52.4 When a witness or witnesses give an evidence
٥٢۔٤ بَابُ إِذَا شَهِدَ شَاهِدٌ أَوْ شُهُودٌ بِشَيْءٍ فَقَالَ آخَرُونَ مَا عَلِمْنَا ذَلِكَ. يُحْكَمُ بِقَوْلِ مَنْ شَهِدَ
[Machine] Al-Humaydi said, "This is as Bilal reported, that the Prophet ﷺ prayed in the Kaaba." Al-Fadl said, "He did not pray." So the people took the testimony of Bilal. Likewise, if two witnesses testify that one person owes another person a thousand dirhams, and two other witnesses testify that it is one thousand and five hundred, the excess is settled.
قَالَ الْحُمَيْدِيُّ هَذَا كَمَا أَخْبَرَ بِلاَلٌ أَنَّ النَّبِيَّ ﷺ صَلَّى فِي الْكَعْبَةِ. وَقَالَ الْفَضْلُ لَمْ يُصَلِّ. فَأَخَذَ النَّاسُ بِشَهَادَةِ بِلاَلٍ. كَذَلِكَ إِنْ شَهِدَ شَاهِدَانِ أَنَّ لِفُلاَنٍ عَلَى فُلاَنٍ أَلْفَ دِرْهَمٍ وَشَهِدَ آخَرَانِ بِأَلْفٍ وَخَمْسِمِائَةٍ يُقْضَى بِالزِّيَادِةَ.
