27. Pilgrims Prevented from Completing the Pilgrimage

٢٧۔ كتاب المحصر

The statement of Allah Most High "But if you are prevented, then [offer] what can be obtained with ease of sacrificial animals. And do not shave your heads until the sacrificial animal has reached its place of slaughter."

When ʿAbdullah bin ʿUmar set out for Mecca intending to perform Umra, at the time of afflictions, he said, "If I should be prevented from reaching the Kaʿba, then I would do the same as Messenger of Allah ﷺ did, so I assume the lhram for Umra as Messenger of Allah ﷺ assumed the Ihram for Umra in the year of Hudaibiya."

That Ubaidullah bin ʿAbdullah and Salim bin ʿAbdullah informed him that they told Ibn ʿUmar when Ibn Az-Zubair was attacked by the army, saying "There is no harm for you if you did not perform Hajj this year. We are afraid that you may be prevented from reaching the Kaʿba." Ibn ʿUmar said "We set out with Messenger of Allah ﷺ and the non-believers of Quraish prevented us from reaching the Kaʿba, and so the Prophet ﷺ slaughtered his Hadi and got his head shaved." Ibn ʿUmar added, "I make you witnesses that I have made ʿUmra obligatory for me. And, Allah willing, I will go and then if the way to Kaʿba is clear, I will perform the Tawaf, but if I am prevented from going to the Kaʿba then I will do the same as the Prophet ﷺ did while I was in his company." Ibn ʿUmar then assumed Ihram for Umra from Dhul-Hulaifa and proceeded for a while and said, "The conditions of ʿUmra and Hajj are similar and I make you witnesses that I have made ʿUmra and Hajj obligatory for myself." So, he did not finish the Ihram till the day of Nahr (slaughtering) came, and he slaughtered his Hadi. He used to say, "I will not finish the Ihram till I perform the Tawaf, one Tawaf on the day of entering Mecca (i.e. of Safa and Marwa for both ʿUmra and Hajj).

27.4 Whoever said that the Muhsar is not supposed to perform 'Umra or Hajj in lieu of the prevented one

٢٧۔٤ باب مَنْ قَالَ لَيْسَ عَلَى الْمُحْصَرِ بَدَلٌ

[Machine] And Ruha said on the authority of Shibl, on the authority of Ibn Abi Najeeh, on the authority of Mujahid, on the authority of Ibn Abbas: "Verily, the substitution is only for those who break their Hajj due to indulgence (in desires), but as for those who are prevented (from completing their Hajj) for a valid excuse or other reasons, then it is permissible for them and they do not have to repeat (the Hajj), even if they have a sacrificial animal with them and they are confined. If they are not able to send it (to the House of Allah in Makkah), then they do not have to sacrifice it. But if they are able to send it, then it is not permissible for them (to sacrifice it) until the sacrificial animal reaches its designated place. And Malik and others said: one may sacrifice their animal and shave their hair anywhere, and there is no expiation for it, because the Prophet (ﷺ) and his companions in Hudaybiyyah sacrificed, shaved, and performed all the rituals before circumambulation and before the sacrificial animal reached the House (Ka'bah). And it is not mentioned that the Prophet (ﷺ) commanded anyone to repeat anything or seek expiation, and Hudaybiyyah is outside the sacred precincts.

bukhari:1813Ismāʿīl > Mālik > Nāfiʿ > ʿAbdullāh b. ʿUmar

When ʿAbdullah bin ʿUmar set out for Mecca with the intentions performing ʿUmra in the period of afflictions, he said, "If I should be prevented from reaching the Kaʿba, then I would do the same as we did while in the company of Messenger of Allah ﷺ ." So, he assumed the Ihram for ʿUmra since the Prophet ﷺ had assumed the Ihram for ʿUmra in the year of Al-Hudaibiya. Then ʿAbdullah bin ʿUmar thought about it and said, "The conditions for both Hajj and ʿUmra are similar." He then turned towards his companions and said, "The conditions of both Hajj and ʿUmra are similar and I make you witnesses that I have made the performance of Hajj obligatory for myself along with ʿUmra." He then performed one Tawaf (between As-Safa and Al-Marwa) for both of them (i.e. Hajj and (ʿUmra) and considered that to be sufficient for him and offered a Hadi.

Messenger of Allah ﷺ stood beside me at Al-Hudaibiya and the lice were falling from my head in great number. He asked me, "Have your lice troubled you?" I replied in the affirmative. He ordered me to get my head shaved. Kaʿb added, "This Holy Verse:--'And if any of you is ill, or has ailment in his scalp (2.196), etc. was revealed regarding me. "The Prophet ﷺ then ordered me either to fast three days, or to feed six poor persons with one Faraq (three Sas) (of dates), or to slaughter a sheep, etc. (sacrifice) whatever was available.

I sat with Kaʿb bin 'Ujra and asked him about the Fidya. He replied, "This revelation was revealed concerning my case especially, but it is also for you in general. I was carried to Messenger of Allah ﷺ and the lice were falling in great number on my face. The Prophet ﷺ said, "I have never thought that your ailment (or struggle) has reached to such an extent as I see. Can you afford a sheep?" I replied in the negative. He then said, "Fast for three days, or feed six poor persons each with half a Sa of food." (1 Sa = 3 Kilograms approx.)
