67. Chapter

٦٧۔ كِتَابُ الدَّعْوَى وَالْبَيِّنَاتِ

67.5 [Machine] The disputants are arguing over something in one of their hands, and each of them establishes evidence for that. Al-Shafi'i, may Allah have mercy on him, said: "It is said: You have both reached equality in the claim and evidence. And the one who has a cause in his hand is stronger than your cause. So, he has the advantage of the strength of his cause, and in it is a Sunnah similar to what we have said.

٦٧۔٥ بَابُ الْمُتَدَاعِيَيْنِ يَتَنَازَعَانِ شَيْئًا فِيُ يَدِ أَحَدِهِمَا , وَيُقِيمُ كُلُّ وَاحِدٍ مِنْهُمَا عَلَى ذَلِكَ بَيِّنَةً قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: " قِيلَ: قَدِ اسْتَوَيْتُمَا فِي الدَّعْوَى وَالْبَيِّنَةِ , وَلِلَّذِي هُوَ فِيِ يَدَيْهِ سَبَبٌ بِكَيْنُونَتِهِ فِي يَدِهِ هُوَ أَقْوَى مِنْ سَبَبِكَ , فَهُوَ لَهُ بفَضْلِ قُوَّةِ سَبَبِهِ , وَفِيهِ سُنَّةٌ بِمِثْلِ مَا قُلْنَا "

[Machine] "It is his camel that he rode, so the Messenger of Allah ﷺ decided what to do with it."  

البيهقي:٢١٢٢٣فَذَكَرَ الْحَدِيثَ الَّذِي أَخْبَرَنَا أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ الْقَاضِي ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ أنبأ الشَّافِعِيُّ أنبأ ابْنُ أَبِيُ يَحْيَى عَنْ إِسْحَاقَ بْنِ أَبِي فَرْوَةَ عَنْ عُمَرَ بْنِ الْحَكَمِ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ أَنَّ رَجُلَيْنِ تَدَاعَيَا بِدَابَّةٍ فَأَقَامَ كُلُّ وَاحِدٍ مِنْهُمَا الْبَيِّنَةَ

أَنَّهَا دَابَّتُهُ نَتَجَهَا فَقَضَى بِهَا رَسُولُ اللهِ ﷺ لِلَّذِي هِيَ فِيُ يَدَيْهِ

[Machine] Two men came to the Prophet (PBUH) regarding a dispute over a camel. Each of them claimed ownership of the camel and presented evidence. The Messenger of Allah (PBUH) judged in favor of the person who had the camel in his possession.  

البيهقي:٢١٢٢٤وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْأَصْبَهَانِيُّ الْفَقِيهُ أنبأ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ وَمُحَمَّدُ بْنُ جَعْفَرٍ الْمَطِيرِيُّ وَأَبُو بَكْرٍ أَحْمَدُ بْنُ عِيسَى الْخَوَّاصُ قَالُوا ثنا مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ مَنْصُورٍ أَبُو إِسْمَاعِيلَ الْفَقِيهُ ثنا زَيْدُ بْنُ نُعَيْمٍ بِبَغْدَادَ ثنا مُحَمَّدُ بْنُ الْحَسَنِ ثنا أَبُو حَنِيفَةَ عَنْ هَيْثَمٍ الصَّيْرَفِيِّ عَنِ الشَّعْبِيِّ عَنْ جَابِرٍ

أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى النَّبِيِّ ﷺ فِي نَاقَةٍ فَقَالَ كُلُّ وَاحِدٍ مِنْهُمَا نُتِجَتْ هَذِهِ النَّاقَةُ عِنْدِي وَأَقَامَ بَيِّنَةً فَقَضَى بِهَا رَسُولُ اللهِ ﷺ لِلَّذِي هِيَ فِيُ يَدَيْهِ

[Machine] Two men argued over ownership of a sheep. Each of them presented evidence that it belonged to them and that they had produced it. Then Shurayh said, "It belongs to the one who has the lamb in his possession, as the producer has more right."  

البيهقي:٢١٢٢٥وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو الْوَلِيدِ الْفَقِيهُ أنبأ الْحَسَنُ بْنُ سُفْيَانَ ثنا مُحَمَّدُ بْنُ عُبَيْدٍ ثنا حَمَّادُ بْنُ زَيْدٍ عَنْ أَيُّوبَ عَنْ مُحَمَّدٍ

أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى شُرَيْحٍ فِي دَابَّةٍ فَأَقَامَ كُلُّ وَاحِدٍ مِنْهُمَا الْبَيِّنَةَ أَنَّهَا لَهُ وَأَنَّهُ أَنْتَجَهَا فَقَالَ شُرَيْحٌ هِيَ لِلَّذِي فِيُ يَدَيْهِ النَّاتِجُ أَحَقُّ مِنَ الْعَارِفِ

[Machine] That two men claimed ownership of a beast, so one of them presented evidence that he had acquired it, while the other presented evidence that it was his own, which he recognized. Shurayh said, "The one who acquired it has more right than the one who recognized it."  

البيهقي:٢١٢٢٦وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ أنبأ أَبُو الْوَلِيدِ ثنا عَبْدُ اللهِ بْنُ مُحَمَّدٍ ثنا عَمْرُو بْنُ زُرَارَةَ أنبأ هُشَيْمٌ عَنْ يُونُسَ وَابْنِ عَوْنٍ وَهِشَامٍ عَنْ مُحَمَّدِ بْنِ سِيرِينَ عَنْ شُرَيْحٍ

أَنَّ رَجُلَيْنِ ادَّعَيَا دَابَّةً فَأَقَامَ أَحَدُهُمَا الْبَيِّنَةَ وَهِيَ فِي يَدِهِ أَنَّهُ نَتَجَهَا وَأَقَامَ الْآخَرُ بَيِّنَةً أَنَّهَا دَابَّتُهُ عَرَفَهَا فَقَالَ شُرَيْحٌ النَّاتِجُ أَحَقُّ مِنَ الْعَارِفِ
