36. Chapter
٣٦۔ كِتَابُ الْوَدِيعَةِ
[Machine] That Abu Bakr Al-Siddiq, may Allah be pleased with him, lost a deposit that was in a torn pocket with no guarantee for it.
أَنَّ أَبَا بَكْرٍ الصِّدِّيقَ رَضِيَ اللهُ عنْهُ قَضَى فِي وَدِيعَةٍ كَانَتْ فِي جِرَابٍ فَضَاعَتْ مِنْ خَرْقِ الْجِرَابِ أَنْ لَا ضَمَانَ فِيهَا
[Machine] Ibn Mas'ood and قالا said: "There is no guarantee for a believer, and we were told by Shurayh that there is no guarantee for anything entrusted except for the excessive (amount). And a hadith with a weak chain of narration has been narrated in that regard."
وَابْنَ مَسْعُودٍ ؓ قَالَا لَيْسَ عَلَى مُؤْتَمَنٍ ضَمَانٌ وَرُوِّينَا عَنْ شُرَيْحٍ لَيْسَ عَلَى الْمُسْتَوْدَعِ غَيْرِ الْمُغِلِّ ضَمَانٌ وَرُوِيَ فِي ذَلِكَ حَدِيثٌ مُسْنَدٌ بِإِسْنَادٍ ضَعِيفٍ
[Machine] The Messenger of Allah ﷺ said, "There is no guarantee for a believer." Ibn Lahi'ah narrated from Amr ibn Shu'aib from his father from his grandfather from the Prophet ﷺ who said, "Whoever is entrusted with something, there is no guarantee for him."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا ضَمَانَ عَلَى مُؤْتَمَنٍ 12700 وَرَوَى ابْنُ لَهِيعَةَ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنِ النَّبِيِّ ﷺ قَالَ مَنِ اسْتُودِعَ وَدِيعَةً فَلَا ضَمَانَ عَلَيْهِ
[Machine] That she should not give it to either of them without their owner being present until they meet. So one of them came to her and said, "My owner has died, so give me the money." She refused, so he disputed with her for three years and interceded on his behalf until she gave it to him. Then the other one came and said, "Give me what is mine." He took it to Umar ibn Al-Khattab and Umar said to him, "Do you have any evidence?" He said, "My evidence is clear." Umar said, "I think you are only a guarantor." She said, "I ask you, O Abu Fulan, to take us to the son of Abu Talib." So they went to him, and he was watering a garden while wearing a robe. They narrated the story to him, and he said, "Bring your companion to me and the belongings."
أَنْ لَا تَدْفَعَهَا إِلَى وَاحِدٍ مِنْهُمَا دُونَ صَاحِبِهِ حَتَّى يَجْتَمِعَا فَأَتَاهَا أَحَدُهُمَا فَقَالَ إِنَّ صَاحِبِي تُوُفِّيَ؛ فَادْفَعِي إِلِيَّ الْمَالَ فَأَبَتْ فَاخْتَلَفَ إِلَيْهَا ثَلَاثَ سِنِينَ وَاسْتَشْفَعَ عَلَيْهَا حَتَّى أَعْطَتْهُ ثُمَّ إِنَّ الْآخَرَ جَاءَ فَقَالَ أَعْطِينِي الَّذِي لِي فَذَهَبَ بِهَا إِلَى عُمَرَ بْنِ الْخَطَّابِ فَقَالَ لَهُ عُمَرُ ؓ هَلْ بَيِّنَةٌ؟ قَالَ هِيَ بَيِّنَتِي فَقَالَ مَا أَظُنُّكِ إِلَّا ضَامِنَةً قَالَتْ أَسْأَلُكَ يَا أَبَا فُلَانٍ أَنْ تَرْفَعَنَا إِلَى ابْنِ أَبِي طَالِبٍ فَأَتَوْهُ وَهُوَ يُطَيِّنُ حَوْضًا لَهُ فِي بُسْتَانٍ وَهُوَ مُتَّزِرٌ بِكِسَاءٍ فَقَصُّوا عَلَيْهِ الْقِصَّةَ فَقَالَ ائْتِنِي بِصَاحِبِكَ وَالِي مَتَاعِكَ
[Machine] That Umar ibn al-Khattab included it as a trust that was stolen from his house.
أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ ضَمَّنَهُ وَدِيعَةً سُرِقَتْ مِنْ بَيْتِ مَالِهِ
[Machine] That he had, in fact, deprived himself of it, so he guaranteed it to himself through another transaction and Allah is the most knowledgeable.
أَنَّهُ كَانَ فَرَّطَ فِيهَا فَضَمَّنَهَا إِيَّاهُ بِالتَّفْرِيطِ وَاللهُ أَعْلَمُ
[Machine] I was entrusted with some money, so I put it with my own money. It was lost among my wealth, so I brought it to Umar and he said, "Indeed, you are trustworthy in my view. However, the money was lost among your wealth, so I will guarantee it."
اسْتُودِعْتُ مَالًا فَوَضَعْتُهُ مَعَ مَالِي فَهَلَكَ مِنْ بَيْنِ مَالِي فَرُفِعْتُ إِلَى عُمَرَ فَقَالَ إِنَّكَ لَأَمِينٌ فِي نَفْسِي وَلَكِنْ هَلَكَتْ مِنْ بَيْنِ مَالِكِ فَضَمَنْتُهُ
[Machine] He used to say, "If he moves it, he has guaranteed it."
كَانَ يَقُولُ إِذَا حَرَّكَهَا فَقَدْ ضَمِنَ
