32. Book of Gifting
٣٢۔ كِتَابُ الْهِبَةِ
[Machine] Narrated by Al-Qa'nabiy: he said, 'Narrated from Layth ibn Sa'ad, from Ibn Shihab, from Muhammad ibn al-Nu'man and Humaid ibn Abdur-Rahman, from Nu'man ibn Bashir, that Bashir ibn Sa'ad came to the Messenger of Allah ﷺ and said, "I have emancipated my son, this slave." The Prophet ﷺ said, "Have you emancipated all of your children?" He replied, "No." The Prophet ﷺ said, "Then return him."
حَدَّثَنَا الْقَعْنَبِيُّ قَالَ حَدَّثَنَا لَيْثُ بْنُ سَعْدٍ عَنِ ابْنِ شِهَابٍ عَنْ مُحَمَّدِ بْنِ النُّعْمَانِ وَحُمَيْدُ بْنُ عَبْدِ الرَّحْمَنِ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ أَنَّ بَشِيرَ بْنَ سَعْدٍ جَاءَ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ إِنِّي نَحَلْتُ ابْنِي هَذَا هَذَا الْعَبْدَ فَقَالَ النَّبِيُّ ﷺ «أَوَكُلَّ وَلَدِكَ نَحَلْتَ هَذَا؟ » قَالَ لَا قَالَ «فَارْدُدْهُ»
ذِكْرُ الْأَمْرِ بِالتَّسْوِيَةِ بَيْنَ الْأَوْلَادِ فِي النَّحْلِ إِذْ تَرْكُهُ حَيْفٌ
"My father took me to the Messenger of Allah to ask him to bear witness to a gift that he had given me. He said: 'Do you have any other children besides him?' He said: 'Yes.' He said: 'Treat them equally.'" (Using translation from Nasāʾī 3686)
سَمِعْتُ النُّعْمَانَ بْنَ بَشِيرٍ يَقُولُ انْطَلَقَ بِي أَبِي إِلَى رَسُولِ اللَّهِ ﷺ لِيُشْهِدَهُ عَلَى عَطِيَّةٍ يُعْطِينِيهَا فَقَالَ «هَلْ لَكَ وَلَدٌ غَيْرَهُ؟ » قَالَ قُلْتُ نَعَمْ قَالَ «سَوِّ بَيْنَهُمْ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
"My father took me to the Messenger of Allah to ask him to bear witness to a gift that he had given me. He said: 'Do you have any other children besides him?' He said: 'Yes.' He said: 'Treat them equally.'" (Using translation from Nasāʾī 3686)
سَمِعْتُ النُّعْمَانَ بْنَ بَشِيرٍ وَهُوَ يَخْطُبُ يَقُولُ انْطَلَقَ بِي أَبِي إِلَى النَّبِيِّ ﷺ لِيُشْهِدَهُ عَلَى عَطِيَّةٍ أَعْطَانِيهَا فَقَالَ «هَلْ لَكَ بَنُونَ سِوَاهُ؟ » قَالَ نَعَمْ قَالَ «سَوِّ بَيْنَهُمْ»
ذِكْرُ لَفْظَةٍ أَوْهَمَتْ عَالِمًا مِنَ النَّاسِ أَنَّ الْإِيثَارَ فِي النَّحْلِ بَيْنَ الْأَوْلَادِ جَائِزٌ
I have donated this slave of mine to my son. Messenger of Allah ﷺ said: Have you donated to every one of your sons (a slave) like this? He said: No. Thereupon Messenger of Allah (may peace he upon him) said: Then take him back. (Using translation from Muslim 1623a)
أَنَّ أَبَاهُ أَتَى بِهِ رَسُولُ اللَّهِ ﷺ فَقَالَ إِنِّي نَحَلْتُ ابْنِي هَذَا غُلَامًا كَانَ لِي فَقَالَ رَسُولُ اللَّهِ ﷺ «أَكُلَّ وَلَدِكَ نَحَلْتَهُ مِثْلَ هَذَا؟ » فَقَالَ لَا فَقَالَ رَسُولُ اللَّهِ ﷺ «فَارْجِعْهُ»
ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ ﷺ «فَارْجِعْهُ» أَرَادَ بِهِ لَأَنَّهُ غَيْرُ الْحَقِّ
[Machine] A woman named Bashir said, "My son became a young man, and I bear witness that he is the messenger of Allah." The messenger ﷺ asked, "Does he have any siblings?" She replied, "Yes." He then asked, "Have you given each of them the same as what you have given him?" She replied, "No." He said, "This is not right, and I bear witness only to the truth."
