nasai-kubra:5010ʿAmr b. ʿUthmān b. Saʿīd > al-Walīd > Ibn Jurayj > ʿAṭāʾ > ʿAbdullāh b. ʿAmr

[Machine] O Messenger of Allah, we hear from you narrations. Can we write them down? He said, "Yes." So, the first thing that was written was the book of the Prophet ﷺ to the people of Makkah: it is not permissible to have two conditions in one sale, nor a sale and a loan altogether, nor a sale of something that is not guaranteed. And whoever owes a hundred dirhams, he should repay them except for ten dirhams, then he is a slave, or on a hundred and ten dirhams, he should repay them except for two dirhams, then he is a slave.  

الكبرى للنسائي:٥٠١٠أَخْبَرَنِي عَمْرُو بْنُ عُثْمَانَ بْنِ سَعِيدٍ قَالَ حَدَّثَنَا الْوَلِيدُ عَنِ ابْنِ جُرَيْجٍ قَالَ أَخْبَرَنِي عَطَاءٌ عَنْ عَبْدِ اللهِ بْنِ عَمْرٍو قَالَ

يَا رَسُولَ اللهِ إِنَّا نَسْمَعُ مِنْكَ أَحَادِيثًا أَفَتَأْذَنُ لَنَا أَنْ نَكْتُبَهَا؟ قَالَ «نَعَمْ» فَكَانَ أَوَّلَ مَا كُتِبَ كِتَابُ النَّبِيِّ ﷺ إِلَى أَهْلِ مَكَّةَ لَا يَجُوزُ شَرْطَانِ فِي بَيْعٍ وَاحِدٍ وَلَا بَيْعٍ وَسَلَفٍ جَمِيعًا وَلَا بَيْعِ مَا لَمْ يُضْمَنْ وَمَنْ كَانَ مُكَاتَبًا عَلَى مِائَةِ دِرْهَمٍ فَقَضَاهَا إِلَّا عَشَرَةَ دَرَاهِمَ فَهُوَ عَبْدٌ أَوْ عَلَى مِائَةِ وَقِيَّةٍ فَقَضَاهَا إِلَّا أُوقِيَّتَيْنِ فَهُوَ عَبْدٌ

He said, "Yes," and the first thing the Messenger of Allah wrote to the people of Mecca was that it is not permissible for there to be two conditions in one sale, and there should not be a sale and a loan together, and there should not be a sale unless it is guaranteed. And whoever is in debt for one hundred dirhams and he pays them all except for ten dirhams, then he is a slave. And whoever is in debt for one hundred oqiyyah and he pays them all except for one oqiyyah, then he is a slave. This is what I found him upon and I do not see it protected."  

البيهقي:٢١٦٤٠وَأَخْبَرَنَا عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثنا زِيَادُ بْنُ الْخَلِيلِ التُّسْتَرِيُّ ثنا إِبْرَاهِيمُ بْنُ الْمُنْذِرِ حَدَّثَنِي هِشَامُ بْنُ سُلَيْمَانَ الْمَخْزُومِيُّ ثنا ابْنُ جُرَيْجٍ عَنْ عَبْدِ اللهِ بْنِ عَمْرِو بْنِ الْعَاصِ قَالَ

"عَنْ عَطَاء الخُرَاسَانِىِّ: أَنَّ عَبْدَ اللَّهِ بْنَ عَمْرِو بْنِ العَاصِ قَالَ: يَا رَسُولَ اللَّهِ: إِنَّا نَسْمَعُ مِنْكَ أَحَادِيثَ، أفَتَأذَنُ لِى فَأَكتُبَهَا؟ قَالَ: نَعَمْ، قَالَ: فَكَانَ أَوَّلُ مَا كَتَبَ بِهِ النَّبِىُّ ﷺ إِلَى أَهْلِ مَكَّةَ كِتَابًا: لَا يَجُوزُ شَرْطَانِ فِى بَيْع وَاحِدٍ، وَبَيْعٌ وَسَلَفٌ جَمِيعًا، وَبَيْعُ مَا لَمْ يَضْمَنْ، ومن كَانَ مُكَاتَبًا علَى مِائَةِ دِرْهَمٍ، فَقَضَاهَا كُلَّهَا إِلَّا دِرْهَمًا فَهُو عَبْدٌ أَوْ عَلَى مِائَةِ أُوِقَيةٍ فَقَضَاهَا كُلَّهَا إِلَّا أُوقِيَّة فَهُوَ عَبْدٌ".
