'Asim, what did Messenger of Allah ﷺ say to you? 'Asim said to 'Uwaimir: You did not bring something good. Messenger of Allah ﷺ did not like this religious verdict that I sought from him. 'Uwaimir said: By Allah, I will not rest until I have asked him about it. 'Uwaimir proceeded until he came to Messenger of Allah ﷺ as he was sitting amidst people, and said: Messenger of Allah, tell me about a person who found a man with his wife. Should he kill him, and then you would kill him, or how should he act? Thereupon Messenger of Allah ﷺ said: (Verses) have been revealed concerning you and your wife; so go and bring her. Sahl said that they both invoked curses (and further said): I was along with people in the company of Messenger of Allah ﷺ. And when they had finished, Uwaimir said: Messenger of Allah, I shall have told a lie against her if I keep her (now). So he divorced her with three pronouncements before Messenger of Allah ﷺ had commanded him. Ibn Shihab said: Subsequently that was the practice of invokers of curses (al Mutala'inain)  

أَنَّ رَجُلاً وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ فَسَلْ لِي عَنْ ذَلِكَ يَا عَاصِمُ رَسُولَ اللَّهِ ﷺ فَسَأَلَ عَاصِمٌ رَسُولَ اللَّهِ ﷺ فَكَرِهَ رَسُولُ اللَّهِ ﷺ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَمِعَ مِنْ رَسُولِ اللَّهِ ﷺ فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَهُ عُوَيْمِرٌ فَقَالَ يَا عَاصِمُ مَاذَا قَالَ لَكَ رَسُولُ اللَّهِ ﷺ قَالَ عَاصِمٌ لِعُوَيْمِرٍ لَمْ تَأْتِنِي بِخَيْرٍ قَدْ كَرِهَ رَسُولُ اللَّهِ ﷺ الْمَسْأَلَةَ الَّتِي سَأَلْتُهُ عَنْهَا قَالَ عُوَيْمِرٌ وَاللَّهِ لاَ أَنْتَهِي حَتَّى أَسْأَلَهُ عَنْهَا فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى رَسُولَ اللَّهِ ﷺ وَسَطَ النَّاسِ فَقَالَ يَا رَسُولَ اللَّهِ أَرَأَيْتَ رَجُلاً وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ فَقَالَ رَسُولُ اللَّهِ ﷺ قَدْ نَزَلَ فِيكَ وَفِي صَاحِبَتِكَ فَاذْهَبْ فَأْتِ بِهَا قَالَ سَهْلٌ فَتَلاَعَنَا وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللَّهِ ﷺ فَلَمَّا فَرَغَا قَالَ عُوَيْمِرٌ كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللَّهِ إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا ثَلاَثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللَّهِ ﷺ قَالَ ابْنُ شِهَابٍ فَكَانَتْ سُنَّةَ الْمُتَلاَعِنَيْنِ  

[Machine] A man named 'Uwaymir came to him from the tribe of Banu 'Ajlan and said, "O 'Asim, what do you think of a man who finds another man with his wife? Should he kill him?" So 'Asim asked the Messenger of Allah ﷺ about this. The Messenger of Allah ﷺ disliked such questions and disapproved of them until 'Asim became unable to bear what he heard from the Messenger of Allah ﷺ . So he mentioned the meaning of the hadith of Malik, except that he said, "He divorced her before the Prophet ﷺ commanded him to do so." He said, "So his separation from her became a Sunnah (recommended practice) for those who curse each other."  

جَاءَهُ عُوَيْمِرٌ رَجُلٌ مِنْ بَنِي عَجْلَانَ فَقَالَ يَا عَاصِمُ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ؟ فَيَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ سَلْ لِي يَا عَاصِمُ رَسُولَ اللهِ فَسَأَلَ عَاصِمٌ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ فَكَرِهَ رَسُولُ اللهِ ﷺ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَمِعَ مِنْ رَسُولِ اللهِ ﷺ فَذَكَرَ مَعْنَى حَدِيثِ مَالِكٍ إِلَّا أَنَّهُ قَالَ فَطَلَّقَهَا قَبْلَ أَنْ يَأْمُرَهُ النَّبِيُّ ﷺ قَالَ فَكَانَ فِرَاقُهُ إِيَّاهَا سُنَّةً فِي الْمُتَلَاعِنَيْنِ  

