AHMAD 7033:
from Ibn Isḥāq And Dhakar ʿAmr b. Shuʿayb b. Muḥammad b. ʿAbdullāh b. ʿAmr b. al-ʿĀṣ from his father from his grandfather —
[Machine] The Messenger of Allah ﷺ said, "Whoever intentionally kills a believer, then he is to be handed over to the guardians of the victim. If they wish, they may kill him, and if they wish, they may accept blood money which is thirty camels, thirty cow offspring, and forty goat offspring. That is the compensation for intentional murder. And whatever agreement they come to, it is for them. That is a severe punishment. As for a similar unintentional killing, his mind is hardened and his compensation is to be paid as blood money. He is not to be killed. This is because Satan may incite discord among people, resulting in bloodshed without hatred or weapons. The Messenger of Allah ﷺ said, 'If someone carries a weapon against us, he is not one of us,' and he is not to be ambushed on the road. Whoever is killed in any other manner is to be treated similar to unintentional murder, with compensation to be paid as blood money. This is in the sacred month, for the sanctity of the Haram and for the neighbors. And whoever is killed accidentally, his compensation is one hundred camels, thirty cows that can give birth, thirty cows that cannot give birth, and thirty goat offspring. And ten young male camels from the offspring of the cows. The Messenger of Allah ﷺ used to value them at four hundred dinars or their equivalent in gold. And he used to evaluate them according to the prices of camels. When the price increased, he would increase its value, and when it decreased, he would decrease its value. In the time of the Messenger of Allah ﷺ , it ranged from four hundred dinars to eight hundred dinars, and their equivalent in gold was eight thousand dirhams. He ruled that someone who valued their wealth based on cows should pay two hundred cows as compensation, and someone who valued it based on sheep should pay two thousand sheep as compensation. And in case of a broken nose, when the whole nose is damaged, the compensation is to be assessed as a full nose. But if only a part of it is damaged, half the compensation is to be paid. In the case of an injured eye, half the compensation is to be paid. It is fifty from the number of camels, or their equivalent in gold or paper money, or one hundred cows, or one thousand sheep. As for a man, half the compensation is to be paid. As for a hand, half the compensation is to be paid. As for a mamoomeh (a part of the scalp), one-third of the compensation is to be paid, which is thirty-three camels, or their value in gold, paper money, cows, or sheep. And for a ja'ifah (a mouth injury), one-third of the compensation is to be paid, which is fifteen camels. And for a monaqqilah (broken teeth), five camels are to be paid. And for a broken tooth, five camels are to be paid. And for a broken bone, five camels are to be paid.

