ذِكْرُ الْبَيَانِ بِأَنَّ الْعَقْدَ إِذَا وَقَعَ بَيْنَ الْمُسْلِمِينَ وَأَهْلِ الْحَرْبِ لَا يَحِلُّ نَقْضُهُ إِلَّا عِنْدَ الْإِعْلَامِ أَوِ انْقِضَاءِ الْمُدَّةِ

[Machine] There was a treaty between Muawiyah and the Romans, and he used to travel towards their lands while intending, once the treaty was fulfilled, to change it upon them. Then a sheikh (an elderly man) would say, "Allahu Akbar! Allahu Akbar! No treachery!" And it was Amr ibn Abasa. So, I asked him, and he said, "I heard the Messenger of Allah ﷺ saying, 'If there is a treaty between people, it is not permissible to break it until its term has expired or it is mutually agreed upon.'"  

ابن حبّان:٤٨٧١أَخْبَرَنَا حَامِدُ بْنُ مُحَمَّدِ بْنِ شُعَيْبٍ حَدَّثَنَا سُرَيْجُ بْنُ يُونُسَ حَدَّثَنَا مُحَمَّدُ بْنُ يَزِيدَ حَدَّثَنَا شُعْبَةُ عَنْ أَبِي الْفَيْضِ عَنْ سُلَيْمِ بْنِ عَامِرٍ قَالَ

كَانَ بَيْنَ مُعَاوِيَةَ وَبَيْنَ الرُّومِ عَقْدٌ وَكَانَ يَسِيرُ نَحْوَ بِلَادِهِمْ وَهُوَ يُرِيدُ إِذَا انْقَضَى الْعَقْدُ أَنْ يُغِيرَ عَلَيْهِمْ فَإِذَا شَيْخٌ يَقُولُ اللَّهُ أَكْبَرُ اللَّهُ أَكْبَرُ لَا غَدْرَ فَإِذَا هُوَ عَمْرُو بْنُ عَبَسَةَ فَسَأَلْتُهُ فَقَالَ سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «إِذَا كَانَ بَيْنَ قَوْمٍ عَقْدٌ فَلَا يَحُلُّ عُقْدَةٌ حَتَّى يَمْضِيَ أَمَدُهَا أَوْ يُنْبَذَ إِلَيْهِمْ عَلَى سَوَاءٍ»

[Machine] Muawiyah was traveling in the land of the Romans and there was a distance between him and them. He intended to approach them, so when the distance was over, he attacked them. Then, a sheikh on a horse said, "Allahu Akbar (Allah is the Greatest), Allahu Akbar, loyalty, not treachery. Indeed, the Messenger of Allah ﷺ said: "Whoever has a covenant with a people should not untie it or tighten it until its term is over, or he comes to an agreement with them." Muawiyah heard this and returned, and there was Amr bin Abasa.

كَانَ مُعَاوِيَةُ يَسِيرُ بِأَرْضِ الرُّومِ وَكَانَ بَيْنَهُمْ وَبَيْنَهُ أَمَدٌ فَأَرَادَ أَنْ يَدْنُوَ مِنْهُمْ فَإِذَا انْقَضَى الْأَمَدُ غَزَاهُمْ فَإِذَا شَيْخٌ عَلَى دَابَّةٍ يَقُولُ اللهُ أَكْبَرُ اللهُ أَكْبَرُ وَفَاءٌ لَا غَدْرٌ إِنَّ رَسُولَ اللهِ ﷺقَالَ مَنْ كَانَ بَيْنَهُ وَبَيْنَ قَوْمٍ عَهْدٌ فَلَا يَحِلَّنَّ عُقْدَةً وَلَا يَشُدَّهَا حَتَّى يَنْقَضِيَ أَمَدُهَا أَوْ يَنْبِذَ إِلَيْهِمْ عَلَى سَوَاءٍ فَبَلَغَ ذَلِكَ مُعَاوِيَةَ فَرَجَعَ وَإِذَا الشَّيْخُ عَمْرُو بْنُ عَبَسَةَ

[Machine] There was a covenant between Muawiyah and a group of people from the Romans. Muawiyah went out and started walking in their land until they violated the covenant, so he changed his attitude towards them. Then a man called out among the people, saying, "Verily, it is fidelity, not treachery!" It was Amr ibn Abasa, who said, "I heard the Messenger of Allah, ﷺ , saying, 'Whoever has a covenant with a people, should not tighten its knot, nor undo it until its appointed time is concluded or he breaks it equally with them.'"

كَانَ بَيْنَ مُعَاوِيَةَ وَبَيْنَ قَوْمٍ مِنَ الرُّومِ عَهْدٌ فَخَرَجَ مُعَاوِيَةُ قَالَ فَجَعَلَ يَسِيرُ فِي أَرْضِهِمْ حَتَّى يَنْقُضُوا فَيُغِيرَ عَلَيْهِمْ فَإِذَا رَجُلٌ يُنَادِي فِي نَاحِيَةِ النَّاسِ وَفَاءٌ لَا غَدْرٌ فَإِذَا هُوَ عَمْرُو بْنُ عَبَسَةَ فَقَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ كَانَ بَيْنَهُ وَبَيْنَقَوْمٍ عَهْدٌ فَلَا يَشِدَّ عُقْدَةً وَلَا يَحُلُّهَا حَتَّى يَمْضِيَ أَمَدُهَا أَوْ يَنْبِذَ إِلَيْهِمْ عَلَى سَوَاءٍ
