٢١۔ كتاب البيوع
The Prophet ﷺ forbade the sales called Al-Mukhabara, Al-Muhaqala and Al-Muzabana and the selling of fruits till they are free from blights. He forbade the selling of the fruits except for money, except the 'Araya.
سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ ؓ نَهَى النَّبِيُّ ﷺ عَنِ الْمُخَابَرَةِ وَالْمُحَاقَلَةِ وَعَنِ الْمُزَابَنَةِ وَعَنْ بَيْعِ الثَّمَرِ حَتَّى يَبْدُوَ صَلاَحُهَا وَأَنْ لاَ تُبَاعَ إِلاَّ بِالدِّينَارِ وَالدِّرْهَمِ إِلاَّ الْعَرَايَا
Once the Prophet ﷺ went out during the day. Neither did he talk to me nor I to him till he reached the market of Bani Qainuqa and then he sat in the compound of Fatima's house and asked about the small boy (his grandson Al-Hasan) but Fatima kept the boy in for a while. I thought she was either changing his clothes or giving the boy a bath. After a while the boy came out running and the Prophet ﷺ embraced and kissed him and then said, 'O Allah! Love him, and love whoever loves him.'
عَنْ أَبِي هُرَيْرَةَ الدَّوْسِيِّ ؓ قَالَ خَرَجَ النَّبِيُّ ﷺ فِي طَائِفَةِ النَّهَارِ لاَ يُكَلِّمُنِي وَلاَ أُكَلِّمُهُ حَتَّى أَتَى سُوقَ بَنِي قَيْنُقَاعَ فَجَلَسَ بِفِنَاءِ بَيْتِ فَاطِمَةَ فَقَالَ أَثَمَّ لُكَعُ أَثَمَّ لُكَعُ فَحَبَسَتْهُ شَيْئًا فَظَنَنْتُ أَنَّهَا تُلْبِسُهُ سِخَابًا أَوْ تُغَسِّلُهُ فَجَاءَ يَشْتَدُّ حَتَّى عَانَقَهُ وَقَبَّلَهُ وَقَالَ اللَّهُمَّ أَحْبِبْهُ وَأَحِبَّ مَنْ يُحِبُّهُ قَالَ سُفْيَانُ قَالَ عُبَيْدُ اللَّهِ أَخْبَرَنِي أَنَّهُ رَأَى نَافِعَ بْنَ جُبَيْرٍ أَوْتَرَ بِرَكْعَةٍ
Messenger of Allah ﷺ forbade two ways of wearing clothes and two kinds of dealings. (A) He forbade the dealings of the Mulamasa and the Munabadha. In the Mulamasa transaction the buyer just touches the garment he wants to buy at night or by daytime, and that touch would oblige him to buy it. In the Munabadha, one man throws his garment at another and the latter throws his at the former and the barter is complete and valid without examining the two objects or being satisfied with them (B) The two ways of wearing clothes were Ishtimal-as-Samma, i e., to cover one's shoulder with one's garment and leave the other bare: and the other way was to wrap oneself with a garment while one was sitting in such a way that nothing of that garment would cover one's private part.
