[Machine] A woman was approached by a man in the darkness of the morning while she was heading towards the mosque. He forcefully dragged her against her will, but she sought help from a passing man who scared the man away and then a group of armed men passed by, and she sought their help. They caught the man who had attacked her and were about to punish him when they brought him to the Prophet ﷺ . She informed him that the man had assaulted her, and the people corroborated that they had caught him. The Prophet ﷺ said, "I was there to help her because of her male companion. Now you have caught me, so leave the man." She said that he was lying and it was the man who had attacked her. The Messenger of Allah ﷺ said, "Take him and stone him." A man from the crowd stood up and said, "Don't stone him because I am the one who committed the act with her." He confessed, and then three individuals, the man who had assaulted her, the one who had helped her, and the woman, gathered before the Messenger of Allah ﷺ . He said to the man who had assaulted her, "As for you, you are forgiven." Then he said kind words to the man who had helped her. Umar said, "Stone the one who has confessed to committing adultery." The Messenger of Allah ﷺ said, "Verily, he has repented to Allah with a repentance that if the people of Madinah had done, it would have been accepted from them."  

الطبراني:١٨٣١٢حَدَّثَنَا عُبَيْدُ بْنُ غَنَّامٍ ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ثنا عَمْرُو بْنُ حَمَّادِ بْنِ طَلْحَةَ الْقَنَّادُ ثنا أَسْبَاطُ بْنُ نَصْرٍ عَنْ سِمَاكِ بْنِ حَرْبٍ عَنْ عَلْقَمَةَ بْنِ وَائِلِ بْنِ حُجْرٍ عَنْ أَبِيهِ

أَنَّ امْرَأَةً وَقَعَ عَلَيْهَا رَجُلٌ فِي سَوَّادِ الصُّبْحِ وَهِي تَعَمِدُ إِلَى الْمَسْجِدِ يَغْصِبُهَا عَلَى نَفْسِهَا فَاسْتَعَانَتْ بِرَجُلٍ مَرَّ عَلَيْهَا وَفَرَّ صَاحِبُهَا ثُمَّ مَرَّ عَلَيْهَا قَوْمٌ ذُو عُدَّةٍ فَاسْتَعَانَتْ بِهِمْ فَأَدْرَكُوا الَّذِي اسْتِعَانَتْ بِهِ وسَبَقَهُمُ الْآخَرُ فَأَتَوْا بِهِ النَّبِيَّ ﷺ فَأَخْبَرَتْهُ أَنَّهُ وَقَعَ عَلَيْهَا وَأَخْبَرَهُ الْقَوْمُ أَنَّهُمْ أَدْرَكُوهُ يَشْتَدُّ فَقَالَ إِنَّمَا كُنْتُ أُعْيِنُهَا عَلَى صَاحِبِهَا فَأَدْرَكُونِي هَؤُلَاءِ فَأَخَذُونِي قَالَتْ كَذَبَ هُوَ الَّذِي وَقَعَ عَلَيَّ فَقَالَ رَسُولُ اللهِ ﷺ «اذْهَبُوا بِهِ فَارْجُمُوهُ» فَقَامَ رَجُلٌ مِنَ النَّاسِ فَقَالَ لَا تَرْجُمُوهُ وَلَأَنَا الَّذِي فَعَلْتُ بِهَا الْفِعْلَ فَاعْتَرَفَ فَاجْتَمَعَ ثَلَاثَةٌ عِنْدَ رَسُولِ اللهِ ﷺ الَّذِي وَقَعَ عَلَيْهَا وَالَّذِي أَعَانَهَا وَالْمَرْأَةُ فَقَالَ «أَمَّا أَنْتَ فَقَدْ غُفِرَ لَكَ» وَقَالَ لِلَّذِي أَعَانَها قَوْلًا حَسَنًا فَقَالَ عُمَرُ ارْجُمِ الَّذِي اعْتَرَفَ بِالزِّنَا فَقَالَ رَسُولُ اللهِ ﷺ «أَلَا إِنَّهُ قَدْ تَابَ إِلَى اللهِ تَوْبَةً لَوْ تَابَهَا أَهْلُ يَثْرِبَ لَقُبِلَ مِنْهُمْ»

