[Machine] While we were walking with the Messenger of Allah ﷺ in a restricted area of ar-Rawha, we were riding on a lame donkey. So I mentioned this to the Prophet ﷺ and he said, "Leave it." Then, the owner of the donkey, who was a man from Bahz, came to the Prophet ﷺ and said, "O Messenger of Allah, what is your opinion about this donkey?" So the Prophet ﷺ commanded Abu Bakr to divide it among the companions. As they were passing by a deer tied under a tree with an arrow, the Prophet ﷺ commanded a man not to take it. So the people moved on and left it.  

الحاكم:٦٦١٨حَدَّثَنَا عَلِيُّ بْنُ حَمْشَاذٍ الْعَدْلُ ثَنَا إِسْمَاعِيلُ بْنُ إِسْحَاقَ الْقَاضِي وَزِيَادُ بْنُ الْخَلِيلِ التُّسْتَرِيُّ قَالَا ثَنَا إِبْرَاهِيمُ بْنُ الْمُنْذِرِ الْحِزَامِيُّ ثَنَا عَبْدُ الْعَزِيزِ بْنُ أَبِي حَازِمٍ عَنْ يَزِيدَ بْنِ عَبْدِ اللَّهِ بْنِ الْهَادِ عَنْ مُحَمَّدِ بْنِ إِبْرَاهِيمَ التَّيْمِيِّ عَنْ عِيسَى بْنِ طَلْحَةَ بْنِ عُبَيْدِ اللَّهِ عَنْ عُمَيْرِ بْنِ سَلَمَةَ الضَّمْرِيِّ قَالَ

بَيْنَمَا نَحْنُ نَسِيرُ مَعَ رَسُولِ اللَّهِ ﷺ وَهُوَ مُحْرِمٌ بِبَعْضِ نَوَاحِي الرَّوْحَاءِ إِذْ نَحْنُ بِحِمَارٍ مَعْقُورٍ فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «دَعُوهُ» فَأَتَاهُ صَاحِبُهُ الَّذِي عَقَرَهُ وَهُوَ رَجُلٌ مِنْ بَهْزٍ فَقَالَ يَا رَسُولَ اللَّهِ ﷺ شَأْنُكُمْ بِهَذَا الْحِمَارِ فَأَمَرَ رَسُولَ اللَّهِ ﷺ أَبَا بَكْرٍ «أَنْ يَقْسِمَهُ بَيْنَ الرِّفَاقِ ثُمَّ مَرَّ فَلَمَّا كَانَ بِالْإِثَابَةِ مَرَّ بِظَبْيٍ حَاقِفٍ فِي ظِلِّ شَجَرَةٍ فِيهِ سَهْمٌ فَأَمَرَ النَّبِيَّ ﷺ إِنْسَانًا» فَنَادَى أَنْ لَا يَأْخُذَهُ إِنْسَانٌ فَنَفَذَ النَّاسُ وَتَرَكُوهُ سنده صحيح

Yahya related to me from Malik that Yahya ibn Said al-Ansari said that Muhammad ibn Ibrahim ibn al-Harith at-Taymi told him from Isa ibn Talha ibn Ubaydullah, fromUmayr ibn Salama ad-Damri, from al-Bahzi, that the Messenger of Allah ﷺ set out once for Makka while in ihram. When they had reached ar-Rawha, they unexpectedly came upon a wounded wild ass. Someone mentioned it to the Messenger of Allah ﷺ and hesaid, "Leave it. The man to whom it belongs is about to come." Then al-Bahzi, who was the man, came to the Prophet ﷺ and said, "Messenger of Allah, do whatever you want with this ass,' and the Messenger of Allah ﷺ told Abu Bakr to divide it up among the company. Then they went on until they came to the well of al-Uthaba, which was between ar-Ruwaytha and al-Arj (between Makka and Madina), where they unexpectedly came upon a gazelle with an arrow in it, Iying on its side in some shade. He claimed that the Messenger of Allah ﷺ told someone to stand by it to make sure no one disturbed it until everyone had passed by.  

