54. Apostacy
٥٤۔ كِتَابُ الْمُرْتَدِّ
[Machine] As for me, if I were to kill them, it would be according to the saying of the Prophet ﷺ , and if I were to burn them, it would be due to the prohibition of the Prophet ﷺ . The Messenger of Allah ﷺ said, "Whoever changes his religion, kill him," and he also said, "Do not punish with the punishment of Allah." This is the wording of the hadith of Isma'il, and in another narration of Ya'qub, concerning a group of heretics or apostates, so he ordered for them to be burnt.
أَمَّا أَنَا فَلَوْ كُنْتُ لَقَتَلْتُهُمْ لِقَوْلِ النَّبِيِّ ﷺ وَلَمَا حَرَّقْتُهُمْ لِنَهْيِ النَّبِيِّ ﷺ قَالَ رَسُولُ اللهِ ﷺ مَنْ بَدَّلَ دِينَهُ فَاقْتُلُوهُ وَقَالَ لَا تُعَذِّبُوا بِعَذَابِ اللهِ ﷻ لَفْظُ حَدِيثِ إِسْمَاعِيلَ وَفِي رِوَايَةِ يَعْقُوبَ بِقَوْمٍ مِنَ الزَّنَادِقَةِ أَوْ مُرْتَدِّينَ فَأَمَرَ بِهِمْ فَحُرِّقُوا
'Ali came to some people of Az-Zutt, who worshipped idols, and burned them. Ibn 'Abbas said: "But the Messenger of Allah [SAW] said: 'Whoever changes his religion, kill him.'" (Using translation from Nasāʾī 4065)
أَنَّ عَلِيًّا ؓ أُتِيَ بِنَاسٍ مِنَ الزُّطِّ يَعْبُدُونَ وَثَنًا فَحَرَّقَهُمْ بِالنَّارِ فَقَالَ ابْنُ عَبَّاسٍ إِنَّمَا قَالَ رَسُولُ اللهِ ﷺ مَنْ بَدَّلَ دِينَهُ فَاقْتُلُوهُ
The blood of a Muslim man who testifies that there is no god but Allah and that I am the Messenger of Allah should not be lawfully shed but only for one of three reasons: married fornicator, soul for soul, and one who deserts his religion separating himself from the community. قَالَ رَسُولُ اللهِ ﷺ لَا يَحِلُّ دَمُ رَجُلٍ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنِّي رَسُولُ اللهِ إِلَّا أَحَدُ ثَلَاثَةِ نَفَرٍ النَّفْسُ بِالنَّفْسِ وَالثَّيِّبُ الزَّانِي وَالتَّارِكُ لِدِينِهِ الْمُفَارِقُ لِلْجَمَاعَةِ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ الْأَعْمَشِ
[Machine] On the day of the conquest of Mecca, the Messenger of Allah ﷺ granted safety to everyone except for four people and two women. He commanded to kill them if they were found clinging to the curtains of the Kaaba. This incident is mentioned in relation to their apostasy, some of them repenting, and the killing of others. This is the complete account, God willing.
لَمَّا كَانَ يَوْمُ فَتْحِ مَكَّةَ آمَنَ رَسُولُ اللهِ ﷺ النَّاسَ إِلَّا أَرْبَعَةَ نَفَرٍ وَامْرَأَتَيْنِ وَقَالَ اقْتُلُوهُمْ وَإِنْ وَجَدْتُمُوهُمْ مُتَعَلِّقِينَ بِأَسْتَارِ الْكَعْبَةِ وَذَكَرَ الْحَدِيثَ فِي رِدَّتِهِمْ وَرُجُوعِ بَعْضِهِمْ وَقَتْلِ الْبَعْضِ وَذَلِكَ يَرِدُ بِتَمَامِهِ إِنْ شَاءَ اللهُ
[Machine] That the mother of a child from a man insulted the Messenger of Allah ﷺ , so he killed her. Then a proclaimer called out the Messenger of Allah ﷺ saying: "Indeed, her blood has been wasted." And it was also narrated by Isra'il from 'Uthman Al-Shahham with its length extended.
أَنَّ أُمَّ وَلَدٍ لِرَجُلٍ سَبَّتْ رَسُولَ اللهِ ﷺ فَقَتَلَهَا فَنَادَى مُنَادِي رَسُولِ اللهِ ﷺ إِنَّ دَمَهَا هَدَرٌ وَرَوَاهُ أَيْضًا إِسْرَائِيلُ عَنْ عُثْمَانَ الشَّحَّامِ بِطُولِهِ مَوْصُولًا
[Machine] A woman insulted the Prophet Muhammad ﷺ, so Khalid ibn al-Walid killed her.
