[Machine] A group from the army of the Messenger of Allah ﷺ raided the people of a water source in the morning. A man from the people of the water rose up and a man from the companions of the Prophet ﷺ attacked him. He said, "I am a Muslim!" and the companion killed him. When they came to the Prophet ﷺ, they informed him of what happened. He stood up to deliver a sermon, praised Allah and glorified Him, then he said, "As for what follows, what is the matter with a Muslim killing another Muslim while he says, 'I am a Muslim?'" He said, "O Messenger of Allah, he said it seeking refuge." So he turned his face away from him and said, "Indeed, Allah has prohibited me from taking the life of a Muslim." He said this three times.  

الطبراني:١٥١١٠حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ وَأَبُو مُسْلِمٍ الْكَشِّيُّ قَالَا ثَنَا حَجَّاجُ بْنُ الْمِنْهَالِ ثَنَا حَمَّادُ بْنُ سَلَمَةَ عَنْ يُونُسَ بْنِ عُبَيْدٍ عَنْ حُمَيْدِ بْنِ هِلَالٍ قَالَ جَمَعَ بَيْنِي وَبَيْنَ بِشْرِ بْنِ عَاصِمٍ رَجُلٌ فَحَدَّثَنِي عَنْ عُقْبَةَ بْنِ مَالِكٍ

أَنَّ جَيْشًا لِرَسُولِ اللهِ ﷺ غَشُوا أَهْلَ مَاءٍ صُبْحًا فَثَارَ رَجُلٌ مِنَ الْمَاءِ فَحَمَلَ عَلَيْهِ رَجُلٌ مِنْ أَصْحَابِ النَّبِيِّ ﷺ فَقَالَ إِنِّي مُسْلِمٌ فَقَتَلَهُ فَلَمَّا قَدِمُوا عَلَى النَّبِيِّ ﷺ أُخْبِرَ بِذَلِكَ فَقَامَ خَطِيبًا فَحَمِدَ اللهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ أَمَّا بَعْدُ فَمَا بَالُ الْمُسْلِمِ يَقْتُلُ الْمُسْلِمَ وَهُوَ يَقُولُ إِنِّي مُسْلِمٌ فَقَالَ يَا رَسُولَ اللهِ قَالَهَا تَعَوُّذًا فَقَالَ هَكَذَا وَحَوَّلَ وَجْهَهُ عَنْهُ فَقَالَ «إِنَّ اللهَ أَبَى عَلَيَّ فِيمَنْ قَتَلَ مُسْلِمًا» قَالَهَا ثَلَاثًا

[Machine] Once, a group of people who were on a secret mission for the Messenger of Allah ﷺ approached a well in the morning. A man from the people of the well appeared and one of the Muslims apprehended him. The man said, "I am a Muslim," but he was killed. When they returned, they informed the Prophet ﷺ about what had happened. The Messenger of Allah ﷺ stood up to address the people, praised Allah and glorified Him, then said, "What is wrong with a Muslim killing another man while the latter is saying, 'I am a Muslim'? The man said this as a means of seeking refuge." Upon hearing this, the face of the Messenger of Allah ﷺ turned away, and he stretched out his right hand and said, "I swear by Allah, the one who kills a Muslim will never enter Paradise." He repeated this statement three times.  

أحمد:١٧٠٠٩حَدَّثَنَا يُونُسُ حَدَّثَنَا حَمَّادٌ يَعْنِي ابْنَ سَلَمَةَ عَنْ يُونُسَ بْنِ عُبَيْدٍ عَنْ حُمَيْدِ بْنِ هِلَالٍ قَالَ جَمَعَ بَيْنِي وَبَيْنَ بِشْرِ بْنِ عَاصِمٍ رَجُلٌ فَحَدَّثَنِي عَنْ عُقْبَةَ بْنِ مَالِكٍ

أَنَّ سَرِيَّةً لِرَسُولِ اللهِ ﷺ غَشُوا أَهْلَ مَاءٍ صُبْحًا فَبَرَزَ رَجُلٌ مِنْ أَهْلِ الْمَاءِ فَحَمَلَ عَلَيْهِ رَجُلٌ مِنَ الْمُسْلِمِينَ فَقَالَ إِنِّي مُسْلِمٌ فَقَتَلَهُ فَلَمَّا قَدِمُوا أَخْبَرُوا النَّبِيَّ ﷺ بِذَلِكَ فَقَامَ رَسُولُ اللهِ ﷺ خَطِيبًا فَحَمِدَ اللهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ أَمَّا بَعْدُ فَمَا بَالُ الْمُسْلِمِ يَقْتُلُ الرَّجُلَ وَهُوَ يَقُولُ إِنِّي مُسْلِمٌ فَقَالَ الرَّجُلُ إِنَّمَا قَالَهَا مُتَعَوِّذًا فَصَرَفَ رَسُولُ اللهِ ﷺ وَجْهَهُ وَمَدَّ يَدَهُ الْيُمْنَى فَقَالَ أَبَى الله عَلَيَّ مَنْ قَتَلَ مُسْلِمًا ثَلَاثَ مَرَّاتٍ

[Machine] On the authority of the Prophet ﷺ , he said: "After that, what is the matter with a man killing another man while he says, 'I am a Muslim?' The killer said, 'O Messenger of Allah, he said it seeking refuge (from harm).' The Messenger of Allah ﷺ said: 'Thus did he utter it in a vain attempt to protect himself.' Then the Messenger of Allah ﷺ turned his face away from him. He said, 'Allah has forbidden the killing of a person who testifies that none has the right to be worshipped but Allah, and that I am the Messenger of Allah. Although he did not comment on it, Al-Dhahabi recognized it in his summary."  

الحاكم:٤٨حَدَّثَنَاهُ أَبُو عَلِيٍّ الْحُسَيْنُ بْنُ عَلِيٍّ الْحَافِظُ أَنْبَأَنَا أَبُو خَلِيفَةَ الْفَضْلُ بْنُ مُحَمَّدِ بْنِ شُعَيْبٍ الْقَاضِي ثنا أَحْمَدُ بْنُ يَحْيَى بْنِ حُمَيْدٍ ثنا حَمَّادُ بْنُ سَلَمَةَ عَنْ يُونُسَ بْنِ عُبَيْدٍ عَنْ حُمَيْدِ بْنِ هِلَالٍ عَنْ بِشْرِ بْنِ عَاصِمٍ عَنْ عُقْبَةَ بْنِ مَالِكٍ

عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ أَمَّا بَعْدَ فَمَا بَالُ الرَّجُلِ يَقْتُلُ الرَّجُلَ وَهُوَ يَقُولُ أَنَا مُسْلِمٌ؟ فَقَالَ الْقَاتِلُ يَا رَسُولَ اللَّهِ إِنَّمَا قَالَهَا مُتَعَوِّذًا فَقَالَ رَسُولُ اللَّهِ ﷺ هَكَذَا وَكَرِهَ مَقَالَتَهُ وَحَوَّلَ وَجْهَهُ عَنْهُ فَقَالَ «أَبَى اللَّهُ عَلَى مَنْ قَتَلَ مُسْلِمًا أَبَى اللَّهُ عَلَى مَنْ قَتَلَ مُسْلِمًا» سكت عنه الذهبي في التلخيص
