"There was a time when we did not pass so many judgments, but now that time is over. Now Allah, the Mighty and Sublime, has decreed that we reach a time when, as you see, (we are asked to pass many judgments). Whoever among you is asked to pass a judgment after this day, let him pass judgment according to what is in the Book of Allah. If he is faced with a matter that is not mentioned in the Book of Allah, let him pass judgment according to the way His Prophet [SAW] passed judgment. If he is faced with a matter that is not mentioned in the Book of Allah, and concerning which His Prophet did not pass judgment, then let him pass judgment according to the way the righteous passed judgment. And let him not say 'I am afraid, I am afraid.' For that which is lawful is clear and that which is unlawful is clear, and between them are matters which are not as clear. Leave that which makes you doubt for that which does not make you doubt." (Using translation from Nasāʾī 5398)   

الدارمي:١٦٧أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ عَنْ سُفْيَانَ عَنِ الْأَعْمَشِ عَنْ عُمَارَةَ بْنِ عُمَيْرٍ عَنْ حُرَيْثِ بْنِ ظُهَيْرٍ عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ قَالَ

أَتَى عَلَيْنَا زَمَانٌ لَسْنَا نَقْضِي وَلَسْنَا هُنَالِكَ وَإِنَّ اللَّهَ قَدْ قَدَّرَ مِنَ الْأَمْرِ أَنْ قَدْ بَلَغْنَا مَا تَرَوْنَ «فَمَنْ عَرَضَ لَهُ قَضَاءٌ بَعْدَ الْيَوْمِ فَلْيَقْضِ فِيهِ بِمَا فِي كِتَابِ اللَّهِ ﷻ فَإِنْ جَاءَهُ مَا لَيْسَ فِي كِتَابِ اللَّهِ فَلْيَقْضِ بِمَا قَضَى بِهِ رَسُولُ اللَّهِ ﷺ فَإِنْ جَاءَهُ مَا لَيْسَ فِي كِتَابِ اللَّهِ وَلَمْ يَقْضِ بِهِ رَسُولُ اللَّهِ ﷺ فَلْيَقْضِ بِمَا قَضَى بِهِ الصَّالِحُونَ وَلَا يَقُلْ إِنِّي أَخَافُ وَإِنِّي أُرَى فَإِنَّ الْحَرَامَ بَيِّنٌ وَالْحَلَالَ بَيِّنٌ وَبَيْنَ ذَلِكَ أُمُورٌ مُشْتَبِهَةٌ فَدَعْ مَا يَرِيبُكَ إِلَى مَا لَا يَرِيبُكَ»

[Machine] "Whoever is presented with a case, let them judge according to what is in the book of Allah. If a matter comes to them that is not in the book of Allah, then let them judge according to what the Prophet ﷺ judged. If a matter comes to them that is not in the book of Allah and the Prophet ﷺ did not judge on it, then let them judge according to what the righteous have said. If a matter comes to them that is not in the book of Allah, the Prophet ﷺ did not judge on it, and the righteous did not judge on it, then let them use their own reasoning. If they cannot determine what is right, then let them accept and not be ashamed."  

الحاكم:٧٠٣٠أَخْبَرَنَا أَبُو بَكْرِ بْنُ إِسْحَاقَ أَنْبَأَ عَبْدُ اللَّهِ بْنُ أَحْمَدَ بْنِ حَنْبَلٍ ثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ نُمَيْرٍ ثَنَا أَبُو مُعَاوِيَةَ عَنِ الْأَعْمَشِ عَنِ الْقَاسِمِ عَنْ أَبِيهِ عَنْ عَبْدِ اللَّهِ قَالَ

