51.14 Giving gifts by a husband to his wife, and by a wife to her husband
٥١۔١٤ باب هِبَةِ الرَّجُلِ لاِمْرَأَتِهِ وَالْمَرْأَةِ لِزَوْجِهَا
[Machine] Ibrahim said, "There is a reward." And Umar ibn Abd al-Aziz said, "They shall not return." And the Prophet ﷺ sought permission from his wives to be nursed in Aisha's house. And the Prophet ﷺ said, "The one who returns a gift is like a dog that vomits and then licks it back up." And Al-Zuhri said about someone who said to his wife, "Give me some of your dowry, or all of it." Then he did not stay except for a short while before he divorced her. She returned to him and he said to her, "If she returned it out of greed, then it is not deceitful in any way." It is allowable. Allah the Almighty said, "But if you decide to return to them anything of it - then for you is fine."
قَالَ إِبْرَاهِيمُ جَائِزَةٌ. وَقَالَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ لاَ يَرْجِعَانِ. وَاسْتَأْذَنَ النَّبِيُّ ﷺ نِسَاءَهُ فِي أَنْ يُمَرَّضَ فِي بَيْتِ عَائِشَةَ. وَقَالَ النَّبِيُّ ﷺ: «الْعَائِدُ فِي هِبَتِهِ كَالْكَلْبِ يَعُودُ فِي قَيْئِهِ». وَقَالَ الزُّهْرِيُّ فِيمَنْ قَالَ لاِمْرَأَتِهِ هَبِي لِي بَعْضَ صَدَاقِكِ أَوْ كُلَّهُ. ثُمَّ لَمْ يَمْكُثْ إِلاَّ يَسِيرًا حَتَّى طَلَّقَهَا فَرَجَعَتْ فِيهِ قَالَ يَرُدُّ إِلَيْهَا إِنْ كَانَ خَلَبَهَا، وَإِنْ كَانَتْ أَعْطَتْهُ عَنْ طِيبِ نَفْسٍ، لَيْسَ فِي شَيْءٍ مِنْ أَمْرِهِ خَدِيعَةٌ، جَازَ، قَالَ اللَّهُ تَعَالَى: {فَإِنْ طِبْنَ لَكُمْ عَنْ شَيْءٍ مِنْهُ نَفْسًا}.