عن ابن اسحاق و ذكر عمرو بن شعيب بن محمد بن عبد الله بن عمرو بن العاص عن أبيه عن جده —
قَالَ رَسُولُ اللهِ ﷺ مَنْ قَتَلَ مُؤْمِنًا مُتَعَمِّدًا فَإِنَّهُ يُدْفَعُ إِلَى أَوْلِيَاءِ الْقَتِيلِ فَإِنْ شَاءُوا قَتَلُوا وَإِنْ شَاءُوا أَخَذُوا الدِّيَةَ وَهِيَ ثَلَاثُونَ حِقَّةً وَثَلَاثُونَ جَذَعَةً وَأَرْبَعُونَ خَلِفَةً فَذَلِكَ عَقْلُ الْعَمْدِ وَمَا صَالَحُوا عَلَيْهِ مِنْ شَيْءٍ فَهُوَ لَهُمْ وَذَلِكَ شَدِيدُ الْعَقْلِ وَعَقْلُ شِبْهِ الْعَمْدِ مُغَلَّظَةٌ مِثْلُ عَقْلِ الْعَمْدِ وَلَا يُقْتَلُ صَاحِبُهُ وَذَلِكَ أَنْ يَنْزِغَ الشَّيْطَانُ بَيْنَ النَّاسِ فَتَكُونَ دِمَاءٌ فِي غَيْرِ ضَغِينَةٍ وَلَا حَمْلِ سِلَاحٍ فَإِنَّ رَسُولَ اللهِ ﷺ قَالَ يَعْنِي مَنْ حَمَلَ عَلَيْنَا السِّلَاحَفَلَيْسَ مِنَّا وَلَا رَصَدَ بِطَرِيقٍ فَمَنْ قُتِلَ عَلَى غَيْرِ ذَلِكَ فَهُوَ شِبْهُ الْعَمْدِ وَعَقْلُهُ مُغَلَّظَةٌ وَلَا يُقْتَلُ صَاحِبُهُ وَهُوَ بِالشَّهْرِ الْحَرَامِ وَلِلْحُرْمَةِ وَلِلْجَارِ وَمَنْ قُتِلَ خَطَأً فَدِيَتُهُ مِائَةٌ مِنَ الْإِبِلِ ثَلَاثُونَ ابْنَةُ مَخَاضٍ وَثَلَاثُونَ ابْنَةُ لَبُونٍ وَثَلَاثُونَ حِقَّةٌ وَعَشرة بَكَارَةٍ بَنِي لَبُونٍ ذُكُورٍ قَالَ وَكَانَ رَسُولُ اللهِ ﷺ يُقِيمُهَا عَلَى أَهْلِ الْقُرَى أَرْبَعَ مِائَةِ دِينَارٍ أَوْ عِدْلَهَا مِنَ الْوَرِقِ وَكَانَ يُقِيمُهَا عَلَى أَثْمَانِ الْإِبِلِ فَإِذَا غَلَتْ رَفَعَ فِي قِيمَتِهَا وَإِذَا هَانَتْ نَقَصَ مِنْ قِيمَتِهَا عَلَى عَهْدِ الزَّمَانِ مَا كَانَ فَبَلَغَتْ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ مَا بَيْنَ أَرْبَعِ مِائَةِ دِينَارٍ إِلَى ثَمَانِ مِائَةِ دِينَارٍ وَعِدْلُهَا مِنَ الْوَرِقِ ثَمَانِيَةُ آلَافِ دِرْهَمٍ وَقَضَى أَنَّ مَنْ كَانَ عَقْلُهُ عَلَى أَهْلِ الْبَقَرِ فِي الْبَقَرِ مِائَتَيْ بَقَرَةٍ وَقَضَى أَنَّ مَنْ كَانَ عَقْلُهُ عَلَى أَهْلِ الشَّاءِ فَأَلْفَيْ شَاةٍ وَقَضَى فِي الْأَنْفِ إِذَا جُدِعَ كُلُّهُ بِالْعَقْلِ كَامِلًا وَإِذَا جُدِعَتْأَرْنَبَتُهُ فَنِصْفُ الْعَقْلِ وَقَضَى فِي الْعَيْنِ نِصْفَ الْعَقْلِ خَمْسِينَ مِنَ الْإِبِلِ أَوْ عِدْلَهَا ذَهَبًا أَوْ وَرِقًا أَوْ مِائَةَ بَقَرَةٍ أَوْ أَلْفَ شَاةٍ وَالرِّجْلُ نِصْفُ الْعَقْلِ وَالْيَدُ نِصْفُ الْعَقْلِ وَالْمَأْمُومَةُ ثُلُثُ الْعَقْلِ ثَلَاثٌ وَثَلَاثُونَ مِنَ الْإِبِلِ أَوْ قِيمَتُهَا مِنَ الذَّهَبِ أَوِ الْوَرِقِ أَوِ الْبَقَرِ أَوِ الشَّاءِ وَالْجَائِفَةُ ثُلُثُ الْعَقْلِ وَالْمُنَقِّلَةُ خَمْسَ عَشْرَةَ مِنَ الْإِبِلِ وَالْمُوضِحَةُ خَمْسٌ مِنَ الْإِبِلِ وَالْأَسْنَانُ خَمْسٌ مِنَ الْإِبِلِ
