Aisha, (mother of the faithful believers) wanted to buy a slave girl and manumit her, but her masters said that they would sell her only on the condition that her Wala' would be for them. ʿAisha told Messenger of Allah ﷺ of that. He said, "What they stipulate should not hinder you from buying her, as the Wala' is for the manumitted."

أَهْلُهَا نَبِيعُكِهَا عَلَى أَنَّ وَلاَءَهَا لَنَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ لاَ يَمْنَعُكِ ذَلِكَ فَإِنَّمَا الْوَلاَءُ لِمَنْ أَعْتَقَ

Aisha wanted to buy a slave-girl in order to manumit her. The girl's masters stipulated that her Wala' would be for them. Messenger of Allah ﷺ said (to ʿAisha), "What they stipulate should not stop you, for the Wala' is for the liberator."

قَالَ رَسُولُ اللَّهِ ﷺ لاَ يَمْنَعُكِ ذَلِكِ فَإِنَّمَا الْوَلاَءُ لِمَنْ أَعْتَقَ

that she intended to buy Barira (a slave girl) and her masters stipulated that they would have her Wala'. When ʿAisha mentioned that to the Prophet ﷺ ; he said, "Buy her, for the Wala' is for the one who manumits."

أَنْ تَشْتَرِيَ بَرِيرَةَ فَاشْتَرَطُوا عَلَيْهَا الْوَلاَءَ فَذَكَرَتْ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ اشْتَرِيهَا إِنَّمَا الْوَلاَءُ لِمَنْ أَعْتَقَ

That Aisha, the mother of the Believers, intended to buy a slave girl in order to manumit her. The slave girl's master said, "We are ready to sell her to you on the condition that her Wala should be for us." Aisha mentioned that to Messenger of Allah ﷺ who said, "This (condition) should not prevent you from buying her, for the Wala is for the one who manumits (the slave)."

أَهْلُهَا نَبِيعُكِهَا عَلَى أَنَّ وَلاَءَهَا لَنَا فَذَكَرَتْ لِرَسُولِ اللَّهِ ﷺ فَقَالَ لاَ يَمْنَعُكِ ذَلِكِ فَإِنَّمَا الْوَلاَءُ لِمَنْ أَعْتَقَ

When Aisha intended to buy Barira, she said to the Prophet, "Barira's masters stipulated that they will have the Wala." The Prophet ﷺ said (to Aisha), "Buy her, as the Wala is for the one who manumits."

لِلنَّبِيِّ ﷺ إِنَّهُمْ يَشْتَرِطُونَ الْوَلاَءَ فَقَالَ النَّبِيُّ ﷺ اشْتَرِيهَا فَإِنَّمَا الْوَلاَءُ لِمَنْ أَعْتَقَ

We are prepared to sell her to you on the condition that her right of inheritance would vest with you. She (Hadrat A'isha) made a mention of that to Messenger of Allah ﷺ whereupon he said: This should not stand in your way. The right of inheritance vests in one who emancipates.

أَهْلُهَا نَبِيعُكِهَا عَلَى أَنَّ وَلاَءَهَا لَنَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ لاَ يَمْنَعُكِ ذَلِكَ فَإِنَّمَا الْوَلاَءُ لِمَنْ أَعْتَقَ

'A'isha (Allah be pleated with her) thought of buying a slave-girl and emancipating her, but her owners refused to (sell her but on the condition) that the right of inheritance would vest in them. She made a mention of that to Messenger of Allah ﷺ. whereupon he said: Let this (condition) not stand in your way for the right of inheritance vests with one who emancipates.

أَنْ تَشْتَرِيَ جَارِيَةً تُعْتِقُهَا فَأَبَى أَهْلُهَا إِلاَّ أَنْ يَكُونَ لَهُمُ الْوَلاَءُ فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ لاَ يَمْنَعُكِ ذَلِكِ فَإِنَّمَا الْوَلاَءُ لِمَنْ أَعْتَقَ

'Aishah, mother of believers (ra), intended to buy a slave-girl to set her free. Her people said: We shall sell her to you on one condition that we shall inherit from her. 'Aishah mentioned it to the Messenger of Allah ﷺ. He said: That should not prevent you, for the right of inheritance belongs to the one who has set a person free.