أَنَّ امْرَأَةً سَبَّتِ النَّبِيَّ ﷺ فَقَتَلَهَا خَالِدُ بْنُ الْوَلِيدِ ؓ
[Machine] Regarding Islam, the Messenger of Allah ﷺ commanded that it be presented to her, and if she refuses, she should be executed. So they presented Islam to her, but she refused except to be killed, so she was killed. In this narration, it is narrated from one unknown source, but it has also been narrated from another source as well from Ibn Al-Munkadir.
عَنِ الْإِسْلَامِ فَأَمَرَ رَسُولُ اللهِ ﷺ أَنْ يُعْرَضَ عَلَيْهَا الْإِسْلَامُ وَإِلَّا قُتِلَتْ فَعَرَضُوا عَلَيْهَا الْإِسْلَامَ فَأَبَتْ إِلَّا أَنْ تُقْتَلَ فَقُتِلَتْ فِي هَذَا الْإِسْنَادِ بَعْضُ مَنْ يُجْهَلُ وَقَدْ رُوِيَ مِنْ وَجْهٍ آخَرَ عَنِ ابْنِ الْمُنْكَدِرِ
[Machine] So the Prophet ﷺ ordered that Islam be presented to her, and if she accepted, then she would be spared, otherwise she would be killed. Ali reported that Ibn Sa'id narrated to him from Muhammad bin 'Ubaid bin 'Utbah, from Ma'mar bin Bakkar, with a similar chain of narration, and it has also been narrated weakly from another source from Al-Zuhri, from his uncle, with the same meaning. And this is the correct view of Al-Zuhri, which is authentic from him.
فَأَمَرَ النَّبِيُّ ﷺ أَنْ يُعْرَضَ عَلَيْهَا الْإِسْلَامُ فَإِنْ رَجَعَتْ وَإِلَّا قُتِلَتْ 16867 قَالَ وَأنبأ عَلِيٌّ ثنا ابْنُ سَعِيدٍ ثنا مُحَمَّدُ بْنُ عُبَيْدِ بْنِ عُتْبَةَ ثنا مَعْمَرُ بْنُ بَكَّارٍ بِإِسْنَادِهِ مِثْلَهُ وَرُوِيَ عَنِ ابْنِ أَخِي الزُّهْرِيِّ عَنْ عَمِّهِ بِمَعْنَاهُ وَرُوِي مِنْ وَجْهٍ آخَرَ ضَعِيفٍ عَنِ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنْ عَائِشَةَ ؓ وَهَذَا مَذْهَبُ الزُّهْرِيِّ صَحِيحٌ عَنْهُ
[Machine] She will be asked to repent, and if she repents, she will be spared; otherwise, she will be killed.
تُسْتَتَابُ فَإِنْ تَابَتْ وَإِلَّا قُتِلَتْ
[Machine] Some people disagreed with us about the apostasy, and their argument was something.
فَخَالَفَنَا بَعْضُ النَّاسِ فِي الْمُرْتَدَّةِ وَكَانَتْ حُجَّتُهُ شَيْئًا
عَنْ أَبِي بَكْرٍ ؓ
[Machine] It is called Umm Qirfat, she denied her faith after accepting Islam, so Abu Bakr Al-Siddiq called her to repent, but when she did not repent, he killed her. Al-Layth said, "This is what we have heard and it is my opinion." Ibn Wahb also said the same, and Malik said something similar. Al-Shafi'i said, "We cannot use it as evidence because it is weak according to the scholars of Hadith." The sheikh said, "Its weakness is due to its discontinuation, although we have narrated it from two different narrators."
يُقَالُ لَهَا أُمُّ قِرْفَةَ كَفَرَتْ بَعْدَ إِسْلَامِهَا فَاسْتَتَابَهَا أَبُو بَكْرٍ الصِّدِّيقُ ؓ فَلَمْ تَتُبْ فَقَتَلَهَا قَالَ اللَّيْثُ وَذَاكَ الَّذِي سَمِعْنَا وَهُوَ رَأْيِي قَالَ ابْنُ وَهْبٍ وَقَالَ لِي مَالِكٌ مِثْلَ ذَلِكَ قَالَ الشَّافِعِيُّ فَمَا كَانَ لَنَا أَنْ نَحْتَجَّ بِهِ إِذْ كَانَ ضَعِيفًا عِنْدَ أَهْلِ الْعِلْمِ بِالْحَدِيثِ قَالَ الشَّيْخُ ضَعْفُهُ فِي انْقِطَاعِهِ وَقَدْ رُوِّينَاهُ مِنْ وَجْهَيْنِ مُرْسَلَيْنِ
[Machine] Uthman ibn Affan used to say this about those who disbelieved after having belief.
عُثْمَانَ بْنَ عَفَّانَ ؓ كَانَ يَقُولُ ذَلِكَ فِيمَنْ كَفَرَ بَعْدَ إِيمَانِهِ