[Machine] A woman encountered a man in the darkness of the morning while she was going to the mosque, wrapped in a garment over herself. She called out for help to a passing man, so he ran away with his companion. Then, others passed by her, so she called out for help to them and they caught the man she had called out for. They reached him before the others did, and they brought him to her. She said to him, "I am the one who called out for help from you, but the other man is already gone." So they brought him to the Prophet ﷺ, and she informed him that he had encountered her. The people also informed the Prophet that they had caught him after he had made a strong escape. The Prophet said, "I had only come to the aid of her companion, so how were they able to catch me?" She said, "He is the one who encountered me." The Messenger of Allah ﷺ said, "Take him away and stone him." Then, a man from the people stood up and said, "Don't stone him, but stone me. I am the one who committed this act." So, he confessed, and three individuals gathered before the Messenger of Allah ﷺ - the one who had encountered her, the one who had come to her aid, and the woman. The Prophet said to the woman, "As for you, forgiveness has been granted to you." He said to the one who had come to her aid, "Well-spoken." Then, Umar asked, "Shouldn't we stone the one who confessed to adultery?" The Messenger of Allah ﷺ refused, saying, "No, for he has repented to Allah." Abu Abdur Rahman said, "The most generous of them in narration is the hadith of Abu Umamah, which is marfu."

[Machine] A man fell upon a woman in the darkness of the morning while she was heading to the mosque. She cried out for help to a passing man, and her companion fled. Then a group of people with weapons passed by, and she called out to them for help. They caught the man she was calling to and the others arrived afterwards. They brought him to her, and he claimed to be the one she was calling to for help, and the other man had already left. They brought him to the Messenger of Allah ﷺ , and she informed him that the man had assaulted her, and the companions informed him that they caught the man. The Messenger of Allah ﷺ said, "You did not do it, so there is no punishment for you. As for the one who responded to her, his statement is good." Umar said, "Should I stone the one who confessed to adultery?" The Messenger of Allah ﷺ said, "No, because he has repented to Allah. If it was the people of Madinah or people of Yathrib who had confessed, their repentance would have been accepted from them." Isra'il narrated it from Simak, and he mentioned in it that they brought him to the Prophet ﷺ . When he ordered him to be punished, her companion who fell upon her stood up and mentioned the story. Based on this narration, it is possible that he ordered his punishment and it is possible that they testified against him regarding adultery, and they erred in that until her companion stood up and confessed to adultery. Similar confessions have been found from Ma'iz, the Juhaniyyah, and the Ghameediyyah, and their punishments were not dropped. Their narrations are more numerous and well-known, and Allah knows best.  

البيهقي:١٧٣٢٣وَاسْتِدْلَالًا بِمَا أَخْبَرَنَا أَبُو الْقَاسِمِ زَيْدُ بْنُ أَبِي هَاشِمٍ الْعَلَوِيُّ وَعَبْدُ الْوَاحِدِ بْنُ مُحَمَّدِ بْنِ النَّجَّارِ الْمُقْرِئُ بِالْكُوفَةِ قَالَا أنبأ أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ عَلِيِّ بْنِ دُحَيْمٍ الشَّيْبَانِيُّ ثنا أَحْمَدُ بْنُ حَازِمِ بْنِ أَبِي غَرَزَةَ ثنا عَمْرُو بْنُ حَمَّادٍ عَنْ أَسْبَاطِ بْنِ نَصْرٍ عَنْ سِمَاكٍ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ عَنْ أَبِيهِ وَائِلِ بْنِ حُجْرٍ زَعَمَ