أَنَّ عَائِشَةَ ؓ أُمَّ الْمُؤْمِنِينَ أَرَادَتْ أَنْ تَشْتَرِيَ جَارِيَةً تَعْتِقُهَا فَقَالَ أَهْلُهَا نَبِيعُكِهَا عَلَى أَنَّ وَلاَءَهَا لَنَا فَذَكَرَتْ عَائِشَةُ ذَاكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ لاَ يَمْنَعُكِ ذَلِكَ فَإِنَّ الْوَلاَءَ لِمَنْ أَعْتَقَ

she wanted to buy Barirah and set her free, but they stipulated that her loyally as a freed slave (wala') should be to them. She mentioned that to the Messenger of Allah and he said: "Buy her and set her fee, and loyally is due to the one who frees the slave." She was given the choice when she was freed. Some meat was brought to the Messenger of Allah and it was said: "This is something that is given in charity to Barirah." He said: "It is charity for her and gift for us." And her husband was a free man.

أَنْ تَشْتَرِيَ بَرِيرَةَ فَتَعْتِقَهَا وَأَنَّهُمُ اشْتَرَطُوا وَلاَءَهَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ اشْتَرِيهَا وَاعْتِقِيهَا فَإِنَّ الْوَلاَءَ لِمَنْ أَعْتَقَ وَخُيِّرَتْ حِينَ أُعْتِقَتْ وَأُتِيَ رَسُولُ اللَّهِ ﷺ بِلَحْمٍ فَقِيلَ هَذَا مِمَّا تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَقَالَ هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ وَكَانَ زَوْجُهَا حُرًّا

"Buy her and set her free, for Al-Wala' is to the one who sets the slave free." Some meat was brought and it was said: "This is some of that which was given in charity to Barirah." He said: "It is charity for her and a gift for us." And the Messenger of Allah gave her the choice, and her husband was a free man.

"We will sell her to you on condition that her loyalty (Walla) is to us," She mentioned that top the Messenger of Allah and he said: "That should not stop you. Loyalty belongs to the one who sets the slave free."

أَنْ يَشْتَرِطُوا وَلَاءَهَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ «اشْتَرِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» فَاشْتَرَتْهَا فَأَعْتَقَتْهَا وَخَيَّرَهَا مِنْ زَوْجِهَا وَكَانَ حُرًّا وَأَنَّ النَّبِيَّ ﷺ أُتِيَ بِلَحْمٍ فَقَالَ مِنْ أَيْنَ هَذَا؟ قِيلَ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَقَالَ «هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ»

"We will sell her to you on condition that her loyalty (Walla) is to us," She mentioned that top the Messenger of Allah and he said: "That should not stop you. Loyalty belongs to the one who sets the slave free." (Using translation from Nasāʾī 4644)

[AI] Aisha said, "Would you sell your family?" So she went to her family and mentioned it to them. They said, "Not unless you stipulate that we have her freedom." The Prophet ﷺ said, "Buy her and set her free, for loyalty belongs to the one who sets someone free."

لَهَا عَائِشَةُ أَيَبِيعُكِ أَهْلُكِ؟ فَأَتَتْ أَهْلَهَا فَذَكَرَتْ ذَلِكَ لَهُمْ فَقَالُوا لَا إِلَّا أَنْ تَشْتَرِطَ لَنَا وَلَاءَهَا فَقَالَ النَّبِيُّ ﷺ اشْتَرِيهَا فَأَعْتِقِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ

[AI] Bareerah's husband was a free man. When she was freed, the Messenger of Allah ﷺ gave her the choice to either stay with him or leave. She chose herself and said that her family wanted to sell her and demand loyalty. She mentioned this to the Prophet ﷺ , and he said to buy her and free her, as loyalty belongs to the one who sets free.

