[Machine] Narrated by the Prophet ﷺ , he said, "A divorced woman has more right to herself than her guardian, and the satisfaction of a virgin is her silence."  

الطبراني:١٠٧٤٣حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللهِ وَحَفْصُ بْنُ عُمَرَ بْنِ الصَّبَّاحِ الرَّقِّيُّ قَالَا ثنا مُسْلِمُ بْنُ إِبْرَاهِيمَ ثنا شُعْبَةُ عَنْ مَالِكِ بْنِ أَنَسٍ عَنْ عَبْدِ اللهِ بْنِ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ

عَنِ النَّبِيِّ ﷺ قَالَ «الثَّيِّبُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ رِضَاهَا سُكُوتُهَا»

A woman who has been previously married (Thayyib) has more right to her person than her guardian. And a virgin should also be consulted, and her silence implies her consent.

أَنَّ النَّبِيَّ ﷺ قَالَ الثَّيِّبُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْمَرُ وَإِذْنُهَا سُكُوتُهَا

The above tradition has been transmitted by ‘Abd Allaah bin Al Fadl through his chain of narrators and with different meaning. The version goes “A woman without a husband has more right to her person than her guardian and the father of a virgin should ask her permission about herself.” Abu Dawud said “ The word “her father” is not guarded.