«مَنْ عُرِضَ لَهُ قَضَاءٌ فَلْيَقْضِ بِمَا فِي كِتَابِ اللَّهِ فَإِنْ جَاءَهُ أَمْرٌ لَيْسَ فِي كِتَابِ اللَّهِ ﷻ فَلْيَقْضِ بِمَا قَضَى بِهِ النَّبِيُّ ﷺ فَإِنْ جَاءَهُ أَمْرٌ لَيْسَ فِي كِتَابِ اللَّهِ ﷻ وَلَمْ يَقْضِ بِهِ نَبِيُّهُ ﷺ فَلْيَقْضِ بِمَا قَالَهُ الصَّالِحُونَ فَإِنْ جَاءَهُ أَمْرٌ لَيْسَ فِي كِتَابِ اللَّهِ وَلَمْ يَقْضِ بِهِ نَبِيُّهُ ﷺ وَلَمْ يَقْضِ بِهِ الصَّالِحُونَ فَلْيَجْتَهِدْ رَأْيَهُ فَإِنْ لَمْ يُحْسِنْ فَلْيُقِرَّ وَلَا يَسْتَحِي»

[Machine] Abdullah ibn Mas'ud said, "O people, a time has come upon us where we are not deciding, and we are not there. Indeed, Allah has conveyed to us what you see. So whoever among you is presented with a matter after today, let them decide based on what is in the Book of Allah. If an issue comes to them that is not in the Book of Allah, then let them decide based on what the Messenger of Allah ﷺ decided. If an issue comes to them that is not in the Book of Allah and the Messenger of Allah ﷺ did not decide on it, then let them decide based on the decisions of the righteous predecessors. If an issue comes to them that is not in the Book of Allah, the Messenger of Allah ﷺ did not decide on it, and the righteous predecessors did not decide on it, then let them strive and not say, 'I am afraid' or 'I see.' Truly, what is permissible is clear, what is forbidden is clear, and between them are matters that are doubtful. So leave what is doubtful for that which is not doubtful."  

الطبراني:٨٩٢٠حَدَّثَنَا أَبُو خَلِيفَةَ ثنا مُحَمَّدُ بْنُ كَثِيرٍ ثنا سُفْيَانُ عَنِ الْأَعْمَشِ عَمِّ عُمَارَةَ بْنِ عُمَيْرٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ يَزِيدَ وَرُبَّمَا قَالَ عَنْ حُرَيْثِ بْنِ ظُهَيْرٍ قَالَ قَالَ

"عَنِ ابْنِ مَسْعُودٍ قَالَ: قَدْ أَتَى عَلَيْنَا زَمَانٌ لَسْنَا نَقْضى، وَلَسْنَا هُنَاك، وَإِنَّ الله قَدْ بَلَّغَنَا مَا تَرَوْنَ، فَمَنْ عَرَضَ لَهُ منْكُمْ قَضَاء بَعْدَ الْيَومِ فَلْيَقْض فيه بِمَا في كِتَاب الله، فإِنْ أَتَاهُ أَمْرٌ لَيْسَ فِى كِتَاب الله فَلْيَقْضِ فِيه بِمَا قَضَى بِه رَسُولُ الله ﷺ فَإِنْ أَتَاةُ أَمْرٌ لَيْسَ في كِتَاب الله (وَلَمْ يَقْضِ فِيه رَسُولُ الله ﷺ ) (*) فَلْيَقْضِ بِمَا قَضَى بِهِ الصَّالحُونَ، فَإِنْ أَتَاهُ أَمْرٌ لَيْسَ فِى كتَاب الله وَلَمْ يَقْضِ فيهِ رَسُولُ الله ﷺ وَلَمْ يَقْضِ فِيهِ الصَالِحُونَ فَلْيَجْتَهِدْ رَأيَهُ، وَلَا يَقُولَنَّ أَحَدُكُمْ: إِنَّى أَخَافُ، وَإنِّى أَرَى؛ فَإِنَّ الْحَلَالَ بَيِّنٌ وَاَلْحَرَامَ بَيِّنٌ، وَبَيْنَ ذَلِكَ أُمُورٌ مُشْتَبِهَةٌ، فَدَعْ مَا يَرِيبُكَ إِلَى مَا لَا يَريبُكَ".
