حَمْزَةُ أَبُو عُمَرَ الْعَائِذِيُّ، عَنْ عَلْقَمَةَ بْنِ وَائِلٍ

[Machine] I witnessed the Messenger of Allah ﷺ when a man was brought in shackles. The Messenger of Allah ﷺ said to the guardian of the deceased, "Do you forgive him?" He replied, "No." The Messenger of Allah ﷺ said, "Then take the blood money." He replied, "No." So the Messenger of Allah ﷺ said, "Then you may kill him." He said, "Yes." So he took him away with him. He said, "Come, do you forgive?" repeating the same words as before. The guardian of the deceased repeated the same words three times. Then the Messenger of Allah ﷺ said at the fourth time, "Indeed, if you forgive, then it will be as if it was your own sin and the sin of your companion." So he left him. I saw him dragging his shackles.  

الطبراني:١٨٣٠٠ – حَدَّثَنَا مُحَمَّدُ بْنُ الْعَبَّاسِ الْمُؤَدِّبُ ثنا هَوْذَةُ بْنُ خَلِيفَةَ ثنا عَوْفُ بْنُ أَبِي جَمِيلَةَ عَنْ حَمْزَةَ أَبُو عُمَرَ الْعَائِذِيُّ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ عَنْ أَبِيهِ قَالَ

شَهِدْتُ رَسُولَ اللهِ ﷺ حِينَ جِيءَ بِالرَّجُلِ فِي نِسْعَةٍ يُقَادُ فَقَالَ رَسُولُ اللهِ ﷺ لِوَلِيِّ الْمَقْتُولِ «أَتَعْفُو عَنْهُ؟» قَالَ لَا قَالَ «فَتَأْخُذُ الدِّيَةَ» قَالَ لَا قَالَ فَتَقْتُلُهُ قَالَ نَعَمْ قَالَ فَاذْهَبْ بِهِ فَتَوَلَّى مِنْ عِنْدِهِ قَالَ تَعَالَ أَتَعْفُو؟ مِثْلَ قَوْلِهِ الْأَوَّلِ فَقَالَ وَلِيُّ الْمَقْتُولِ مِثْلَ قَوْلِهِ ثَلَاثَ مَرَّاتٍ فَقَالَ رَسُولُ اللهِ ﷺ عِنْدَ الرَّابِعَةِ «أَمَا إِنَّكَ إِنْ عَفَوْتَ فَإِنَّهُ يَبُوءُ بِإِثْمِكَ وَإِثْمَ صَاحِبِكَ» فَتَرَكَهُ قَالَ فَأَنَا رَأَيْتُهُ يَجُرُّ نِسْعَتَهُ

Then when he had gone he said: If you forgive him, he will carry your sin and the sin of your companion (the victim)." So he forgave him and let him go." He said: "And I saw him dragging his string."

He said: 'No.' He said: 'Will you accept the Diyah?' He said: 'No.' He said: 'Will you kill him?' He said: 'Yes.' He said: 'Take him away.' When he went and turned away from him, he called him back and said: 'Will you forgive him?' He said: 'No.' He said: 'Will you accept the Diyah?' He said: 'No.' He said: 'Will you kill him?' I was with the Prophet ﷺ when a man who was a murderer and had a strap round his neck was brought to him. He then called the legal guardian of the victim and asked him: Do you forgive him? He said: No. He asked: Will you accept the blood-money? He said: No. He asked: Will you kill him? He said: Yes. He said: Take him. When he turned his back, he said: Do you forgive him? He said: No. He said: Will you accept the blood-money? He said: No. He said: Will you kill him? He said: Yes. He said: Take him. After repeating all this a fourth time, he said: If you forgive him, he will bear the burden of his own sin and the sin of the victim. He then forgave him. He (the narrator) said: I saw him pulling the strap.  

أبو داود:٤٤٩٩ – حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ عُمَرَ بْنِ مَيْسَرَةَ الْجُشَمِيُّ حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ عَنْ عَوْفٍ حَدَّثَنَا حَمْزَةُ أَبُو عُمَرَ الْعَائِذِيُّ حَدَّثَنِي عَلْقَمَةُ بْنُ وَائِلٍ حَدَّثَنِي وَائِلُ بْنُ حُجْرٍ قَالَ

He replied, "No." The Prophet ﷺ then asked, "Will you accept blood money?" He again replied, "No." The Prophet ﷺ then asked, "Will you kill him?" He finally replied, "Yes." The Prophet ﷺ said, "If you forgive him, then he will bear your sin and the sin of his companion." The guardian decided to forgive him and said, "I have seen him dragging his chains, and he has been forgiven."  

الدارمي:٢٤٠٤ – أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ الْهَمْدَانِيُّ حَدَّثَنَا أَبُو أُسَامَةَ عَنْ عَوْفٍ عَنْ حَمْزَةَ أَبِي عُمَرَ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ الْحَضْرَمِيِّ عَنْ أَبِيهِ وَائِلِ بْنِ حُجْرٍ قَالَ

جِيءَ بِالْقَاتِلِ الَّذِي قَتَلَ إِلَى رَسُولِ اللهِ ﷺ جَاءَ بِهِ وَلِيُّ الْمَقْتُولِ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ أَتَعْفُو؟ قَالَ لَا قَالَ أَتَأْخُذُ الدِّيَةَ؟ قَالَ لَا قَالَ أَتَقْتُلُ؟ قَالَ نَعَمْ قَالَ فَاذْهَبْ بِهِ فَلَمَّا ذَهَبَ دَعَاهُ فَقَالَ أَمَا إِنَّكَ إِنْ عَفَوْتَ عَنْهُ فَإِنَّهُ يَبُوءُ بِإِثْمِكَ وَإِثْمِ صَاحِبِكَ فَعَفَا عَنْهُ فَأَرْسَلَهُ قَالَ فَرَأَيْتُهُ وَهُوَ يَجُرُّ نِسْعَتَهُ
