ذِكْرُ وَصْفِ مَاعِزِ بْنِ مَالِكٍ الْمَرْجُومِ فِي حَيَاةِ رَسُولِ اللَّهِ ﷺ

[Machine] He witnessed the Messenger of Allah ﷺ and a man with curly, short hair and muscular body was brought to him confessing to adultery. The Messenger of Allah ﷺ asked him twice and then ordered to stone him, saying, "Every time we go on a military expedition for the sake of Allah, one of you falls behind with a young she-goat as his mate. Surely, I will not spare any of them, but will ensure their punishment." Perhaps he said, "Simak, unless I do not carry out the punishment on him." He said, "Simak," so I mentioned it to Sa'id bin Jubair and he said, "The Prophet ﷺ ordered to return him four times." Shu'bah said, "Al-Hakam said it is recommended to return him four times." Hammad said, "Once."  

ابن حبّان:٤٤٣٦أَخْبَرَنَا سُلَيْمَانُ بْنُ الْحَسَنِ الْعَطَّارُ بِالْبَصْرَةِ قَالَ حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ مُعَاذِ بْنِ مُعَاذٍ قَالَ حَدَّثَنَا أَبِي قَالَ حَدَّثَنَا شُعْبَةُ عَنْ سِمَاكِ بْنِ حَرْبٍ أَنَّهُ سَمِعَ جَابِرَ بْنَ سَمُرَةَ يُحَدِّثُ

أَنَّهُ شَهِدَ رَسُولَ اللَّهِ ﷺ وَأُتِيَ بِرَجُلٍ أَشْعُرَ قَصِيرٍ ذِي عَضَلَاتٍ أَقَرَّ بِالزِّنَى فَرَدَّهُ مَرَّتَيْنِ ثُمَّ أَمَرَ بِهِ فَرُجِمَ وَقَالَ «كُلَّمَا نَفَرْنَا غَازِينَ فِي سَبِيلِ اللَّهِ يَتَخَلَّفُ أَحَدُكُمْ لَهُ نَبِيبٌ كَنَبِيبِ التَّيْسِ يَمْنَحُ إِحْدَاهُنَّ الْكُثَيْبَةَ أَمَا إِنِّي لَنْ أُوتِيَ بِأَحَدٍ مِنْهُمْ إِلَّا جَعَلْتُهُ نَكَالًا» وَرُبَّمَا قَالَ سِمَاكٌ إِلَّا نَكَّلْتُهُ قَالَ سِمَاكٌ فَذَكَرْتُهُ لِسَعِيدِ بْنِ جُبَيْرٍ فَقَالَ رَدَّهُ النَّبِيُّ ﷺ أَرْبَعَ مَرَّاتٍ قَالَ شُعْبَةُ وَقَالَ الْحَكَمُ يَنْبَغِي أَنْ يَرُدَّهُ أَرْبَعَ مَرَّاتٍ وَقَالَ حَمَّادٌ مَرَّةً

We set out for Jihad in the cause of Allah and one of you lagged behind and shrieked like the bleating of a male goat and one of then (goats' gave a small quantity of milk. In case Allah gives me power over one of them, I will punish him (in such a way that it may have a deterrent effect upon others). In another narration transmitted on the authority of Sa'id b Jubair (the words are), that He (the Holy Prophet) turned him away four times."

سَمِعْتُ جَابِرَ بْنَ سَمُرَةَ يَقُولُ أُتِيَ رَسُولُ اللَّهِ ﷺ بِرَجُلٍ قَصِيرٍ أَشْعَثَ ذِي عَضَلاَتٍ عَلَيْهِ إِزَارٌ وَقَدْ زَنَى فَرَدَّهُ مَرَّتَيْنِ ثُمَّ أَمَرَ بِهِ فَرُجِمَ فَقَالَ رَسُولُ اللَّهِ ﷺ كُلَّمَا نَفَرْنَا غَازِينَ فِي سَبِيلِ اللَّهِ تَخَلَّفَ أَحَدُكُمْ يَنِبُّ نَبِيبَ التَّيْسِ يَمْنَحُ إِحْدَاهُنَّ الْكُثْبَةَ إِنَّ اللَّهَ لاَ يُمْكِنِّي مِنْ أَحَدٍ مِنْهُمْ إِلاَّ جَعَلْتُهُ نَكَالاً أَوْ نَكَّلْتُهُ قَالَ فَحَدَّثْتُهُ سَعِيدَ بْنَ جُبَيْرٍ فَقَالَ إِنَّهُ رَدَّهُ أَرْبَعَ مَرَّاتٍ

