16. Chapter of Ḍād (Male)
١٦۔ بَابُ الضَّادِ
[Machine] It has a message from the Messenger of Allah ﷺ: "Be humble and do not excessively pride yourself, as it is more pleasing to the face and more advantageous to the spouse."
لَهَا رَسُولُ اللهِ ﷺ «اخْفِضِي وَلَا تَنْهَكِي فَإِنَّهُ أَنْضَرُ لِلْوَجْهِ وَأَحْظَى عِنْدَ الزَّوْجِ»
[Machine] The Messenger of Allah ﷺ said, "O Dihyah, what is your food?" I said, "Meat and milk." He said, "Then what does it become?" I said, "Then it becomes what you already know." The Messenger of Allah ﷺ said, "Verily, Allah has set an example for the world in what comes out of the son of Adam."
قَالَ رَسُولُ اللهِ ﷺ «يَا ضَحَّاكُ مَا طَعَامُكَ؟» قُلْتُ اللَّحْمُ وَاللَّبَنُ قَالَ «ثُمَّ يَصِيرُ إِلَى مَاذَا؟» قُلْتُ ثُمَّ يَصِيرُ إِلَى مَا قَدْ عَلِمْتَ فَقَالَ رَسُولُ اللهِ ﷺ «إِنَّ اللهَ ﷻ ضَرَبَ مَا يَخْرُجُ مِنِ ابْنِ آدَمَ مَثَلًا لِلدُّنْيَا»
[Machine] I do not see the diya (blood money) except for the close relatives because they understand it. Is there anyone among you who has knowledge about this from the Messenger of Allah? Al-Dhahhak bin Sufyan al-Kalbi replied, and the Messenger of Allah used to send him to the Bedouins, "The Messenger of Allah wrote to me that I should give the wife of Ashyam al-Dhibaabi from the diyat (blood money) of her husband." Omar (RA) implemented that.
مَا أَرَى الدِّيَةَ إِلَّا لِلْعَصَبَةِ لِأَنَّهُمْ يَعْقِلُونَ عَنْهُ فَهَلْ مَعَ أَحَدٍ مِنْكُمْ مِنْ رَسُولِ اللهِ ﷺ فِي ذَلِكَ شَيْئًا؟ فَقَالَ الضَّحَّاكُ بْنُ سُفْيَانَ الْكِلَابِيُّ وَكَانَ رَسُولُ اللهِ ﷺ اسْتَعْمَلَهُ عَلَى الْأَعْرَابِ كَتَبَ إِلَيَّ رَسُولُ اللهِ ﷺ أَنْ أُوَرِّثَ امْرَأَةَ أَشْيَمٍ الضِّبَابِيِّ مِنْ دِيَةِ زَوْجِهَا فَأَخَذَ بِذَلِكَ عُمَرُ ؓ
[Machine] "Enter your dome so that I may inform you." He entered, and the [Prophet] came to him and said, "The Messenger of Allah ﷺ wrote to me that a woman from Ashyam Al-Dibabiy is to inherit from her husband’s mind."
ادْخُلْ قُبَّتَكَ حَتَّى أُخْبِرَكَ فَدَخَلَ فَأَتَاهُ فَقَالَ «كَتَبَ إِلَيَّ رَسُولُ اللهِ ﷺ أَنْ أُوَرِّثَ امْرَأَةَ أَشْيَمٍ الضِّبَابِيِّ مِنْ عَقْلِ زَوْجِهَا»
[Machine] I do not know anything for you, then we call upon the people that anyone who has knowledge from the Messenger of Allah ﷺ, let him stand up. Then Dhahhak bin Sufyan al-Kilabi stood up and said, "The Messenger of Allah ﷺ wrote to me that I should inherit the wife of Ashyam al-Dibabi from the blood money of her husband." So Umar inherited her.
مَا أَعْلَمُ لَكِ شَيْئًا ثُمَّ نَشَدَ النَّاسَ مَنْ كَانَ عِنْدَهُ عِلْمٌ مِنْ رَسُولِ اللهِ ﷺ فَلْيَقُمْ فَقَامَ الضَّحَّاكُ بْنُ سُفْيَانَ الْكِلَابِيُّ فَقَالَ «كَتَبَ إِلَيَّ رَسُولُ اللهِ ﷺ أَنْ أُوَرِّثَ امْرَأَةَ أَشْيَمٍ الضِّبَابِيِّ مِنْ دِيَةِ زَوْجِهَا» فَوَرَّثَهَا عُمَرُ ؓ
“The blood money is for the near male relatives from the father's side and the wife does not inherit anything from the blood money of her husband,” until Ad-Dahhak bin Sufyan wrote to him, and told him that the Prophet ﷺ ruled that the wife of Ashyam bin Dibabi should inherit from the blood money of her husband.
