٢٧۔ كِتَابُ الْمُسَاقَاةِ
[Machine] The Messenger of Allah ﷺ worked with the people of Khaybar in exchange for half of what is produced from the fruits or crops. Anas Ibn Malik reported that Abu Bakr ibn Yazdad narrated to us, saying that Abu Ishaq al-Isfara'ini, the Imam, informed us that Muhammad ibn Ayyub al-Razi narrated to us, saying that Musaddad narrated to us, saying that Yahya mentioned it in a similar way, except that he said "in exchange for half of what comes out of it from fruits or crops."
أَنَّ رَسُولَ اللهِ ﷺ عَامَلَ أَهْلَ خَيْبَرَ بِشَطْرِ مَا يَخْرُجُ مِنْ ثَمَرٍ أَوْ زَرْعٍ 11622 وَأَخْبَرَنَا أَبُو إِسْحَاقَ الِإسْفَرَايِينِيُّ الْإِمَامُ أنبأ أَبُو بَكْرِ بْنُ يَزْدَادَ ثنا مُحَمَّدُ بْنُ أَيُّوبَ الرَّازِيُّ ثنا مُسَدَّدٌ ثنا يَحْيَى فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ بِشَطْرِ مَا يَخْرُجُ مِنْهَا مِنْ ثَمَرٍ أَوْ زَرْعٍ
[Machine] That 'Umar ibn al-Khattab expelled the Jews from the land of Hijaz and when the Messenger of Allah ﷺ conquered Khaybar, he intended to remove the Jews from it. The land, when he appeared on it, belonged to Allah, His Messenger, and the Muslims. He wanted to expel the Jews from it, so they asked the Messenger of Allah ﷺ to let them stay, offering to give half of the fruits as payment for their use. The Messenger of Allah ﷺ said to them, "We will let you stay on those terms, as long as 'Umar is in charge." Then 'Umar expelled them from his rule to Tayma and Ariha. This was narrated by Abu 'Abdullah al-Hafiz, from Abu Bakr ibn Ishaq al-Faqih, from Ahmad ibn Salamah, from Ishaq ibn Mansur, from 'Abd al-Razzaq, from Ibn Jurayj, from Musa ibn 'Uqbah, from Ibn 'Umar, that 'Umar ibn al-Khattab expelled the Jews and Christians from the land of Hijaz. Then he mentioned the Hadith similar to the Hadith of Muhammad ibn Shurahbil.
أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ أَجْلَى الْيَهُودَ مِنْ أَرْضِ الْحِجَازِ وَكَانَ رَسُولُ اللهِ ﷺ لَمَّا ظَهَرَ عَلَى خَيْبَرَ أَرَادَ إِخْرَاجَ الْيَهُودِ مِنْهَا وَكَانَتِ الْأَرْضُ حِينَ ظَهَرَ عَلَيْهَا لِلَّهِ وَلِرَسُولِهِ وَلِلْمُسْلِمِينَ فَأَرَادَ إِخْرَاجَ الْيَهُودِ مِنْهَا فَسَأَلَتِ الْيَهُودُ رَسُولَ اللهِ ﷺ أَنْ يُقِرَّهُمْ بِهَا عَلَى أَنْ يَكْفُوا عَمَلَهَا وَلَهُمْ نِصْفُ الثَّمَرِ فَقَالَ لَهُمْ رَسُولُ اللهِ ﷺ نُقِرُّكُمْ بِهَا عَلَى ذَلِكَ مَا شِئْنَا فَقَرُّوا بِهَا حَتَّى أَجْلَاهُمْ عُمَرُ ؓ فِي إِمَارَتِهِ إِلَى تَيْمَاءَ وَأَرِيحَاءَ 11624 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو بَكْرِ بْنُ إِسْحَاقَ الْفَقِيهُ ثنا أَحْمَدُ بْنُ سَلَمَةَ ثنا إِسْحَاقُ بْنُ مَنْصُورٍ أنبأ عَبْدُ الرَّزَّاقِ أنبأ ابْنُ جُرَيْجٍ أَخْبَرَنِي مُوسَى بْنُ عُقْبَةَ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ أَجْلَى الْيَهُودَ وَالنَّصَارَى مِنْ أَرْضِ الْحِجَازِ ثُمَّ ذَكَرَ الْحَدِيثَ بِمِثْلِ حَدِيثِ مُحَمَّدِ بْنِ شُرَحْبِيلَ
[Machine] When Khaibar was conquered, the Jews asked the Messenger of Allah ﷺ to allow them to stay there, and in return they would give half of the fruits and crops produced from the land. The Messenger of Allah ﷺ agreed to this and they continued this arrangement during the time of the Messenger of Allah ﷺ , Abu Bakr, and a portion of the caliphate of Umar. The fruits were divided into two portions, with one portion belonging to Khaibar and the Messenger of Allah ﷺ taking one-fifth.