نَهَى رَسُولُ اللَّهِ ﷺ عَنْ لِبْسَتَيْنِ وَعَنْ بَيْعَتَيْنِ نَهَى عَنِ الْمُلاَمَسَةِ وَالْمُنَابَذَةِ فِي الْبَيْعِ وَالْمُلاَمَسَةُ لَمْسُ الرَّجُلِ ثَوْبَ الآخَرِ بِيَدِهِ بِاللَّيْلِ أَوْ بِالنَّهَارِ وَلاَ يُقَلِّبُهُ إِلاَّ بِذَلِكَ وَالْمُنَابَذَةُ أَنْ يَنْبِذَ الرَّجُلُ إِلَى الرَّجُلِ بِثَوْبِهِ وَيَنْبِذَ الآخَرُ ثَوْبَهُ وَيَكُونَ ذَلِكَ بَيْعَهُمَا عَنْ غَيْرِ نَظَرٍ وَلاَ تَرَاضٍ وَاللِّبْسَتَيْنِ اشْتِمَالُ الصَّمَّاءِ وَالصَّمَّاءُ أَنْ يَجْعَلَ ثَوْبَهُ عَلَى أَحَدِ عَاتِقَيْهِ فَيَبْدُو أَحَدُ شِقَّيْهِ لَيْسَ عَلَيْهِ ثَوْبٌ وَاللِّبْسَةُ الأُخْرَى احْتِبَاؤُهُ بِثَوْبِهِ وَهْوَ جَالِسٌ لَيْسَ عَلَى فَرْجِهِ مِنْهُ شَىْءٌ

عَنْ أَبِي هُرَيْرَةَ الدَّوْسِيِّ ؓ قَالَ خَرَجَ النَّبِيُّ ﷺ فِي طَائِفَةِ النَّهَارِ لاَ يُكَلِّمُنِي وَلاَ أُكَلِّمُهُ حَتَّى أَتَى سُوقَ بَنِي قَيْنُقَاعَ فَجَلَسَ بِفِنَاءِ بَيْتِ فَاطِمَةَ فَقَالَ أَثَمَّ لُكَعُ أَثَمَّ لُكَعُ فَحَبَسَتْهُ شَيْئًا فَظَنَنْتُ أَنَّهَا تُلْبِسُهُ سِخَابًا أَوْ تُغَسِّلُهُ فَجَاءَ يَشْتَدُّ حَتَّى عَانَقَهُ وَقَبَّلَهُ وَقَالَ اللَّهُمَّ أَحْبِبْهُ وَأَحِبَّ مَنْ يُحِبُّهُ قَالَ سُفْيَانُ قَالَ عُبَيْدُ اللَّهِ أَخْبَرَنِي أَنَّهُ رَأَى نَافِعَ بْنَ جُبَيْرٍ أَوْتَرَ بِرَكْعَةٍ
21.3 The prohibition of selling Habl Al-Habalah
٢١۔٣ باب تَحْرِيمِ بَيْعِ حَبَلِ الْحَبَلَةِ
Messenger of Allah ﷺ forbade the sale called 'Habal-al-Habala which was a kind of sale practiced in the Pre- Islamic Period of ignorance. One would pay the price of a she-camel which was not born yet would be born by the immediate offspring of an extant she-camel.
أَنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنْ بَيْعِ حَبَلِ الْحَبَلَةِ وَكَانَ بَيْعًا يَتَبَايَعُهُ أَهْلُ الْجَاهِلِيَّةِ كَانَ الرَّجُلُ يَبْتَاعُ الْجَزُورَ إِلَى أَنْ تُنْتَجَ النَّاقَةُ ثُمَّ تُنْتَجُ الَّتِي فِي بَطْنِهَا
21.4 The prohibition of urging a buyer to cancel a purchase in order to sell him one's own goods; And urging a seller to cancel a sale already agreed upon so that one can buy the goods oneself; And the prohibition of artificially inflating prices; And the prohibition of letting milk accumulate in the udder in order to deceive the purchaser
٢١۔٤ باب تَحْرِيمِ بَيْعِ الرَّجُلِ عَلَى بَيْعِ أَخِيهِ وَسَوْمِهِ عَلَى سَوْمِهِ وَتَحْرِيمِ النَّجْشِ وَتَحْرِيمِ التَّصْرِيَةِ
Messenger of Allah ﷺ said, "Do not urge somebody to return what he has already bought (i.e. in optional sale) from another seller so as to sell him your own goods."
