malik:36-55Mālik > Ibn Shihāb > ʿUrwah b. al-Zubayr

Malik related to me from Ibn Shihab from Urwa ibn az-Zubayr that A'isha, the wife of the Prophet ﷺ said, "Abu Bakr as-Siddiq gave me palm trees whose produce was twenty awsuq from his property at al-Ghaba. When he was dying, he said, 'By Allah, little daughter, there is no one I would prefer to be wealthy after I die than you. There is no one it is more difficult for me to see poor after I die than you. I gave you palm-trees whose produce is twenty awsuq. Had you cut them and taken possession of them, they would have been yours, but today they are the property of the heirs, and they are your two brothers and your two sisters, so divide it according to the Book of Allah.' A'isha continued, "I said, 'My father! By Allah, even if it had been more, I would have left it. There is only Asma. Who is my other sister?" Abu Bakr replied, 'What is in the womb of Kharija? (Kharija was the wife of Abu Bakr's 'brother' from the Ansar.) I think that it is going to be a girl.' "  

مالك:٣٦-٥٥وَحَدَّثَنِي مَالِكٌ عَنِ ابْنِ شِهَابٍ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ

عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ أَنَّهَا قَالَتْ إِنَّ أَبَا بَكْرٍ الصِّدِّيقَ كَانَ نَحَلَهَا جَادَّ عِشْرِينَ وَسْقًا مِنْ مَالِهِ بِالْغَابَةِ فَلَمَّا حَضَرَتْهُ الْوَفَاةُ قَالَ وَاللَّهِ يَا بُنَيَّةُ مَا مِنَ النَّاسِ أَحَدٌ أَحَبُّ إِلَىَّ غِنًى بَعْدِي مِنْكِ وَلاَ أَعَزُّ عَلَىَّ فَقْرًا بَعْدِي مِنْكِ وَإِنِّي كُنْتُ نَحَلْتُكِ جَادَّ عِشْرِينَ وَسْقًا فَلَوْ كُنْتِ جَدَدْتِيهِ وَاحْتَزْتِيهِ كَانَ لَكِ وَإِنَّمَا هُوَ الْيَوْمَ مَالُ وَارِثٍ وَإِنَّمَا هُمَا أَخَوَاكِ وَأُخْتَاكِ فَاقْتَسِمُوهُ عَلَى كِتَابِ اللَّهِ قَالَتْ عَائِشَةُ فَقُلْتُ يَا أَبَتِ وَاللَّهِ لَوْ كَانَ كَذَا وَكَذَا لَتَرَكْتُهُ إِنَّمَا هِيَ أَسْمَاءُ فَمَنِ الأُخْرَى فَقَالَ أَبُو بَكْرٍ ذُو بَطْنِ بِنْتِ خَارِجَةَ أُرَاهَا جَارِيَةً

I married you with twenty gold coins from my own money. If you wish to keep it and preserve it, then it belongs to you. But indeed, it is the wealth of the inheritor, and it is your brothers and sisters, so divide it according to the Book of Allah.' I said, 'O my father, by Allah, if it was like this and that, I would leave it. This is only names, so who is the other one?' He said, 'Dhu Batn bint Kharijah, whom I see as a maid servant.' Ibn Wahb informed me that Abdullah bin Umar narrated from Abdul Rahman bin Al-Qasim from his father, who narrated from Aisha, may Allah be pleased with her, that she said: 'Ibn Wahb also informed me that Hanzala bin Abi Sufyan narrated that he heard Qasim bin Muhammad narrating the same, except that he said, 'It is a piece of land called Tamrad, which he did not sell.'"

[Machine] The wife of the Prophet ﷺ said, "Indeed, Abu Bakr is truthful." He said in reference to the clothes he donated to him, "If you had sewed them or torn them, they would have been yours. But today, they belong to the heirs. And they are your brothers and sisters. So divide them according to the Book of Allah." Aisha said, "By Allah, O father, if it was like this and that, I would have left it. These are only names, so who is the other one?" He said, "It is Zainab bint Khuzaimah whom I see as a girl."

"عَنْ عائشة قالت: لمَّا حَضَرَتْ أبا بكر الوفاةُ قال: أَىْ بُنَيَّةُ؟ إِنَّهُ لَيْسَ أحَدٌ أَحَبَّ إِلَىَّ غِنًى مِنْكِ، وَلَا أَعَزَّ عَلَىَّ فَقْرًا مِنْكِ، وَإِنِّى قَدْ كُنْتُ نَحَلْتُكِ جِدَادَ عِشْرِينَ وَسْقًا مِنْ أَرْضِى الَّتِى بالْغَابَة، وإنَّكِ لَوْ كُنْتِ حُزْتِيهِ كَانَ لَكِ، فَإِذَا لَمْ تفْعَلِى فَإِنَّمَا هُوَ لِلْوَارِثِ، وَإِنَّمَا هُمَا أَخَوَاكِ وَأُخْتَاكِ، قلت: هَلْ هِىَ إِلَّا أُمُّ عَبْدِ الله؟ قال: نَعَمْ، وَذُو بَطْنِ ابْنَةِ خَارِجَةَ قَدْ أُلْقِىَ فِى نَفْسِى أَنَّهَا جَارِيَةٌ، فَأَحْسِنُوا إِلَيْهَا، فَوَلَدَتْ أُمَّ كُلْثُومٍ".