[Machine] A man came to the Prophet ﷺ and said, "O Messenger of Allah, what do you think of a man who sees his wife with another man and he kills him, and then you also kill him? How would you deal with him?" So Allah, the Most High, revealed what is mentioned in the Quran about those who curse each other. Then the Messenger of Allah ﷺ said to him, "The matter concerning you and your wife has been settled." He said, "But we cursed each other and I was a witness before the Messenger of Allah ﷺ ." The man said, "O Messenger of Allah, if I had restrained myself from killing him, I would have lied about her, so I divorced her." Then she became pregnant and he denied the pregnancy. Her son was summoned to her, and then the ruling regarding inheritance was applied, that he would inherit from her and she would inherit from him as Allah had prescribed for her.  

أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ أَرَأَيْتَ رَجُلًا رَأَى مَعَ امْرَأَتِهِ رَجُلًا يَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ بِهِ؟ فَأَنْزَلَ اللَّهُ جَلَّ وَعَلَا مَا ذِكْرُ فِي الْقُرْآنِ مِنَ الْمُتَلَاعِنِينَ فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ «قَدْ قُضِيَ فِيكَ وَفِي امْرَأَتِكَ» قَالَ فَتَلَاعَنَا وَأَنَا شَاهِدٌ عِنْدَ رَسُولِ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنْ أَمْسِكُهَا فَقَدْ كَذَبْتُ عَلَيْهَا فَفَارَقَهَا فَكَانَتْ سُنَّةٌ بَعْدُ أَنْ يُفَرَّقَ بَيْنَ الْمُتَلَاعِنِينَ فَكَانَتْ حَامِلًا فَأَنْكَرَ حَمْلَهَا وَكَانَ ابْنُهَا يُدْعَى إِلَيْهَا ثُمَّ جَرَتِ السُّنَّةُ فِي الْمِيرَاثِ أَنْ يَرِثَهَا وَتَرِثُ مِنْهُ مَا فَرَضَ اللَّهُ لَهَا

Should he kill him and then be killed by you, or how should he act? Ask the Apostle of Allaah ﷺ ‘Asim, for me about it. ‘Asim then asked the Apostle of Allaah ﷺ about it. The Apostle of Allaah ﷺ disliked the question and denounced it. What ‘Asim heard from the Apostle of Allaah ﷺ fell heavy on him. When ‘Asim returned to his family ‘Uwaimr came to him and asked ‘Asim “What did the Apostle of Allaah ﷺ say to you”? Asim replied “You did not do good to me”. The Apostle of Allaah ﷺ disliked the question that I asked him. Thereupon ‘Uwaimir said “I swear by Allaah, I shall not leave until I ask him about it. So, ‘Uwaimir came to the Apostle of Allaah ﷺ while he was sitting in the midst of the people.” He said “Apostle of Allaah ﷺ tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act?” The Apostle of Allaah ﷺ said “A revelation has been sent down about you and your wife so go away and bring her. Sahl said “So we cursed one another while I was along with the people who were with the Apostle of Allaah ﷺ. Then when they finished, ‘Umamir said “I shall have lied against her, Apostle of Allaah ﷺ if I keep her. He pronounced her divorce three times before the Apostle of Allaah ﷺcommanded him (to do so). [Machine] A man came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, what do you think about a man who sees his wife with another man; should he kill him and then be killed, or what should he do?" So Allah ﷻ revealed regarding them what is mentioned in the Qur'an about the cursing. The Messenger of Allah ﷺ said to him, "The matter has been decided regarding you and your wife." He said, "We cursed each other while I was present with the Messenger of Allah ﷺ." He said, "O Messenger of Allah, if I were to keep her, then I would have lied about her. So I separated from her and the practice (Sunnah) among them was that they would be separated between the two who cursed each other. And she was pregnant, so he denied her pregnancy. The practice after that regarding inheritance was that she could inherit from him what Allah had ordained for her."
