“If one of us did not need his land, he would give it (to someone else to cultivate) in return for one third, or one half of the yield , and he would stipulate (that the should receive) the produce grows on the banks of three streams, and the grains that remain in the ear after threshing, and the produce irrigated by a stream. Life at that time was hard, and he would work (the land) with iron and whatever Allah (SWT) willed, and he would benefit from it. Then Rafi bin Khadij came to us and said: ‘The Messenger of Allah ﷺ forbade you to do something that may seem beneficial to you, but obedience to Allah and obedience to His Messenger are more beneficial for you. The Messenger of Allah ﷺ forbade Haq for you, and he said: “Whoever has no need of his land, let him give it to his brother (to cultivate) or let him leave it (uncultivated).”  

ابن ماجة:٢٤٦٠حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى أَنْبَأَنَا عَبْدُ الرَّزَّاقِ أَنْبَأَنَا الثَّوْرِيُّ عَنْ مَنْصُورٍ عَنْ مُجَاهِدٍ عَنْ أُسَيْدِ بْنِ ظُهَيْرٍ ابْنِ أَخِي رَافِعِ بْنِ خَدِيجٍ عَنْ رَافِعِ بْنِ خَدِيجٍ قَالَ كَانَ أَحَدُنَا إِذَا اسْتَغْنَى عَنْ أَرْضِهِ أَعْطَاهَا بِالثُّلُثِ وَالرُّبُعِ وَالنِّصْفِ وَاشْتَرَطَ ثَلاَثَةَ جَدَاوِلَ وَالْقُصَارَةَ وَمَا سَقَى الرَّبِيعُ وَكَانَ الْعَيْشُ إِذْ ذَاكَ شَدِيدًا وَكَانَ يَعْمَلُ فِيهَا بِالْحَدِيدِ وَبِمَا شَاءَ اللَّهُ وَيُصِيبُ مِنْهَا مَنْفَعَةً فَأَتَانَا رَافِعُ بْنُ خَدِيجٍ فَقَالَ

إِنَّ رَسُولَ اللَّهِ ﷺ نَهَاكُمْ عَنْ أَمْرٍ كَانَ لَكُمْ نَافِعًا وَطَاعَةُ اللَّهِ وَطَاعَةُ رَسُولِهِ أَنْفَعُ لَكُمْ إِنَّ رَسُولَ اللَّهِ ﷺ يَنْهَاكُمْ عَنِ الْحَقْلِ وَيَقُولُ مَنِ اسْتَغْنَى عَنْ أَرْضِهِ فَلْيَمْنَحْهَا أَخَاهُ أَوْ لِيَدَعْ

Rafi' b. Khadij came to us and said: The Messenger of Allah ﷺ forbids you from a work which is beneficial to you ; and obedience to Allah and His Prophet ﷺ is more beneficial to you. The Messenger of Allah ﷺ forbids you from renting land for share of its produce and he said: If anyone if not in need of his land he should lend it to his brother or leave it. Abu Dawud said: Shu'bah and Mufaddal b. Muhalhal have narrated it from Mansur in similar way. Shu'bah said (in his version): Usaid, nephew of Rafi' b, Khadij.  

أبو داود:٣٣٩٨حَدَّثَنَا مُحَمَّدُ بْنُ كَثِيرٍ أَخْبَرَنَا سُفْيَانُ عَنْ مَنْصُورٍ عَنْ مُجَاهِدٍ أَنَّ أُسَيْدَ بْنَ ظُهَيْرٍ قَالَ جَاءَنَا رَافِعُ بْنُ خَدِيجٍ فَقَالَ

إِنَّ رَسُولَ اللَّهِ يَنْهَاكُمْ عَنْ أَمْرٍ كَانَ لَكُمْ نَافِعًا وَطَاعَةُ اللَّهِ وَطَاعَةُ رَسُولِ اللَّهِ ﷺ أَنْفَعُ لَكُمْ إِنَّ رَسُولَ اللَّهِ ﷺ يَنْهَاكُمْ عَنِ الْحَقْلِ وَقَالَ مَنِ اسْتَغْنَى عَنْ أَرْضِهِ فَلْيَمْنَحْهَا أَخَاهُ أَوْ لِيَدَعْ  

