"عَنْ الْحَسَنِ: أَنَّ عَلِىَّ بْنَ أَبِى طَالِبٍ قَالَ: مَا أَحَدٌ يَمُوتُ فِى حَدٍّ مِنَ الْحُدُودِ، فَأَجِدُ فِى نَفْسِى مِنْهُ شيْئًا، إِلَّا الَّذِى يَمُوتُ فِى حَدِّ الْخَمْرِ، فَإنَّهُ شَىْءٌ أَحْدَثْنَاهُ بَعْدَ النَّبِىِّ - ﷺ - فَمَنْ مَاتَ مِنهُ فَدِيَتُهُ إِمَّا قَالَ: فِى بَيْتِ الْمَالِ، وَإِمَّا قَالَ: عَلَى عَاقِلَةِ الإِمامِ".
[Machine] Someone dies within the limits of the boundaries, and I find in myself no objection to it except for the one who dies in the limits of alcohol. Indeed, it is something that we mentioned after the Prophet ﷺ. So whoever dies from it, his blood money is either said to be in the Beit al-Mal or said to be on the discretion of the Imam. I doubt it refers to Imam Ash-Shafi'i. Ash-Shafi'i said and it has reached us that Umar ibn Al-Khattab sent to a woman who got scared and miscarried her fetus. She consulted Ali, and he gestured that she should be killed. Umar commanded Ali and said, "I have made up my mind about you to decide the matter for your people."
