رَجُلانِ يَخْتَصِمَانِ فِي أَرْضٍ فَقَالَ أَحَدُهُمَا إِنَّ هَذَا انْتَزَى عَلَى أَرْضِي فِي الْجَاهِلِيَّةِ يَا رَسولَ اللهِ وهُو امْرُؤُ الْقَيْسِ وَهَذَا رَبِيعَةُ بْنُ عَبدان فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيه وَسَلَّم بَيِّنَتُكَ قَالَ لَيْسَ لِي بَيِّنَةٌ قَالَ يَمِينُهُ قَالَ إِذًا يَذْهَبُ بِهَا قَالَ لَيْسَ لَكَ إلاَّ ذَلِكَ فَلَمَّا قَامَ لِيَحْلِفَ قَالَ رَسُول اللهِ صَلَّى اللَّهُ عَلَيه وَسَلَّم مَنِ اقْتَطَعَ أَرْضًا ظُلْمًا لَقِيَ اللَّهَ وهُو عَلَيْهِ غَضْبَانُ قَالَ أَبُو بَكْرٍ أَحْسَبُ أَنَّهُ قَالَ مَنْ أَقْطَعَ أَرْضًا ظُلْمًا بِيَمِينِهِ
I was with the Messenger of Allah ﷺ that two men came there disputing over a piece of land. One of them said: Messenger of Allah, this man appropriated my land without justification in the days of ignorance. The (claimant) was Imru'l-Qais b. 'Abis al-Kindi and his opponent was Rabi'a b. 'Iban He (the Holy Prophet) said (to the claimant): Have you evidence (to substantiate your claim)? He replied: I have no evidence. Upon this he (the Messenger of Allah) remarked: Then his (that is of the defendant) is the oath. He (the claimant) said: In this case he (the defendant) would appropriate this (the property). He (the Holy Prophet) said: There is than no other way left for you but this. He (the narrator) said: When he (the defendant) stood up to take oath, the Messenger of Allah ﷺ said: He who appropriated the land wrongfully would meet Allah in a state that He would be angry with him. Ishaq in his narration mentions Rabi'a b. 'Aidan (instead of Rabi'a b. 'Ibdan).

Warning against unjustly taking land

[Machine] I was with the Prophet ﷺ when two opponents came to him. One of them said, "O Messenger of Allah, this man usurped my land during the period of ignorance, and he is Amr ibn Qays ibn 'Abis Al-Kindi, and his opponent is Rabi'ah." The Messenger of Allah ﷺ asked, "Do you have any evidence?" He replied, "No." The Prophet ﷺ said, "Then his oath will invalidate yours, for he does not care about what he swears by." The Messenger of Allah ﷺ said, "You have no right over it except for that." When he went to swear his oath, the Prophet ﷺ said, "Indeed, if he swears an oath upon his wealth unjustly, he will meet Allah while He is angry with him."
كُنْتُ عِنْدَ النَّبِيِّ ﷺ فَأَتَاهُ خَصْمَانِ فَقَالَ أَحَدُهُمَا يَا رَسُولَ اللهِ إِنَّ هَذَا انْتَزَى عَلَى أَرْضِي فِي الْجَاهِلِيَّةِ وَهُوَ امْرُؤُ الْقَيْسِ بْنُ عَابِسٍ الْكِنْدِيُّ وَخَصْمُهُ رَبِيعَةُ فَقَالَ أَرْضِي أَزْرَعُهَا فَقَالَ رَسُولُ اللهِ ﷺ أَلَكَ بَيِّنَةٌ ؟ قَالَ لَا قَالَ يَمِينُهُ قَالَ إِذًا يَذْهَبُ بِهَا إِنَّهُ لَيْسَ يُبَالِي مَا حَلَفَ عَلَيْهِ فَقَالَ رَسُولُ اللهِ ﷺ إِنَّهُ لَيْسَ لَكَ مِنْهُ إِلَّا ذَلِكَ فَلَمَّا ذَهَبَ لِيَحْلِفَ قَالَ أَمَا إِنَّهُ إِنْ حَلَفَ عَلَى مَالِهِ ظُلْمًا لَقِيَ اللهَ وَهُوَ عَلَيْهِ غَضْبَانُ

One of them said, "Indeed, this man has encroached upon my land during the pre-Islamic period, and he is Utbah bin Abis al-Kindi, and his opponent is Rabi'ah." The other man said, "This land is mine, and I cultivate it." The Prophet asked, "Do you have any evidence?" He replied, "No." The Prophet said, "Then the land belongs to him due to his oath." The first man said, "He does not care about fulfilling his oaths." The Prophet said to him, "You have nothing to do with it except that." When he went to fulfill his oath, the Prophet said, "Indeed, if he swore falsely about his property, he will meet Allah ﷻ while He is angry with him."