قَالَ أَبُو دَاوُدَ وَهَكَذَا رَوَاهُ شُعْبَةُ وَمُفَضَّلُ بْنُ مُهَلْهَلٍ عَنْ مَنْصُورٍ قَالَ شُعْبَةُ أُسَيْدُ ابْنُ أَخِي رَافِعِ بْنِ خَدِيجٍ

"Rafi' bin Khadij came to us and said: 'The Messenger of Allah has forbidden something that was beneficial for us, but obedience to the Messenger of Allah is better for you. He has forbidden Al-Haql (renting land in return for one-third or one-quarter of the produce) to you, and says: Whoever has land, let him give it (to someone else to cultivate it) or leave it. And he has forbidden Al-Muzabanah. Al-Muzabanah means when a man has a lot of date-palm trees and another man comes and takes it in return for a certain number of Wasqs of dried dates.'" ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِأَنَّ الزَّجْرَ عَنِ الْمُزَارَعَةِ وَكِرَاءِ الْأَرْضِ، إِنَّمَا زُجِرَ، إِذَا كَانَ ذَلِكَ عَلَى شَرْطٍ غَيْرٍ مَعْلُومٍ

[Machine] "Indeed, the Messenger of Allah ﷺ prohibited you from a matter that would have benefited you, regarding the field and a third and a quarter. So whoever has land and can fulfill his needs without it, then let him give it to his brother or let him cultivate it. And he prohibited you from usury."  

ابن حبّان:٥١٩٨أَخْبَرَنَا أَحْمَدُ بْنُ عَلِيِّ بْنِ الْمُثَنَّى قَالَ حَدَّثَنَا أَبُو خَيْثَمَةَ قَالَ حَدَّثَنَا جَرِيرٌ عَنْ مَنْصُورٍ عَنْ مُجَاهِدٍ عَنْ أُسَيْدِ بْنِ ظُهَيْرٍ قَالَ كَانَ أَحَدُنَا إِذَا اسْتَغْنَى عَنْ أَرْضِهِ وَافْتَقَرَ إِلَيْهَا غَيْرُهُ زَارَعَهَا بِالثُّلُثِ وَالرُّبُعِ وَالنِّصْفِ وَكَانَ يَشْتَرِطُ ثَلَاثَ جَدَاوِلَ وَمَا سَقَى الرَّبِيعِ وَكُنَّا نُعَالِجُهَا عِلَاجًا شَدِيدًا بِالْبَقَرِ وَالْحَدِيدِ وَبِأَشْيَاءَ وَكُنَّا نُصِيبُ مِنْهَا « فَأَتَانَا رَافِعُ بْنُ خَدِيجٍ فَقَالَ

» إِنَّ رَسُولَ اللَّهِ ﷺ نَهَاكُمْ عَنْ أَمْرٍ كَانَ يَنْفَعُكُمْ عَنِ الْحَقْلِ وَالْحَقْلُ الثُّلُثُ وَالرُّبُعُ فَمَنْ كَانَتْ لَهُ أَرْضٌ فَاسْتَغْنَى عَنْهَا فَلْيَمْنَحْهَا أَخَاهُ أَوْ لِيَزْرَعْ وَنَهَاكُمْ عَنِ الْمُزَابَنَةِ «

[Machine] My uncles came to us and said, "The Messenger of Allah, ﷺ , forbade us from doing something that was beneficial for us, and the obedience of Allah and His Messenger is more beneficial for us." He said, "Whoever has land, let him cultivate it or give it to his brother."  

الطبراني:٤٣٥٩حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ الْمَعْمَرِيُّ ثنا عَلِيُّ بْنُ الْمَدِينِيِّ ثنا سُفْيَانُ عَنْ عَبْدِ الْكَرِيمِ بْنِ أَبِي الْمُخَارِقِ عَنْ مُجَاهِدٍ عَنْ رَافِعِ بْنِ خَدِيجٍ قَالَ

رَاحَ إِلَيْنَا خَالَايَ فَقَالَا نَهَى رَسُولُ اللهِ ﷺ عَنْ أَمْرٍ كَانَ لَنَا نَافِعًا وَطَاعَةُ اللهِ وَطَاعَةُ رَسُولِهِ لَنَا أَنْفَعُ قَالَ «مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا أَوْ لِيَمْنَحْهَا أَخَاهُ»