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ لاَ يَبِيعُ بَعْضُكُمْ عَلَى بَيْعِ أَخِيهِ
Messenger of Allah ﷺ said, "Do not go forward to meet the caravan (to buy from it on the way before it reaches the town). And do not urge buyers to cancel their purchases to sell them (your own goods) yourselves, and do not practice Najsh. A town dweller should not sell the goods for the desert dweller. Do not leave sheep unmilked for a long time, when they are on sale, and whoever buys such an animal has the option of returning it, after milking it, along with a Sa of dates or keeping it. it has been kept unmilked for a long period by the seller (to deceive others).
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ لاَ تَلَقَّوُا الرُّكْبَانَ وَلاَ يَبِيعُ بَعْضُكُمْ عَلَى بَيْعِ بَعْضٍ وَلاَ تَنَاجَشُوا وَلاَ يَبِيعُ حَاضِرٌ لِبَادٍ وَلاَ تُصَرُّوا الْغَنَمَ وَمَنِ ابْتَاعَهَا فَهْوَ بِخَيْرِ النَّظَرَيْنِ بَعْدَ أَنْ يَحْتَلِبَهَا إِنْ رَضِيَهَا أَمْسَكَهَا وَإِنْ سَخِطَهَا رَدَّهَا وَصَاعًا مِنْ تَمْرٍ
Messenger of Allah ﷺ forbade (1) the meeting of the caravan (of goods) on the way, (2) and that a residing person buys for a bedouin, (3) and that a woman stipulates the divorce of the wife of the would-be husband, (4) and that a man tries to cause the cancellation of a bargain concluded by another. He also forbade An-Najsh (see Hadith 824) and that one withholds the milk in the udder of the animal so that he may deceive people on selling it.
نَهَى رَسُولُ اللَّهِ ﷺ عَنِ التَّلَقِّي وَأَنْ يَبْتَاعَ الْمُهَاجِرُ لِلأَعْرَابِيِّ وَأَنْ تَشْتَرِطَ الْمَرْأَةُ طَلاَقَ أُخْتِهَا وَأَنْ يَسْتَامَ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ وَنَهَى عَنِ النَّجْشِ وَعَنِ التَّصْرِيَةِ
21.5 The prohibition of intercepting traders
٢١۔٥ باب تَحْرِيمِ تَلَقِّي الْجَلَبِ
Whoever buys a sheep which has not been milked for a long time, has the option of returning it along with one Sa of dates; and the Prophet ﷺ forbade going to meet the seller on the way (as he has no knowledge of the market price and he may sell his goods at a low price).
مَنِ اشْتَرَى شَاةً مُحَفَّلَةً فَرَدَّهَا فَلْيَرُدَّ مَعَهَا صَاعًا وَنَهَى النَّبِيُّ ﷺ أَنْ تُلَقَّى الْبُيُوعُ
21.6 The prohibition of the town-dweller selling on behalf of a bedouin
٢١۔٦ باب تَحْرِيمِ بَيْعِ الْحَاضِرِ لِلْبَادِي
Ibn ʿAbbas said, "Messenger of Allah ﷺ said, 'Do not go to meet the caravans on the way (for buying their goods without letting them know the market price); a town dweller should not sell the goods of a desert dweller on behalf of the latter.' I asked Ibn ʿAbbas, 'What does he mean by not selling the goods of a desert dweller by a town dweller?' He said, 'He should not become his broker.' "
قَالَ رَسُولُ اللَّهِ ﷺ لاَ تَلَقَّوُا الرُّكْبَانَ وَلاَ يَبِيعُ حَاضِرٌ لِبَادٍ قَالَ فَقُلْتُ لاِبْنِ عَبَّاسٍ مَا قَوْلُهُ لاَ يَبِيعُ حَاضِرٌ لِبَادٍ قَالَ لاَ يَكُونُ لَهُ سِمْسَارًا
21.8 It is invalid to sell goods before taking possession of them
٢١۔٨ باب بُطْلاَنِ بَيْعِ الْمَبِيعِ قَبْلَ الْقَبْضِ
The Prophet ﷺ forbade the selling of foodstuff before receiving it. I consider that all types of sellings should be done similarly.