قَالَتِ امْرَأَةُ بَشِيرٍ انْحَلِ ابْنِي هَذَا غُلَامًا وَأَشْهِدْ رَسُولَ اللَّهِ ﷺ فَقَالَ يَعْنِي رَسُولَ اللَّهِ ﷺ «أَلَهُ إِخْوَةٌ؟ » قَالَ نَعَمْ قَالَ «فَأَعْطَيْتُ كُلَّ وَاحِدٍ مِنْهُمْ مِثْلَ مَا أَعْطَيْتُهُ؟ » فَقَالَ لَا فَقَالَ «لَا يَصْلُحُ هَذَا وَإِنِّي لَا أَشْهَدُ إِلَّا عَلَى الْحَقِّ»
ذِكْرُ الْخَبَرِ الْمُصَرِّحِ بِنَفْيِ جَوَازِ الْإِيثَارِ فِي النَّحْلِ بَيْنَ الْأَوْلَادِ
That his father had given him a slave. The Messenger of Allah ﷺ said: What is this slave ? He replied: This is my slave which my father has given me. He asked: Has he given all your brothers the same as he has given you? He replied: No. He then said: Return it, then. (Using translation from Abū Dāʾūd 3543)
رَسُولُ اللَّهِ ﷺ «مَا هَذَا الْغُلَامُ؟ » قَالَ غُلَامٌ أَعْطَانِيهِ أَبِي قَالَ «فَكُلُّ إِخْوَتِكَ أَعْطَاهُ كَمَا أَعْطَاكَ؟ » قَالَ لَا قَالَ «فَارْدُدْهُ» وَقَالَ لِأَبِيهِ لَا تُشْهِدْنِي عَلَى جَوْرٍ «
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِأَنَّ الْإِيثَارَ بَيْنَ الْأَوْلَادِ غَيْرُ جَائِزٍ فِي النَّحْلِ
[Machine] My mother asked my father for some of his wealth as a gift. He agreed and kept it for a year, then gave it to me. My mother said, "I will not be pleased until the Messenger of Allah ﷺ testifies for you." So my father said to the Messenger of Allah, "O Messenger of Allah, this woman, the mother of this child, has been fighting me for a year over a certain gift for my son. Now that I have given it to him, she wishes for you to testify." The Messenger of Allah said, "O Basheer, do you have any other children besides this one?" He replied, "Yes." The Messenger of Allah said, "Do not testify against me unjustly."
سَأَلَتْ أُمِّي أَبِي بَعْضَ الْمَوْهِبَةِ مِنْ مَالِهِ فَالْتَوَى بِهِ سَنَةً ثُمَّ بَدَا لَهُ فَوَهَبَهَا لِي وَإِنَّهَا قَالَتْ لَا أَرْضَى حَتَّى تُشْهِدَ رَسُولَ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ أُمَّ هَذَا بِنْتَ رَوَاحَةَ قَاتَلَتْنِي مُنْذُ سَنَةٍ عَلَى بَعْضِ مَوْهِبَةٍ لِابْنِي هَذَا وَقَدْ بَدَا لِي فَوَهَبْتُهَا لَهُ وَقَدْ أَعْجَبَهَا أَنْ تُشْهِدَكَ يَا رَسُولَ اللَّهِ فَقَالَ «يَا بَشِيرُ أَلَكَ وَلَدٌ سِوَى هَذَا؟ » قَالَ نَعَمْ قَالَ «لَا تُشْهِدْنِي عَلَى جَوْرٍ»
ذِكْرُ خَبَرٍ ثَالِثٍ يُصَرِّحُ بِأَنَّ الْإِيثَارَ بَيْنَ الْأَوْلَادِ فِي النَّحْلِ حَيْفٌ غَيْرُ جَائِزِ اسْتِعْمَالُهُ
[Machine] "To allow me to have a honey bee from his property, but he refused. Then after a while or two, he offered to give me a honey bee. I said to the person who had asked for it for my son, 'I had prevented you, but it has become clear to me that I should allow it for him.' She said, 'No, by Allah, I will not agree until you take him by the hand and present him to the Messenger of Allah ﷺ so that he may intercede for you.' So he took me by the hand and brought me to the Messenger of Allah ﷺ and narrated the incident to him. The Prophet ﷺ said to him, 'Do you have any other offspring besides him?' He said, 'Yes.' The Prophet ﷺ asked, 'Have you given each of them the same as you have given this one?' He replied, 'No.' The Prophet ﷺ then said, 'I will not bear witness in favor of this action. This is an injustice. I only bear witness in favor of justice. Be fair to your children in regard to the bees as you would like them to be fair to you in righteousness and kindness.'"