لَمَّا افْتُتِحَتْ خَيْبَرُ سَأَلَتْ يَهُودُ رَسُولَ اللهِ ﷺ أَنْ يُقِرَّهُمْ فِيهَا عَلَى أَنْ يَعْمَلُوا عَلَى النِّصْفِ مِمَّا يَخْرُجُ مِنْهَا مِنَ الثَّمَرِ وَالزَّرْعِ فَقَالَ رَسُولُ اللهِ ﷺ أُقِرُّكُمْ فِيهَا عَلَى ذَلِكَ مَا شِئْنَا فَكَانُوا فِيهَا كَذَلِكَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَأَبِي بَكْرٍ ؓ وَطَائِفَةٍ مِنْ إِمَارَةِ عُمَرَ فَكَانَتِ الثَّمَرَةُ تُقْسَمُ عَلَى السُّهْمَانِ مِنْ نِصْفِ خَيْبَرَ وَيَأْخُذُ رَسُولُ اللهِ ﷺ الْخُمُسَ
[Machine] That the Prophet ﷺ fought the people of Khaybar until he drove them to their forts and he conquered the land, the crops, and the palm trees. They said, "O Muhammad, let us be in this land to cultivate it and benefit from it." The Messenger of Allah ﷺ and his companions did not have workers to do this, so he granted them Khaybar on the condition that they would have half of every crop, palm tree, and any other thing that became apparent to the Messenger of Allah ﷺ . Abdullah bin Rawaha used to come to them every year to measure it for them and then he would allocate their share for them. They complained to the Messenger of Allah ﷺ in a year when he had measured it severely and they wanted to ransom him. He said, "O enemies of Allah, you feed me Sa'ha (a type of unclear food) and yet I have come to you from the most beloved people to me. And you are more hateful to me than monkeys and pigs. My hatred towards you does not outweigh my love for him (Abdullah bin Rawaha) that I should not treat you justly." They said, "By this, the heavens and the earth were established."
أَنَّ النَّبِيَّ ﷺ قَاتَلَ أَهْلَ خَيْبَرَ حَتَّى أَلْجَأَهُمْ إِلَى قَصْرِهِمْ فَغَلَبَ عَلَى الْأَرْضِ وَالزَّرْعِ وَالنَّخْلِ فَقَالُوا يَا مُحَمَّدُ دَعْنَا نَكُونُ فِي هَذِهِ الْأَرْضِ نُصْلِحُهَا وَنَقُومُ عَلَيْهَا وَلَمْ يَكُنْ لِرَسُولِ اللهِ ﷺ وَلَا لِأَصْحَابِهِ غِلْمَانٌ يَقُومُونَ عَلَيْهَا فَأَعْطَاهُمْ خَيْبَرَ عَلَى أَنَّ لَهُمُ الشَّطْرَ مِنْ كُلِّ زَرْعٍ وَنَخْلٍ وَشَيْءٍ مَا بَدَا لِرَسُولِ اللهِ ﷺ وَكَانَ عَبْدُ اللهِ بْنُ رَوَاحَةَ ؓ يَأْتِيهِمْ فِي كُلِّ عَامٍ فَيَخْرُصُهَا عَلَيْهِمْ ثُمَّ يُضَمِّنُهُمُ الشَّطْرَ فَشَكَوْا إِلَى رَسُولِ اللهِ ﷺ فِي عَامٍ شِدَّةَ خَرْصِهِ وَأَرَادُوا أَنْ يَرْشُوهُ فَقَالَ يَا أَعْدَاءَ اللهِ تُطْعِمُونِي السُّحْتَ وَلَقَدْ جِئْتُكُمْ مِنْ عِنْدِ أَحَبِّ النَّاسِ إِلِيَّ وَلَأَنْتُمْ أَبْغَضُ إِلِيَّ مِنْ عِدَّتِكُمْ مِنَ الْقِرَدَةِ وَالْخَنَازِيرِ وَلَا يَحْمِلُنِي بُغْضِي إِيَّاكُمْ وَحُبِّي إِيَّاهُ عَلَى أَنْ لَا أَعْدِلَ عَلَيْكُمْ فَقَالُوا بِهَذَا قَامَتِ السَّمَاوَاتُ وَالْأَرْضُ
[Machine] The Messenger of Allah ﷺ distributed the wealth of Khaybar among the Jews, and their arrows were known. He made a condition with them that if he wished, he would expel them.