سَمِعْتُ ابْنَ عَبَّاسٍ ؓ يَقُولُ أَمَّا الَّذِي نَهَى عَنْهُ النَّبِيُّ ﷺ فَهْوَ الطَّعَامُ أَنْ يُبَاعَ حَتَّى يُقْبَضَ قَالَ ابْنُ عَبَّاسٍ وَلاَ أَحْسِبُ كُلَّ شَىْءٍ إِلاَّ مِثْلَهُ
Messenger of Allah ﷺ said, "He who buys foodstuff should not sell it till he is satisfied with the measure with which he has bought it.
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ مَنِ ابْتَاعَ طَعَامًا فَلاَ يَبِيعُهُ حَتَّى يَسْتَوْفِيَهُ
Some people used to buy foodstuff at the head of the market and used to sell it on the spot. Allah's Apostle forbade them to sell it till they brought it to (their) places.
كَانُوا يَبْتَاعُونَ الطَّعَامَ فِي أَعْلَى السُّوقِ فَيَبِيعُونَهُ فِي مَكَانِهِمْ فَنَهَاهُمْ رَسُولُ اللَّهِ ﷺ أَنْ يَبِيعُوهُ فِي مَكَانِهِ حَتَّى يَنْقُلُوهُ
21.10 Affirming that both parties to a transaction have the option (of canceling it) while they are still together
٢١۔١٠ باب ثُبُوتِ خِيَارِ الْمَجْلِسِ لِلْمُتَبَايِعَيْنِ
Messenger of Allah ﷺ said, "Both the buyer and the seller have the option of canceling or confirming a bargain unless they separate, or the sale is optional." (See Hadith No.320).
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ الْمُتَبَايِعَانِ كُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ عَلَى صَاحِبِهِ مَا لَمْ يَتَفَرَّقَا إِلاَّ بَيْعَ الْخِيَارِ
Messenger of Allah ﷺ said, "Both the buyer and the seller have the option of canceling or confirming the bargain, as long as they are still together; and unless they separate or one of them gives the other the option of keeping or returning the things and a decision is concluded then, in which case the bargain is considered final. If they separate after the bargain and none of them has rejected it, then the bargain is rendered final."
عَنْ رَسُولِ اللَّهِ ﷺ أَنَّهُ قَالَ إِذَا تَبَايَعَ الرَّجُلاَنِ فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا وَكَانَا جَمِيعًا أَوْ يُخَيِّرُ أَحَدُهُمَا الآخَرَ فَتَبَايَعَا عَلَى ذَلِكَ فَقَدْ وَجَبَ الْبَيْعُ وَإِنْ تَفَرَّقَا بَعْدَ أَنْ يَتَبَايَعَا وَلَمْ يَتْرُكْ وَاحِدٌ مِنْهُمَا الْبَيْعَ فَقَدْ وَجَبَ الْبَيْعُ
21.11 Honesty in selling and disclosure of defects
٢١۔١١ باب الصِّدْقِ فِي الْبَيْعِ وَالْبَيَانِ
The etiquette of transactions where an honest exchange of goods is blessed
Messenger of Allah ﷺ said, "The seller and the buyer have the right to keep or return goods as long as they have not parted or till they part; and if both the parties spoke the truth and described the defects and qualities (of the goods), then they would be blessed in their transaction, and if they told lies or hid something, then the blessings of their transaction would be lost."
قَالَ رَسُولُ اللَّهِ ﷺ: «الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا» أَوْ قَالَ «حَتَّى يَتَفَرَّقَا۔ فَإِنْ صَدَقَا وَبَيَّنَا بُورِكَ لَهُمَا فِي بَيْعِهِمَا وَإِنْ كَتَمَا وَكَذَبَا مُحِقَتْ بَرَكَةُ بَيْعِهِمَا۔»
21.12 One who is deceived in transactions
٢١۔١٢ باب مَنْ يُخْدَعُ فِي الْبَيْعِ
A person came to the Prophet ﷺ and told him that he was always betrayed in purchasing. The Prophet ﷺ told him to say at the time of buying, "No cheating."
