ذِكْرُ الْخَبَرِ الْمُصَرِّحِ بِنَفْيِ جَوَازِ الْإِيثَارِ فِي النَّحْلِ بَيْنَ الْأَوْلَادِ

ibnhibban:5102 – Aḥmad b. ʿAlī b. al-Muthanná > Abū Khaythamah > Jarīr > ʿĀṣim > al-Shaʿbī > al-Nuʿmān b. Bashīr > Abāh Aʿṭāh Ghulām

That his father had given him a slave. The Messenger of Allah ﷺ said: What is this slave ? He replied: This is my slave which my father has given me. He asked: Has he given all your brothers the same as he has given you? He replied: No. He then said: Return it, then. (Using translation from Abū Dāʾūd 3543)   

ابن حبّان:٥١٠٢ – أَخْبَرَنَا أَحْمَدُ بْنُ عَلِيِّ بْنِ الْمُثَنَّى قَالَ حَدَّثَنَا أَبُو خَيْثَمَةَ قَالَ حَدَّثَنَا جَرِيرٌ عَنْ عَاصِمٍ عَنِ الشَّعْبِيِّ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ أَنَّ أَبَاهُ أَعْطَاهُ غُلَامًا فَقَالَ

رَسُولُ اللَّهِ ﷺ «مَا هَذَا الْغُلَامُ؟ » قَالَ غُلَامٌ أَعْطَانِيهِ أَبِي قَالَ «فَكُلُّ إِخْوَتِكَ أَعْطَاهُ كَمَا أَعْطَاكَ؟ » قَالَ لَا قَالَ «فَارْدُدْهُ» وَقَالَ لِأَبِيهِ لَا تُشْهِدْنِي عَلَى جَوْرٍ «

Who is this slave (how have you come to possess it)? Thereupon he (Nu'man b. Bashir) said: My father has donated it to me, whereupon he said: Have all brothers (of yours) been given this gift as given to you? He said: No. Thereupon he (the Holy Prophet) said: Then return him.

لَهُ النَّبِيُّ ﷺ مَا هَذَا الْغُلاَمُ قَالَ أَعْطَانِيهِ أَبِي قَالَ فَكُلَّ إِخْوَتِهِ أَعْطَيْتَهُ كَمَا أَعْطَيْتَ هَذَا قَالَ لاَ قَالَ فَرُدَّهُ