مالك:٢٠-٨١وَحَدَّثَنِي عَنْ مَالِكٍ عَنْ يَحْيَى بْنِ سَعِيدٍ الأَنْصَارِيِّ أَنَّهُ قَالَ أَخْبَرَنِي مُحَمَّدُ بْنُ إِبْرَاهِيمَ بْنِ الْحَارِثِ التَّيْمِيُّ عَنْ عِيسَى بْنِ طَلْحَةَ بْنِ عُبَيْدِ اللَّهِ عَنْ عُمَيْرِ بْنِ سَلَمَةَ الضَّمْرِيِّ عَنِ الْبَهْزِيِّ

أَنَّ رَسُولَ اللَّهِ ﷺ خَرَجَ يُرِيدُ مَكَّةَ وَهُوَ مُحْرِمٌ حَتَّى إِذَا كَانَ بِالرَّوْحَاءِ إِذَا حِمَارٌ وَحْشِيٌّ عَقِيرٌ فَذُكِرَ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ دَعُوهُ فَإِنَّهُ يُوشِكُ أَنْ يَأْتِيَ صَاحِبُهُ فَجَاءَ الْبَهْزِيُّ وَهُوَ صَاحِبُهُ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ شَأْنَكُمْ بِهَذَا الْحِمَارِ فَأَمَرَ رَسُولُ اللَّهِ ﷺ أَبَا بَكْرٍ فَقَسَمَهُ بَيْنَ الرِّفَاقِ ثُمَّ مَضَى حَتَّى إِذَا كَانَ بِالأَثَايَةِ بَيْنَ الرُّوَيْثَةِ وَالْعَرْجِ إِذَا ظَبْىٌ حَاقِفٌ فِي ظِلٍّ فِيهِ سَهْمٌ فَزَعَمَ أَنَّ رَسُولَ اللَّهِ ﷺ أَمَرَ رَجُلاً أَنْ يَقِفَ عِنْدَهُ لاَ يَرِيبُهُ أَحَدٌ مِنَ النَّاسِ حَتَّى يُجَاوِزَهُ

[Machine] He went out with the Messenger of Allah ﷺ intending to go to Makkah. When they were in a valley called Al-Rawha', they found people's donkey that was wild and stubborn. They mentioned it to the Prophet ﷺ so he said, "Tie it up until its owner comes." So the man, who was the owner of the donkey, came and said to the Messenger of Allah ﷺ , "O Messenger of Allah, what is your opinion about this donkey?" The Messenger of Allah ﷺ then ordered Abu Bakr to divide it among the companions, while they were in the state of ihram. He (the narrator) said, "Then we passed by Al-Uthaiyah, and there we found a deer standing in the shade with an arrow in it. So the Prophet ﷺ ordered a man to stand by it until the people passed by it."  

أحمد:١٥٧٤٤حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ قَالَ أَخْبَرَنَا يَحْيَى أَنَّ مُحَمَّدَ بْنَ إِبْرَاهِيمَ التَّيْمِيَّ أَخْبَرَهُ أَنَّ عِيسَى بْنَ طَلْحَةَ بْنِ عُبَيْدِ اللهِ أَخْبَرَهُ أَنَّ عُمَيْرَ بْنَ سَلَمَةَ الضَّمْرِيَّ أَخْبَرَهُ عَنْ رَجُلٍ مِنْ بَهْزٍ

أَنَّهُ خَرَجَ مَعَ رَسُولِ اللهِ ﷺ يُرِيدُ مَكَّةَحَتَّى إِذَا كَانُوا فِي بَعْضِ وَادِي الرَّوْحَاءِ وَجَدَ النَّاسُ حِمَارَ وَحْشٍ عَقِيرًا فَذَكَرُوهُ لِلنَّبِيِّ ﷺ فَقَالَ أَقِرُّوهُ حَتَّى يَأْتِيَ صَاحِبُهُ فَأَتَى الْبَهْزِيُّ وَكَانَ صَاحِبَهُ فَقَالَ يَا رَسُولَ اللهِ شَأْنَكُمْ بِهَذَا الْحِمَارِ؟ فَأَمَرَ رَسُولُ اللهِ ﷺ أَبَا بَكْرٍ فَقَسَمَهُ فِي الرِّفَاقِ وَهُمْ مُحْرِمُونَ قَالَ ثُمَّ مَرَرْنَا حَتَّى إِذَا كُنَّا بِالْأُثَايَةِ إِذَا نَحْنُ بِظَبْيٍ حَاقِفٍ فِي ظِلٍّ فِيهِ سَهْمٌ فَأَمَرَ النَّبِيُّ ﷺ رَجُلًا أَنْ يَقِفَ عِنْدَهُ حَتَّى يُجِيزَ النَّاسُ عَنْهُ  

ذِكْرُ إِبَاحَةِ قَبُولِ الْمَرْءِ الْهِبَةَ لِلشَّيْءِ الْمَشَاعِ بَيْنَهُ وَبَيْنَ غَيْرِهِ

"While we were traveling with the Prophet in part of Athaya Ar-Rawha and they were in Ihram, we saw a wounded onager, the Messenger of Allah said: "Leave it, for soon the one who wounded it will come,' then a man from Bahz came, and he was the one who had wounded the onager. He said: 'O Messenger of Allah, it is up to you what you do with this onager,' The Messenger of Allah ordered Abu Bakr to distribute it among the people." (Using translation from Nasāʾī 4344)