أَنَّ رَجُلاً ذَكَرَ لِلنَّبِيِّ ﷺ أَنَّهُ يُخْدَعُ فِي الْبُيُوعِ فَقَالَ إِذَا بَايَعْتَ فَقُلْ لاَ خِلاَبَةَ
21.13 The prohibition of selling produce before its goodness appears
٢١۔١٣ باب النَّهْىِ عَنْ بَيْعِ الثِّمَارِ، قَبْلَ بُدُوِّ صَلاَحِهَا بِغَيْرِ شَرْطِ الْقَطْعِ
Messenger of Allah ﷺ forbade the sale of fruits till their benefit is evident. He forbade both the seller and the buyer (such sale).
أَنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنْ بَيْعِ الثِّمَارِ حَتَّى يَبْدُوَ صَلاَحُهَا نَهَى الْبَائِعَ وَالْمُبْتَاعَ
The Prophet ﷺ forbade the selling of fruits unless they get ripe, and none of them should be sold except for Dinar or Dirham (i.e. money), except the 'Araya trees (the dates of which could be sold for dates).
نَهَى النَّبِيُّ ﷺ عَنْ بَيْعِ الثَّمَرِ حَتَّى يَطِيبَ وَلاَ يُبَاعُ شَىْءٌ مِنْهُ إِلاَّ بِالدِّينَارِ وَالدِّرْهَمِ إِلاَّ الْعَرَايَا
I asked Ibn ʿUmar about Salam for dates. Ibn ʿUmar replied, "The Prophet ﷺ forbade the sale (the fruits) of date-palms until they were fit for eating and also forbade the sale of silver for gold on credit." I also asked Ibn ʿAbbas about it. Ibn ʿAbbas replied, "The Prophet ﷺ forbade the sale of dates till they were fit for eating, and could be weighed." I asked him, "What is to be weighed (as the dates are on the trees)?" A man sitting by Ibn ʿAbbas said, "It means till they are cut and stored."
نَهَى النَّبِيُّ ﷺ عَنْ بَيْعِ الثَّمَرِ حَتَّى يَصْلُحَ وَنَهَى عَنِ الْوَرِقِ بِالذَّهَبِ نَسَاءً بِنَاجِزٍ وَسَأَلْتُ ابْنَ عَبَّاسٍ فَقَالَ نَهَى النَّبِيُّ ﷺ عَنْ بَيْعِ النَّخْلِ حَتَّى يَأْكُلَ أَوْ يُؤْكَلَ وَحَتَّى يُوزَنَ قُلْتُ وَمَا يُوزَنُ قَالَ رَجُلٌ عِنْدَهُ حَتَّى يُحْرَزَ
21.14 The prohibition of selling fresh dates in exchange for dry dates except in the case of 'Araya
٢١۔١٤ باب تَحْرِيمِ بَيْعِ الرُّطَبِ بِالتَّمْرِ إِلاَّ فِي الْعَرَايَا
Messenger of Allah ﷺ al lowed the owner of 'Araya to sell the fruits on the trees by means of estimation.
