24. Zakāh (Ritual Charity)

٢٤۔ كتاب الزكاة

24.36 If a property is equally owned by two partners, its Zakat is to be paid as a whole

٢٤۔٣٦ باب مَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بَيْنَهُمَا بِالسَّوِيَّةِ

[Machine] Tawus and Ata' said: When both partners know their wealth, their money should not be combined. Sufyan said: It is not obligatory until he has completed forty sheep for this, and forty sheep for this.

وَقَالَ طَاوُسٌ وَعَطَاءٌ إِذَا عَلِمَ الْخَلِيطَانِ أَمْوَالَهُمَا فَلاَ يُجْمَعُ مَالُهُمَا. وَقَالَ سُفْيَانُ لاَ يَجِبُ حَتَّى يَتِمَّ لِهَذَا أَرْبَعُونَ شَاةً، وَلِهَذَا أَرْبَعُونَ شَاةً.

bukhari:1451Muḥammad b. ʿAbdullāh from my father > Thumāmah > Anas from my father

Abu Bakr wrote to me what Messenger of Allah ﷺ has made compulsory (regarding Zakat) and this was mentioned in it: If a property is equally owned by two partners, they should pay the combined Zakat and it will be considered that both of them have paid their Zakat equally.

أَنَّ أَبَا بَكْرٍ ؓ كَتَبَ لَهُ الَّتِي فَرَضَ رَسُولُ اللَّهِ ﷺ وَمَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بَيْنَهُمَا بِالسَّوِيَّةِ
