a man bought a slave and put him to work, then he found some defect in him, so he returned him. He (the seller) said: "O Messenger of Allah he put my slave to work." The Messenger of Allah ﷺ said: "A slave's earnings belong to his guarantor."  

ابن ماجة:٢٢٤٣حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ حَدَّثَنَا مُسْلِمُ بْنُ خَالِدٍ الزَّنْجِيُّ حَدَّثَنَا هِشَامُ بْنُ عُرْوَةَ عَنْ أَبِيهِ عَنْ عَائِشَةَ

أَنَّ رَجُلاً اشْتَرَى عَبْدًا فَاسْتَغَلَّهُ ثُمَّ وَجَدَ بِهِ عَيْبًا فَرَدَّهُ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّهُ قَدِ اسْتَغَلَّ غُلاَمِي فَقَالَ رَسُولُ اللَّهِ ﷺ الْخَرَاجُ بِالضَّمَانِ

A man bought a slave, and he remained with him as long as Allah wished him to remain. He then found defect in him. He brought his dispute with him to the Prophet ﷺ and he returned him to him. The man said: Messenger of Allah, my slave earned some wages. The Messenger of Allah ﷺ then said: Profit follows responsibility. Abu Dawud said: This chain of narrators (of this version) is not reliable.

أَنَّ رَجُلاً ابْتَاعَ غُلاَمًا فَأَقَامَ عِنْدَهُ مَا شَاءَ اللَّهُ أَنْ يُقِيمَ ثُمَّ وَجَدَ بِهِ عَيْبًا فَخَاصَمَهُ إِلَى النَّبِيِّ ﷺ فَرَدَّهُ عَلَيْهِ فَقَالَ الرَّجُلُ يَا رَسُولَ اللَّهِ قَدِ اسْتَغَلَّ غُلاَمِي فَقَالَ رَسُولُ اللَّهِ ﷺ الْخَرَاجُ بِالضَّمَانِ  

قَالَ أَبُو دَاوُدَ هَذَا إِسْنَادٌ لَيْسَ بِذَاكَ

[Machine] A man purchased a slave and took advantage of him, but then discovered or saw a defect in him, so he returned him due to the defect. The seller said, "The fault of my slave." The Prophet (peace and blessings be upon him) said, "The guarantee is determined by the fault."

أَنَّ رَجُلًا ابْتَاعَ غُلَامًا فَاسْتَغَلَّهُ ثُمَّ وَجَدَ أَوْ رَأَى بِهِ عَيْبًا فَرَدَّهُ بِالْعَيْبِ فَقَالَ الْبَائِعُ غَلَّةُ عَبْدِي فَقَالَ النَّبِيُّ ﷺ الْغَلَّةُ بِالضَّمَانِ

[Machine] A man bought a servant during the time of the Prophet Muhammad ﷺ. The servant had a defect that the man was not aware of, and he took advantage of him. Later, when the man discovered the defect, he returned the servant and argued with him before the Prophet ﷺ. The man said, "O Messenger of Allah, he was in my possession for a long time." The Messenger of Allah ﷺ then said, "The defective merchandise is under warranty."  

الحاكم:٢١٧٧حَدَّثَنَاهُ أَبُو عَبْدِ اللَّهِ مُحَمَّدُ بْنُ يَعْقُوبَ حَدَّثَنَا يَحْيَى بْنُ مُحَمَّدٍ حَدَّثَنَا مُسَدَّدٌ حَدَّثَنَا مُسْلِمُ بْنُ خَالِدٍ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ عَنْ عَائِشَةَ

أَنَّ رَجُلًا اشْتَرَى غُلَامًا فِي زَمَنِ النَّبِيِّ ﷺ وَبِهِ عَيْبٌ لَمْ يُعْلِمْ بِهِ فَاسْتَغَلَّهُ ثُمَّ عَلِمَ الْعَيْبَ فَرَدَّهُ فَخَاصَمَهُ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّهُ اسْتَغَلَّهُ مُنْذُ زَمَانٍ فَقَالَ رَسُولُ اللَّهِ ﷺ «الْغَلَّةُ بِالضَّمَانِ»  

هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ وَقَدْ رَوَاهُ ابْنُ أَبِي ذِئْبٍ عَنْ مَخْلَدِ بْنِ خُفَافٍ عَنْ عُرْوَةَ عَنْ عَائِشَةَ مُخْتَصَرًاصحيح