أَنَّ رَسُولَ اللَّهِ ﷺ أَرْخَصَ لِصَاحِبِ الْعَرِيَّةِ أَنْ يَبِيعَهَا بِخَرْصِهَا
Messenger of Allah ﷺ forbade the selling of fruits (fresh dates) for dried dates but allowed the sale of fruits on the 'Araya by estimation and their new owners might eat their dates fresh. Sufyan (in another narration) said, "I told Yahya (a sub-narrator) when I was a mere boy, 'Meccans say that the Prophet ﷺ allowed them the sale of the fruits on 'Araya by estimation.' Yahya asked, 'How do the Meccans know about it?' I replied, 'They narrated it (from the Prophet ﷺ ) through Jabir.' On that, Yahya kept quiet." Sufyan said, "I meant that Jabir belonged to Medina." Sufyan was asked whether in Jabir's narration there was any prohibition of selling fruits before their benefit is evident (i.e. no dangers of being spoilt or blighted). He replied that there was none.
أَنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنْ بَيْعِ الثَّمَرِ بِالتَّمْرِ وَرَخَّصَ فِي الْعَرِيَّةِ أَنْ تُبَاعَ بِخَرْصِهَا يَأْكُلُهَا أَهْلُهَا رُطَبًا وَقَالَ سُفْيَانُ مَرَّةً أُخْرَى إِلاَّ أَنَّهُ رَخَّصَ فِي الْعَرِيَّةِ يَبِيعُهَا أَهْلُهَا بِخَرْصِهَا يَأْكُلُونَهَا رُطَبًا قَالَ هُوَ سَوَاءٌ قَالَ سُفْيَانُ فَقُلْتُ لِيَحْيَى وَأَنَا غُلاَمٌ إِنَّ أَهْلَ مَكَّةَ يَقُولُونَ إِنَّ النَّبِيَّ ﷺ رَخَّصَ فِي بَيْعِ الْعَرَايَا فَقَالَ وَمَا يُدْرِي أَهْلَ مَكَّةَ قُلْتُ إِنَّهُمْ يَرْوُونَهُ عَنْ جَابِرٍ فَسَكَتَ قَالَ سُفْيَانُ إِنَّمَا أَرَدْتُ أَنَّ جَابِرًا مِنْ أَهْلِ الْمَدِينَةِ قِيلَ لِسُفْيَانَ وَلَيْسَ فِيهِ نَهْىٌ عَنْ بَيْعِ الثَّمَرِ حَتَّى يَبْدُوَ صَلاَحُهُ قَالَ لاَ
Messenger of Allah ﷺ forbade the sale of Muzabana, i.e. selling of fruits for fruits, except in the case of 'Araya; he allowed the owners of 'Araya such kind of sale.
أَنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنِ الْمُزَابَنَةِ بَيْعِ الثَّمَرِ بِالتَّمْرِ إِلاَّ أَصْحَابَ الْعَرَايَا فَإِنَّهُ أَذِنَ لَهُمْ قَالَ أَبُو عَبْدِ اللَّهِ وَقَالَ ابْنُ إِسْحَاقَ حَدَّثَنِي بُشَيْرٌ مِثْلَهُ
The Prophet ﷺ allowed the sale of the dates of 'Araya provided they were about five Awsuq (singular: Wasaq which means sixty Sa's) or less (in amount).
أَنَّ النَّبِيَّ ﷺ رَخَّصَ فِي بَيْعِ الْعَرَايَا فِي خَمْسَةِ أَوْسُقٍ أَوْ دُونَ خَمْسَةِ أَوْسُقٍ قَالَ نَعَمْ
Messenger of Allah ﷺ forbade Muzabana; and Muzabana is the selling of fresh dates for dried old dates by measure, and the selling of fresh grapes for dried grapes by measure.
أَنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنِ الْمُزَابَنَةِ وَالْمُزَابَنَةُ بَيْعُ الثَّمَرِ بِالتَّمْرِ كَيْلاً وَبَيْعُ الزَّبِيبِ بِالْكَرْمِ كَيْلاً
Messenger of Allah ﷺ forbade Al-Muzabana, i.e. to sell ungathered dates of one's garden for measured dried dates or fresh ungathered grapes for measured dried grapes; or standing crops for measured quantity of foodstuff. He forbade all such bargains.