كَانَ زَوْجُ بَرِيرَةَ حُرًّا فَلَمَّا أُعْتِقَتْ وَقَالَ مَرَّةً عَتَقَتْ خَيَّرَهَا رَسُولُ اللهِ ﷺ فَاخْتَارَتْ نَفْسَهَا قَالَتْ وَأَرَادَ أَهْلُهَا أَنْ يَبِيعُوهَا وَيَشْتَرِطُوا الْوَلَاءَ قَالَتْ فَذَكَرْتُ ذَلِكَلِلنَّبِيِّ ﷺ فَقَالَ اشْتَرِيهَا فَأَعْتِقِيهَا فَالْوَلَاءُ لِمَنْ أَعْتَقَ

Malik related to me from Nafi from Abdullah ibn Umar that A'isha umm al-muminin wanted to buy a slave-girl and set her free. Her people said, "We will sell her to you provided that her wala' is ours." She mentioned that to the Messenger of Allah ﷺ and he said, "Don't let that hinder you, for the wala' only belongs to the one who sets free."

أَنَّ وَلاَءَهَا لَنَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ لاَ يَمْنَعَنَّكِ ذَلِكَ فَإِنَّمَا الْوَلاَءُ لِمَنْ أَعْتَقَ

فَقَالَ أَهْلُهَا نَبِيعُهَا عَلَى أَنَّ وَلاءَهَا لَنَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ رَسُولُ اللَّهِ ﷺ لا يَمْنَعُكِ ذَلِكَ فَإِنَّمَا الْوَلاءُ لِمَنْ أَعْتَقَ

أَن عائشة ساومت ببرية فَرَجَعَ النَّبِيّ ﷺ مِنَ الصَّلاةِ فَقَالَتْ إِنَّهُم أَبَوْا أَنْ يَبِيعُوهَا إلاَّ أَنْ يَشْتَرِطُوا الْوَلاءَ فَقَالَ النَّبِيّ ﷺ الْوَلاءُ لِمَنْ أَعْتَقَ

أَنْ تَشْتَرِيَ بَرِيرَةَ لِعِتْقٍ وَأَنَّهُمُ اشْتَرَطُوا وَلَاءَهَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ «اشْتَرِيهَا فَأَعْتِقِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ» وَأُتِيَ رَسُولُ اللهِ ﷺ بِلَحْمٍ فَقَالُوا هَذَا تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَقَالَ هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ وَخُيِّرَتْ

أَنَّ الْوَلَاءَ لَنَا فَذَكَرْتُ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ «لَا يَمْنَعُكِ ذَلِكَ فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ»

[AI] "They stipulated her loyalty, so she mentioned that to the Messenger of Allah ﷺ , and he said, 'Buy her and set her free, for loyalty belongs to the one who emancipates.'"

أَنْ يَشْتَرِطُوا وَلَاءَهَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ «اشْتَرِيهَا فَأَعْتِقِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ»

"I bought Barirah and her masters stipulated that her loyalty (Wala) should be to them, I mentioned that to the Prophet and he said: 'Set her free, and loyalty belongs to the one who pays the silver.''' She said: "so I set her free. The Messenger of Allah called her and gave her the choice regarding her husband, and she chose herself. Her husband was a free man." (Using translation from Nasāʾī 4642)

اشْتَرَيْتُ بَرِيرَةَ فَاشْتَرَطَ أَهْلُهَا وَلَاءَهَا فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «أَعْتِقِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْطَى الْوَرِقَ» قَالَتْ فَعَتَقْتُهَا

The Prophet ﷺ said, "The Wala' is for the manumitted (of the slave). (Using translation from Bukhārī 6752)

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «إِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ»

[AI] To buy a female slave for the purpose of setting her free, and they stipulated her loyalty. So she mentioned that to the Messenger of Allah ﷺ , and the Messenger of Allah ﷺ said, "Buy her and set her free, for loyalty belongs to the one who sets free."

أَنْ تَشْتَرِيَ بَرِيرَةَ لِلْعِتْقِ وَأَنَّهُمُ اشْتَرَطُوا وَلَاءَهَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ «اشْتَرِيهَا فَأَعْتِقِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ»

[AI] The loyalty is for us, so I mentioned that to the Messenger of Allah ﷺ and he said to me, "That should not prevent you, for loyalty belongs to whoever emancipates."

