[Machine] Regarding the scholars whose view from the people of Madinah is as follows: if the child owns the parent, the parent is freed. And if the parent owns the child, the child is freed. As for other relatives, they differ regarding it. The judge said, and Isa bin Minah said, from Ibn Abi Zinad, the people differed regarding it. Ibn Abi Uwais said, from Ibn Abi Zinad, from his father, from them. And they used to say, if a man buys a share from his father or mother, that share is freed and what remains is kept for the person to free it all. And if he inherits a share and does not buy it, the share is freed and what remains is not kept for him.
عَنِ الْفُقَهَاءِ الَّذِينَ يُنْتَهَى إِلَى قَوْلِهِمْ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ إِذَا مَلَكَ الْوَلَدُ الْوَالِدَ عَتَقَ الْوَالِدُ وَإِنْ مَلَكَ الْوَالِدُ الْوَلَدَ عَتَقَ الْوَلَدُ وَأَمَّا مَا سِوَى ذَلِكَ مِنَ الْقَرَابَةِ فَيَخْتَلِفُونَ فِيهِ قَالَ الْقَاضِي وَقَالَ عِيسَى بْنُ مِينَاءٍ عَنِ ابْنِ أَبِي الزِّنَادِ فَاخْتَلَفَ فِيهِ النَّاسُ قَالَ ابْنُ أَبِي أُوَيْسٍ عَنِ ابْنِ أَبِي الزِّنَادِ عَنْ أَبِيهِ عَنْهُمْ وَكَانُوا يَقُولُونَ إِذَا ابْتَاعَ الرَّجُلُ شِقْصًا مِنْ أَبِيهِ أَوْ أُمِّهِ عَتَقَ ذَلِكَ الشِّقْصُ وَقُوِّمَ عَلَيْهِ مَا بَقِيَ فَيُعْتَقُ كُلُّهُ عَلَيْهِ وَإِنْ كَانَ وَرِثَ مِنْهُ شِقْصًا وَلَمْ يَشْتَرِهِ عَتَقَ الشِّقْصُ وَلَمْ يُقَوَّمْ عَلَيْهِ الْبَاقِي
