The Prophet’s estate is charity, not inheritance
[AI] that he adjured Talhah, al-Zubayr, Ali, and al-Abbas—Allah have mercy on them—saying, "Do you know that the Messenger of Allah ﷺ said, "We are not inherited from; what we leave is charity."?" They said, "Yes." Others besides Amr supported Amr in a narration like this from al-Zuhri, so we were satisfied with Amr from al-Zuhri since he was trustworthy. This hadith was narrated by Ikrimah ibn Khalid and Muhammad ibn al-Munkadir from Malik ibn Aws from Umar, and they did not mention it from Abu Bakr. Malik ibn Anas is a hafiz, and he added to those whom we have named, and the addition of a hafiz is accepted when he adds it over a hafiz, for he only added it by virtue of the excellence of his memory. A group also narrated it from Abu Bakr from the Prophet ﷺ, among them Aishah, Abu Hurayrah, and others.
أَنَّهُ اسْتَنْشَدَ طَلْحَةَ وَالزُّبَيْرَ وَعَلِيًّا وَالْعَبَّاسَ رَحْمَةُ اللَّهِ عَلَيْهِمْ: هَلْ تَعْلَمُونَ أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ: «لَا نُورَثُ، مَا تَرَكْنَا صَدَقَةٌ»؟ قَالُوا: نَعَمْ. وَقَدْ تَابَعَ عَمْرًا عَلَى مِثْلِ هَذِهِ الرِّوَايَةِ عَنِ الزُّهْرِيِّ غَيْرُهُ، فَاجْتَزَيْنَا بِعَمْرٍو عَنِ الزُّهْرِيِّ إِذْ كَانَ ثِقَةً، وَقَدْ رَوَى هَذَا الْحَدِيثَ عِكْرِمَةُ بْنُ خَالِدٍ وَمُحَمَّدُ بْنُ الْمُنْكَدِرِ عَنْ مَالِكِ بْنِ أَوْسٍ عَنْ عُمَرَ، وَلَمْ يَذْكُرَاهُ عَنْ أَبِي بَكْرٍ. وَمَالِكُ بْنُ أَنَسٍ حَافِظٌ، وَقَدْ زَادَ عَلَى مَنْ سَمَّيْنَا، وَزِيَادَةُ الْحَافِظِ مَقْبُولَةٌ إِذَا زَادَهَا عَلَى حَافِظٍ، فَإِنَّمَا زَادَهَا بِفَضْلِ حِفْظِهِ، وَقَدْ رَوَاهُ عَنْ أَبِي بَكْرٍ عَنِ النَّبِيِّ ﷺ جَمَاعَةٌ، مِنْهُمْ عَائِشَةُ وَأَبُو هُرَيْرَةَ وَغَيْرُهُمَا.