أَنْ يَنْحِلَنِيَ نَحْلًا مِنْ مَالِهِ وَإِنَّهُ أَبَى عَلَيْهَا ثُمَّ بَدَا لَهُ بَعْدَ حَوْلٍ أَوْ حَوْلَيْنِ أَنْ يَنْحَلَنِيهِ فَقَالَ لَهَا الَّذِي سَأَلْتِ لِابْنِي كُنْتُ مَنَعْتُكِ وَقَدْ بَدَا لِي أَنْ أَنْحَلَهُ إِيَّاهُ قَالَتْ لَا وَاللَّهِ لَا أَرْضَى حَتَّى تَأْخُذَ بِيَدِهِ فَتَنْطَلِقَ بِهِ إِلَى رَسُولِ اللَّهِ ﷺ فَتُشْهِدَهُ قَالَ فَأَخَذَ بِيَدِي فَانْطَلَقَ بِي إِلَى رَسُولِ اللَّهِ ﷺ فَقَصَّ عَلَيْهِ الْقِصَّةَ فَقَالَ لَهُ النَّبِيُّ ﷺ «هَلْ لَكَ مَعَهُ وَلَدٌ غَيْرَهُ؟ » قَالَ نَعَمْ قَالَ «فَهَلْ آتَيْتَ كُلَّ وَاحِدٍ مِنْهُمْ مِثْلَ الَّذِي آتَيْتَ هَذَا؟ » قَالَ لَا قَالَ «فَإِنِّي لَا أَشْهَدُ عَلَى هَذَا هَذَا جَوْرٌ أَشْهِدْ عَلَى هَذَا غَيْرِي اعْدِلُوا بَيْنَ أَوْلَادِكُمْ فِي النَّحْلِ كَمَا تُحِبُّونَ أَنْ يَعْدِلُوا بَيْنَكُمْ فِي الْبِرِّ وَاللُّطْفِ»
ذِكْرُ خَبَرٍ رَابِعٍ يَدُلُّ عَلَى أَنَّ الْإِيثَارَ فِي النَّحْلِ مِنَ الْأَوْلَادِ غَيْرُ جَائِزٍ
"I was told that Bashir bin Sa'd came to the Messenger of Allah and said: 'O Messenger of Allah, my wife 'Amrah bint Rawahah told me to give a gift to her son Nu'man, and she told me to ask you to bear witness to that.' The Prophet said: 'Do you have any other children?' He said: 'Yes.' He said: 'Have you given them something like that which you have given to this one?' He said: 'No.' He said: 'Then do not ask me to bear witness to unfairness.'" (Using translation from Nasāʾī 3683)
أَتَى رَسُولُ اللَّهِ ﷺ بَشِيرَ بْنَ سَعْدٍ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ عَمْرَةَ بِنْتَ رَوَاحَةَ أَرَادَتْنِي أَنْ أَتَصَدَّقَ عَلَى ابْنِهَا بِصَدَقَةٍ وَأَمَرَتْنِي أَنْ أُشْهِدَكَ عَلَيْهَا فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ «هَلْ لَكَ بَنُونَ سِوَاهُ؟ » قَالَ نَعَمْ قَالَ «فَكُلُّهُمْ أَعْطَيْتَهُمْ مِثْلَ مَا أَعْطَيْتَ هَذَا؟ » قَالَ لَا قَالَ «فَلَا تُشْهِدْنِي عَلَى جَوْرٍ»
ذِكْرُ خَبَرٍ خَامِسٍ يُصَرِّحُ بِتَرْكِ اسْتِعْمَالِ الْإِيثَارِ لِلْمَرْءِ فِي النَّحْلِ بَيْنَ وَلَدِهِ
[Machine] My father referred to me in such and such a way, and the Messenger of Allah ﷺ came to testify. He said, "Did you give your children the same treatment as you gave [this person]?" He replied, "No." Then the Messenger of Allah ﷺ said, "Testify against him, for this is injustice." Then he said, "Do you like them to be treated equally in goodness?" He said, "Yes." He said, "So in that case, no."
إِنَّ أَبِي نَحَلَنِي كَذَا وَكَذَا فَأَتَى بِي رَسُولَ اللَّهِ ﷺ لِيُشْهِدَهُ فَقَالَ «أَكُلَّ وَلَدِكَ أَعْطَيْتَ مِثْلَ مَا أَعْطَيْتَ؟ » فَقَالَ لَا فَقَالَ رَسُولُ اللَّهِ ﷺ «أَشْهِدْ عَلَى هَذَا غَيْرِي هَذَا جَوْرٌ» ثُمَّ قَالَ «أَتُحِبُّونَ أَنْ يَكُونُوا فِي الْبِرِّ سَوَاءً؟ » قَالَ نَعَمْ قَالَ «فَلَا إِذًا»
ذِكْرُ خَبَرٍ سَادِسٍ يُصَرِّحُ بِأَنَّ الْإِيثَارَ فِي النَّحْلِ بَيْنَ الْأَوْلَادِ غَيْرُ جَائِزٍ
[Machine] Indeed, my father, Bashir ibn Saad, came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, the daughter of Rawaha gave birth to a boy, and I named him Nu'man. She refused to raise him until I made a garden for him as a gift, which is the best of my wealth." She said, "Bear witness, O Prophet ﷺ ." The Prophet ﷺ said to him, "Do you have any other children?" He replied, "Yes." He said, "Do not bear witness to me except for justice, for I do not bear witness to injustice."
