37.22 If somebody rents land and he or the owner dies
٣٧۔٢٢ باب إِذَا اسْتَأْجَرَ أَرْضًا فَمَاتَ أَحَدُهُمَا
[Machine] Ibn Seerin said that it is not for one's family to expel him until the end of his term. Al-Hakam, Al-Hasan, and Iyas ibn Muawiya said that the lease is valid until its term expires. Ibn 'Umar said that the Prophet ﷺ gave Khaibar as a lease for half of its yield. This occurred during the time of the Prophet ﷺ, Abu Bakr, and a period of Umar's caliphate, and it is not mentioned that Abu Bakr and Umar renewed the lease after the death of the Prophet ﷺ.
وَقَالَ ابْنُ سِيرِينَ لَيْسَ لأَهْلِهِ أَنْ يُخْرِجُوهُ إِلَى تَمَامِ الأَجَلِ. وَقَالَ الْحَكَمُ وَالْحَسَنُ وَإِيَاسُ بْنُ مُعَاوِيَةَ تُمْضَى الإِجَارَةُ إِلَى أَجَلِهَا. وَقَالَ ابْنُ عُمَرَ أَعْطَى النَّبِيُّ ﷺ خَيْبَرَ بِالشَّطْرِ، فَكَانَ ذَلِكَ عَلَى عَهْدِ النَّبِيِّ ﷺ وَأَبِي بَكْرٍ وَصَدْرًا مِنْ خِلاَفَةِ عُمَرَ، وَلَمْ يُذْكَرْ أَنَّ أَبَا بَكْرٍ وَعُمَرَ جَدَّدَا الإِجَارَةَ بَعْدَ مَا قُبِضَ النَّبِيُّ ﷺ.