أَنَّ رَسُولَ اللهِ ﷺ سَاقَى يَهُودَ خَيْبَرَ عَلَى تِلْكَ الْأَمْوَالِ عَلَى الشَّطْرِ وَسِهَامُهُمْ مَعْلُومَةٌ وَشَرَطَ عَلَيْهِمْ إِنَّا إِذَا شِئْنَا أَخْرَجْنَاكُمْ
The Messenger of Allah ﷺ conquered Khaibar, and stipulated that all the land, gold and silver would belong to him. The people of Khaibar said: we know the land more than you ; so give it to us on condition that you should have half of the produce and we would have the half. He then gave it to them on that condition. When the time of picking the fruits of the palm-trees came, he sent 'Abd Allah b. Rawahah to them, and he assessed the among of the fruits of the palm-trees. This is what the people of Medina call khars (assessment). He used to say: In these palm-trees there is such-and-such amount (of produce). They would say: You assessed more to us, Ibn Rawahah (than the real amount). He would say: I first take the responsibility of assessing the fruits of the palm-trees and give you half of (the amount) I said. They would say: This is true, and on this (equity) stand the heavens and the earth. We agreed that we should take (the amount which) you said. (Using translation from Abū Dāʾūd 3410)
أَنَّ النَّبِيَّ ﷺ قَالَ حِينَ افْتَتَحَ خَيْبَرَ وَاشْتَرَطَ عَلَيْهِمْ أَنَّ لَهُ الْأَرْضَ وَكُلَّ صَفْرَاءَ وَبَيْضَاءَ يَعْنِي الذَّهَبَ وَالْفِضَّةَ فَقَالَ لَهُ أَهْلُ خَيْبَرَ نَحْنُ أَعْلَمُ بِالْأَرْضِ فَأَعْطِنَاهَا عَلَى أَنْ نَعْمَلَهَا وَيَكُونَ لَنَا نِصْفُ الثَّمَرَةِ وَلَكُمْ نِصْفُهَا فَزَعَمَ أَنَّهُ أَعْطَاهُمْ عَلَى ذَلِكَ فَلَمَّا كَانَ حِينَ يُصْرَمُ النَّخْلُ بَعَثَ إِلَيْهِمُ ابْنَ رَوَاحَةَ فَخَزَرَ النَّخْلَ وَهُوَ الَّذِي يَدْعُوهُ أَهْلُ الْمَدِينَةِ الْخَرْصَ فَقَالَ فِي ذَا كَذَا وَكَذَا فَقَالُوا أَكْثَرْتَ يَا ابْنَ رَوَاحَةَ قَالَ فَأَنَا آخُذُ النَّخْلَ وَأُعْطِيكُمْ نِصْفَ الَّذِي قُلْتُ قَالُوا هَذَا الْحَقُّ وَبِهِ قَامَتِ السَّمَاءُ وَالْأَرْضُ رَضِينَا أَنْ نَأْخُذَهُ بِالَّذِي قُلْتَ
[Machine] When the Messenger of Allah ﷺ conquered Khaybar, he called upon the Jews and said to them, "We will give you half of the produce on the condition that you work on it. I will grant you security like the security that Allah ﷻ has granted you." The Messenger of Allah ﷺ then sent Abdullah to measure the produce and give them the choice of taking it or leaving it. The Jews came to the Messenger of Allah ﷺ and complained to him about it. He called Abdullah ibn Rawaha and reminded him of what they had complained about. Abdullah said, "O Messenger of Allah, they can take it if they wish and if they leave it, we will take it." The Jews were satisfied and said, "By this, the heavens and the earth have risen." Then the Messenger of Allah ﷺ said during his illness in which he passed away, "Two religions will not be allowed to coexist on the Arabian Peninsula." When that matter came to Umar, he sent a message to the Jews of Khaybar and said, "The Messenger of Allah ﷺ dealt with you in regards to this wealth and made a condition that you would be granted security, meaning the security that Allah and His Messenger ﷻ has granted you. And Allah ﷻ has authorized your expulsion when the Messenger of Allah ﷺ made the agreement with you, so Umar expelled every Jew and Christian from the land of Hijaz, and then he divided it among the people of Hudaibiya."