إِنَّ وَالِدِي بَشِيرَ بْنَ سَعْدٍ أَتَى رَسُولَ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ عَمْرَةَ بِنْتَ رَوَاحَةَ نُفِسَتْ بِغُلَامٍ وَإِنِّي سَمَّيْتُهُ نُعْمَانَ وَإِنَّهَا أَبَتْ أَنْ تُرَبِّيَهُ حَتَّى جَعَلْتُ لَهُ حَدِيقَةً لِي أَفْضَلَ مَالِي هُوَ وَإِنَّهَا قَالَتْ أَشْهِدِ النَّبِيَّ ﷺ عَلَى ذَلِكَ فَقَالَ لَهُ النَّبِيُّ ﷺ «هَلْ لَكَ وَلَدٌ غَيْرَهُ؟ » قَالَ نَعَمْ قَالَ «لَا تُشْهِدْنِي إِلَّا عَلَى عَدْلٍ فَإِنِّي لَا أَشْهَدُ عَلَى جَوْرٍ»
ذِكْرُ مَا يَجِبُ عَلَى الْمَرْءِ مِنْ قَبُولِ مَا يُهْدِي أَخُوهُ الْمُسْلِمُ إِيَّاهُ إِذَا تَعَرَّى عَنْ عِلَّتَيْنِ فِيهِ
[Machine] I heard the Messenger of Allah ﷺ saying, "Whoever is informed of a good deed about his brother without any request or self-interest, he should accept it and not reject it."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «مَنْ بَلَغَهُ مَعْرُوفٌ عَنْ أَخِيهِ مِنْ غَيْرِ مَسْأَلَةٍ وَلَا إِشْرَافِ نَفْسٍ فَلْيَقْبَلْهُ وَلَا يَرُدَّهُ»
ذِكْرُ الزَّجْرِ عَنْ رَدِّ الْمَرْءِ الطِّيبَ، إِذَا عُرِضَ عَلَيْهِ
The Messenger of Allah [SAW] said: "Whoever is offered perfume, let him not refuse it for it is easy to carry, and smells good." (Using translation from Nasāʾī 5259)
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «مَنْ عُرِضَ عَلَيْهِ طِيبٌ فَلَا يَرُدَّهُ فَإِنَّهُ خَفِيفُ الْمَحْمَلِ طَيِّبُ الرَّائِحَةِ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمَرْءَ وَإِنْ كَانَ خَيِّرًا فَاضِلًا إِذَا أُهْدِيَ إِلَيْهِ شَيْءٌ وَإِنْ كَانَ قَلِيلًا عَلَيْهِ قَبُولُهُ وَالْإِفْضَالُ مِنْهُ عَلَى غَيْرِهِ دُونَ الِازْدِرَاءِ بِالشَّيْءِ الْيَسِيرِ، وَالتَّأَمُّلِ لِلشَّيْءِ الْكَثِيرِ
[Machine] The Messenger of Allah ﷺ was in the house of Abu Ayyub. Food containing garlic was brought to him, but he did not eat from it and sent it to Abu Ayyub instead. Abu Ayyub also did not eat from it as he did not see any trace of the Prophet ﷺ having eaten from it. Then he came to the Prophet and asked him about it. The Prophet ﷺ said, "No, it is not forbidden, but I disliked it because of its smell." Then he said, "I dislike what you dislike."
كَانَ رَسُولُ اللَّهِ ﷺ فِي دَارِ أَبِي أَيُّوبَ فَأُتِيَ بِطَعَامٍ فِيهِ ثُومٌ فَلَمْ يَأْكُلْ مِنْهُ وَأَرْسَلَ بِهِ إِلَى أَبِي أَيُّوبَ فَلَمْ يَأْكُلْ مِنْهُ أَبُو أَيُّوبَ إِذْ لَمْ يَرَ فِيهِ أَثَرَ النَّبِيِّ ﷺ ثُمَّ أَتَاهُ فَسَأَلَهُ عَنْهُ فَقَالَ يَا رَسُولَ اللَّهِ أَحَرَامٌ هُوَ؟ قَالَ «لَا وَلَكِنْ كَرِهْتُهُ مِنْ أَجْلِ الرِّيحِ» فَقَالَ إِنِّي أَكْرَهُ مَا كَرِهْتَ
ذِكْرُ إِبَاحَةِ قَبُولِ الْجَمَاعَةِ الْهِبَةَ الْوَاحِدَةَ الْمُشَاعَةَ مِنَ الرَّجُلِ الْوَاحِدِ وَإِنْ لَمْ يَعْلَمْ كُلُّ وَاحِدٍ مِنْهُمْ حِصَّتَهُ مِنْهَا
the Messenger of Allah set out for Makkah and was in Ihram. When they were in Ar-Rawha, they saw a wounded onager. Mention of that was made to the messenger of Allah and he said: "Leave it, for soon its owner will come." Then Al-Bahzi, who was its owner, came to the Messenger of Allah, it is up to you what you want to do with this onager." The Messenger of Allah Commanded Abu Bakr to share it out among the company then he moved on, and when he was in Al-Uthayah, between Ar-Ruwaythah and Al-Arj, They was a gazelle sleeping in the Shade with an arrow in it. It was said that the Messenger of Allah told a man to stand by it and not let anyone disturb it until everyone had passed by." (Using translation from Nasāʾī 2818)
