[Machine] From the Messenger of Allah ﷺ who said: "If a man has a partner in a slave, and then he frees his share while he is alive and establishes a fair value for his wealth, then frees him." Abu Al-Walid Al-Faqih said: Our companions said: His statement "while he is alive" means when his hand is being cut off, indicating that it is not cut off after death. The Shaykh (Allah have mercy on him) said: This is what Muhammad ibn Muslim said  

البيهقي:٢١٣٨٨أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْوَلِيدِ ثنا السَّرَّاجُ ثنا أَحْمَدُ بْنُ مُحَمَّدٍ الْبِرْتِيُّ ثنا أَبُو حُذَيْفَةَ ثنا مُحَمَّدُ بْنُ مُسْلِمٍ عَنْ أَيُّوبَ بْنِ مُوسَى أَخْبَرَنِي نَافِعٌ عَنِ ابْنِ عُمَرَ

عَنْ رَسُولِ اللهِ ﷺ قَالَ إِذَا كَانَ لِلرَّجُلِ شِرْكٌ فِي غُلَامٍ ثُمَّ أَعْتَقَ نَصِيبَهُ وَهُوَ حِيُّ أُقِيمَ عَلَيْهِ قِيمَةَ عَدْلٍ فِي مَالِهِ ثُمَّ أَعْتَقَ قَالَ أَبُو الْوَلِيدِ الْفَقِيهُ قَالَ أَصْحَابُنَا قَوْلُهُ ﷺ وَهُوَ حَيٌّ يَعْنِي حِينَ يُقَوَّمُ عَلَيْهِ يَدُلُّ عَلَى أَنْ لَا يُقَوَّمَ عَلَيْهِ بَعْدَ الْمَوْتِ قَالَ الشَّيْخُ رَحِمَهُ اللهُ هَكَذَا قَالَ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ
