That she was married to Sad bin Khaula who was from the tribe of Bani 'Amr bin Luai, and was one of those who fought the Badr battle. He died while she wa pregnant during Hajjat-ul-Wada.' Soon after his death, she gave birth to a child. When she completed the term of deliver (i.e. became clean), she prepared herself for suitors. Abu As-Sanabil bin Bu'kak, a man from the tribe of Bani Abd-ud-Dal called on her and said to her, "What! I see you dressed up for the people to ask you in marriage. Do you want to marry By Allah, you are not allowed to marry unless four months and ten days have elapsed (after your husband's death)." Subai'a in her narration said, "When he (i.e. Abu As-Sanabil) said this to me. I put on my dress in the evening and went to Messenger of Allah ﷺ and asked him about this problem. He gave the verdict that I was free to marry as I had already given birth to my child and ordered me to marry if I wished."  

أَنْ يَدْخُلَ عَلَى سُبَيْعَةَ بِنْتِ الْحَارِثِ الأَسْلَمِيَّةِ فَيَسْأَلَهَا عَنْ حَدِيثِهَا وَعَنْ مَا قَالَ لَهَا رَسُولُ اللَّهِ ﷺ حِينَ اسْتَفْتَتْهُ فَكَتَبَ عُمَرُ بْنُ عَبْدِ اللَّهِ بْنِ الأَرْقَمِ إِلَى عَبْدِ اللَّهِ بْنِ عُتْبَةَ يُخْبِرُهُ أَنَّ سُبَيْعَةَ بِنْتَ الْحَارِثِ أَخْبَرَتْهُ أَنَّهَا كَانَتْ تَحْتَ سَعْدِ ابْنِ خَوْلَةَ وَهْوَ مِنْ بَنِي عَامِرِ بْنِ لُؤَىٍّ وَكَانَ مِمَّنْ شَهِدَ بَدْرًا فَتُوُفِّيَ عَنْهَا فِي حَجَّةِ الْوَدَاعِ وَهْىَ حَامِلٌ فَلَمْ تَنْشَبْ أَنْ وَضَعَتْ حَمْلَهَا بَعْدَ وَفَاتِهِ فَلَمَّا تَعَلَّتْ مِنْ نِفَاسِهَا تَجَمَّلَتْ لِلْخُطَّابِ فَدَخَلَ عَلَيْهَا أَبُو السَّنَابِلِ بْنُ بَعْكَكٍ رَجُلٌ مِنْ بَنِي عَبْدِ الدَّارِ فَقَالَ لَهَا مَا لِي أَرَاكِ تَجَمَّلْتِ لِلْخُطَّابِ تُرَجِّينَ النِّكَاحَ فَإِنَّكِ وَاللَّهِ مَا أَنْتِ بِنَاكِحٍ حَتَّى تَمُرَّ عَلَيْكِ أَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ قَالَتْ سُبَيْعَةُ فَلَمَّا قَالَ لِي ذَلِكَ جَمَعْتُ عَلَىَّ ثِيَابِي حِينَ أَمْسَيْتُ وَأَتَيْتُ رَسُولَ اللَّهِ ﷺ فَسَأَلْتُهُ عَنْ ذَلِكَ فَأَفْتَانِي بِأَنِّي قَدْ حَلَلْتُ حِينَ وَضَعْتُ حَمْلِي وَأَمَرَنِي بِالتَّزَوُّجِ إِنْ بَدَا لِي  

'Why do I see you adorned? Perhaps you want to get married, but by Allah you will not get married until four months and ten days have passed.' Subai'ah said: 'When he said that to me, I put on my clothes in the evening and went to the Messenger of Allah and asked him about that. He ruled that it had become permissible for me to marry when I gave birth, and he told me to get married if I wanted to.'"

