55.12 Can the founder of an endowment have the benefit of his endowment?
٥٥۔١٢ باب هَلْ يَنْتَفِعُ الْوَاقِفُ بِوَقْفِهِ
[Machine] "And it has been stipulated by Umar that there is no harm for anyone appointed by him to eat. And this also applies to one who dedicates his body or something for the sake of Allah, he is allowed to benefit from it just as others benefit from it, even if it was not stipulated."
وَقَدِ اشْتَرَطَ عُمَرُ ؓ لاَ جُنَاحَ عَلَى مَنْ وَلِيَهُ أَنْ يَأْكُلَ. وَقَدْ يَلِي الْوَاقِفُ وَغَيْرُهُ. وَكَذَلِكَ مَنْ جَعَلَ بَدَنَةً أَوْ شَيْئًا لِلَّهِ، فَلَهُ أَنْ يَنْتَفِعَ بِهَا كَمَا يَنْتَفِعُ غَيْرُهُ وَإِنْ لَمْ يَشْتَرِطْ.