الْوَلَاءَ لَنَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ لَا يَمْنَعْكِ ذَلِكَ؛ فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ

أَنَّ عَائِشَةَ زَوْجَ النَّبِيِّ ﷺ أَرَادَتْ أَنْ تَشْتَرِيَ وَلِيدَةً فَتُعْتِقَهَا فَقَالَ أَهْلُهَا نَبِيعُكِهَا عَلَى أَنَّ وَلَاءَهَا لَنَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ لَا يَمْنَعْكِ ذَلِكَ فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ مَالِكٍ

[AI] She pledged her loyalty to us, so Aisha mentioned this to the Messenger of Allah ﷺ . He replied, "Let that not stop you, for loyalty is only for those who set others free."

وَلَاءَهَا لَنَا فَذَكَرَتْ ذَلِكَ عَائِشَةُ لِرَسُولِ اللهِ ﷺ فَقَالَ لَا يَمْنَعْكِ ذَلِكَ فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ

[AI] They will have loyalty, so she mentioned that to the Messenger of Allah, ﷺ , so he said to her, "Do not be prevented by that, for loyalty is only for those who have been freed."

يَكُونَ لَهُمُ الْوَلَاءُ فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ لَا يَمْنَعْكِ ذَلِكَ فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ

[AI] It is narrated that a person bought a female slave to set her free, but her owners set a condition for her freedom. This was mentioned to the Messenger of Allah ﷺ and he said, "Buy her and set her free, as loyalty is only for those who free slaves."

تَشْتَرِيَ بَرِيرَةَ لِلْعِتْقِ وَأَنَّهُمُ اشْتَرَطُوا وَلَاءَهَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ اشْتَرِيهَا وَأَعْتِقِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ

[AI] He bought a camel, but they demanded loyalty in return. She mentioned this to the Messenger of Allah ﷺ, and the Messenger of Allah ﷺ said, "Buy it, loyalty is for the one who frees."

تَشْتَرِيَ بَرِيرَةَ فَاشْتَرَطُوا عَلَيْهَا الْوَلَاءَ فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ اشْتَرِيهَا الْوَلَاءُ لِمَنْ أَعْتَقَ

From 'Aishah that she wanted to purchase Barirah, but they (he owners) made the condition that they would retain the Wala'. So the Prophet ﷺ said: "Buy her, the Wala' is only for the one who gives the price, or for the one who grants the favor." [He said:] There is something on this topic from Ibn 'Umar. (Using translation from Tirmidhī 1256)

"اشْتَرِيها؛ فإِنَّما الولاءُ لِمَنْ أعْطى الثمَنَ، أو لمنْ وَلِيَ النَّعْمةَ" .

"اشتريها، فأعْتِقِيها، فإِنَّما الولاءُ لمن أعْطى الثَّمن".

"اشترِيها فأعتقيها فإِنَّما الولاء لمن أعْتَقَ" .

"إِنَّمَا الْوَلَاءُ لمن أَعْتَق ".

"أَرَادَتْ عَائِشَةُ أَنْ تَشْتَرِىَ بَرِيرَةَ، فَقَالُوا: تَبْتَاعِينَها عَلَى أَنَّ وَلاَءَهَا لَنَا، فَذَكَرَتْ ذَلِكَ لِلنَّبِىِّ ﷺ فَقَالَ رَسُولُ الله ﷺ : لاَ يَمْنَعُكِ ذَلك مِنْهَا فَإنَّمَا الْوَلاَءُ لِمَنْ أَعْتَقَ".

"أَرَادَ أَهْلُ بَريرَةَ أَنْ يَبِيعُوهَا وَيَشْتَرِطُوا الوَلَاءَ، فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ: اشْتَرِيهَا وَأَعْتِقِيهَا، فَإِنَّمَا الوَلَاءُ لِمَنْ أَعْتَقَ".
