولُ اللَّهِ ﷺ كُلُّ قَسْمٍ قُسِمَ فِي الْجَاهِلِيَّةِ فَهُوَ عَلَى مَا قُسِمَ وَكُلُّ قَسْمٍ أَدْرَكَهُ الإِسْلاَمُ فَهُوَ عَلَى قَسْمِ الإِسْلاَمِ
The Prophet ﷺ said: An estate which was divided in pre-Islamic period may follow the division in force then, but any estate in Islamic times must follow the division laid down by Islam.
قَالَ النَّبِيُّ ﷺ كُلُّ قَسْمٍ قُسِمَ فِي الْجَاهِلِيَّةِ فَهُوَ عَلَى مَا قُسِمَ لَهُ وَكُلُّ قَسْمٍ أَدْرَكَهُ الإِسْلاَمُ فَهُوَ عَلَى قَسْمِ الإِسْلاَمِ
“Whatever division of inheritance was made during the Ignorance period, stands according to the division of the Ignorance period, and whatever division of inheritance was made during Islam, it stands according to the division of Islam.”
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ مَا كَانَ مِنْ مِيرَاثٍ قُسِمَ فِي الْجَاهِلِيَّةِ فَهُوَ عَلَى قِسْمَةِ الْجَاهِلِيَّةِ وَمَا كَانَ مِنْ مِيرَاثٍ أَدْرَكَهُ الإِسْلاَمُ فَهُوَ عَلَى قِسْمَةِ الإِسْلاَمِ
[Machine] The Prophet ﷺ said, "Every inheritance that is acquired during the time of Islam and is not divided, will be divided according to the laws of Islam."
عَنِ النَّبِيِّ ﷺ قَالَ «كُلُّ مِيرَاثٍ أَدْرَكَ الْإِسْلَامَ وَلَمْ يُقْسَمْ فَهُوَ عَلَى قَسْمِ الْإِسْلَامِ»
"مَا كَانَ مِنْ مِيراث قُسِمَ فِي الْجَاهِلِيَّةِ، فَهُوَ عَلى قسْمَةِ الْجَاهِلِيَّةِ، وَمَا كَانَ مِنْ مِيرَاثٍ أَدْرَكَهُ الإِسْلامُ، فَهُوَ عَلَى قِسْمَةِ الإِسْلامِ".
"كُلُّ قَسْمٍ قُسِمَ فِي الجَاهِليَّة فَهُوَ عَلَى مَا قُسمَ، وَكُلُّ قَسْمٍ أدْرَكَهُ الإِسْلامُ فَإِنَّهُ عَلَى قَسْم الإِسْلام".
"كُلُّ مَالٍ قُسِّمَ فِي الْجَاهِلِيةِ فَهُوَ عَلى قَسْم الْجَاهليَّة، وَكُلُّ ميرَاثٍ لَمْ يُقْسَمْ حَتَّى أدْرَكهُ الإِسْلامُ فَهُوَ عَلَى قَسْم الإسْلام".
