(a man from the Ansar) that a number of people from his tribe went to Khaibar and dispersed, and then they found one of them murdered. They said to the people with whom the corpse had been found, "You have killed our companion!" Those people said, "Neither have we killed him, nor do we know his killer." The bereaved group went to the Prophet ﷺ and said, "O Messenger of Allah ﷺ! We went to Khaibar and found one of us murdered." The Prophet ﷺ said, "Let the older among you come forward and speak." Then the Prophet ﷺ said, to them, "Bring your proof against the killer." They said "We have no proof." The Prophet ﷺ said, "Then they (the defendants) will take an oath." They said, "We do not accept the oaths of the Jews." Messenger of Allah ﷺ did not like that the Blood-money of the killed one be lost without compensation, so he paid one-hundred camels out of the camels of Zakat (to the relatives of the deceased) as Diya (Blood-money). They went to the prophet of Allah and said: 'O Prophet of Allah, we went to Khaibar and we found one of our number slain.' The Messenger of Allah said: 'Let the elders speak first.' And he said to them: 'Bring proof of the one whom you suspect killed him.' They said: 'We do not have any proof.' He said: "Then let them swear an oath to you.' They said" 'We will not accept the oath of the Jews.' The Messenger of Allah did not want his blood to have been shed with no Justice done, so he paid a Diyah of one hundred camels from the Sadaqah." 'Amr bin Shu'aib differed with them.

They said to those with whom they had found him: You have killed our friend. They replied: We did not kill him, nor do we know the slayer. We (the people of the slain) then went to the Prophet of Allah ﷺ. He said to them: Bring proof against the one who has slain him. They replied: We have no proof. He said: Then they will take an oath for you. They said: We do not accept the oaths of the Jews. The Messenger of Allah ﷺ did not like no responsibility should be fixed for his blood. So he himself paid his bloodwit consisting of one hundred camels of sadaqah (i.e. camels sent to the Prophet as zakat).

[Machine] He informed him that a group of his people went to Khaibar and dispersed in it. They found one of them dead, so they said to those who found him with them, "Did you kill our companion?" They replied, "We did not kill him nor do we know." He then went to the Messenger of Allah ﷺ and said, "O Prophet of Allah, we went to Khaibar and found one of us dead." The Messenger of Allah ﷺ said, "The most severe thing is severe." He said to them, "Can you bring any evidence against the murderer?" They said, "We have no evidence." He said, "Will you swear?" They said, "We do not accept the oaths of the Jews." The Messenger of Allah ﷺ disliked that his blood be invalid, so he accepted one hundred camels as blood money. This is the wording of the narration from Qatadan, and in the narration of others, it is one hundred camels from the charity.

رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ أَبِي نُعَيْمٍ وَأَخْرَجَهُ مُسْلِمٌ مِنْ حَدِيثِ ابْنِ نُمَيْرٍ عَنْ سَعِيدٍ دُونَ سِيَاقَةِ مَتْنِهِ وَإِنَّمَا لَمْ يَسُقْ مَتْنَهُ لِمُخَالَفَتِهِ رِوَايَةَ يَحْيَى بْنِ سَعِيدٍ قَالَ مُسْلِمُ بْنُ الْحَجَّاجِ فِي جُمْلَةِ مَا قَالَ فِي هَذِهِ الرِّوَايَةِ وَغَيْرُ مُشْكِلٍ عَلَى مَنْ عَقَلَ التَّمْيِيزَ مِنَ الْحُفَّاظِ أَنَّ يَحْيَى بْنَ سَعِيدٍ أَحْفَظُ مِنْ سَعِيدِ بْنِ عُبَيْدٍ وَأَرْفَعُ مِنْهُ شَأْنًا فِي طَرِيقِ الْعِلْمِ وَأَسْبَابِهِ فَهُوَ أَوْلَى بِالْحِفْظِ مِنْهُ قَالَ الشَّيْخُ وَإِنْ صَحَّتْ رِوَايَةُ سَعِيدٍ فَهِيَ لَا تُخَالِفُ رِوَايَةَ يَحْيَى بْنِ سَعِيدٍ عَنْ بَشِيرِ بْنِ يَسَارٍ لِأَنَّهُ قَدْ يُرِيدُ بِالْبَيِّنَةِ الْأَيْمَانَ مَعَ اللَّوْثِ كَمَا فَسَّرَهُ يَحْيَى بْنُ سَعِيدٍ وَقَدْ يُطَالِبُهُمْ بِالْبَيِّنَةِ كَمَا فِي هَذِهِ الرِّوَايَةِ ثُمَّ يَعْرِضُ عَلَيْهِمُ الْأَيْمَانَ مَعَ وُجُودِ اللَّوْثِ كَمَا فِي رِوَايَةِ يَحْيَى بْنِ سَعِيدٍ ثُمَّ يَرُدُّهَا عَلَى الْمُدَّعَى عَلَيْهِمْ عِنْدَ نُكُولِ الْمُدَّعِينَ كَمَا فِي الرِّوَايَتَيْنِ

" عَنْ سَهْلِ بْنِ أَبِى حَثْمَةَ أَنَّ نَفَرًا مِنْ قَوْمه انْطَلَقُوا إِلَى خَيْبَرَ فَتَفَرَّقُوا فِيهَا فَوَجَدُوا أَحَدَهُمْ قَتِيلًا، فَقَالُوا لِلَّذِينَ وَجَدُوهُ عِنْدَهُمْ: قَتَلْتُم صَاحِبَنَا! ! قَالُوا: مَا قَتَلْنَا وَلاَ عَلِمْنَا قَاتِلًا، فَانْطَلَقُوا إِلَى النَّبِىِّ ﷺ ، فَقَالُوا: يَا نَبِىَّ الله، انْطَلَقْنَا إِلَى خَيْبَرَ فَوَجَدْنَا أَحَدَنَا قَتِيلًا، قَالَ النَّبِىُّ ﷺ : الْكُبْرَ الْكُبْرَ (*)، فَقَالَ لَهُمْ: تَأتُونَ بِالْبَيِّنَة عَلَى مَنْ قَتَلَ، قَالُوا: وَمَا لَنَا بيِّنَةٌ، قَالَ: فَيَحْلِفُونَ لَكُمْ، قَالُوا: لاَ نَرْضَى بِأَيْمَانِ الْيَهُوَدِ. فَكَرِهَ النَّبِىُّ ﷺ أَنْ يُبْطَلَ دَمُهُ فَوَادَاهُ (* *) بِمِائَةٍ مِنْ إِبِلِ الصَّدَقَةِ".