أَنَّ رَسُولَ اللَّهِ ﷺ خَرَجَ يُرِيدُ مَكَّةَ حَتَّى إِذَا كَانَ بِالرَّوْحَاءِ إِذَا حِمَارٌ وَحْشِيٌّ عَقِيرٌ فَذُكِرَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ «دَعُوهُ فَإِنَّهُ يُوشِكُ أَنْ يَأْتِيَ صَاحِبَهُ» فَجَاءَ الْبَهْزِيُّ وَهُوَ صَاحِبُهُ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ شَأْنَكُمْ بِهَذَا الْحِمَارِ فَأَمَرَ بِهِ رَسُولُ اللَّهِ ﷺ أَبَا بَكْرٍ فَقَسَمَهُ بَيْنَ الرِّفَاقِ ثُمَّ مَضَى حَتَّى إِذَا كَانَ بِالْأُثَايَةَ بَيْنَ الرُّوَيْثَةِ وَالْعَرْجِ إِذَا ظَبْيٌ حَاقِفٌ فِي ظِلٍّ وَفِيهِ سَهْمٌ فَزَعَمَ أَنَّ رَسُولَ اللَّهِ ﷺ أَمَرَ رَجُلًا يَقِفُ عِنْدَهُ لَا يَرِيبُهُ أَحَدٌ مِنَ النَّاسِ حَتَّى يُجَاوِزَهُ
ذِكْرُ إِبَاحَةِ قَبُولِ الْمَرْءِ الْهِبَةَ لِلشَّيْءِ الْمَشَاعِ بَيْنَهُ وَبَيْنَ غَيْرِهِ
"While we were traveling with the Prophet in part of Athaya Ar-Rawha and they were in Ihram, we saw a wounded onager, the Messenger of Allah said: "Leave it, for soon the one who wounded it will come,' then a man from Bahz came, and he was the one who had wounded the onager. He said: 'O Messenger of Allah, it is up to you what you do with this onager,' The Messenger of Allah ordered Abu Bakr to distribute it among the people." (Using translation from Nasāʾī 4344)
بَيْنَمَا نَحْنُ نَسِيرُ مَعَ رَسُولِ اللَّهِ ﷺ بِبَعْضِ أَثْنَاءِ الرَّوْحَاءِ وَهُمْ حُرُمٌ إِذَا حِمَارٌ مَعْقُورٌ فَقَالَ رَسُولُ اللَّهِ ﷺ «دَعُوهُ فَيُوشِكُ صَاحِبُهُ أَنْ يَأْتِيَهُ» فَجَاءَ رَجُلٌ مِنْ بَهْزٍ هُوَ الَّذِي عَقَرَ الْحِمَارَ فَقَالَ يَا رَسُولَ اللَّهِ شَأْنَكُمْ بِهَذَا الْحِمَارِ فَأَمَرَ رَسُولُ اللَّهِ ﷺ أَبَا بَكْرٍ فَقَسَمَهُ بَيْنَ النَّاسِ
ذِكْرُ إِبَاحَةِ إِهْدَاءِ الْمَرْءِ الْهَدِيَّةَ إِلَى أَخِيهِ وَإِنْ لَمْ يَحِلَّ لِوَاحِدٍ مِنْهُمَا اسْتِعْمَالُ تِلْكَ الْهَدِيَّةِ بِأَنْفُسِهِمَا
'Umar went out and saw a Hullah of Al-Istabraq being offered for sale in the marketplace. He went to the Messenger of Allah [SAW] and said: "O Messenger of Allah, buy this and wear it on Fridays, and when the delegations come to you." The Messenger of Allah [SAW] said: "This is only worn by the one who has no share (in the Hereafter)." Then three Hullahs (of the same fabric) were brought to the Messenger of Allah [SAW] and he gave one to 'Umar, one to 'Ali and one to Usamah. He ('Umar) came to him and said: "O Messenger of Allah, you said what you said about it, then you sent one to me!" He said: "Sell it and spend the money on your needs, or cut it into pieces for your womenfolk to use as head covers." (Using translation from Nasāʾī 5299)
أَنَّ عُمَرَ بْنَ الْخَطَّابِ خَرَجَ فَرَأَى حُلَّةَ إِسْتَبْرَقٍ تُبَاعُ فِي السُّوقِ فَأَتَى رَسُولَ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ اشْتَرِهَا فَالْبَسْهَا يَوْمَ الْجُمُعَةِ وَحِينَ يَقْدَمُ عَلَيْكَ الْوفُودُ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّمَا يَلْبَسُ هَذِهِ مَنْ لَا خَلَاقَ لَهُ» قَالَ ثُمَّ أُتِيَ رَسُولُ اللَّهِ ﷺ بِثَلَاثِ حُلَلٍ مِنْهَا فَكَسَا عُمَرَ حُلَّةً وَكَسَا عَلِيًّا حُلَّةً وَكَسَا أُسَامَةَ حُلَّةً فَأَتَاهُ عُمَرُ فَقَالَ يَا رَسُولَ اللَّهِ قُلْتَ فِيهَا مَا قُلْتَ ثُمَّ بَعَثْتَ بِهَا إِلَيَّ فَقَالَ «بِعْهَا فَاقْضِ بِهَا حَاجَتَكَ أَوْ شُقَّهَا خُمُرًا بَيْنَ نِسَائِكَ»
ذِكْرُ إِبَاحَةِ أَخْذِ الْمُهْدِي هَدِيَّةَ نَفْسِهِ بَعْدَ بَعْثِهِ إِلَى الْمُهْدَى إِلَيْهِ وَمَوْتُ الْمُهْدَى إِلَيْهِ قَبْلَ وصُولِ الْهَدِيَّةِ إِلَيْهِ
[Machine] When the Messenger of Allah ﷺ married me, he said, "I have presented a dress and some bracelets made of musk to the Najashi, and I have not seen him wearing them except after his death. So the gift will be returned, and if it is so, it will be for you." She said, and it happened as the Prophet ﷺ said, the Najashi died and the gift was returned, so the Prophet ﷺ gave a bracelet made of musk to each of his wives and gave the dress and the rest of the musk to Umm Salamah.
