[Machine] Al-Shafi'i and also anyone who borrows something and denies it or if he had a deposit and denies it, there is no sin on him for that. The Sheikh, may Allah have mercy on him, said, "As for the hadith that was narrated about Arriyah... "  

البيهقي:١٧٢٩٦ – أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ أنبأ الشَّافِعِيُّ أنبأ مَالِكٌ عَنِ ابْنِ شِهَابٍ أَنَّ مَرْوَانَ بْنَ الْحَكَمِ أُتِيَ بِإِنْسَانٍ قَدِ اخْتَلَسَ مَتَاعًا فَأَرَادَ قَطْعَ يَدِهِ فَأَرْسَلَ إِلَى زَيْدِ بْنِ ثَابِتٍ فَسَأَلَهُ عَنْ ذَلِكَ فَقَالَ زَيْدٌ لَيْسَ فِي الْخُلْسَةِ قَطْعٌ قَالَ مَالِكٌ الْأَمْرُ عِنْدَنَا أَنَّهُ لَيْسَ فِي الْخُلْسَةِ قَطْعٌ قَالَ

الشَّافِعِيُّ وَكَذَلِكَ مَنِ اسْتَعَارَ مَتَاعًا فَجَحَدَهُ أَوْ كَانَتْ عِنْدَهُ وَدِيعَةٌ فَجَحَدَهَا لَمْ يَكُنْ عَلَيْهِ فِيهَا قَطْعٌ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَأَمَّا الْحَدِيثُ الَّذِي رُوِيَ فِي الْعَارِيَةِ