"Go to Subai'ah bint Al-Harith Al-Aslamiyyah, and ask her about the ruling of the Messenger of Allah concerning her pregnancy." He said: "So 'Umar bin 'Abdullah went to her and asked her. She told him that she was married to Sa'd bin Khawlah, who was one of the Companions of the Messenger of Allah who had been present at Badr. He died during the Farewell Pilgrimage, and she gave birth before four months and ten days had passed since her husband's death. When her Nifas ended, Abu As-Sanabil -a man from Banu 'Abd Ad-Dar- went to her and saw that she had adorned herself. He said: 'Perhaps you want to get married before four months and ten days has passed?' She said: 'When I heard that from Abu As-Sanabil, I went to the Messenger of Allah and told him my story. The Messenger of Allah said: 'It is permissible for you to marry when you gave birth.''"

[Machine] Marwan bin Abdullah ibn Uthbah sent a message to Subay'ah bint Al-Harith, asking her about what the Messenger of Allah ﷺ had given her. She informed him that she was under the guardianship of Saad ibn Khwala, but he passed away during the Farewell Hajj. She said that she had given birth to her child before four and ten months had passed since his death. Abu As-Sanabil, Ibn Ba'kkak, met her when she was experiencing postpartum bleeding and had applied kohl. He told her to wait for forty menstrual periods or their equivalent before considering marriage again. She then went to the Prophet ﷺ and informed him about what Abu As-Sanabil had said. The Prophet ﷺ told her that she was allowed to remarry as soon as she completed her postpartum bleeding.  

أَرْسَلَ مَرْوَانُ عَبْدَ اللهِ بْنَ عُتْبَةَ إِلَى سُبَيْعَةَ بِنْتِ الْحَارِثِ يَسْأَلُهَا عَمَّا أَفْتَاهَا بِهِ رَسُولُ اللهِ ﷺ فَأَخْبَرَتْهُ أَنَّهَا كَانَتْ تَحْتَ سَعْدِ ابْنِ خَوْلَةَ فَتُوُفِّيَ عَنْهَا فِي حَجَّةِ الْوَدَاعِ وَكَانَ بَدْرِيًّا فَوَضَعَتْ حَمْلَهَا قَبْلَ أَنْ تَنْقَضِيَ أَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ مِنْ وَفَاتِهِ فَلَقِيَهَا أَبُو السَّنَابِلِ يَعْنِي ابْنَ بَعْكَكٍ حِينَ تَعَلَّتْ مِنْ نِفَاسِهَا وَقَدْ اكْتَحَلَتْ فَقَالَ لَهَا ارْبَعِي عَلَى نَفْسِكِ أَوْ نَحْوَ هَذَا لَعَلَّكِ تُرِيدِينَ النِّكَاحَ إِنَّهَا أَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ مِنْ وَفَاةِ زَوْجِكِ قَالَتْ فَأَتَيْتُ النَّبِيَّ ﷺ فَذَكَرْتُ لَهُ مَا قَالَ أَبُو السَّنَابِلِ بْنُ بَعْكَكٍ فَقَالَ لَهَا النَّبِيُّ ﷺ قَدْ حَلَلْتِ حِينَ وَضَعْتِ حَمْلَكِ  

[Machine] I entered upon Subay'ah bint Abi Barzah al-Aslamyyah and asked her about her situation. She said, "I was with Sa'd ibn Khawlah and he passed away, so I did not stay with him for more than two months until I gave birth." She said, "Abu Al-Sanabil Ibn Ba'akkak, the brother of Bani Abdul-Dar, proposed to me, and I prepared myself for marriage." She said, "My brother-in-law, Hamwi, entered upon me and I was menstruating and prepared, and he asked, 'What do you want, O Subay'ah?'" She said, "I said, 'I want to get married.'" He said, "By Allah, you cannot have a husband until you complete four months and ten days." She said, "So I went to the Messenger of Allah ﷺ and mentioned that to him, and he said, 'You are permissible for marriage, so get married.'"  

دَخَلْتُ عَلَى سُبَيْعَةَ بِنْتِ أَبِي بَرْزَةَ الْأَسْلَمِيَّةِ فَسَأَلْتُهَا عَنْ أَمْرِهَا فَقَالَتْ كُنْتُ عِنْدَ سَعْدِ ابْنِ خَوْلَةَ فَتُوُفِّيَ عَنِّي فَلَمْ أَمْكُثْ إِلَّا شَهْرَيْنِ حَتَّى وَضَعْتُ قَالَتْ فَخَطَبَنِي أَبُو السَّنَابِلِ بْنُ بَعْكَكٍ أَخُو بَنِي عَبْدِ الدَّارِ فَتَهَيَّأْتُ لِلنِّكَاحِ قَالَتْ فَدَخَلَ عَلَيَّحَمْوِي وَقَدِ اخْتَضَبْتُ وَتَهَيَّأْتُ فَقَالَ مَاذَا تُرِيدِينَ يَا سُبَيْعَةُ قَالَتْ فَقُلْتُ أُرِيدُ أَنْ أَتَزَوَّجَ قَالَ وَاللهِ مَا لَكِ مِنْ زَوْجٍ حَتَّى تَعْتَدِّينَ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا قَالَتْ فَجِئْتُ رَسُولَ اللهِ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ ﷺ لِي قَدْ حَلَلْتِ فَتَزَوَّجِي

"عن أبي سلمة بن عبد الرحمن قال: سئل ابن عباس وأبو هريرة عن رجل توفي عن امرأة فوضعت قبل أن يمضي لها أربعة أشهر، فقال ابن عباس تعتد آخر الأجلين، قال أبو سلمة فقلت: إذا وضعت حملها فقد حل أجلها، فقال أبو هريرة: أنا مع ابن أخي - يعني أبا سلمة- فأرسل ابن عباس وأبو هريرة إلى أم سلمة يسئلونها عن ذلك، فأخبرت أن سبيعة بنت الحارث توفي عنها زوجها فوضعت بعد وفاته بليال، فلقيها أبو السنابل بن بعكك حين بلغت من نفاسها، وقد اكتحلت ولبست، فقال لعلك ترين أن

قد حللت إنك لا تحلين حتى يمضي لك أربعة أشهر وعشر من وفاة زوجك، فلما أمست أتت النبي ﷺ فذكرت له شأنها، وما قال لها أبو السنابل، فقال لها النبي ﷺ إذا وضعت حملك، قالت: وحسبت أن النبي ﷺ قال لها: كذب أبو السنابل".  

" وَعَنْ عُبَيْد اللهِ بْنِ عَبْدِ اللهِ، قَالَ: أَرْسَلَ مَرَوَانُ عَبْدَ اللهِ بْنَ عُتْبَةَ إِلَى سُبَيْعَةَ بِنْتِ الحَارِثِ يَسْأَلُهَا عَمَّا أَفْتَاهَا بِهِ رَسُول اللهِ ﷺ فَأَخْبَرَتْهُ أَنَّهَا كَانَتْ تَحْتَ سَعْدِ بْنِ خَوْلَةَ فَتُوُفِّيَ عَنْهَا فِي حَجَّةِ الوَدَاعِ، وَكَانَ بَدْرِيّا فَوَضَعَتْ حَمْلَهَا قَبْلَ أَنْ يَمْضِيَ لَهَا أَرْبَعَةُ أَشْهُرٍ وَعَشْرًا مِنْ وَفَاتِهِ، فَلَقِيهَا أَبُو السَّنَابِلِ بْنُ بَعْكٍ حِينَ تَعَلَّتْ مِنْ نِفَاسِهَا وَقَدِ اكْتَحلَتْ فَقَالَ: لَعَلَّكِ تُرِيدِينَ النِّكَاحَ؟ إِنَّهَا أَرْبَعَةُ أَشْهُرٍ وَعَشْرًا مِنْ وَفَاةِ زَوْجِكِ، فَأَتَتِ النَّبِيَّ ﷺ فَذَكَرَتْ لَهُ مَا قَالَ أَبُو السَّنَابِلِ، فَقَالَ لَهَا النَّبِيُّ ﷺ قَدْ حَلَلْتِ حِينَ وَضَعْتِ حَمْلَكِ".