[Machine] The Messenger of Allah ﷺ was brought a short, disheveled man with muscles, wearing a waist wrap, who had committed adultery twice. He ordered for him to be stoned. The Messenger of Allah ﷺ said, "Whenever we send a group of soldiers in the cause of Allah, one of them lags behind with a shepherd's crook, giving it to one of them as a reward for bravery. Verily, Allah will not enable me to overtake any one of them except that I will make him an example (of punishment) or I will punish him."

[Machine] He heard Jabir bin Samurah say that a man with long curly hair and strong muscles admitted to committing adultery. The Prophet Muhammad ﷺ ordered that he be stoned to death, and he said, "Whenever we go out for Jihad in the cause of Allah, if one of you lags behind, he will be struck with a reed from the she-camel. As for me, I will not punish any of you in this manner unless I make him a precedent. Perhaps someone said, 'Fish!,' but I will surely punish him."

[Machine] The Messenger of Allah ﷺ called for Ma'iz ibn Malik, a man who was rahter short, with strong muscles, and confessed to him about committing adultery. The Messenger turned away from him, but he came to him from another angle, and again the Messenger turned away from him. He said, "I don't know if it happened twice or thrice." Then, he ordered for him to be stoned. The Messenger ﷺ said, "Whenever we go out for battle, one of them will follow behind someone, his neck like that of a goat, and he would grant one of them permission to have intercourse. Indeed, Allah (SWT) would not allow me to spare anyone of them without making him an example for them or punishing him on their behalf." Saeed ibn Jubair mentioned this to me and said, "Reject it four times."  

البيهقي:١٦٩١٥أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا إِبْرَاهِيمُ بْنُ مَرْزُوقٍ الْبَصْرِيُّ ثنا أَبُو عَامِرٍ وَعُثْمَانُ بْنُ عُمَرَ قَالَا ثنا شُعْبَةُ عَنْ سِمَاكِ بْنِ حَرْبٍ عَنْ جَابِرِ بْنِ سَمُرَةَ

أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِمَاعِزِ بْنِ مَالِكٍ رَجُلٍ أَشْعَرَ قَصِيرٍ ذِي عَضَلَاتٍ فَأَقَرَّ لَهُ بِالزِّنَا فَأَعْرَضَ عَنْهُ فَأَتَاهُ مِنْ وَجْهِهِ الْآخَرِ فَأَعْرَضَ عَنْهُ قَالَ لَا أَدْرِي مَرَّتَيْنِ أَوْ ثَلَاثًا فَأَمَرَ بِهِ فَرُجِمَ وَقَالَ كُلَّمَا نَفَرْنَا غَازِينَ خَلَفَ أَحَدُهُمْ يَنِبُّ نَبِيبَ التَّيْسِ يَمْنَحُ إِحْدَاهُنَّ الْكُثْبَةَ إِنَّ اللهَ ﷻ لَا يُمَكِّنُنِي مِنْ أَحَدٍ مِنْهُمْ إِلَّا جَعَلْتُهُ نَكَالًا عَنْهُنَّ أَوْ نَكَّلْتُهُ عَنْهُنَّ قَالَ فَذَكَرْتُهُ لِسَعِيدِ بْنِ جُبَيْرٍ فَقَالَ رَدَّهُ أَرْبَعَ مَرَّاتٍ