لَمَّا افْتَتَحَ رَسُولُ اللهِ ﷺ خَيْبَرَ دَعَا يَهُودَ فَقَالَ نُعْطِيكُمْ نِصْفَ الثَّمَرِ عَلَى أَنْ تَعْمَلُوها أُقِرُّكُمْ مَا أَقَرَّكُمُ اللهُ ﷻ قَالَ فَكَانَ رَسُولُ اللهِ ﷺ يَبْعَثُ عَبْدَ اللهِ يَخْرُصُهَا ثُمَّ يُخَيِّرُهُمْ أَنْ يَأْخُذُوهَا أَوْ يَتْرُكُوهَا وَأَنَّ الْيَهُودَ أَتَوْا رَسُولَ اللهِ ﷺ فِي بَعْضِ ذَلِكَ فَاشْتَكَوْا إِلَيْهِ فَدَعَا عَبْدَ اللهِ بْنَ رَوَاحَةَ فَذَكَرَ لَهُ مَا ذَكَرُوا فَقَالَ عَبْدُ اللهِ يَا رَسُولَ اللهِ هُمْ بِالْخِيَارِ إِنْ شَاءُوا أَخَذُوهَا وَإِنْ تَرَكُوهَا أَخَذْنَاهَا فَرَضِيَتِ الْيَهُودُ وَقَالَتْ بِهَذَا قَامَتِ السَّمَاوَاتُ وَالْأَرْضُ ثُمَّ إِنَّ رَسُولَ اللهِ ﷺ قَالَ فِي مَرَضِهِ الَّذِي تُوُفِّيَ فِيهِ لَا يَجْتَمِعُ فِي جَزِيرَةِ الْعَرَبِ دِينَانِ قَالَ فَلَمَّا انْتَهَى ذَلِكَ إِلَى عُمَرَ ؓ أَرْسَلَ إِلَى يَهُودِ خَيْبَرَ فَقَالَ إِنَّ رَسُولَ اللهِ ﷺ عَامَلَكُمْ عَلَى هَذِهِ الْأَمْوَالِ وَشَرَطَ لَكُمْ أَنْ يُقِرَّكُمْ يَعْنِي مَا أَقَرَّكُمُ اللهُ وَرَسُولُهُ وَقَدْ أَذِنَ اللهُ ﷻ فِي إِجْلَائِكُمْ حِينَ عَهِدَ رَسُولُ اللهِ ﷺ مَا عَهِدَ فَأَجْلَاهُمْ عُمَرُ ؓ كُلَّ يَهُودِيٍّ وَنَصْرَانِيٍّ فِي أَرْضِ الْحِجَازِ ثُمَّ قَسَمَهَا بَيْنَ أَهْلِ الْحُدَيْبِيَةِ
27.2 [Machine] The treatment of white seed sowing that is between the palm fronds, along with the treatment of the date palm.
٢٧۔٢ بَابُ الْمُعَامَلَةِ عَلَى زَرْعِ الْبَيَاضِ الَّذِي بَيْنَ أَضْعَافِ النَّخْلِ مَعَ الْمُعَامَلَةِ عَلَى النَّخْلِ
[Machine] About the Prophet ﷺ that he gave Khaibar to the Jews to cultivate it and plant it, while they get half of what comes out of it.
عَنِ النَّبِيِّ ﷺ أَنَّهُ أَعْطَى خَيْبَرَ الْيَهُودَ عَلَى أَنْ يَعْمَلُوهَا وَيَزْرَعُوهَا وَلَهُمْ شَطْرُ مَا يَخْرُجُ مِنْهَا
[Machine] Allah ﷺ treated the people of Khaybar with half of what comes out of crops or fruits. He used to give his wives a hundred measures of dates, eighty measures of barley, and twenty measures of wheat every year. When Umar ibn al-Khattab became the ruler, he distributed Khaybar and gave the Prophet's wives the choice between having land and water or receiving a fixed annual income. They disagreed, and some of them chose the land and water, while others chose the fixed income. Aisha and Hafsah chose to have land and water. This narration is mentioned in the hadith of Abu Damrah and in the narration of Ali ibn Mus-hir.