نَهَى رَسُولُ اللَّهِ ﷺ عَنِ الْمُزَابَنَةِ أَنْ يَبِيعَ ثَمَرَ حَائِطِهِ إِنْ كَانَ نَخْلاً بِتَمْرٍ كَيْلاً وَإِنْ كَانَ كَرْمًا أَنْ يَبِيعَهُ بِزَبِيبٍ كَيْلاً أَوْ كَانَ زَرْعًا أَنْ يَبِيعَهُ بِكَيْلِ طَعَامٍ وَنَهَى عَنْ ذَلِكَ كُلِّهِ
21.15 One who sells date palms on which there are dates
٢١۔١٥ باب مَنْ بَاعَ نَخْلاً عَلَيْهَا ثَمَرٌ
Messenger of Allah ﷺ said, "If somebody sells pollinated date palms, the fruits will be for the seller unless the buyer stipulates that they will be for himself (and the seller agrees).
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ مَنْ بَاعَ نَخْلاً قَدْ أُبِّرَتْ فَثَمَرُهَا لِلْبَائِعِ إِلاَّ أَنْ يَشْتَرِطَ الْمُبْتَاعُ
21.16 The prohibition of Muhaqalah and Muzabanah and Mukhabarah: and selling produce before its goodness appears, and Mu'awamah: which is selling years in advance
٢١۔١٦ باب النَّهْيِ عَنِ الْمُحَاقَلَةِ وَالْمُزَابَنَةِ وَعَنِ الْمُخَابَرَةِ وَبَيْعِ الثَّمَرَةِ قَبْلَ بُدُوِّ صَلاَحِهَا وَعَنْ بَيْعِ الْمُعَاوَمَةِ وَهُوَ بَيْعُ السِّنِينَ
21.17 Kira (leasing Land)
٢١۔١٧ باب كِرَاءِ الأَرْضِ
Some men had superfluous land and they said that they would give it to others to cultivate on the condition that they would get one-third or one-fourth or one half of its yield. The Prophet ﷺ said, "Whoever has land should cultivate it himself or give it to his brother or keep it uncultivated."
كَانَتْ لِرِجَالٍ مِنَّا فُضُولُ أَرَضِينَ فَقَالُوا نُؤَاجِرُهَا بِالثُّلُثِ وَالرُّبُعِ وَالنِّصْفِ فَقَالَ النَّبِيُّ ﷺ مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا أَوْ لِيَمْنَحْهَا أَخَاهُ فَإِنْ أَبَى فَلْيُمْسِكْ أَرْضَهُ
The people used to rent their land for cultivation for one-third, one-fourth or half its yield. The Prophet said, "Whoever has land should cultivate it himself or give it to his (Muslim) brother gratis; otherwise keep it uncultivated." Narrated Abu Huraira: Messenger of Allah ﷺ said, "Whoever has land should cultivate it himself or give it to his (Muslim) brother gratis; otherwise he should keep it uncultivated."
النَّبِيُّ ﷺ مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا أَوْ لِيَمْنَحْهَا فَإِنْ لَمْ يَفْعَلْ فَلْيُمْسِكْ أَرْضَهُ وَقَالَ الرَّبِيعُ بْنُ نَافِعٍ أَبُو تَوْبَةَ حَدَّثَنَا مُعَاوِيَةُ عَنْ يَحْيَى عَنْ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ ؓ قَالَ قَالَ رَسُولُ اللَّهِ ﷺ مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا أَوْ لِيَمْنَحْهَا أَخَاهُ فَإِنْ أَبَى فَلْيُمْسِكْ أَرْضَهُ
Messenger of Allah ﷺ forbade Muzabana and Muhaqala; and Muzabana means the selling of ripe dates for dates still on the trees.
عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ ؓ أَنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنِ الْمُزَابَنَةِ وَالْمُحَاقَلَةِ وَالْمُزَابَنَةُ اشْتِرَاءُ الثَّمَرِ بِالتَّمْرِ فِي رُءُوسِ النَّخْلِ
Ibn ʿUmar used to rent his farms in the time of Abu Bakr, ʿUmar, ʿUthman, and in the early days of Muawiya. Then he was told the narration of Rafiʿ 'bin Khadij that the Prophet ﷺ had forbidden the renting of farms. Ibn ʿUmar went to Rafiʿ and I accompanied him. He asked Rafiʿ who replied that the Prophet had forbidden the renting of farms. Ibn ʿUmar said, "You know that we used to rent our farms in the lifetime of Messenger of Allah ﷺ for the yield of the banks of the water streams (rivers) and for certain amount of figs.
أَنَّ ابْنَ عُمَرَ ؓ كَانَ يُكْرِي مَزَارِعَهُ عَلَى عَهْدِ النَّبِيِّ ﷺ وَأَبِي بَكْرٍ وَعُمَرَ وَعُثْمَانَ وَصَدْرًا مِنْ إِمَارَةِ مُعَاوِيَةَ ثُمَّ حُدِّثَ عَنْ رَافِعِ بْنِ خَدِيجٍ أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ كِرَاءِ الْمَزَارِعِ فَذَهَبَ ابْنُ عُمَرَ إِلَى رَافِعٍ فَذَهَبْتُ مَعَهُ فَسَأَلَهُ فَقَالَ نَهَى النَّبِيُّ ﷺ عَنْ كِرَاءِ الْمَزَارِعِ فَقَالَ ابْنُ عُمَرَ قَدْ عَلِمْتَ أَنَّا كُنَّا نُكْرِي مَزَارِعَنَا عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ بِمَا عَلَى الأَرْبِعَاءِ وَبِشَىْءٍ مِنَ التِّبْنِ
21.18 Leasing out Land (Kira) in return for food
٢١۔١٨ باب كِرَاءِ الأَرْضِ بِالطَّعَامِ
My uncle Zuhair said, "Messenger of Allah ﷺ forbade us to do a thing which was a source of help to us." I said, "Whatever Messenger of Allah ﷺ said was right." He said, "Messenger of Allah ﷺ sent for me and asked, 'What are you doing with your farms?' I replied, 'We give our farms on rent on the basis that we get the yield produced at the banks of the water streams (rivers) for the rent, or rent it for some Wasqs of barley and dates.' Messenger of Allah ﷺ said, 'Do not do so, but cultivate (the land) yourselves or let it be cultivated by others gratis, or keep it uncultivated.' I said, 'We hear and obey.'
ظُهَيْرٌ لَقَدْ نَهَانَا رَسُولُ اللَّهِ ﷺ عَنْ أَمْرٍ كَانَ بِنَا رَافِقًا قُلْتُ مَا قَالَ رَسُولُ اللَّهِ ﷺ فَهْوَ حَقٌّ قَالَ دَعَانِي رَسُولُ اللَّهِ ﷺ قَالَ مَا تَصْنَعُونَ بِمَحَاقِلِكُمْ قُلْتُ نُؤَاجِرُهَا عَلَى الرُّبُعِ وَعَلَى الأَوْسُقِ مِنَ التَّمْرِ وَالشَّعِيرِ قَالَ لا تَفْعَلُوا ازْرَعُوهَا أَوْ أَزْرِعُوهَا أَوْ أَمْسِكُوهَا قَالَ رَافِعٌ قُلْتُ سَمْعًا وَطَاعَةً
21.21 Lending Land
٢١۔٢١ باب الأَرْضِ تُمْنَحُ
When I mentioned it (i.e. the narration of Rafiʿ 'bin Khadij: no. 532) to Tawus, he said, "It is permissible to rent the land for cultivation, for Ibn ʿAbbas said, 'The Prophet ﷺ did not forbid that, but said: One had better give the land to one's brother gratis rather than charge a certain amount for it.' "