لَمَّا تَزَوَّجَنِي رَسُولُ اللَّهِ ﷺ قَالَ «إِنِّي قَدْ أَهْدَيْتُ إِلَى النَّجَاشِيِّ حُلَّةً وَأَوَاقِيَّ مِسْكٍ وَلَا أُرَاهُ إِلَّا قَدْ مَاتَ وَسَتُرَدُّ الْهَدِيَّةُ فَإِنْ كَانَ كَذَلِكَ فَهِيَ لَكَ» قَالَتْ فَكَانَ كَمَا قَالَ النَّبِيُّ ﷺ مَاتَ النَّجَاشِيُّ وَرُدَّتِ الْهَدِيَّةُ فَدَفَعَ النَّبِيُّ ﷺ إِلَى كُلِّ امْرَأَةٍ مِنْ نِسَائِهِ أُوقِيَّةَ مِسْكٍ وَدَفَعَ الْحُلَّةَ وَسَائِرَ الْمِسْكِ إِلَى أُمِّ سَلَمَةَ
ذِكْرُ الْإِخْبَارِ عَنْ إِبَاحَةِ أَكْلِ الْمَرْءِ الْهَدِيَّةَ الَّتِي كَانَتْ تُصُدِّقَتْ عَلَى الْمُهْدِي قَبْلَ أَنْ يُهْدِيَهَا إِلَيْهِ
she wanted to buy Barirah to set her free, but they stipulated that her loyalty (should be to them. She mentioned that to the Messenger of Allah and the Messenger of Allah said: "Buy her, and wet her free and loyalty (Wala) belongs to the one who sets the slave free." Some meat was brought to the Messenger of and it was said that this had been given in charity to Bariirah. He said: "It is charity for her, and a gift for us." And she was given the choice (Using translation from Nasāʾī 4643)
أَنْ تَشْتَرِيَ بَرِيرَةَ لِلْعِتْقِ فَاشْتَرَطُوا وَلَاءَهَا فَذُكِرَ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ رَسُولُ اللَّهِ ﷺ «اشْتَرِيهَا وَأَعْتِقِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» وَأُهْدِيَ لِرَسُولِ اللَّهِ ﷺ لَحْمٌ فَقُلْتُ لِلنَّبِيِّ ﷺ هَذَا تُصُدِّقَ عَلَى بَرِيرَةَ فَقَالَ «هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ» قَالَ عَبْدُ الرَّحْمَنِ وَكَانَ زَوْجُهَا حُرًّا
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا قَالَتْ عَائِشَةُ: هَذَا تُصُدِّقَ عَلَى بَرِيرَةَ
Three Sunan were established because of Barirah. One of those Sunan was that she was set free and was given the choice concerning her husband; the Messenger of Allah said: 'Al Wala' is to the one who set the slave free;' and the Messenger of Allah entered when some meat was being cooked in a pot, but bread and some condiments were brought to him. He said: 'Do I not see a pot in which some meat is being cooked?' They said: 'Yes, O Messenger of Allah, that is meat that was given in charity to Barirah and you do not eat (food given in) charity.' The Messenger of Allah said: 'It is charity for her and a gift for us.' (Using translation from Nasāʾī 3447)
أَنَّهَا قَالَتْ كَانَ فِي بَرِيرَةَ ثَلَاثُ سُنَنٍ إِحْدَى السُّنَنِ الثَّلَاثِ أَنَّهَا أُعْتِقَتْ فَخُيِّرَتْ فِي زَوْجِهَا وَقَالَ رَسُولُ اللَّهِ ﷺ «الْوَلَاءُ لِمَنْ أَعْتَقَ» وَدَخَلَ رَسُولُ اللَّهِ ﷺ وَالْبُرْمَةُ تَفُورُ بِلَحْمٍ فَقُرِّبَ إِلَيْهِ خُبْزٌ وَإِدَامٌ مِنْ إِدَامِ الْبَيْتِ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَلَمْ أَرَ بُرْمَةً فِيهَا لَحْمٌ» قَالُوا بَلَى يَا رَسُولَ اللَّهِ وَلَكِنْ ذَاكَ لَحْمٌ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ وَأَنْتَ لَا تَأْكُلُ الصَّدَقَةَ فَقَالَ رَسُولُ اللَّهِ ﷺ «هُوَ عَلَيْهَا صَدَقَةٌ وَهُوَ لَنَا هَدِيَّةٌ»
