32. Book of Gifting
٣٢۔ كِتَابُ الْهِبَةِ
"The one who takes back his gift is like the one who goes back to his vomit." (Using translation from Nasāʾī 3696)
عَنِ النَّبِيِّ ﷺ قَالَ «الْعَائِدُ فِي هِبَتِهِ كَالْعَائِدِ فِي قَيْئِهِ»
ذِكْرُ الْبَيَانِ بِأَنَّ حُكْمَ الرَّاجِعِ فِي صَدَقَتِهِ حُكْمُ الرَّاجِعِ فِي هِبَتِهِ سَوَاءٌ فِي هَذَا الزَّجْرِ
“The likeness of the one who gives charity then takes it back is that of a dog who vomits then goes back and eats its vomit.” (Using translation from Ibn Mājah 2391)
قَالَ رَسُولُ اللَّهِ ﷺ «مَثَلُ الَّذِي يَتَصَدَّقُ ثُمَّ يَرْجِعُ فِي صَدَقَتِهِ مَثَلُ الْكَلْبِ يَقِيءُ ثُمَّ يَرْجِعُ فَيَأْكُلُ قَيْئِهِ»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذَا الزَّجْرَ الَّذِي أُطْلِقَ بِلَفْظِ الْعُمُومِ لَمْ يُرَدْ بِهِ كُلُّ الْهِبَاتِ وَلَا كُلُّ الصَّدَقَاتِ
The Prophet ﷺ said: It is not lawful for a man to make a donation or give a gift and then take it back, except a father regarding what he gives his child. One who gives a gift and then takes it back is like a dog which eats and vomits when it is full, then returns to its vomit. (Using translation from Abū Dāʾūd 3539)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَحِلُّ لِرَجُلٍ أَنْ يُعْطِيَ عَطِيَّةً أَوْ هِبَةً ثُمَّ يَرْجِعُ فِيهَا إِلَّا الْوَالِدَ فِيمَا يُعْطِي وَلَدَهُ وَمَثَلُ الَّذِي يُعْطِي عَطِيَّةً أَوْ هِبَةً ثُمَّ يَرْجِعُ فِيهَا كَمَثَلِ الْكَلْبِ أَكَلَ حَتَّى شَبِعَ ثُمَّ قَاءَ ثُمَّ عَادَ إِلَى قَيْئِهِ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يَعُودَ الْمَرْءُ فِي الشَّيْءِ الَّذِي يَتَصَدَّقُ بِهِ بِالْمِلْكِ بَعْدَ زَوَالِ مِلْكِهِ عَنْهُ، فِيمَا قَبْلُ
‘Umar bin Al Khattab gave a horse as alms in the way of Allah. He then found it being sold, and intended to buy it. So he asked the Messenger of Allah ﷺ about this. He said Do not buy it, and do not take back your sadaqah. (Using translation from Abū Dāʾūd 1593)
أَنْ يَبْتَاعَهُ فَسَأَلَ رَسُولَ اللَّهِ ﷺ عَنْ ذَلِكَ فَقَالَ «لَا تَبْتَعْهُ وَلَا تَعُدْ فِي صَدَقَتِكَ»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذَا الْفَرَسَ قَدْ ضَاعَ عِنْدَ الَّذِي كَانَ فِي يَدِهِ، فَأَرَادَ عُمَرُ أَنْ يَشْتَرِيَهُ بَعْدَ ذَلِكَ
I gave a horse in Allah's Cause. The person to whom it was given, did not look after it. I intended to buy it from him, thinking that he would sell it cheap. When I asked the Prophet ﷺ he said, "Don't buy it, even if he gives it to you for one Dirham, as the person who takes back what he has given in charity, is like a dog that swallows back its vomit." عَنْ ذَلِكَ رَسُولَ اللَّهِ ﷺ فَقَالَ «لَا تَبْتَعْهُ وَإِنْ أَعْطَاكَهُ بِدِرْهَمٍ وَاحِدٍ فَإِنَّ الْعَائِدَ فِي صَدَقَتِهِ كَالْكَلْبِ يَعُودُ فِي قَيْئِهِ»
