[Machine] Abu Abbas narrated that Rabee' said, Shafi'i said, Abdul Wahab reported from Ayoub bin Abi Tameemah, who reported from Muhammad bin Sirin, that Ash'ath bin Qais had a companion and he saw his wife and was attracted to her. Then he died on the way. Ash'ath bin Qais proposed to her, but she refused to marry him except by her own condition. So he married her based on her condition, but then he divorced her before she made her judgment. She said to him, "Make a judgment" and she mentioned two men who were his father's slaves from birth. He said, "Make a judgment other than them." She refused. So he went to Umar and said, "O Commander of the Faithful, I failed three times." Umar asked, "What are they?" He said, "I was infatuated with a woman." Umar said, "That's what you shouldn't have done." Then he married her based on her condition, but then he divorced her before she made her judgment. Umar said, "Is she a Muslim woman?" Shafi'i (May Allah have mercy on him) said, Umar meant, "Does she have a dowry like that of a Muslim woman, meaning from her own womenfolk?" And Allah knows best.
ثنا أَبُو الْعَبَّاسِ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ عَبْدُ الْوَهَّابِ عَنْ أَيُّوبَ بْنِ أَبِي تَمِيمَةَ عَنْ مُحَمَّدِ بْنِ سِيرِينَ أَنَّ الْأَشْعَثَ بْنَ قَيْسٍ صَحِبَ رَجُلًا فَرَأَى امْرَأَتَهُ فَأَعْجَبَتْهُ فَتُوُفِّيَ فِي الطَّرِيقِ فَخَطَبَهَا الْأَشْعَثُ بْنُ قَيْسٍ فَأَبَتْ أَنْ تَتَزَوَّجَهُ إِلَّا عَلَى حُكْمِهَا فَتَزَوَّجَهَا عَلَى حُكْمِهَا ثُمَّ طَلَّقَهَا قَبْلَ أَنْ تَحْكُمَ فَقَالَ احْكُمِي فَقَالَتْ أُحَكِّمُ فُلَانًا وَفُلَانًا رَقِيقٌ كَانُوا لِأَبِيهِ مِنْ تِلَادِهِ فَقَالَ احْكُمِي غَيْرَ هَؤُلَاءِ فَأَبَتْ فَأَتَى عُمَرَ ؓ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ عَجَزْتُ ثَلَاثَ مَرَّاتٍ قَالَ مَا هُنَّ قَالَ عَشِقْتُ امْرَأَةً قَالَ هَذَا مَا لَمْ تَمْلِكْ قَالَ ثُمَّ تَزَوَّجْتُهَا عَلَى حُكْمِهَا ثُمَّ طَلَّقْتُهَا قَبْلَ أَنْ تَحْكُمَ فَقَالَ عُمَرُ ؓ امْرَأَةٌ مِنَ الْمُسْلِمِينَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ يَعْنِي عُمَرُ ؓ لَهَا مَهْرُ امْرَأَةٍ مِنَ الْمُسْلِمِينَ وَيَعْنِي مِنْ نِسَائِهَا وَاللهُ أَعْلَمُ