ذِكْرُ جَوَازِ أَكْلِ الصَّدَقَةِ الَّتِي تُصُدِّقَ بِهَا عَلَى إِنْسَانٍ، ثُمَّ أَهْدَاهَا الْمُتَصَدَّقَ عَلَيْهِ لَهُ وَإِنْ كَانَ مِمَّنْ لَا يَحِلُّ لَهُ أَخْذُ الصَّدَقَةِ وَلَا أَكْلُهَا
Is there anything to eat? She said: Messenger of Allah, I swear by God, there is no food with us except a bone of goat which my freed maid-servant was given as sadaqa. Upon this he said: Bring that to me, for it (the sadaqa) has reached its destination. (Using translation from Muslim 1073a)
أَنَّ جُوَيْرِيَةَ زَوْجَةَ النَّبِيِّ ﷺ أَخْبَرَتْهُ أَنَّ رَسُولَ اللَّهِ ﷺ دَخَلَ عَلَيْهَا فَقَالَ «هَلْ مِنْ طَعَامٍ؟ » قَالَتْ لَا وَاللَّهِ يَا رَسُولَ اللَّهِ مَا عِنْدَنَا طَعَامٌ إِلَّا عَظْمَ شَاةٍ أُعْطِيَتْ مَوْلَاتِي مِنَ الصَّدَقَةِ قَالَ «قَرِّبِيهِ فَقَدْ بَلَغَتْ مَحِلَّهَا»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ، قَوْلَ مَنْ زَعَمَ أَنَّ عُبَيْدَ بْنَ السَّبَّاقِ، لَمْ يَسْمَعْ هَذَا الْخَبَرَ مِنْ جُوَيْرِيَةَ
[Machine] The Prophet ﷺ entered upon her and said, "Is there any food?" She replied, "No, O Messenger of Allah, except for a meal that was given to us by a kind person from the charity." The Messenger of Allah ﷺ said, "Bring it closer."
أَنَّ النَّبِيَّ ﷺ دَخَلَ عَلَيْهَا فَقَالَ «هَلْ مِنْ طَعَامٍ؟ » قَالَتْ لَا يَا رَسُولَ اللَّهِ إِلَّا طَعَامٌ أُعْطِيَتْهُ مَوْلَاةٌ لَنَا مِنَ الصَّدَقَةِ فَقَالَ رَسُولُ اللَّهِ ﷺ «قَرِّبِيهِ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِإِبَاحَةِ مَا ذَكَرْنَاهُ
[Machine] The Prophet ﷺ said to Aisha, "Do you have something to feed me?" She replied, "Only from the sheep that was sent as a gift to Nusaybah from the charity." He said, "Bring it, for it has reached its place."
أَنَّ النَّبِيَّ ﷺ قَالَ لِعَائِشَةَ «عِنْدَكِ شَيْءٌ تُطْعِمِينِي؟ » قَالَتْ لَا إِلَّا مِنَ الشَّاةِ الَّتِي بُعِثَتْ بِهَا إِلَى نُسَيْبَةُ مِنَ الصَّدَقَةِ قَالَ «هَاتِيهِ فَقَدْ بَلَغَتْ مَحِلَّهَا»
ذِكْرُ جَوَازِ قَبُولِ الْمَرْءِ الَّذِي لَا يَحِلُّ لَهُ أَخْذُ الصَّدَقَةِ الْهَدِيَّةِ مِمَّنْ تُصُدِّقَ عَلَيْهِ بِتِلْكَ الْهَدِيَّةِ
[Machine] Aisha bought a female slave named Burayrah from the Ansar in order to set her free. They stipulated that she should make a contract with them, and she agreed to that. When the Prophet Muhammad ﷺ came, she informed him about the agreement, and he said, "Only those who set others free can have rights over them." Then he ascended the pulpit and said, "What is the matter with people who stipulate conditions that are not in the Book of Allah?" Burayrah had a husband, so the Messenger of Allah ﷺ gave her the option to stay with her husband or leave him. She chose to leave him, and the Prophet ﷺ entered her house, where he found a sheep's leg or hand. He asked Aisha, "Why don't you cook this meat for us?" She told him to confirm it from Burayrah, and then she gave it to him. He said, "Cook it, it is her charity, and we have a present."
