Yahya related to me from Malik from Nafi from Abdullah ibn Umar that the Messenger of Allah ﷺ said, "If palm trees are sold after they have been pollinated, the fruit belongs to the seller unless the buyer makes a stipulation about its inclusion."

And whoever pollinates a date palm and then sells it after pollination, he has the right to its fruits, unless the buyer specifies a condition."

And whoever straightens a palm tree and then sells it after making it straight, he is entitled to its fruits unless the buyer stipulates otherwise."

أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَلَهُ مَالُهُ وَعَلَيْهِ دَيْنُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ أَبَّرَ نَخْلًا فَبَاعَهُ بَعْدَ تَوْبِيرِهِ فَلَهُ ثَمَرَتُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَهَذَا إِنْ صَحَّ فَإِنَّمَا أَرَادَ وَاللهُ أَعْلَمُ الْعَبْدَ الْمَأْذُونَ لَهُ فِي التِّجَارَةِ إِذَا كَانَ فِي يَدِهِ مَالٌ وَفِيهِ دَيْنٌ يَتَعَلَّقُ بِهِ فَالسَّيِّدُ يَأْخُذُ مَالَهُ وَيَقْضِي مِنْهُ دَيْنَهُ
"مَنْ ابْتَاعَ نَخْلًا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا للبَائِعِ، إِلا أَنْ يَشْتَرِطَ المُبْتَاعُ، وَمَنْ ابْتَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلَّذِي بَاعهُ، إِلا أَنْ يَشْتَرِط المُبْتَاعُ".
"مَنْ بَاعَ نَخْلًا قَدْ أُبرَتْ فَثَمَرُهَا لِلبَائع إِلَّا أنْ يَشْتَرط الْمُبْتَاعُ".
"مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلْبَائِع إلا أَنْ يَشْتَرِط الْمُبْتَاعُ".
"مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ، فَمَالُهُ لَهُ وَعَلَيه دَينُه إِلا أَنْ يَشْتَرِطَ الْمُبْتَاع، وَمَن أَبَّر نَخْلًا فَبَاعَ بَعْدَ مَا يُؤبِّرُه، فَلَهُ ثَمَرَتُه إِلا أَنْ يَشْتَرِط الْمُبْتَاعُ".
"مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ، فَمَالُهُ لِسَيِّده إِلا أَنْ يَشْتَرِطَ الَّذِي اشْتَرَاه".
"مَنْ بَاعَ عَبْدًا، فَمَالُهُ لِلبَائِع، إِلا أَنْ يَشْتَرِطَ الْمُبْتَاعُ، يَقُول: اشْتَرَيتُهُ مِنْكَ وَمَالهُ".
"مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ، فَمَالُهُ لِلبَائِع، إِلا أَنْ يَشْتَرِطَ الْمُبْتَاعُ، وَمَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ، فَثَمَرَتُهَا لِلْبَائِعِ، إِلا أَنْ يَشْتَرِطَ الْمُبْتَاعُ".
"عن عمر قال: مَنْ بَاع عبدًا ولهُ مالٌ فَمَالهُ لِسَيَّده إلا أَنْ يشْتَرِطَ الَّذِى اشتراه".
"عَنْ عَلِيٍّ قَالَ: مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ، فَمَالُهُ لِلبَائِع إِلَّا أَنْ يَشْتَرط الْمُبْتَاعُ، وَمَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرتُهَا لِلْبَائِع إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ، قَضَي بِذَلِكَ رَسُولُ الله ﷺ ".