اللهِ ﷺ عَامَلَ أَهْلَ خَيْبَرَ بِشَطْرِ مَا يَخْرُجُ مِنْ زَرْعٍ أَوْ ثَمَرٍ قَالَ فَكَانَ يُعْطِي أَزْوَاجَهُ كُلَّ عَامٍ مِنْهُ مِائَةَ وَسْقٍ ثَمَانِينَ وَسْقًا تَمْرًا وَعِشْرِينَ وَسْقًا شَعِيرًا فَلَمَّا كَانَ عُمَرُ ؓ قَسَمَ خَيْبَرَ فَخَيَّرَ أَزْوَاجَ النَّبِيِّ ﷺ أَنْ يَقْطَعَ لَهُنَّ مِنَ الْأَرْضِ وَالْمَاءِ أَوْ يَضْمَنَ لَهُنَّ الْوُسُوقَ كُلَّ عَامٍ فَاخْتَلَفْنَ فَمِنْهُنَّ مَنِ اخْتَارَ الْأَرْضَ وَالْمَاءَ وَمِنْهُنَّ مَنِ اخْتَارَ الْوُسُوقَ فَكَانَتْ عَائِشَةُ وَحَفْصَةُ ؓ مِمَّنِ اخْتَارَتَا الْأَرْضَ وَالْمَاءَ لَفْظُ حَدِيثِ أَبِي ضَمْرَةَ وَفِي رِوَايَةِ عَلِيِّ بْنِ مُسْهِرٍ أَعْطَى رَسُولُ اللهِ ﷺ خَيْبَرَ بِشَطْرِ مَا يَخْرُجُ مِنْ تَمْرٍ أَوْ زَرْعٍ ثُمَّ ذَكَرَ الْبَاقِيَ بِمَعْنَاهُ
27.3 [Machine] The condition of working in achievement over the worker
٢٧۔٣ بَابُ شَرْطِ الْعَمَلِ فِي الْمُسَاقَاةِ عَلَى الْعَامِلِ
The Prophet ﷺ handed over the Jews of Khaibar the palm trees and the land of Khaibar on condition that they should employ what belonged to them in working on them, and that he should have half of the fruits. (Using translation from Abū Dāʾūd 3409)
أَنَّ النَّبِيَّ ﷺ دَفَعَ إِلَى يَهُودِ خَيْبَرَ نَخْلَ خَيْبَرَ وَأَرْضَهَا عَلَى أَنْ يَعْتَمِلُوهَا مِنْ أَمْوَالِهِمْ وَأَنَّ لِرَسُولِ اللهِ ﷺ شَطْرَ ثَمَرَتِهَا
[Machine] He said, when the immigrants arrived from Mecca to Medina, they arrived with nothing in their hands, and the Ansar, the people of the land and the houses, shared with them the fruits of their wealth every year, and provided for them work and sustenance, and they recited the rest of the story.
أَنَّهُ قَالَ لَمَّا قَدِمَ الْمُهَاجِرُونَ مِنْ مَكَّةَ إِلَى الْمَدِينَةِ قَدِمُوا وَلَيْسَ بِأَيْدِيهِمْ شَيْءٌ وَكَانَ الْأَنْصَارُ أَهْلَ الْأَرْضِ وَالْعَقَارِ فَقَاسَمَهُمُ الْأَنْصَارُ عَلَى أَنْ أَعْطَوْهُمْ أَنْصَافَ ثِمَارِ أَمْوَالِهِمْ كُلَّ عَامٍ وَيَكْفُوهُمُ الْعَمَلَ وَالْمُؤْنَةَ وَذَكَرُوا بَاقِيَ الْحَدِيثِ
[Machine] When the emigrants left from Mecca to Medina and they had nothing, the Ansar divided their fruits and their wealth among them every year in order to suffice them in provisions and work. The narration mentioned this.
لَمَّا خَرَجَ الْمُهَاجِرُونَ مِنْ مَكَّةَ إِلَى الْمَدِينَةِ وَلَيْسَ بِأَيْدِيهِمْ شَيْءٌ فَقَاسَمَتْهُمُ الْأَنْصَارُ عَلَى أَنْ أَعْطَوْهُمْ أَنْصَافَ ثِمَارِ أَمْوَالِهِمْ فِي كُلِّ عَامٍ عَلَى أَنْ يَكْفُوهُمُ الْمُؤْنَةَ وَالْعَمَلَ وَذَكَرَ الْحَدِيثَ