اشْتَرَتْ عَائِشَةُ بَرِيرَةَ مِنَ الْأَنْصَارِ لِتُعْتِقَهَا وَاشْتَرَطُوا عَلَيْهَا أَنْ تَجْعَلَ لَهُمْ وَلَاءَهَا فَشَرَطَتْ ذَلِكَ فَلَمَّا جَاءَ نَبِيُّ اللَّهِ ﷺ أَخْبَرَتْهُ بِذَلِكَ فَقَالَ ﷺ «إِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» ثُمَّ صَعِدَ الْمِنْبَرَ فَقَالَ «مَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ» وَكَانَ لِبَرِيرَةَ زَوْجٌ فَخَيَّرَهَا رَسُولُ اللَّهِ ﷺ إِنْ شَاءَتْ أَنْ تَمْكُثَ مَعَ زَوْجِهَا كَمَا هِيَ وَإِنْ شَاءَتْ فَارَقَتْهُ فَفَارَقَتْهُ وَدَخَلَ النَّبِيُّ ﷺ الْبَيْتَ وَفِيهِ رِجْلُ شَاةٍ أَوْ يَدٍ فَقَالَ ﷺ لِعَائِشَةَ «أَلَا تَطْبُخُونَ لَنَا هَذَا اللَّحْمَ» فَقَالَتْ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَأَهْدَتْهُ لَنَا فَقَالَ «اطْبُخُوا فَهُوَ عَلَيْهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ»
32.2 [Machine] The Return in Gift
٣٢۔٢ بَابُ الرُّجُوعِ فِي الْهِبَةِ
"The one who takes back his gift is like the one who goes back to his vomit." (Using translation from Nasāʾī 3696)
عَنِ النَّبِيِّ ﷺ قَالَ «الْعَائِدُ فِي هِبَتِهِ كَالْعَائِدِ فِي قَيْئِهِ»
ذِكْرُ الْبَيَانِ بِأَنَّ حُكْمَ الرَّاجِعِ فِي صَدَقَتِهِ حُكْمُ الرَّاجِعِ فِي هِبَتِهِ سَوَاءٌ فِي هَذَا الزَّجْرِ
“The likeness of the one who gives charity then takes it back is that of a dog who vomits then goes back and eats its vomit.” (Using translation from Ibn Mājah 2391)
قَالَ رَسُولُ اللَّهِ ﷺ «مَثَلُ الَّذِي يَتَصَدَّقُ ثُمَّ يَرْجِعُ فِي صَدَقَتِهِ مَثَلُ الْكَلْبِ يَقِيءُ ثُمَّ يَرْجِعُ فَيَأْكُلُ قَيْئِهِ»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذَا الزَّجْرَ الَّذِي أُطْلِقَ بِلَفْظِ الْعُمُومِ لَمْ يُرَدْ بِهِ كُلُّ الْهِبَاتِ وَلَا كُلُّ الصَّدَقَاتِ
The Prophet ﷺ said: It is not lawful for a man to make a donation or give a gift and then take it back, except a father regarding what he gives his child. One who gives a gift and then takes it back is like a dog which eats and vomits when it is full, then returns to its vomit. (Using translation from Abū Dāʾūd 3539)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَحِلُّ لِرَجُلٍ أَنْ يُعْطِيَ عَطِيَّةً أَوْ هِبَةً ثُمَّ يَرْجِعُ فِيهَا إِلَّا الْوَالِدَ فِيمَا يُعْطِي وَلَدَهُ وَمَثَلُ الَّذِي يُعْطِي عَطِيَّةً أَوْ هِبَةً ثُمَّ يَرْجِعُ فِيهَا كَمَثَلِ الْكَلْبِ أَكَلَ حَتَّى شَبِعَ ثُمَّ قَاءَ ثُمَّ عَادَ إِلَى قَيْئِهِ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يَعُودَ الْمَرْءُ فِي الشَّيْءِ الَّذِي يَتَصَدَّقُ بِهِ بِالْمِلْكِ بَعْدَ زَوَالِ مِلْكِهِ عَنْهُ، فِيمَا قَبْلُ
‘Umar bin Al Khattab gave a horse as alms in the way of Allah. He then found it being sold, and intended to buy it. So he asked the Messenger of Allah ﷺ about this. He said Do not buy it, and do not take back your sadaqah. (Using translation from Abū Dāʾūd 1593)
أَنْ يَبْتَاعَهُ فَسَأَلَ رَسُولَ اللَّهِ ﷺ عَنْ ذَلِكَ فَقَالَ «لَا تَبْتَعْهُ وَلَا تَعُدْ فِي صَدَقَتِكَ»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذَا الْفَرَسَ قَدْ ضَاعَ عِنْدَ الَّذِي كَانَ فِي يَدِهِ، فَأَرَادَ عُمَرُ أَنْ يَشْتَرِيَهُ بَعْدَ ذَلِكَ
I gave a horse in Allah's Cause. The person to whom it was given, did not look after it. I intended to buy it from him, thinking that he would sell it cheap. When I asked the Prophet ﷺ he said, "Don't buy it, even if he gives it to you for one Dirham, as the person who takes back what he has given in charity, is like a dog that swallows back its vomit." عَنْ ذَلِكَ رَسُولَ اللَّهِ ﷺ فَقَالَ «لَا تَبْتَعْهُ وَإِنْ أَعْطَاكَهُ بِدِرْهَمٍ وَاحِدٍ فَإِنَّ الْعَائِدَ فِي صَدَقَتِهِ كَالْكَلْبِ يَعُودُ فِي قَيْئِهِ»
